AUTHORISED BETTING OPERATIONS ACT 2000

Major Betting Operations Licence

1. Grant of Licence

1.1 Pursuant to sections 7(1) and 7(3) of the AuthorisedBetting Operations Act 2000 (‘Act’) and all other relevantenabling powers and with the advice and consent of theExecutive Council, I, Marjorie Jackson-Nelson, Governorof the State of South Australia grant a major bettingoperations licence (‘Licence’) to Unitab Pty Ltd (ACN 097719 107) (‘Licensee’) authorising the Licensee:

(a) to conduct off-course totalizator betting on races heldby licensed racing clubs;

(b) to conduct off-course totalizator betting on approvedcontingencies;

(c) to conduct on-course totalizator betting under agree-ments with licensed racing clubs on races held bylicensed racing clubs and on approved contingencies;and

(d) to conduct other forms of betting on approvedcontingencies (other than fixed odds betting on raceswithin Australia on which licensed bookmakers areauthorised to conduct betting).

1.2 The Licence is granted subject to:

(a) the provisions and conditions set out in the Act; and

(b) the supplementary licence conditions set out in theapproved licensing agreement.

2. Term

2.1 This Licence takes effect on and from the date on whichcompletion occurs under the Business Sale Agreementbetween the Minister for Government Enterprises, theLicensee and TAB Queensland Limited.

2.2 This Licence expires on 30 June 2100 unless sooner can-celled under the Act or surrendered with the approval of theAuthority.

3. Definitions and Interpretation

In this Licence, unless the context otherwise requires, termsdefined in the Act have the same meaning and:

(a) headings are for convenience only and do not affect theinterpretation of this licence;

(b) words importing the singular include the plural and viceversa;

(c) words importing a gender include any gender;

(d) an expression importing a natural person includes anycompany, partnership, trust, joint venture, association,corporation or other body corporate and any govern-mental agency;

(e) a reference to a condition, clause, schedule or part is to acondition, clause, schedule or part of this licence;

(f) a reference to any statute, regulation, proclamation, orderin council, ordinance or by-law includes all statutes,regulations, proclamations, orders in council, ordinancesor by-laws varying, consolidating, re-enact-ing,extending or replacing them and a reference to a statuteincludes all regulations, proclamations, orders in council,ordinances, by-laws and determinations issued under thatstatute;

(g) a reference to a document or a provision of a documentincludes an amendment or supplement to, or replace-ment or novation of, that document or that provision ofthat document.

Note: Access to Loch Luna is mainly by boat—all huntersshould be aware of dangerous quicksand in a number ofareas.

BY-LAW MADE UNDER THE LOCAL GOVERNMENT ACT 1999

By-law No 6—Bird Scaring Devices

TO regulate the use of bird scaring devices for the prevention ofnuisance.

Definitions

1. ‘device’ means any noise generating device designed andused for the purpose of scaring birds from land;

‘flammable undergrowth’ means grass, weeds and otherflammable or potentially flammable growth;

‘land’ means any piece or section of land or any aggregationof contiguous land subject to the same ownership oroccupation;

‘multiple detonation device’ means a device that has morethan one detonation in any 10 minute period;

‘noise sensitive premises’ means a dwelling not associatedwith the land upon which the device is located, a library, achild care centre, a kindergarten, a school or othereducational institution, a hospital, a surgery or other medicalinstitution, a public park or garden or recreation space.

Prohibited Activities

2. No person being the owner or occupier of land, shall use oremploy any device:

(1) in such a manner as to be a nuisance or danger to any otherperson;

(2) on Christmas Day or Good Friday;

(3) where the device is gas powered:

(a) unless all flammable undergrowth within a 4 m radiusof the device is destroyed by cutting, slashing orutilising other means; and

(b) unless all other flammable material within a 4 mradius of the device is removed.

Permissive Activities

No person being the owner or occupier of land shall, withoutpermission:

(1) activate a device:

(a) other than between the hours of 7 a.m. and 8 p.m.;

(b) at frequencies greater than 6 per hour;

In this context an activation:

(i) for a gas powered device is one detonation producing asingle emission; and

(ii) for an electronic noise generating device is a singlenoise emission or one which produces a continuoussequence of noise emissions but which does notexceed 30 seconds in duration.

(2) activate a device within 200 m of a noise sensitivepremises;

(4) direct a device towards a noise sensitive premises;

(5) activate more than one device per 10 hectares of land; and

(6) activate a device in a building or structure.

Notice

4. (1) Where there is a breach of any provision of this by-lawthe council may serve notice in writing on the owner or occupierof any land requiring that person to reduce the number ofactivations or to disarm or to remove a device.

(2) Any person on whom a notice is served shall comply withthe notice.

(3) If the notice is not complied with the council may carry outor cause to be carried out the measures required by the notice andmay recover the cost of so doing from the person to whom thenotice was directed.

Protection of Council

The council shall not be liable for any loss caused in exercisingits powers under this by-law.

The foregoing by law was duly made and passed at a meeting ofthe City of Playford held on 28 August 2001, by an absolutemajority of the members for the time being constituting thecouncil, there being at least two thirds of the members present.

Notification and Minor Matters Plan Amendment Report—Draft for Public Consultation

NOTICE is hereby given that the City of Unley has prepared aPlan Amendment Report (PAR) to amend the Unley (City)Development Plan by introducing policies which clarify therequired public notification of development, and address a rangeof other minor amendments, but not to alter the policy intent ofCouncil’s Development Plan.

In summary the proposed amendment:

• clarifies policy with respect to development public notifi-cation categories (but does not change the designation ofthe category of particular uses);

• clarifies policy dealing with the classification of uses aseither complying or non-complying (again without chang-ing the classification of existing individual uses);

• ensures that forms of development considered by council tobe minor development can be assigned as Category 1;

• improves grammatical expression of policy;

• corrects typographical errors; and

• clarifies the expression of some policy to improve isunderstanding.

BY-LAW MADE UNDER THE LOCAL GOVERNMENT ACT 1999

By-law No. 1—Local Government Land

TO manage the control and use of streets, roads, public places,parklands, reserves and other land under the control of the council.

Definitions

1. In this by-law:

(1) ‘Local Government Land’ means all local governmentland as defined in the Local Government Act 1999(except roads), that is owned by the Council under thecouncil’s care, control or management;

(2) ‘Authorised Person’ means any person appointed bycouncil under Chapter 12, Part 3 of the Local Govern-ment Act 1999;

(3) ‘Building’ includes any structure of any kind whether forhuman habitation or not;

(4) ‘Firearm’ means any gun or device including an airgun,speargun or slingshot from or by which any kind of shot,bullet or missile can be discharged;

(5) ‘Waste’ includes soil, stone, rubble, animal, mineral orvegetable matter and other debris, waste and refuse ofany kind;

(6) ‘Offensive’ includes threatening, abusive, insulting orannoying behaviour;

(7) ‘Officer’ means any Council Officer, Police Officer orauthorised person;

(8) a ‘vehicle’ includes:

(a) a motor vehicle, trailer and tram;

(b) a bicycle;

(c) an animal-drawn vehicle and an animal that is beingridden or drawing a vehicle;

Prohibited Activities

2. No person shall, on Local Government Land:

(1) (a) damage, injure, deface or interfere with, or climbover or upon any buildings, structures or anyproperty of the council whatsoever;

(b) throw, cast, place, deposit or leave any rubbish, dirtor refuse of any kind whatsoever except in a garbagecontainer provided for that purpose;

(c) enter or use any public or sanitary convenience orurinal set apart for a person of the opposite sex;

Council may do work

(2) if the notice is not complied with the council may causethe measures required by the notice to be performed, andmay recover the cost of so doing from the person towhom the notice was directed;

Council employees, Authorised Officers and Exempt Vehicles

(3) (a) the restrictions in this by-law do not apply to anyofficer or employee acting in course and within thescope of that person’s normal duties;

(b) drivers of exempt vehicles and vehicles used by anofficer or employee of the council in the course ofnormal duties are exempt from the operation ofparagraphs 3 (11) and 4 (2) of this by-law;

Application of paragraphs

(4) any of subparagraphs 3 (11) (e), 3 (11) (f), 3 (11) (g), 3(11) (h), 3 (11) (i), 3 (12) (b), 3 (14) of this by-lawshall apply only in such portion or portions of the area asthe council may by resolution direct (pursuant to theLocal Government Act 1999, or any enactment insubstitution therefor).

By-law No. 2—Boat Ramps/Cradle

TO regulate the use of the boat ramp/cradle and surrounding landsat Tumby Bay and Port Neill which are used for access to the boatramp and which are under the control of the council.

Definitions

1. In this by-law:

(1) ‘Authorised Person’ means any person appointed bycouncil under Chapter 12, Part 3 of the LocalGovernment Act 1999.

(2) ‘Boat Ramp’ means a facility constructed, maintainedand operated for the launching and retrieval of smallcraft and located at Saxon Street, Tumby Bay andAnchor Drive, Port Neill.

(3) ‘Cradle’ means a trailer used for retrieval and main-tenance of small craft.

(4) ‘Officer’ means any Council Officer, Police Officer orauthorised person.

(5) ‘Vehicle’ includes trailer and means every sort ofmoving contrivance used for the carrying and trans-porting of persons or things.

Fees

2. (1) Council from time to time may prescribe a fee for use ofthe boat ramp/cradle.

(2) No person shall use the boat ramp/cradle without paying thefee before using the boat ramp/cradle.

(3) Council may grant exemptions to the payment of the fee e.g.to organisations involved in search and rescue at sea.

(4) Council may erect signs or notices which indicate the feeand the place where it is to be paid.

(5) A receipt in a format prescribed by the council shall beissued for payment of the fee and the receipt shall be displayed onthe dashboard of the vehicle or attached to the trailer for it to bechecked by an officer.

(6) No person shall fish or swim within 10 m of the boat ramp.

(7) An officer may affix an account to pay on any vehicle,which does not display a valid receipt.

Offence

3. Any person who fails to pay the fee commits an offence asprescribed in By-law No. 4.

BY-LAW MADE UNDER THE LOCAL GOVERNMENT ACT 1999

By-law No. 4—Permits and Penalties

TO provide for a permit system and continuing penalties incouncil by-laws and to clarify the construction of such by-laws.

Permits

1. (1) In any by-law of the council unless the contrary intentionis clearly indicated, the word ‘permission’ means the permissionof the council given in writing.

(2) Council may attach such conditions to a grant of permis-sionas it thinks fit, and may vary or revoke such conditions or imposenew conditions by notice in writing to the permit holder.

(3) Any permit holder shall comply with every such condition.

Penalties

2. (1) Any person who commits an offence against or is inbreach of any by-law shall be liable to a penalty not exceeding themaximum penalty prescribed under the Local Government Act1999 (as at August 2001 this amount is $750).

(2) Unless otherwise decided by resolution of the council, theexpiation fee for our alleged offences against any by-law is 25%of the maximum penalty.

(3) Any person who attempts to commit any act which is anoffence against or in breach of any by-law shall be guilty of anoffence, which shall be dealt with as if the offence or breach itselfhad been committed.

Construction

(4) Every by-law of the council shall be subject to any Act ofParliament and Regulations made thereunder.
