introducing ourselves on the Board. I’m Wally Armer. I 19

live in Vail, Arizona. I make sure that people know 20

that’s Arizona, not Colorado. And I am the livestock 21

representative on the Board. And thank you, Vanessa, for 22

getting us Legal today. 23

MR. CHAIRMAN: Thank you. At this point, we’re 3

going to call for the public call to the public, and I do 4

have several, so I would request if you could try and 5

limit your remarks to about three minutes, with one 6

exception at the end, I will give a little freedom to our 7

last call to the public. 8

But with that being said, from Santa Cruz 9

County, Rudy Molera. 10

MR. MOLERA: Mr. Chairman, State Parks Board, 11

I’d like to welcome you all to Santa Cruz County. Mr. 12

Martyn, it’s great to have you here, a former colleague 13

of mine, the Supervisors State Association. It’s good to 14

have you here. 15

I want to first all thank our community of 16

Tubac because they’re exemplary. They have pretty much 17

shown the State of Arizona what it is to take charge and, 18

boy, do they take charge. This Park, I don’t know if 19

you’ve had the privilege of walking around and visiting, 20

but they’ve done an excellent job of it and really kept 21

it going. It’s an incredible partnership that we’ve 22

joined. 23

And we have a little transition. A new group 24

is going to take over. We’re excited and look forward to 25

a continued relationship with the Tubac community. It’s 1

an honor and privilege once again. Thank you. Thank you 2

for being here. 3

MR. CHAIRMAN: Thank you for all your support, 4

the Board of Supervisors, if you would relay that to 5

everyone, I would appreciate it. 6

MR. MOLERA: Thank you, Mr. Chairman. 7

MR. CHAIRMAN: Next, the County Manager, Carlos 8

Rivera. 9

MR. RIVERA: Mr. Chairman, Members of the 10

Board, thank you for coming down here and having your 11

meeting here at Tubac. As Supervisor Molera mentioned, 12

the Board of Supervisors approved an agreement recently 13

with Friends of Tubac Presidio to take over from the 14

Tubac Historical Society. 15

The Historical Society has done a wonderful job 16

out here. They’ve kept the place up and it was 17

unfortunate that due to some internal issues they decided 18

that they want to terminate the agreement. 19

My charge was to sit down with all the groups 20

involved to try to negotiate a smooth transition. I wish 21

it would have gone a lot smoother than I’d planned. But 22

it is effective work (indiscernible). 23

Today, the Board of Supervisors approved the 24

renewal of the (indiscernible) with you all, to continue 25

to keep the Park open. The one change that I did talk to 1

Mr. Ream about was making it effective for three years. I 2

don’t want to have to go back and do it annually. We 3

know the State is still burdened financially and when the 4

State does finally complete (indiscernible) we’ll take it 5

back, and we’re fine with that too. But a three-year 6

agreement with the escape clause in there was fine with 7

us. 8

I just want to thank you for coming down, and 9

Mr. Molera mentioned, the Friends of Presidio and the 10

Historical Society have been wonderful people to work 11

with and hopefully they’ll continue to provide the 12

wonderful service to you all and to the community, 13

because this is a great benefit to Tubac and the County. 14

MR. CHAIRMAN: Again, thank you. And for 15

anyone who is now aware of it, the reason Santa Cruz -– 16

we have our IGA our Inner Governmental Agreement with the 17

County. It’s pretty much the only way we as a State 18

agency can operate other than some real extreme 19

situations. 20

So we were very appreciative of Santa Cruz 21

County for stepping up to the plate three years ago when 22

we first started negotiating this. And certainly happy 23

to see it continue. So thanks again. 24

MR. KINSLEY: Well I join my distinguished 1

colleagues from the County in welcoming you all here. 2

It’s a great time to come to the Parks Board here and I 3

hope you’re happy here and hope that you enjoy your stay. 4

In my remarks I want to salute the Tubac 5

Historical Society, which last December made the decision 6

to cancel their agreement with Santa Cruz County to 7

operate the Tubac Presidio, and we’re pleased that the 8

Board of Supervisor has transferred that agreement now to 9

the Friends of the Tubac Presidio. And we’ve got several 10

board members of the friends here. 11

Unfortunately, there has arisen a dispute 12

regarding the leadership of the Historical Society, and 13

that dispute has frozen all of the bank accounts of the 14

Tubac Historical Society, which include three accounts 15

that pertain directly to the Presidio. The funds have 16

always been separated, they have never been co-mingled, 17

there are separate titles on the accounts and yet they 18

are frozen in this internal dispute. 19

The Presidio and all of its volunteers and 20

management has no interest at all in the Historical 21

Society dispute. There’s no connection between the 22

Presidio and either faction of the Historical Society. 23

But the funds that are frozen are absolutely critical to 24

the success of the Presidio. 25

Our gift shop has been hampered by low 1

inventory. The freeze has limited our ability to take 2

credit cards. We’re hoping to get that fixed today, and 3

as we head into the summer months with no winter 4

visitors, these funds are going to be even more critical. 5

So I am asking the Board for any possible help 6

that you can give us in coaxing the acting President of 7

the Historical Society, Mr. Chilcote, to agree to release 8

the Presidio funds and to go ahead and sort out their own 9

Historical Society funds in the best way they know how. 10

And given that we have so many people from the 11

public here, could I ask for a show of hands of people 12

who would like to see the return of the Park funds to 13

operate the Park in the most efficient way possible? 14

Again, we welcome you here, and any help you 15

could give us in this matter, I would be really honored 16

to have. Thank you very much. 17

MR. CHAIRMAN: Thank you. I tell you what, I 18

wore my hat today. We can pass the hat before we leave. 19

Thank you, Shaw. Gwen Griffin, please. 20

MS. GRIFFIN: I ask to speak to something 21

because I am a volunteer of the Park and an unfortunate 22

part of the internal conflict that the Tubac Historical 23

Society. But I’m really talking to you today about the 24

Park. 25

My parents donated the property on which the 1

museum stands, and they did it because they wanted to see 2

Tubac become a first State Park. They really felt when 3

they came up -– the last year my dad’s life was spent 4

trying to get the State Parks Board, which had not picked 5

a site yet, to chose Tubac, and they made the 6

presentation. And I’m very proud of the fact that they 7

did. 8

And I’m concerned that this internal conflict 9

and Historical Society is affecting the Presidio Park 10

when really the funds have nothing to do with the 11

historical site. The funds are separate. They were 12

collected -– they were donated and collected for the 13

purpose of running the Park. 14

So again, I would like to ask also, any help 15

you can to give those funds to the Park they belong. 16

Because I do volunteer here, I can tell you it was a big 17

headache working at the desk and not being able to use 18

the credit card machine because we don’t have the money 19

for it. This is such an important site. You have no 20

idea how wonderful it is hear people say when they come 21

in, “you know this is really a treasure here,” and how 22

pleased they are. Sometimes I have to twist arms because 23

they’re not quite sure whether this will be something 24

worth seeing, and they always come back and tell me how 25

wonderful it was to go through, and I feel really good 1

about that. I’m sure my parents would be pleased. 2

MR. CHAIRMAN: Thank you very much. Mindy 4

Maddock. These are in no particular order except the way 5

they were handed to me. 6

MS. MADDOCK: Thank you, thank you, from the 7

Chamber of Commerce. The Chamber of Commerce here in 8

Tubac is dedicated and it’s our mission to bring commerce 9

and business and people to Tubac. That is our mission 10

and our goal. And to that end, we have an office, we 11

support the Presidio. 12

What is fascinating is that the majority of 13

people coming into the Chamber of Commerce office asking 14

for a map, asking for where this is, are here looking for 15

the Presidio State Park. 16

I had some houseguests about three weeks ago. 17

They were here nine years ago. It took me nine years to 18

get them back from Florida to here. And I said, “But you 19

must go down to the Presidio” and Chuck’s comment was, 20

“We saw that, thanks.” I said, “No, no, no, you’ve got 21

to see it now.” 22

They went, came back and if you can say the man 23

bubbled, he was bubbling with enthusiasm. He could not 24

stop talking about the change, the dramatic change here 25

at the Presidio, and it was due solely to Shaw Kinsley 1

and all of the incredible volunteers here, the Farnns’ 2

and all the names I could keep naming here, they have 3

worked their tails off to make this a jewel in the crown 4

of Arizona and of Tubac. 5

One of the things that we want to encourage is 6

that we are an entire town here, we work together. And 7

it wasn’t just the volunteers, it was also the business 8

community, the gallery owners, everybody pitched in with 9

money, time and effort. 10

Yes, there is a dispute going on. They need 11

the money. They need their money unfrozen and returned 12

to them. 13

When we started we all -– most of us met here 14

about three years ago, signed the agreement between the 15

State Parks Board and the County. What a time of 16

jubilation that was. What a time of just joy. It is 17

time to pass the torch and the County and the Friends of 18

the State Presidio, Tubac State Presidio Park and Museum, 19

stand ready. They need your assistance, whatever you can 20

give. 21

You may renew the agreement with confidence. 22

MR. CHAIRMAN: Thank you so much, Mindy. Rich 24

Bowman. 25

MR. BOWMAN: Welcome, Mr. Chairman and Board 1

Members. Thank you for coming down here. What I’m going 2

to mention briefly, I’m currently the President of a 3

large organization, over 300 members, the Santa Cruz 4

Valley Systems Council. In fact, we are the largest 5

organization in Santa Cruz County. But primarily our 6

member base is right here in the northwest part of the 7

County. 8

And I think I can unequivocally speak for at 9

least -– I don’t want to say 100 percent, because you 10

never know. But I can speak for 99.9 percent of our 11

members, that everyone supports this Presidio Park. We 12

see it as a treasure to not only to Santa Cruz County but 13

our Village of Tubac. And the work that Director Shaw 14

Kinsley has done in the last three years has been 15

unbelievable. 16

I want to thank the good help we’ve had our 17

County Manager and the County Supervisors who voted 18

unanimously to enter into the new IGA so that the Park 19

could continue on under its new group, the Friends of the 20

Presidio Park and Museum. 21

I personally know every one of the Directors of 22

that group and you could not ask for a better 23

representation of CEO ability, lawyers, I mean they come 24

with a wealth of educational and background to make this 1

work. 2

I think that you’ve already heard about the 3

issue with the funds being frozen. Personally, I think a 4

letter from your Board to the bank -- the bank is sort of 5

caught between a rock and a hard place. I think a letter 6

from your Board to the bank authorizing the release of 7

those funds to the County Manager until the new group 8

meets their non-profit status, would suffice with the 9

bank and the Park could continue and start their ongoing 10

operations and be able to use the credit card machine and 11

whatever. 12

So thank you for being here. We’ve got 13

facilities. I’m sure you’ve already seen and we want to 14

keep it going, and I have the utmost faith in the new 15

group that they’re going to do a great job overseeing the 16

Park. Thank you. 17

MR. CHAIRMAN: Thank you, Rich. I will add, my 18

wife and I had a cousin of hers and husband in town about 19

a month ago and we brought them down here. Even from 20

Texas they were quite impressed. 21

I would like to at this time publicly thank and 22

acknowledge the Tucson (sic) Historical Society and the 23

work they did for the three years, keeping the Park open 24

and continuing –- 25

MR. STETSON: You called it “Tucson.” Tubac. 1

MR. CHAIRMAN: Tubac Park. And I have every 2

confidence in the world that the Friends of the Presidio 3

will carry on in the same way and we look forward to 4

working with you very much. 5

I’ll tell you what’s interesting as I look at 6

the number of folks that showed up today. I can only 7

think of two other places around the state where we’ve 8

had meetings where this many people showed up. That was 9

in Apache Junction and Payson. And it says something 10

about small-town Arizona. 11

With that, we’re going to switch directions and 12

we’re going to go to Mr. John Driggs, the ex-mayor of 13

Phoenix, who was asked to address us today. And since 14

he’s the only ex-mayor we’ve got on board today, I’ll 15

give the mayor a few extra minutes. Mayor Driggs? 16

MR. DRIGGS: Mr. Chairman, Members of the State 17

Parks Board. My name is John Driggs, citizen. But I head 18

an organization called the Arizona Second Century 19

Initiative, which is a secondary name for my first 20

committee, which was the Arizona Capital Centennial 21

Committee. 22

And in charge of that was as a part of my 23

membership in both the Legislature’s Commission for the 24

Centennial and the Governor’s -– we ended up with two 25

commissions for the Centennial, and I had the pleasure of 1

serving on both. 2

The Centennial is over, so I had to change the 3

name. It’s now the Arizona Second Century Initiative, 4

and my specific authority, and it’s been working with 5

four Senate Presidents and three Speakers, to renew the 6

State Capitol and put it back into traditional 7

legislative function of use in that historic building 8

under the Capitol dome. 9

I’d like Kelly to pass to each one of you my 10

six-page white paper on how through a private sector 11

government coordinated initiative, we’re going to breathe 12

life into six very important public buildings, six of 13

which are in control or owned by the State, and one by 14

the City of Phoenix. And that is Tovrea Castle. 15

Some of you may recall that this is my third 16

presentation in this category “call to the public” on the 17

issue of Tovrea Castle. I was designated Chairman 18

(indiscernible) project in ’99, volunteer Chairman I 19

would say, by then-Councilman Phil Gordon. That project 20

is now in it’s 23rd or 24th year. As a Bond project, City 21

of Phoenix can still not generate open to the public. 22

The other buildings that you see in this white 23

paper, start with the State Capitol. Three of the 24

buildings are on the governmental mall are either totally 25

or grossly underutilized, and then you have the three 1

buildings in the Papago Park area. 2

Mr. Chairman, Board Members, I believe that 3

it’s somewhat (indiscernible) that we’re meeting in a 4

historic building and that I’m hearing issues about how 5

State Parks and the private sector and the local 6

community can cooperate to help maintain our history. 7

We can just that history started here. Arizona 8

history started here. And when I was elected mayor in 9

1969, one of the first things I learned, and I had an all 10

new city council, all new city council. A staff member 11

came in and said, “Mayor, did you realize that this is 12

Phoenix’s Centennial in 1970?” And I said, “No, bring me 13

the file.” They came back two days later and said, 14

“Mayor, there is no file.” The previous mayor and 15

administration of which -– too long a story, you don’t 16

need to hear it now, but I had to scramble and in four 17

months put on a Centennial for Phoenix. 18

As a part of that, the State’s most famous 19

historian at the time (indiscernible), who helped found 20

the Arizona Historical Foundation of Barry Goldwater. I 21

had him come in my office and he said, “Mayor, Phoenix is 22

a wasteland of history. There’s no Historical Society 23

here, there is no history in Phoenix.” One of the things 24

I did as Mayor was form the Phoenix Historical Society. 25

And we started working on a museum. And then the State 1

Society said, out of Tucson, the Arizona Historical 2

Society is probably the only Historical Society in the 3

whole country, not based in the Capitol. It’s based in 4

Tucson. 5

The then-Assistant Publisher of the Arizonan 6

Republic Gazette came to me and says, “If Phoenix goes it 7

alone with the Historical Society, it will kill many 8

efforts the State Society has to gain a presence in 9

Phoenix.” So I (indiscernible) with them, and you don’t 10

have time to hear all the details, but the fact is, 11

Phoenix is still a wasteland of history. 12

Because the museum that was created there for 13

the State Historical Society does not function and that’s 14

one of the six buildings in your white paper. And it’s 15

incumbent upon this Board as a State Agency, to 16

understand that that huge building in Papago Park, and no 17

one is more familiar with it than I am, because the 18

Historical Society asked me to raise all the money to get 19

it rolling. I raised four million dollars to get the 20

exhibits done and get it open, almost 20 years ago. It 21

has never worked as a museum. 22

So you have that marvelous and I literally mean 23

it, when I leave here, I’m meeting with the Chairman of 24

the Arizona Historical Society, his law office in Tucson, 25

and I’m going to say to that group, and I’ve been a Board 1

Member off and on ever since -– the ‘60s. I’m going to 2

say it’s time for the State Historical Society to get its 3

own act together in Phoenix, actually the museum in 4

Tempe, that smaller part of Papago Park. 5

But I’m suggesting to this Board that you have 6

a great mission to do in Maricopa County -– and the 7

ironic thing is, you don’t even have any jurisdiction in 8

Maricopa County, because you don’t have a single State 9

Park in Maricopa County. That’s the province of one of 10

your Board Members. 11

And I don’t know the details, but when State 12

Parks was created, and this is my only understanding, 13

that when State Parks was created, there was an 14

understanding, and I don’t even know if it’s a contract 15

written, a constitution, or whatever it is, but there was 16

a gentlemen’s agreement -– I don’t why they call it a 17

“gentlemen’s agreement.” Maybe it should have been 18

gentlemen’s and ladies’ agreement -- but that there not 19

be a State Park in Maricopa County. Why? 20

I’m from the third largest county in the United 21

States and some of the most historic things right there, 22

no State Parks? So I’m suggesting as a part of this 23

overall presentation, Mr. Chairman, that if you haven’t 24

done it already, please direct Bryan Martyn, and I’ve had 25

the great pleasure of working with him almost since he 1

arrived on this job, that a matter of action be presented 2

to this Board at its next meeting to fix the situation 3

that there is no State Park in Maricopa County, come up 4

with a designation category, and I propose that the staff 5

proposes to you, that the first State Park in Maricopa 6

County would be the Capitol State Park, number one. 7

And the second State Park, I didn’t think I’d 8

ever put Tovrea Castle in second place. But I think it 9

-– we have such a unique opportunity in that governmental 10

mall, the historic buildings and things that are grossly 11

underutilized. One of them used to be a museum, the 12

Mining and Mineral Museum. It’s now locked up. It’s an 13

abandoned building. And you have within your 14

jurisdiction, the State Historic Preservation Officer. 15

I don’t know if the Board Members realize just 16

how much power and influence you have. You were until 17

they changed the statute for the Centennial, you were one 18

of our entities, and you have two of them -– there are 19

four entities that form the Arizona Historical Advisory 20

Commission. The Arizona Park at U of A, State Museum, 21

the Arizona Historical Society, and the other two are 22

you, the State Parks Board and the person that reports to 23

you, and Mr. Martyn, the State Historic Preservation 24

Officer. 25

You have immense power and influence. And so 1

I’m asking you to use that influence and let’s make 2

Maricopa County a (indiscernible) for historic State 3

Parks, with those designations, and I’m sure that the law 4

department can help the staff guide through anything that 5

would need to be done. I’m thinking that initially, 6

nothing would change financially. Tovrea Castle, 7

everything would remain the same. It would simply be a 8

different agency that would give Tovrea Castle a status. 9

And it showed up -– I don’t know how many of you have 10

seen it. This is the February issue of the State Agency 11

Department of Transportation’s magazine to the world, 12

Arizona Highways. Look at what’s on the cover. Tovrea 13

Castle. It calls it one of the five icons in the State. 14

One of your former Chairman, John Hanks, 15

Prescott, when I took him to Tovrea Castle 12 years ago, 16

he said at the top of this building, he says, “This must 17

be a State Park.” And then I found out later that 18

there’s this gentlemen’s understanding that there not be 19

a State Park in Maricopa County. 20

So I’m just saying, let’s change the 21

guidelines. It will bring the State Parks into a whole 22

new focus, and it will enhance the kind of thing that’s 23

happening here with citizens’ involvement in State Parks, 24

and I think it will be a renaissance for State Parks. 25

certainly take it under consideration. 3

MR. DRIGGS: Thank you. 4

MR. CHAIRMAN: And just as a point of order, we 5

do have one State Park, although we don’t operate it, 6

it’s (indiscernible) thanks to Carefree and Cave Creek. 7

They run it for us. 8

MR. DRIGGS: It’s the “Johnny Come Lately,” of 9

course, but I’m thinking of the emphasis of historic 10

State Park as opposed -– 11

MR. CHAIRMAN: Thank you for coming, everyone. 12

Don’t everybody leave. All right. Next on the Agenda is 13

a Consent Agent and we have nothing to consent to today, 14

so we’re going to move right into the Director’s Summary. 15

MR. MARTYN: Thank you, Mr. Chairman. Mr. 17

Chairman, if I may request a point of personal privilege 18

to address the audience briefly, if it’s all right? 19

MR. CHAIRMAN: You certainly may. 20

MR. MARTYN: Thank you, Mr. Chairman. On behalf 21

of Arizona State Parks staff and Rangers, I want to thank 22

everybody in this room who not only has worked over the 23

troubles over the last few months, but has worked through 24

the troubles of the last few years. 25

We could not do State Parks without our 1

volunteers. We have over 800 volunteers that make our 2

Agency work. I can’t be more clear. 800 volunteers make 3

our Agency work. Without those volunteers, our Agency 4

does not work. I can’t begin to thank you enough. 5

Personally, for me, I represent over 310 Park employees 6

and volunteers. We couldn’t do it without. 7

So you are definitely our family, you are part 8

of the reason we exist, you are part of the reason we’re 9

successful, and you are part of the reason why we have 10

2.2 million visitors every year who love State Parks, 11

thanks to you. Your smiling faces and your dedication to 12

everything we do, if I could pay you all, I would. But 13

please accept this as my most sincere form of payment. 14

MR. CHAIRMAN: And we will do anything we can 18

to help you resolve the current conflict if you wish and 19

get things back on track. 20

MR. MARTYN: Mr. Chairman and Board, it’s been 22

busy for the last month. A quick Director’s update 23

(indiscernible) events from where I’ve been recently, 24

just so you know, and the public appreciates this. I 25

just got back last week, I spent a week in Boston, went 1

to Harvard for an executive education class. We talked 2

about running State Parks like a business, make them as 3

fiscally sound as we can, and know that we at State Parks 4

are dedicated to going to get the answers to the test. 5

This is a tough road to hoe, how do you save 6

State Parks, and maneuver to utilize the business acumen 7

that’s out there. We talk about State Parks, it used to 8

be kind of like a library museum. You didn’t have to 9

make money. Well, we’ve got to make money now. 10

So we’re dedicated to getting the education and 11

getting out there. It was –- I went to a class called 12

“Driving Government Performance,” which is right in our 13

wheelhouse, it’s what we do. It was a great class. It was 14

a great networking exercise. I ended up using my GI Bill 15

to pay the $7,000 for the one week at Harvard, so 16

taxpayer dollars weren’t spent. 17

But we are dedicated to that and just as a 18

Board, I hope you know, that’s the direction we are 19

taking this Agency based on your guidance. 20

But it was a good week, and the weather was 21

good. It’s not good this week and it wasn’t the week 22

before, but it was good weather while I was there. 23

This last weekend, I got back late Friday 24

night, and then Sunday morning I found myself out at 25

Picacho Peak at the Civil War Reenactment. I want to 1

thank all the staff who made that event work. We talked 2

about volunteers. It was a great opportunity to get 3

employees, mostly staff, the Phoenix office, out to the 4

field, and they love it and they’re driving people 5

around. I want to thank the Deputy Directors who made 6

time to get out there as well. 7

We had almost 4,000 guests over the two days. 8

We raised about $11,000, I think is the number. It was 9

good. It was a good exercise for me and staff to -– I 10

was driving a golf cart back and forth. We take the 11

handicap folk at the parking lot and drive them to the 12

front gate basically of where the events are happening, 13

and men and women and child, everybody was having a good 14

time. As I drove them back, they were excited to go in 15

to see the cool stuff going on in there, as I drove them 16

back out to their car, they were overjoyed. From the 85-17

year-old grandma to the 6-year-old kid, everybody had a 18

good time. They really liked the loud cannon especially. 19

But it was a great event. And again, volunteers make 20

this work. 21

All the re-enactors, not one of them got paid. 22

There were almost 200 re-enactors out there and these guy 23

and gals dedicate their time to support (indiscernible) 24

and what they’re all about, that they utilize our Park, 25

our State property, to make great things happen, and we 1

all benefit from it. They’re dedicated to staying on the 2

Park and they would be interested in continuing with more 3

of this at some other Parks. 4

So we’re starting to talk to them about getting 5

these re-enactors out around the state and letting them 6

do what they do. A very positive event. 7

Also, about three weeks ago, we spent some time 8

down at (indiscernible), which is the home of the old 9

John Wayne movie, McClintock, that house out there. If 10

you didn’t know it, it’s just down the street from here 11

by the way, relative down the street. A great piece of 12

property that we picked up through some Heritage money a 13

few years ago. 14

We have -– I was looking on-line for some 15

pictures of the house, and I ran across the old weather 16

vane, a picture of the weather vane, and I clicked on it 17

and sure enough, there was a company that sold it, that 18

weather vane. I’m like, we’ve got to get the weather 19

vane for the John Wayne, for the McClintock house. So I 20

started calling around and the guy who makes the weather 21

vane lives in Benson, Arizona, of all places. 22

So I called him and asked him if we could get a 23

cost and I explained what we were going to use it for, 24

and he said, “You can have it. I just want to be down 25

there when you put it on the house.” So they dedicated 1

the weather vane for the house. So we went out there to 2

the house and we put it up, and this guy belongs to a 3

Jeep group, a Jeep travel group. There must have been 50 4

people out at the house, and I can’t tell you how excited 5

these people were to walk through the 10,000 square foot 6

home, both inside and outside. They were very, very 7

pleased. 8

Now we’re still working through some issues on 9

the property. That property, just for the public’s sake, 10

is more of the environmental piece. The house is just an 11

add-on. We control about 21,000 acres total down there 12

for an environmental piece. One of our missions is to 13

protect resources, and this resource is more of a nature 14

preserve, just happens to have a little cool historic 15

house on it. So it’s not really open to the public, but 16

it’s a great venue. 17

So it was a good event and we continue to do 18

great things. 19

Some things coming up. A big thing, and I’m 20

sure everybody in this room is aware that this weekend, 21

we’re getting an award, and I want to thank Sholoff 22

(phonetic) for heading that up, and this is good. This 23

is good exposure at a national level for a great Park, 24

and who is the gentlemen who runs that that I saw? 25

MR. MARTYN: Great guy, I’m sure everybody here 4

knows this guy is dedicated. And it’s great to recognize 5

the work that he does to keep that press up and keep it 6

operational as a matter of fact. Good things happening 7

there. So we’re very excited about that. Looking forward 8

to that. 9

And then Catalina State Park, we’ve got their 10

30th anniversary coming on May 4. Those invitations 11

should be going out this week. We are sending those out 12

to how many? 13

will be a nice event showcasing one of our most popular 16

Parks, the most profitable Parks at that. So good thing. 17

MR. MARTYN: Under item Number H, we talk about 1

State Parks, legislative updates. There are currently 2

three bills that are moving through the House and the 3

Senate. 4

The Continuation Bill is all the way through 5

the House and the Senate. It’s waiting, it’s through 6

caucus. It’s just waiting for a vote. We don’t see any 7

problems there. It did go forward with ten years, so 8

that’s a good piece of legislation that I don’t see any 9

problems with. 10

We had a little bit of pushback in the House, 11

but I talked to the legislator. He wanted to involve big 12

game hunting on Arizona State Park. I told him that 13

Tubac was probably a good place to go look for elk. So 14

he’s been educated on what actually State Park’s function 15

is. We’re not a big game reserve. So we’re good there. 16

The SPLIF Bill, 2172, State Lake Improvement 17

Fund, which represents about two million dollars to the 18

Agency based on the recompilation of how we did SPLIF. 19

It’s an ADOT Bill. It didn’t make it through the House on 20

a 60/0 vote, so I’m sure it’s doomed for failure at some 21

level. That’s a good Bill. That’s advantageous to all 22

the Agency, and we’re anxious to see that move forward. 23

It is sitting suspense in caucus in the Senate, just 24

waiting for a Senate vote, and then it will make its way 1

over to the Governor’s office. 2

Finally, the State Parks one, 2621, that’s that 3

Bill that prescribes an opt-in on the vehicle 4

registration, a donation of sorts, that the State Parks 5

Board will determine what the donation value, what it 6

would be, and then any accompanying promotional item that 7

would go with it. 8

That Bill itself is over on the Senate side 9

right now. It goes to Rules next and we'll see. So far 10

it’s had great support in both the House and the Senate. 11

We’re watching that Bill closely. 12

So with that, any questions about things going 13

on relative to legislation effecting State Parks? 14

MR. CHAIRMAN: Seems like things are a little 15

quieter than they have been in the past, which is always 16

good. 17

MR. MARTYN: This is the calm before the storm 18

I’m afraid, as far as the Legislature is concerned, sir. 19

But anything else on that, sir? 20

MR. CHAIRMAN: No questions from any of the 21

MR. CHAIRMAN: Why don’t we move ahead with 24

State Parks Operations at this point. 25

BOARD MEMBER: I didn’t know where we were 1

headed. 2

MR. CHAIRMAN: Yeah. People can find out about 3

some of our other State Parks around the State, how we’re 4

doing. 5

MR. REAM: I don’t have a page number here, but 6

this is what the front page looks like, H2, in your Board 7

packet. I’m more interested in the table and the updated 8

attachment. 9

Mr. Chairman, Members of the Board, I just want 10

to remind everyone here that there are three Parks in 11

Santa Cruz County. It’s the smallest county in Arizona, 12

but it has quite a number of Arizona State Parks in it. 13

The Tubac Presidio State Historic Park, San Rafael 14

Natural Area, the Sonoita Creek Natural Area and 15

Patagonia Lake State Park. So it is -- I mean the next 16

biggest one is five Parks in Yavapai County and Pinal 17

County. I do call your attention to that. We have quite 18

an investment in Santa Cruz County. 19

You know the 13 Parks that are open to the 20

public and without any financial partners. We also have 21

the Parks operated by Arizona State Park staff, that is 22

Rangers on the property, and through partnership support 23

either in-kind or financial. 24

We have the Parks like Tubac Presidio State 1

Historical Park, which is operated by -– through an 2

agreement with Santa Cruz County and operated now by the 3

Friends of Tubac Presidio and Museum. If I write a 4

check, I need to know all that. 5

So I want to go down and tell -– I gave a 6

pretty good description last meeting on where we were on 7

all these. We’ve had some updates since then. I’ll just 8

give you those updates and I’ll be done for the day. 9

The first is Fort Verde State Historic Park. 10

The Council is still considering it. This is a change 11

from a year-to-year agreement like we had here at Tubac, 12

to a five-year agreement. And they want to make sure all 13

the ducks are in a row before they sign a five-year 14

agreement for the operation of that Park. And 15

(indiscernible) time, we’re planning on setting up a 16

meeting and going over some of the concerns of that 17

partnership, and hopefully, we can get that ironed out. 18

The Hopi Tribe Partnership has been signed by 19

the Tribal Council and the Chairman of the Hopi Tribe, 20

and we’re just waiting for our copy to get back. It’s 21

just awaiting the Director’s signature. They’ve already 22

sent the check. So we are set for another year with the 23

management at Homolovi State Park and the partnership 24

with the Hopi Tribe. 25

Move on down to the Tubac Presidio. I didn’t 1

even know this. This is how fresh this is. They voted 2

to accept this agreement this morning. I will assume it 3

will be signed by the County Manager or the Chairman of 4

the Board of Supervisors, I don’t know which, and then 5

that will be available for the Director’s signature and 6

that will be going on as well. 7

Many of you know, I’ll say it one more time, 8

that we are involving grazing. Our conservation owner, 9

who owns the property adjacent to San Rafael, will be 10

grazing about 100 head of cattle for the next five months 11

at San Rafael. He’ll be using two pastures and it will 12

be about 2 and a half months on each pasture. 13

We are getting the same money that -– we used 14

the State Lands formula for determining that 15

(indiscernible). We call it our Special Use Permit, 16

because it is not a long-term lease. We may have 17

grazing, we may not. It all depends. It’s all special 18

use. 19

MR. CHAIRMAN: It’s a fire prevention tool, if 20

nothing else, to keep the house from burning down. 21

MR. REAM: I’ll move down to Lyman Lake State 22

Park. We’ve made our call again to Apache County. I 23

will remind you that the Park will open in May for day 24

use, and then on Memorial Day, we’ll open it for camping 25

all through the summer. This is an exciting prospect. 1

We’ve had a long-term commitment from Apache County for 2

four years. We’ve been getting money from Apache County 3

and making the Park open and available during those 4

summer months. 5

This is something new for State Parks, having a 6

seasonal operation in the State Park, and it’s working 7

out very well. We think we’ve got it down. So we’re 8

hoping that that will work out. We will be open in May. 9

The Tombstone Courthouse has been approved by 10

the Tombstone City Council, and signed by the Director. 11

That one is done. That is operated by -- the Tombstone 12

Chamber of Commerce, operates that Park with an agreement 13

with the City of Tombstone. A little bit different. 14

Everyone of them is unique to each town and each 15

situation. 16

Then finally, McFarland. It won’t expire until 17

June, but just so the little town of Tubac and Santa Cruz 18

County doesn’t feel left out, they’re having some turmoil 19

there in that small town over who is going to run that 20

Park, whether it’s going to be Main Street Program or the 21

Florence Historical Society. We’re changing our 22

agreement. The Main Street Program is out, the Florence 23

Historical Society is in, and what we like to call in-24

flux right now, as we move through the agreement process 1

with the town. 2

So hopefully, we’ll have that done by the end 3

of March. I believe the Historical Society is already 4

moving in. We do have a current agreement with the town 5

no matter what. 6

That’s all I have. I’m open to questions on 7

these. Again, all of these have been really great to 8

work on. It’s been great to work with these communities. 9

It is especially rewarding that these people who take 10

these over, how much they love the places and you can see 11

that in the way they operate them and the way they take 12

care of these Arizona State Park property. 13

MR. CHAIRMAN: There are no questions. Thank 14

you, Jay. I might add for the public’s benefit, just a 15

little explanation on the seasonal deal. 16

When we started getting into running into some 17

financial problems, one of the decisions that was made or 18

conclusions that was made, was that some place like El 19

Paso in the middle of the summer was hotter than Haiti, 20

and the only reason to keep it open in the summer is to 21

rescue people that are foolish enough to hike to the top 22

of it without any water. 23

So we decided that we would close a Park such 24

as that during the hot summer months. By the same token, 25

you go up to Lyman Lake up in Apache County where it’s 1

cold as all get out in the winter time, you’re probably 2

not going to be able to do a lot of fishing or swimming 3

on the lake. So we’ve closed it in the winter time and 4

we’re able to shuffle some folks around and keep those 5

Parks open during the peak season. So it’s worked out 6

very well. 7

Next on the Agenda is a status update on 8

Presidio State Park, and Shaw, would you like to address 9

us on this? 10

MR. KINSLEY: I’d be happy. The status of the 11

Park is that we’re finishing up our busiest season. 12

March is our crescendo and visitation has been very good. 13

We’ve been blessed with being able to enhance several of 14

the exhibits. Michael Frisinger (phonetic) has given me 15

dry-mounted images of the 1974 dig that installed the 16

most significant exhibit we have here at the 17

archeological dig that exposed the foundations and the 18

artifacts found by the Arizona State Museum and the 19

University of Arizona. These color pictures just really 20

enhance that underground site and are very useful to 21

school groups and illuminating the whole process of 22

archeology. 23

We are very much looking forward to the award 24

on Saturday as a National Historical Site for Journalism 25

and we promise not to ask why it was so long in coming, 1

since it was the first newspaper in Arizona in 1859. But 2

we are very happy to have it. 3

The excitement of about 3 and a half weeks ago 4

when the paintings that use to grace these walls were 5

removed forcibly and passed out that door to a waiting 6

van. We’re looking forward to the change in the 7

leadership of the Historical Society, so those might come 8

back. In the meantime, we are blessed to have a 9

fantastic exhibit of the Anza Exhibit supplied by the 10

National Park Service, and another gift from Michael 11

Frisinger. This traveling exhibit by the Smithsonian 12

Institution of the scenes of change, talking about the 13

Colombian Expedition, has gotten great comments and 14

reviews from visitors and it’s taken care in a nice space 15

here. 16

I’m really open to any questions you might have 17

about the operations, but steady as she goes is sort of 18

our motto right now. 19

MR. CHAIRMAN: Bryan, Ken, do either one of you 20

something to add? 21

MR. MARTYN: Mr. Chairman, if I might. Mr. 22

Bowman mentioned something about a letter from the Board 23

to the bank and County Manager, if I might address. We 24

would have to work through that with the Board’s guidance 25

relative to the legality of can we even do that. You 1

know what with our commitment and the Board’s commitment 2

is for the Park to remain open with our primary partner, 3

the County, and all the imaginations of the problems that 4

are happening below that is what it is. 5

But we’ll explore, Mr. Chairman, the legality 6

of what might be able to do to help, and then get back to 7

you through the Board and myself if that’s all right, Mr. 8

(indiscernible). 9

MALE SPEAKER: That would be great. We’d sure 10

appreciate the help. 11

MR. CHAIRMAN: We’ll do whatever we can, as 12

long as our lawyer doesn’t get us in trouble. 13

MALE SPEAKER: Well, let’s all stay on the 14

right side of that. 15

MR. CHAIRMAN: Yes, question? 16

MALE SPEAKER: Yes, sir. If I could just add 17

an addendum. The money that I believe is in those 18

accounts that was already brought up, does not belong to 19

the Tubac Historical Society. It was money that was 20

given to the Presidio Park by groups such as our, the 21

Citizens Council, homeowner’s associations, individual 22

contributions, and it should not in any way be held 23

hostage because of the dispute between who the real board 24

is of the Tubac Historical Society. 25

And that’s why from a legal standpoint, the 1

bank is just looking for -– actually a reason, so they 2

can turn that money over to the County. I don’t see it 3

being a real legal problem. But I know that it’s 4

something you have to explore. 5

MR. CHAIRMAN: Do we have contact information 6

on that? 7

MR. STETSON: We do. 8

MR. CHAIRMAN: Okay. Thank you, Shaw, and 9

thanks to everybody who is here today for all your work 10

you’ve done in the past and are going keep doing for the 11

next three years minimum. 12

Okay. Kent, would you like to give us a 13

revenue forecast, a revenue, and visitation? 14

MR. ENNIS: Thank you, Mr. Chairman. I’ll be 15

brief as usual, or try to be. 16

We experienced our second January and February 17

decline in attendance and Park revenue on a month basis 18

over the prior February. We had about 16 percent in 19

revenues in the system. We’re down about 12 percent. 20

Yes, 12 percent. And we attribute that entirely due to 21

the cold, the two cold months that we had. 22

We are watching this very closely. We think –- 23

we were able to track it daily now with the reservation 24

system, and we think we’re in the process of catching up 25

so that we’ll be at least flat this month. We’ve got a 1

ways to go. 2

But the good news is, is that we are still 3

attendance-wise flat on the year and year-to-date and we 4

are flat revenue-wise in the Park system. And our 5

revenue forecast is very conservative, and so flat is 6

essentially good. So we’re flat these two months. They 7

were also marked last year in January, February, but a 8

real surge. So we couldn’t keep that up. We’re not –- 9

in other words, at this moment, we’re not all concerned. 10

Our OHV Fund is actually up year-to-date, 11

approximately 3 and a half, 4 percent, so we’re good 12

there. 13

And of course our State Lake Improvement Fund 14

is the most stable and it’s essentially dead on from last 15

year and dead on forecast. And so we’re hoping that 16

these revenue enhancements, one or more, that the 17

Director had talked about in the Legislative update, will 18

come through. They will be a great help to us in the 19

future. 20

With that, I’ll be happy to answer any 21

questions. 22

MR. CHAIRMAN: Yes? 23

MR. EVERETT: The Legislation you mentioned, 24

how would that impact? 25

MR. MARTYN: Mr. Chairman, Mr. Everett, if you 1

look -– take it back one slide. You see the black lines 2

that are up nice and high right there, those would come 3

back basically. It’s about $200,000 a month that we 4

would be able to utilize operationally. There’s some 5

limitations obviously to SPLIF funds, but it would be a 6

great advantage. 7

MR. EVERETT: And is that one where -– it’s a 8

safety fund isn’t it, that goes to counties? 9

MR. MARTYN: Boating safety. 10

MR. EVERETT: Yeah, okay. 11

MR. MARTYN: And this is (indiscernible). 12

MR. EVERETT: So this would all increase 13

(indiscernible)? 14

MR. MARTYN: Correct, yes, sir. Yes, sir, 15

that’s correct. This is a good thing for the Agency. 16

Eventually, our goal is to get off of the SPLIF Fund. 17

But in the interim, this is a good tool for us to 18

continue getting out of our two hundred million dollar 19

request for capital backlog. 20

MR. CHAIRMAN: Any further questions for Kent? 21

Item G (indiscernible). 23

MALE SPEAKER: Mr. Chairman, my name is on this 24

memo and the subsequent grants related (indiscernible). 25

But since we reorganized almost a year ago, I’ve been 1

working in a daily fashion with our grant staff. 2

(Indiscernible) I would like to go with our 3

(indiscernible) and go with our expertise and have the 4

expert on this matters, Doris Pulsifer make this 5

presentation, with your permission. 6

MR. CHAIRMAN: You may. It makes perfectly 7

good sense to me. 8

MS. PULSIFER: Good afternoon, Members of the 9

Board. The next few items are actually all pretty much 10

trails grants related, so I’ll just go and try to give 11

you some little bit of background on each one for the 12

benefit of the ones that are new. 13

This first items is a recommendation that 14

hasn’t been forwarded from the OHVAG, and it deals with 15

OHV Ambassador Grant Program. The Ambassador Program is 16

kind of a sub-program of the overall OHV Grant Program. 17

The purpose of the Ambassador Program is basically for 18

the operation of the Ambassador Group which they train 19

volunteers to go out and have a presence on these OHV 20

areas and to have events and just have a presence and 21

promote safe and responsible recreation. They passed out 22

educational materials and those kinds of things. 23

The Community Forest Trust is a partner with 24

the Prescott Forest. What they do, they coordinate 25

volunteer activities. And a couple of years ago, the 1

Community Forest Trust on behalf of the Prescott National 2

Forest area, submitted a Grant Application for the 3

Ambassador Program funds. And they were awarded $18,500. 4

As part of what the grant was for is basically 5

was for equipment and materials and here two years later, 6

they’ve pretty much purchased everything that they 7

needed. But in the meantime, part of the deal was that 8

they would provide the OHVA coordinator. Due to budget 9

cuts and those types of things, they have not been able 10

to secure the funding for the coordinator. 11

And so what this request is, because they’ve 12

only spent a little over $6,000 of their total grant 13

award, they’re not asking for any additional money or 14

anything like that. This is merely just a transfer of 15

the unexpended funds that was to be used for equipment 16

and transfer that over and allow them to use that to pay 17

an OHVA coordinator part-time. 18

So that’s basically all this is. Like I said, 19

the OVHAG Group has reviewed this and has approved it. 20

to consider a revision to the OHV Project Grant Writing 13

Process, Criteria, and Evaluation Form. 14

And, again, just to give you a little bit of 15

background in a nutshell. A couple of years ago, 16

(indiscernible) prior to last September, the OHVAG Group 17

had the authority to rate and award grant funding. And a 18

couple of years ago while they were going through this -– 19

they had a little bit different process back with -– they 20

asked staff if they could assist them by looking at a 21

method for them to be able to score these grants. 22

And so staff did that and came up with what we 23

call the Evaluation Tool. And that’s basically just –- 24

it’s a form that allows it to prioritize the projects. 25

So kind of moving, fast forwarding to last June, this 1

body requested that the grant criteria and funding 2

request be reviewed staff, (indiscernible) and for those 3

recommendations to be then forwarded to the Board for 4

final approval. 5

So following that action, in August AORCC met 6

and then OVHAG. And the purpose to bring AORCC into the 7

picture was because statutorily AORCC is responsible for 8

reviewing OHV grants. And somewhere along the lines, 9

years before I came to State Parks, they stopped doing 10

that. I suspect it had something to do with back when we 11

had the Heritage funds and it was probably split up where 12

AORCC probably took over the trails, the Heritage trails 13

part, and then (indiscernible) took care of the OHV 14

grants. 15

I’m not sure that that’s how it came about, but 16

I kind of suspect that’s what happened. 17

Anyway, going back to June –- or, I mean, last 18

August, following that request by the Board 19

(indiscernible), first AORCC met and they reviewed the 20

evaluation tool and the criteria and they made a few 21

suggestions. Pretty much they accepted what staff had 22

come up with and the evaluation tool is basically split 23

up into two sections. The main section is the ace 24

points, which is basically -– it takes the priorities of 25

the State Trails Plan and it assigns points to the 1

different components. There’s three priorities, and 2

within the three priorities there’s different components. 3

So the face part, assigned the tools 100 points 4

for that section and then we asked AORCC and OHVAG both, 5

to consider bonus categories. So the second part just 6

assigns different points to different bonus categories. 7

And if you look in your packet, just a couple of pages 8

farther on you’ll see a description of those bonus 9

categories. 10

So AORCC, basically, their recommendation went 11

forward and in their recommendation they decided that 12

they did not want to be responsible for actually rating 13

the grants. They asked for staff to do that and then 14

bring the recommendation to them and they would consider 15

that recommendation. That was one part. 16

And then OHVAG, on the other hand, they wanted 17

to go ahead and do their own ratings. So that was kind 18

of the difference there. 19

The other significant, and it wasn’t really all 20

that significant was, in the bonus category, this is 21

where we come to this item here, there was a slight 22

difference in the bonus category having to do with public 23

support. 24

Now part of the reason going back to why the 1

Board asked AORCC to take part in coming up with criteria 2

is because of the two different perspectives. AORCC kind 3

of has an overall picture of the recreation arena, where 4

OHVAG has a focus on OHV-related activities. 5

So the two perspectives, just a little bit 6

different there, and it kind of comes out in this one 7

particular bonus category, in that AORCC's view of public 8

support is a little bit different in the definition of 9

what public support is. 10

In AORCC's mind, public support is the overall 11

public support non-OHV groups. Now, OHVAG on the other 12

hand sees public support as support from OHV groups. So 13

this is where the two differences came in. 14

When this was forwarded to the Board in 15

September, the Board pretty much approved all of the 16

bonus categories and it was their decision that at that 17

time that public Parks -– considered overall support from 18

letters -– from anybody. 19

And so following that action in September, the 20

Grant Manuals were delivered based on the criteria that 21

was approved by the Board. We accepted the applications 22

from the different entities based on this criteria and it 23

was ranked and rated based on that criteria. 24

Now, we told both AORCC and OHVAG that 1

following this first cycle using this new grant criteria 2

and the evaluation tool, that they would have the 3

opportunity to evaluate the rating process and make 4

recommendations. 5

So following this first cycle, first it was 6

presented to AORCC and AORCC made their recommendations 7

on the funding request and they evaluated the process and 8

they didn’t have any changes. They felt that the 9

evaluation process and the evaluation tool all worked 10

very well, and so they do not have a recommendation for 11

me to present to you today. 12

OHVAG on the other hand had a few different 13

ideas that they still want to review a little bit more. 14

But for today, the recommendation that they did forward 15

was for you to, again, please reconsider the public 16

support and what their definition is, again, the OHV 17

community. 18

So that’s what this request is, asking you to 19

reconsider that bonus criteria of the definition of 20

public support. 21

MR. CHAIRMAN: That we originally took care of 22

in September of last year? 23

recommended here, this only affects their personal 9

criteria and rating. It does -– and this does not in any 10

impact AORCC's recommendation or staff’s recommendation. 11

This just allows the OHV community to place more emphasis 12

somewhere than the other. 13

This body as the approval authority for these 14

grants, still can take or whatever piece of 15

recommendation that is. This is simply giving the OHVAG 16

community kind of their own spin on it, and then it will 17

be this job, this Board’s job to massage, take that into 18

consideration relative to the score that they give to a 19

particular item. 20

We did see in this last grant cycle, that the 21

OHV community agreed with staff’s recommendations, where 22

AORCC actually changed a few things. 23

So, ultimately, it will give this Board still 24

the ability to make an educated decision relative to the 25

grant cycle, but it will also empower the HOV community 1

to feel that they’re getting their focus on what they 2

want to do. And that was the reason why the Board made 3

the recommendation months ago, allowed AORCC to take 4

their look at, allowed staff to take their look at it, 5

and then let OHV put their two cents in. 6

That’s all we’re doing. This motion allows 7

OHVAG to personalize their grant criteria. 8

MALE SPEAKER: Mr. Chairman? 9


MALE SPEAKER: Question then based on that. So 11

there would now be two separate grant rating criteria? 12

One that OHVAG would use and one that AORCC would use? 13

MS. PULSIFER: No. Because we developed the 14

Grant Manual. We can only have one set of criteria. So 15

it’s whatever this Board –- 16

MALE SPEAKER: So if we pass this, then we are 17

going against what AORCC is recommending and going with 18

what OHVAG is recommending? 19

MR. MARTYN: Excuse me, Mr. Chairman. Okay, if 20

the Board approves this, what happens to the overall 21

grant criteria? 22

MS. PULSIFER: The overall grant criteria stays 23

the same. It’s just the definition of what public 24

support, community support is. And it’s just basically 25

what AORCC's perspective is overall and OHVAG is focused 1

on the OHV community. So it’s two different 2

perspectives. 3

MALE SPEAKER: So if this is passed, though, 4

whose perspective do we use? 5

MS. PULSIFER: I don’t really want to speak for 6

AORCC, but AORCC really -– they -– I don’t think that 7

they would really have a problem with narrowing it down 8

to the OHV community. They feel that, you know, public 9

support is probably -– weighs more in the long run. 10

But I don’t think that they would necessarily 11

have a problem if it was narrowed down to OHV. 12

FEMALE SPEAKER: And so I’m only comfortable 13

with overall public support. I’m not sure how all the 14

dynamics work here with the way these groups interact. 15

But if this is narrowing it down anywhere so it’s just 16

OHV and that’s the guideline that we’re looking at, 17

that’s not something that I would be supportive of. 18

MALE SPEAKER: Nor would I. 19

MR. MARTYN: Mr. Chairman, so let’s make this 20

clear for the Board’s sake. Relative to the criteria 21

that would be written, overall criteria, we would change 22

it to focus on the OHV definition, and the original AORCC 23

definition would come out. 24

you’re accurate in your perception of what you’re asking 2

for here. 3

MR. CHAIRMAN: I was going to say, absent no 4

MS. PULSIFER: Okay, Number 3. This motion is 6

forwarded to you from the ASCOT Group, the Arizona State 7

Trails Community on Trails, and they are charged with 8

reviewing the nominations for trails to be included in 9

the State Trail System. And they’ve been collecting 10

these applications for some time now, and they’ve 11

actually received 16 applications, one was -– it’s not 12

included in this recommendation. It’s not that it’s not 13

a good trail, it’s just that they need more work on their 14

application. 15

So for today, the recommendation from ASCOT, is 16

to approve these 15 trails that are listed here in table 17

one, just so that for a matter of record so that you 18

won’t have to read them into your motion, I’m going to 19

go through them real quick. 20

We have eight that have been submitted from 21

Maricopa County and for a total of 21.9 miles. It 22

includes the Lake Pleasant Regional Park-Anthem I-17 23

Connector Trails, the Mule Deer Trail, the Sonoran Trail, 24

Verde Trails, the Tortoise Trail, the Rock Knob Trail, 1

the Chuparosa Trail, and Shallmo Wash Trail. 2

The Town of Marana has submitted six 3

applications for a total of 22 miles, and they include 4

the Alamo Springs Trail, Cochinse Spring Trail, Lower 5

Javelina Trail, Upper Javelina Trail, Wild Burrow Trail, 6

Wild Mustang Trail. 7

And the City of Bullhead City submitted one 8

application for 1.25 miles and that's for the Colorado 9

River Nature Trail. 10

So we have 15 trails totaling 45.15 miles. And 11

these trails meet different criteria, depending on what 12

type of trail they are. They have specific –- depending 13

on trail, they have specific criteria, whether it’s urban 14

trail across State trail, recreation trail, interpretive 15

trail, historic trail, or paddle trail. 16

The existing -– the trails that are forwarded 17

for recommendation have to be either an existing trail or 18

a proposed trail that the planning has been completed or 19

construction is ready to go. So that’s part of the 20

criteria for these trails. 21

MR. CHAIRMAN: Any questions? 22

Chairman, Doris. So the trails that are proposed are the 24

rights to the property ownership of the trail. Have 25

those been established, has the property owner been 1

consulted with on these? 2

MS. PULSIFER: That’s part of the requirement, 3

yes. 4

MS. PULSIFER: So it’s -– basically, it’s a 7

designation is what it is. 8

FEMALE SPEAKER: And part of the review process 9

is that the property owner has been consulted with and 10

has agreed to the designation on their land? 11

MS. PUSLIFER: Yes, that’s all part of the 12

application. 13

FEMALE SPEAKER: Okay. Thank you. 14

MR. CHAIRMAN: If there are no further 15

listed in Table 1 into the State Trail system. 18

MS. PULSIFER: Okay. The last item is a 5

funding request for the OHV Program, funding ramps. And 6

we have offered two different options here motions. 7

Again, going back to the criteria both AORCC 8

and OHVAG rated these applications based on the criteria 9

that was approved back in September. What staff has 10

presented to both groups and both groups have agreed, 11

that we would like to be able to take -– we have -– well, 12

we anticipate that we’ll have about three million dollars 13

available for grants through June of 2014. One of the 14

things that we would like to see even though we’ve got 15

plenty of money available – actually, we could probably 16

fund all of them or at least most of them. But instead 17

of just funding grants or requests just because we have 18

enough money, we’d like to see the money go to good 19

projects. 20

So the recommendation from staff to the two 21

groups was that we try to divide the money up into three 22

different cycles. So up to the time that we offered the 23

notice or the opportunity for the first cycle, we had 24

about 2,000 –- 2.4 million available. 25

The grants that were received, I went ahead, 1

and we had them listed in attachments A, B, and C of your 2

packet and I realized that they were kind of small to 3

read. So I have reproduced them on larger sheets that I 4

handed out just before the meeting today. 5

Now one of the things, again, having to do with 6

the evaluation tool, it turns out that the evaluation 7

tool seems to be working really, really well, because 8

again, the evaluation tool is just meant to prioritize 9

these funding requests. 10

And so when AORCC met to review these -– to 11

review the funding request and gain -- keep in mind that 12

AORCC selected for staff to rate the grants or the rating 13

team I should say, the review team to rate the grants and 14

then bring a recommendation to them and they would 15

consider the rating team’s recommendation. 16

AORCC met first and they agreed with staff’s 17

recommendation and that was to fund the top -– the seven 18

highest-rated grants. In addition to that, our OHV 19

coordinator also recommended that we go below the line 20

and that we fund the Arizona Game and Fish project, which 21

was for a trail designation for Alamo Trail. It was only 22

for $3,000. They felt it was a worthy trail and even 23

though it fell below the line, it was recommended. 24

AORCC agreed with staff’s recommendation to 1

fund the top seven, plus the Arizona Game and Fish, but 2

in addition to that, Game and Fish also recommended to 3

approve the BLM project for the mobile station. And 4

that’s also below the line. 5

The Mobile Information Center, AORCC felt that 6

it was a good project because it included -– it was a 7

mobile station that was going to include exhibits on 8

outdoor recreation and it also included educational 9

information in there, materials on OHV. So there 10

recommendation was to include the BLM project. 11

So AORCC's recommendation was to fund the seven 12

highest scoring projects which totals $775,563; plus the 13

Arizona Game and Fish trail designation to Alamo Lake for 14

$3,000, and then the BLM for $73,556, for a total of nine 15

projects totaling $852,119. 16

Now when OHVAG met and again now they each –- 17

each member was provided with the entire packet and they 18

individually rated these applications and then they met 19

as a group and they came up with a consensus rating. 20

And the beauty of it is is that although their 21

scores were a little bit different than staff’s scores, 22

in the end, it turned out that they were the exact same 23

projects. And even though they may not have been quite 24

the same order, it was still the top seven. 25

So OHVAG’s recommendation actually mirrors 1

staff’s recommendation and they to agreed with staff that 2

Game and Fish, the $3,000 request for the designation for 3

the Alamo Trail was a good project, and they also 4

recommended that for approval. 5

Now they had a different take on the BLM. We 6

made them aware of AORCC's recommendation. Now OHVAG’s 7

opinion is that although the BLM project is a good 8

recreation project, it’s not that there’s anything wrong 9

with the Mobile Information Center, it’s just OHV money, 10

it doesn’t focus on OHV, it focuses on overall 11

recreation. And OHVAG’s concern is that the money should 12

be the good use of OHV money and should be more focused 13

on OHV. 14

So OHVAG’s recommendation mirrors staff’s and 15

they did not recommend the BLM. So their recommendation 16

and staff’s recommendation is to fund the top seven 17

highest plus the Game and Fish. 18

MR. CHAIRMAN: And AORCC agreed with that and 19

added the BLM project? 20

MS. PULSIFER: And added the BLM. 21

MR. CHAIRMAN: That’s the only difference? 22

MS. PULSIFER: Exactly. 23

MR. CHAIRMAN: Any comments? 24

MR. MARTYN: Mr. Chairman, if I might explain. 1

I want to thank Doris for working through all this and I 2

appreciate the Board. I think we’ve set this up 3

correctly now, and the fact that OHV came up with similar 4

-– as to the exact same pecking order, the top seven, 5

validates -- I think it validates the process. 6

As far as AORCC and what they’ve decided, there 7

was some input –- AORCC agreed and I do sit on the Board 8

of AORCC just so everybody knows. AORCC basically looked 9

at this and agreed that the top seven met the criteria, 10

also agreed that the $3,000 was good, which is actually 11

item number 9 based on the criteria. But I had a member 12

who explained item number 8 and the benefit relative to 13

the community, was a member of the OHV community as well, 14

and so the AORCC Board basically lowered the line down to 15

pulling the top nine. 16

The line is arbitrary. There is no -– we have 17

plenty of money in the fund and staff made a cut and it 18

is where it is, to make sure we fund good projects. 19

AORCC pulled in, just basically moved the line down 20

because they believe that this project is worth funding 21

today. 22

You as a body, have the ability to drop the 23

line or move the line or pull anything out that you want. 24

By statute you can do anything you want to do. Know that 25

the AORCC recommendation, the addition, item number 8, if 1

it doesn’t get funded this time, I believe personally 2

that it has the ability to resubmit and possibly get 3

above the cut line next time. 4

So you can’t lose on this. I think we meet the 5

criteria of what the OHV community is looking for and I 6

think we’re well within the law and this is what we do 7

with OHV, and I’m pleased to say that we are meeting the 8

law because we went away from it for quite awhile and 9

we’re back in where we need to be. 10

I’m happy to answer any questions, Mr. Chair. 11


MALE SPEAKER: Comment then based on that. 13

Your feeling is that the BLM project could come in at a 14

later date and possibly make the cut? 15

MR. MARTYN: Mr. Chairman, yes, I believe it 16

is. It’s whether you want to approve it now or do you 17

want to wait and approve it later. I think that’s kind 18

of where you are at, and you have the ability to do 19

whichever you like. 20

MALE SPEAKER: And Mr. Chairman, I guess my 21

thought on that is to stay with what OHVAG is 22

recommending to us as the funding body and go that route, 23

especially, you know, if they think we can bring that 24

project back in at a later date. Because that project is 25

partially recreation or OHV is a segment of what that 1

project deals with, not totally OHV. 2

So my recommendation would be to go with what 3

OHVAG is recommending, and I read some of the comments 4

from their meeting and there was some feeling of that. 5

Also, Mr. Chairman, I’d like to ask one 6

additional question if I could. 7

MR. CHAIRMAN: Certainly. 8

MALE SPEAKER: Some of the funding in here goes 9

for route designation, which is not on-the-ground work, 10

and I know some of the members of OHVAG were concerned 11

about that as am I. And this is really just a point of 12

clarification. 13

But if BLM is not awarded those funds to do the 14

route designation, is it relatively unlikely that those 15

projects may move forward to actual trail development if 16

the routes aren’t initially designated, if we don’t 17

provide funding for designation? 18

MS. PULSIFER: If we don’t provide money for 19

designation, next time when they apply that it would –- 20

MALE SPAEAKER: No. I guess my question is, 21

that's the first step for the BLM to get into trail work, 22

off highway vehicle trail work, correct? 23

MS. PUSLIFER: Yes. 24

MALE SPEAKER: And so that’s why they’re 1

putting in here for just off highway vehicle route 2

designation? 3

MS. PULSIFER: Yes. 4

MALE SPEAKER: Right? 5

MS. PULSIFER: Correct. 6

MALE SPEAKER: Okay. And I know some of the 7

OHVAG had concerns that we were spending money on 8

planning purposes rather than on-the-ground trail 9

development. 10

MS. PULSIFER: Well, on-the-ground trail 11

development is a higher priority. 12

MALE SPEAKER: Right. 13

MS. PULSIFER: Although some of these other 14

items are also priority in the States Trail Plan, they’re 15

just not as high of a priority, but they do qualify. 16

MALE SPAKER: I’m fine, Mr. Chairman. 17

MR. MARTYN: Mr. Chairman, thank you. Relative 18

to BLM, there’s no way to tell what’s going to happen to 19

BLM. You know that under sequestration, a lot of these 20

Federal agencies are cut. If there is no funding, I 21

would say it’s very far stretched to see that anything 22

will be done relative to a new project. 23

So that’s where -– if you don’t fund not, 24

probably not going to happen. That would be my guess. 25
