The City of Lloydminster Act[section 6]

[O.C. 345/2011] 9 JUNE 2011

On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that:

(a) Effective July 1, 2011, the land described in Schedule A attached hereto is separated from the Rural Municipality of Wilton No. 472 in Saskatchewan and the County of Vermilion River in Alberta and annexed to the City of Lloydminster;

(b) Any taxes owing to the Rural Municipality of Wilton No. 472 or the County of Vermilion River at the end of June 30, 2011, in respect of the annexed land, are transferred to and become payable to the City of Lloydminster, together with any lawful penalties and costs levied in respect of those taxes, and the City of Lloydminster upon collecting those taxes, penalties or costs shall forthwith pay them to the Rural Municipality of Wilton No. 472 or the County of Vermilion River, whichever municipality the taxes to the end of June 30, 2011, were owed to;

(c) This Order in Council is complementary to an Order in Council of the Lieutenant Governor in Council of Alberta that approves the separation of the land described in Schedule A from the Rural Municipality of Wilton No. 472 and the County of Vermilion River and the annexation of that land to the City of Lloydminster;

(d) The assessor for the City of Lloydminster must, for the purposes of taxation in 2012 and subsequent years, assess the annexed land and any assessable improvements to it; and

(e) This Order in Council is conditional on the issuance of the Order in Council of the Lieutenant Governor in Council of Alberta referred to in paragraph (c).

1. All those lands in the Province of Saskatchewan in Township forty-nine (49) in Range twenty-eight (28) lying West of the Third meridian described as follows:

(a) north-east fractional section twenty-two (22) including road widening shown on Plan No. BW2003;(b) the adjoining road allowances lying west and east of the north-east fractional section twenty-two (22); (c) north-west quarter of section twenty-three (23); and(d) north-east quarter of section twenty-three (23).

2. All those lands in the Province of Alberta in Township forty-nine (49) in Range one (1) lying West of the Fourth meridian described as follows:

(a) road widening shown on Plan No. 4448JY in the north-east quarter of section twenty-four (24). ________________________

BOUNDARIES OF THE CITY OF LLOYDmINSTER JULY 1, 2011

1. All those lands in the Province of Saskatchewan in Township forty-nine (49) in Range twenty-eight (28) lying West of the Third meridian described as:

(a) the north-east fractional twenty-two (22), the north half of section twenty-three (23), all of sections twenty-six (26), fractional twenty-seven (27), fractional thirty-four (34) and thirty-five (35); and

(b) the west half of section thirty-six (36) excepting that portion of the south-west quarter lying east of the westerly limits of the Canadian Pacific Railway right-of-way shown on a plan of record with the Information Services Corporation of Saskatchewan as No. A.H. 1722.

2. All those lands in the Province of Saskatchewan in Township fifty (50) in range twenty-eight (28) lying West of the Third meridian described as:

(a) the west half of section one (1);(b) all of sections two (2), fractional three (3), fractional ten (10) and eleven (11);(c) the west half of section twelve (12); and(d) the west half and south-east quarter of section thirteen (13).

Area Description

The WaterWolf Planning District shall consist of the lands within the corporate limits of the affiliated municipalities as identified within the Agreement and listed above.

Appointment of a District Planning Commission

The affiliated municipalities and the Whitecap Dakota First Nation (Indian Band), pursuant to subclause 97(b)(i) of The Planning and Development Act, 2007, have agreed to the “WaterWolf District Planning Commission” consisting of one council member appointed by each affiliated municipality and one representative from the Whitecap Dakota First Nation (Indian Band).

Arrangements

The matters referred to in clauses 97(c) and (d) of the aforementioned Act are set out in Sections 3 and 7 of the Agreement attached hereto.

2. There are no assets or liabilities to distribute between the Rural municipality of Coteau No. 255 and the remaining affiliated municipalities.

SACHEZ QUE: La date de tombée pour les soumissions à la Gazette de la Saskatchewan est le lundi à 5 p.m., la semaine de la parution. En cas de jour férié à l’intérieur de la semaine de parution, la date de tombée sera remise un jour avant, soit le vendredi à 5 p.m. Pour les envois de soumissions à la Gazette par la poste, veuillez prévoir une semaine au complet. La parution de tout matériel reçu en retard sera remise au numéro de la semaine suivante.

Tous les documents qui paraîtront dans la Gazette de la Saskatchewan doivent être soumis électroniquement (WordPerfect ou Word) et accompagnés d’une copie papier signée et envoyée au bureau de l’Imprimeur de la Reine, ministère de la Justice de la Saskatchewan, B19-3085, rue Albert, Regina SK S4S 0B1, tél. 306-787-2367, ou par courriel: [email protected].

Chaque document ou disquette doit être complet, conformément aux normes de parution, et doit être séparé de la lettre d’accompagnement. Les signatures sur les documents doivent être dactylographiées ou écrites lisiblement en lettres moulées et doivent apparaître immédiatement en dessous de la signature écrite.

Le paiement d’avance est exigé pour TOUS les avis placés dans la Gazette de la Saskatchewan par les clients non gouvernementaux. Les chèques ou les mandats doivent être établis à l’ordre du fonds renouvelable de l’Imprimeur de la Reine. Veuillez y inclure la TPS en plus des tarifs réguliers au taux de 5 % pour chaque article cité ci-dessous dans la catégorie « soumis à la TPS ».
