WHEREAS, the City of Osage City, Kansas has determined by a traffic study that stop signs are needed at a certain intersection and the place- ment of the same would be in the interest of public safety and welfare. WHEREAS, the Enforcing Officer of the City of Osage City, Kansas did on the 19th day of June, 2018, file with the governing body of said City a statement in writing that a certain structure, hereinafter described, was un- safe and dangerous; and WHEREAS, the governing body did by Resolution dated the 13th day of November, 2018, fix the time and place of a hear- ing at which the owner, his or her agent, any lienholders of record and any occupant of such structure could appear and show cause why such structure should not be condemned and ordered repaired or demolished, and provided for giving notice thereof as provided by law; and WHEREAS, such Resolution was published in the official city pa- per on the 22nd day of Novem- ber, 2018, and on the 29th day of November, 2018, and a copy of such Resolution was served on all persons entitled thereto in all respects as provided by law; and WHEREAS, on the 8th day of Jan- uary, 2019, a public hearing was conducted and the governing body heard all evidence submit- ted by the enforcing officer of the City, and the owner of such structure did appear and did not show cause as to why the structure should not be condemned as unsafe, danger- ous or unfit for habitation and ordered repaired or demolished with any costs to the City of any repairs or demolition to be assessed against the property. Owner requested what repairs were required and requested on extension of time to make the repairs. The matter was tabled until the next meeting on Janu- ary 22, 2019, to allow time for repairs. WHEREAS, due to inclement weather the meeting on Janu- ary 22, 2019, was cancelled with rescheduling for the meeting on February 12, 2019. Owner of the property was duly notified of the rescheduling of the meeting by hand delivery to his residence at 402 Holliday Street, Osage City, Kansas. WHEREAS, on this 12th day of February, 2019, the owner of the property did appear and the governing body heard additional evidence regarding the condition of the property and statements from the owner and upon being duly advised the governing body determined the structure on the property had not been ad- equately repaired and remained unsafe, dangerous and unfit for habitation. NOW, THEREFORE, BE IT RE- SOLVED BY THE GOVERNING BODY OF THE CITY OF OSAGE CITY: That said governing body hereby finds that the structure located on Lots 1 and 3 in Block 13, in the Original Town of Osage City, to the City of Osage City, Osage County, Kansas, commonly known as 233 Holliday, Osage City, Kansas, is unsafe and dan- gerous and hereby directs such structure to be removed and the premises made safe and secure. ORDINANCE NO. 1631

AN ORDINANCE REGULATING TRAFFIC AND ESTABLISHING STOP SIGNS AT DESIGNATED INTERSECTION WITHIN THE CITY OF OSAGE CITY, KANSAS.

WHEREAS, the City of Osage City, Kansas has determined by a traffic study that stop signs are needed at a certain intersection and the place-ment of the same would be in the interest of public safety and welfare.

NOW, THEREFORE, BE IT OR-DAINED BY THE GOVERNING BODY OF THE CITY OF OSAGE CITY, KANSAS:

SECTION 1. There shall be placed traffic control signs for purpose of regulating traffic at the following designated inter-section in the City of Osage City, Kansas:

(a) At the intersection of 4th Street and Main Street, stop signs shall be erected for east and west bound traffic.

SECTION 2. It shall be unlawful for any person to violate any traffic control sign erected in accordance with this ordi-nance, and any person found guilty or convicted or upon entry of a plea of guilty or nole contendre for a violation of this ordinance, shall be subject to a fine in an amount not less than $20.00 nor more than $100.00 for each violation. SECTION 3. This Ordinance

shall take effect and be in full force from and after its passage by the governing body, approval by the Mayor, and publication in the official city newspaper.

RESOLUTION NO. 1041

A RESOLUTION FINDING THAT THE STRUCTURE LOCATED ON LOTS 1 AND 3 IN BLOCK 13, IN THE ORIGINAL TOWN OF OSAGE CITY, IN THE CITY OF OSAGE CITY, OSAGE COUNTY, KANSAS, COMMONLY KNOWN AS 233 HOLLIDAY, OSAGE CITY, KAN-SAS, IS UNSAFE OR DANGEROUS AND DIRECTING THE STRUCTURE TO BE REPAIRED OR REMOVED AND THE PREMISES MADE SAFE AND SECURE.

WHEREAS, the Enforcing Officer of the City of Osage City, Kansas did on the 19th day of June, 2018, file with the governing body of said City a statement in writing that a certain structure, hereinafter described, was un-safe and dangerous; and

WHEREAS, the governing body did by Resolution dated the 13th day of November, 2018, fix the time and place of a hear-ing at which the owner, his or her agent, any lienholders of record and any occupant of such structure could appear and show cause why such structure should not be condemned and ordered repaired or demolished, and provided for giving notice thereof as provided by law; and

WHEREAS, such Resolution was published in the official city pa-per on the 22nd day of Novem-ber, 2018, and on the 29th day of November, 2018, and a copy of such Resolution was served on all persons entitled thereto in all respects as provided by law; and

WHEREAS, on the 8th day of Jan-uary, 2019, a public hearing was conducted and the governing body heard all evidence submit-ted by the enforcing officer of the City, and the owner of such structure did appear and did not show cause as to why the structure should not be condemned as unsafe, danger-ous or unfit for habitation and ordered repaired or demolished with any costs to the City of any repairs or demolition to be assessed against the property. Owner requested what repairs were required and requested on extension of time to make the repairs. The matter was tabled until the next meeting on Janu-ary 22, 2019, to allow time for repairs.

WHEREAS, due to inclement weather the meeting on Janu-ary 22, 2019, was cancelled with rescheduling for the meeting on February 12, 2019. Owner of the property was duly notified of the rescheduling of the meeting by hand delivery to his residence at 402 Holliday Street, Osage City, Kansas.

WHEREAS, on this 12th day of February, 2019, the owner of the property did appear and the governing body heard additional evidence regarding the condition of the property and statements from the owner and upon being duly advised the governing body determined the structure on the property had not been ad-

equately repaired and remained unsafe, dangerous and unfit for habitation.

NOW, THEREFORE, BE IT RE-SOLVED BY THE GOVERNING BODY OF THE CITY OF OSAGE CITY:That said governing body hereby finds that the structure located on Lots 1 and 3 in Block 13, in the Original Town of Osage City, to the City of Osage City, Osage County, Kansas, commonly known as 233 Holliday, Osage City, Kansas, is unsafe and dan-gerous and hereby directs such structure to be removed and the premises made safe and secure. The Owner of such structure is hereby given 90 days from the date of publication of this Reso-lution within which to remove such structure from the prop-erty, and if such owner fails to remove such structure within the time stated or fails to diligently prosecute the same until the work is completed, said govern-ing body will cause the structure

to be razed and removed and the costs of such razing and removing, less salvage if any, to be assessed as a special assess-ment against the lot or parcel of land upon which the structure is located as provided by law.

BE IT FURTHER RESOLVED, that the City Clerk shall cause this Resolution to be published once in the official city paper and a copy mailed to the owners, agents, lienholders and occu-pants as provided by law.
