Under section 95 of the Gas Distribution Act, 1999, theLieutenant-Governor in Council makes the following Reg-ulation:

2 The following definitions apply in this Regulation. 2 Les définitions suivantes s’appliquent au présent rè-glement.

“Act” means the Gas Distribution Act, 1999. (Loi)

“cost of service method or technique” means themethod or technique of approving or fixing rates and tariffsbased on the cost of providing distribution services in ac-cordance with generally recognized utility regulatory prin-ciples and practices. (méthode ou technique fondée sur lerecouvrement des coûts)

“market based method or technique” means the methodor technique of approving or fixing rates and tariffs basedon the principles and practices generally adopted by theBoard before January 1, 2012, in relation to the holder ofthe general franchise. (méthode ou technique axée sur lemarché)

3 The following classes of customers are prescribed forthe purposes of section 52 of the Act:

4(1) The Board shall, when approving or fixing just andreasonable rates and tariffs under section 52 of the Act foreach class of customers, adopt the cost of service method

4(2) In determining rates and tariffs for classes of cus-tomers under subsection (1) utilizing the market basedmethod or technique, the Board shall use electricity as thealternative energy source and ensure a target savings levelof 20% for the Small General Service class, and use No. 2Heating Oil as the alternative energy source and ensure atarget savings level of 15% for those classes of customersother than the Small General Service class.

4(3) The Board shall, when approving or fixing just andreasonable rates and tariffs under section 52 of the Act,ensure that the expenses and investments included in therevenue requirement are prudent.

1 The enacting clause of New Brunswick Regulation84-103 under the Private Investigators and Security Ser-vices Act is repealed and the following is substituted:
