Executive Director Helmer reviewed the NJ Department of Community Affairs guidance for hosting public virtual meetings:

1) the meeting is to be limited to matters necessary for the continuing operation of the government which relate to the applicable emergency declaration; and

APPROVAL OF MINUTES Minutes from the May 18th meeting were tabled for approval at the July meeting. LIST OF BILLS President Lasser asked for a motion to accept the bills as presented for payment for the month of June 2020 totaling $3,620,095.04 Commissioner Baron made the motion to accept the payment of bills as presented. The motion was seconded by Commissioner Cass-Schmidt and unanimously approved by roll call vote. (Attachment No. 1) 2019 REPORT OF AUDIT Dave Helmer noted that the 2019 Audit report had been distributed to all the Commissioners, and introduced John Mooney from firm Nisivoccia, LLP. Mr. Mooney expressed that the cooperation and professionalism from the finance staff at the Park Commission is commendable especially during COVID-19. The revenue numbers are down from the year 2018 to 2019 with a $1.2 million surplus overall. Last year golf revenue was down from what was budgeted at $419,000.00 which various every year due to weather and other unforeseen events. Expenditures were $900,000.00 higher than in 2018. There was also a $275,000.00 reduction of 2018 funding transferring into 2019. The Trust funds were found to be in order, no issues were found with the debt funds including capital funding. One recommendation is to “confirm purchase orders”, it was found that items are being purchased without an approved requisition. This year will be a challenging year for everyone, and he will work closely with staff and review different opportunities to minimize the overall lower surplus at the end of the year. Mr. Mooney was thanked for his report and Director Helmer continued with his report. REPORT OF THE EXECUTIVE DIRECTOR Billy Casper Golf advised staff that they were not able to renew the contract for the use of the name “Billy Casper Golf”. Beginning next month they will operate under the name Antares Golf, LLC. (Attachment No. 2)

The following permit refund requests were received due to COVID-19: • Wedding at Schooley’s Mountain Lodge on Sept 26, 2020 – pre-paid $726.00 with a

balance of $476.00. The couple had their wedding ceremony in their home. Staff had notified the customers that in general, the Park Commission retains 30% of the balance due when cancelling. The request for refund was from customers concerned with having a large group of people in a small building. At this time the limit is 50 people inside a room in a Park Commission building.

• Loantaka Brook Reservation South Street shelter on August 8, 2020 – refund of $135.00. The senior’s group who has been meeting at the site annually, was concerned holding their event this year.

• Lodge rental originally scheduled for March 31, 2020, and re-scheduled for July 17, 2020

for wife’s retirement and birthday party was cancelled due to the occupancy limits. As a result, they requested a refund of $930.00.

The Commissioners had no objections to refund the fees as requested. Director Helmer provide an update on Park operations. The indoor restrooms at the golf courses opened last week. The 10-minute tee time intervals resumed last Saturday. Lee’s Marina boat launches were increased from twenty five (25) to forty (40) boats on weekdays and the staff has recommended to increase the weekend limits to forty (40) boat launches as well. The Marina continues to be staffed seven days a week by James Mathews and Colin Nilson. The rowing club called Row New Jersey and formally known as the Mountain Lakes rowing club, has been precluded from using the marina but is requesting access on weekdays after July 6, 2020 from 7 am to noon with limited rowing teams, approximately 30% of the team on site and following all COVID-19 guidelines. The club will be allowed to resume if they cover the cost for a Porta John at the storage and training location and limit their members from entering the main building area. Central Park, the turf fields, inline rinks, volleyball pits and challenger fields were opened today. The park is getting back to normal and bookings have increased by various sporting clubs. Outdoor facilities, excluding playgrounds and exercise stations, are open to the public with capacity limitations. Going forward over the next few weeks, all parking areas will be opened to full access, and we will be resuming our picnic, ballfield and outdoor facility rentals. There is a meeting scheduled for tomorrow between the President of US Rink, President of US Amateur Hockey Association, State Department Health Officials and the Governor Deputy Chief of Staff to talk about a “return to ice” proposal which could allow for ice rinks to open before the anticipated mid-to-late July date. The arena has been preparing for no-contact professional skating lesson session, followed by hockey clinics in anticipation of a potential opening date. The biggest issue will be the capacity limitations placed on each of the ice rinks. Furthermore, we provided the

details of the air intake system at the Mennen Arena which differs from other rinks by being able to provide fresh air intake (on the hour) for each of the three (3) rinks. Fifteen (15) of the Park Commission’s standalone public restrooms will be open on Wednesdays through Sundays, with the two restrooms at Central Park open 7 days per week. We are currently under contract with a cleaning contractor that will be cleaning and sanitizing the restrooms once a day in the morning hours. The outside contractor has been brought in since the UV sanitizing system we ordered is on backorder. The Mahlon Dickerson Reservation RV camping opened on June 15, 2020 with thirty (30) reservations booked through June 28, 2020. The Adirondack and tent camping sites are opening today, and an increase in bookings are expected. With regards to the indoor rooms, (Haggerty Center, classrooms, etc.) there are a few reservations in July, as we continue to monitor the COVID-19 guidelines. Any tented events at the Willowwood or Frelinghuysen Arboretum sell for approximately $3,000 to $5,000 a day. Director Helmer noted that one portable (with water) restroom facility is included in the rental contract and recommends that it be increased to two in order to keep the building closed. This will minimize staffing needs at each event. Director Helmer noted that he was contacted by a production company for the NFL Players Association looking for a space that could accommodate 150 cars on Friday and Saturday evenings for “Movie Nights” beginning July 3, 2020 through September 4, 2020 from 7 pm to midnight showing two movies a night. Staff is reviewing which sites could be utilized. Matt Trump, Superintendent of Natural Resource, informed me that we’re continuing our relationship with the New Jersey & U.S. Department of Agriculture to release small wasps to address issues with the Emerald Ash Borer infestation under the bio control program. Berkshire Valley Golf course was featured on golficity, a video program whose premise is a golf club challenge, where golfers made a bet on each hole on which golf club they would give up as they play a round of golf. It’s a great promotional video for the course, and it refers to the beautiful views and the second hole which is believed to be the hardest Par 3 in New Jersey. The company Zagstar went out of business. The Park Alliance was using the company for the rent-a-bikes at Loantaka Brook Reservation. Zagstar has not picked up the bikes and Denise Lanza is in contact with TransOptions who is doing a similar bike rental program to find out whether or not the Alliance could be part of that initiative. On June 4, 2020 the Lake Hopatcong Foundation reached out for permission to place a large banner at Lee’s Marina advising boaters about invasive water plant species. The foundation has been battling the water chestnut affectively over the past years, and now the concern is that the Hydrilla (waterthyme) plant is being brought to the lake.

We were able to accommodate the Islamic Center of Morris County to hold an outdoor religious service on June 12, 2020, and June 19, 2020 for their Friday afternoon prayer service at one of the turf fields at Central Park. As I reported last year, the Commissioner permitted the Sussex County Mosquito Control Department to perform larva sampling for the Eastern Equine Encephalitis virus in mosquitos at the Sparta/Sussex County side of the Mahlon Dickerson reservation. The Commission has been asked to allow the continued support of this initiative again this year, any findings will be reported to the Morris County Mosquito Control Department. The Morris and Sussex Departments have worked together in the past, which benefits residents from both counties and bordering municipalities. Director Helmer noted that the final county tax support for the year was received and that there was still a budget gap due to the revenue loss caused by park and facility closures. The Executive Committee has met on two occasions to review the proposed plans to reduced costs to meet the adjusted anticipated revenue. The Committee has also had two conference calls with the Freeholder Sub-Committee responding to county government initiatives impacted by COVID-19. President Lasser asked for a motion to accept the Report of the Executive Director. Commissioner Cass-Schmidt made the motion; Commissioner Cogger seconded the motion and it was unanimously approved by roll call vote. President Lasser asked for a motion to adopt Resolution No. 60-20 (Attachment No. 3) placing the Commission meeting into Executive Session pursuant to provisions of N.J.S.A. 10:4-12 (5), (6), (7) and (8), the pertinent provisions of the “Open Public Meetings Act.” Commissioner Baron moved the motion; Commissioner McCarthy seconded the motion and it was unanimously approved by roll call vote. EXECUTIVE SESSION The Commission reviewed the Park Police Report for May 2020. Commissioner Cass-Schmidt inquired about how the officers were holding up during these times. It was noted that the officers have been responding well to incidents and have reported an increase in illegal dumping within the park system. Park Police is also supporting the traffic and logistics for the CCM testing site along with patrols. During the month of May, 1 arrest was made, 67 Motor Vehicle Violations were given, 6 Ordinance Violations were written and 4 warnings were given. There was one DRE performed. 21 Assists/Security/Traffic calls within the MCPC and other agencies were addressed. There were 5,687 Calls for Service. President Lasser asked for a motion to accept the Report of the Personnel & Safety Committee. Commissioner Baron made the motion, which was seconded by Commissioner Cass-Schmidt and was unanimously approved by voice vote.

REPORT OF COUNSEL Park Counsel Suminski reported on two real estate matters.

• Wheeler transaction- The property is in Kinnelon Borough and consists of a 12 acre lot

(#124) with a purchase price of $275,000.00, and an additional not to exceed $45,000.00 to be paid for demolition of two structures on the property. Currently, we are not able to finalize the contract as I have not been able to get in touch with the attorney for the property owners. It was brought to my attention that the adjoining lot (lot #125 consisting of 33 acres owned by the same owners) is also for sale and under ongoing negotiations to sell both properties to the same buyer which might be the reason for the delay in finalizing the sale of lot #124 to the Park Commission.

• Tredwell Property/Trust for Public Land – The property consisting of four lots is located on Weldon Road in Jefferson Township. As previously advised, a discrepancy was identified concerning the total acreage listed in the sale price. Currently, it is not clear what the amount is that the Trust for Public Land is requesting from the Park Commission. Before any contract write up, there needs to be a receipt of the final sales price, finalized appraisal costs, title insurance costs, survey costs as well as an itemized funding request listing all final transactions costs. This project has Green Acres funding and the TPL has a MCOSTF grant, both of these agencies need to approve the appraised value before project can move forward.

President Lasser asked for a motion to accept the Report of Counsel. Commissioner Cass-Schmidt made the motion, which was seconded by Commissioner Abrantes and unanimously approved by voice vote. CONSIDERATION OF EXECUTIVE SESSION The Commission meeting returned to open session on the motion of Commissioner Seabury which was seconded by Commissioner McCarthy, and unanimously approved by voice vote. The items discussed in closed session will be printed as part of the minutes as soon as practicable. HEARING OF CITIZENS Citizens were notified that comments may be provided by sending an e-mail in advance of or at the time of the meeting to [email protected]. Director Helmer advised that one public comment was received per email from Diane Nelson on Monday June 15, 2020 stating “My appeal to the Park Commission dated March 16, 2020 has not been addressed due to the cancellation of the March 23, 2020 Commission meeting. Please provide copies of my letter to Commissioner Lasser, to other Commissioners for discussion at the June 22, 2002 hearing of the citizens. Attached is a copy of my letter to Stuart Lasser asking that the commission submit objections to the Department of Health issuance of a permit to growing and processing marijuana adjacent to the Tourne County Park. Also attached, are copies of objections from Denville and the Town of Boonton. Thank you, Diane Nelson.”

Ms. Nelson followed up with an email at 4:30 pm today “I hope members have had an opportunity to review my letter of March 16, 2020 to Commissioner Lasser. I urge the Park Commission to submit objections to the State Department of Health permit to grow and process medical marijuana at 130 Old Denville Road, Boonton Township. This site is immediately adjacent to the Tourne County Park.” (Attachment No. 4)

Director Helmer reported that it was discussed back in October of last year (2019) at which time the same contention related to the Department of Health review of the application for the location of the facility was brought up. The application had left out that the marijuana growing facility was located next to a county park. It appears that this type of facility is under the jurisdiction of the Department of Agriculture and as long as marijuana is not sold to the public, it does not fall under the drug-free zone.

The site is located within the confines of the Township of Boonton’s well field. The commission’s understanding is that, after review by the county planning board, that the facility at this time has no dramatic impact, and that the previous operations of a nursery had probably dumped fertilizer and pesticides which was worst. The local planning board controls the air quality and other requirements for the facility within their jurisdiction. The facility is an approved medical marijuana growing facility by the State Department of Agriculture. Counsel Suminski will review all correspondence and identify any potentially new issues. He will than make recommendations to the Commission for its response to assure the continued protection of the Tourne County Park.

President Lasser asked for a motion to leave the public comment section. Commissioner Baron made the motion, which was seconded by Commissioner Abrantes and unanimously approved by voice vote. CONSIDERATION OF RESOLUTIONS President Lasser asked for a motion to accept Resolution Number 61-20 (Attachment No. 5) which adopts Resolution No. 62-20 through Resolution No. 66-20 (Attachment No. 6 through Attachment No. 10) as submitted. Commissioner Cogger made the motion, which was seconded by Commissioner Cass-Schmidt and unanimously approved by roll call vote. ADJOURNMENT There being no further business, Commissioner Abrantes made the motion to adjourn the meeting at 6:45 p.m. The motion was seconded by Commissioner Cass-Schmidt and unanimously approved by voice vote. BE IT RESOLVED, by the Morris County Park Commission on this 22nd day of June 2020, that:

MORRIS COUNTY PARK COMMISSION RESOLUTION NO. 62-20

WHEREAS, Pursuant to N.J.S.A. 40A:11-3(c) and 18A:18A-3(b), the State Treasurer of the State of New Jersey has exercised his authority to adjust the bid thresholds for awarding contracts for entities governed by the Local Public Contracts Law N.J.S.A. 40A:11-1 and 18A-18A, and

WHEREAS, effective July 1, 2020, the bid threshold for contracting units whose purchasing agents possess a Qualified Purchasing Agent (QPA) certificate awarded by the Division of Local Government Services shall increase from $40,000.00 to $44,000.00, and the new quote threshold for local units with a QPA is $6,600.00, and

WHEREAS, local units that do not have a QPA-certified purchasing agent remain subject to the $17,500.00 minimum bid threshold with a corresponding quote threshold of $2,625.00, and

WHEREAS, pursuant to N.J.S.A. 40A:11-9(g) the Morris County Park Commission can designate a Qualified Purchasing Agent for a period of one year until certification requirements are met to become the Qualified Purchasing Agent, and

WHEREAS, Richard Vitale was designated as the Qualified Purchasing Agent by way of Resolution 35-20 on April 14, 2020, NOW THEREFORE

BE IT RESOLVED, by the Morris County Park Commission on this 22nd day of June 2020 as follows:

1. That the Morris County Park Commission, in the County of Morris, in the State of NewJersey hereby will increase its public bid threshold to $44,000.00, effective July 1, 2020and

THE MORRIS COUNTY PARK COMMISSION RESOLUTION NO. 63-20

WHEREAS, N.J.S.A. 40A:5-4 requires the governing body of every local unit to have made an annual audit of its books, accounts and financial transactions, and

WHEREAS, the Annual Report of Audit for the year 2019 has been filed by a Registered Municipal Accountant with the “Clerk of the Board of Freeholders” pursuant to N.J.S.A. 40: A 5-6, and a copy has been received by each member of the governing body, and

WHEREAS, R.S. 52:27BB-34 authorizes the Local Finance Board of the State of New Jersey to prescribe reports pertaining to the local fiscal affairs, and

WHEREAS, the Local Finance Board has promulgated N.J.A.C. 5:30-6.5, a regulation requiring that the governing body of each municipality shall, by resolution, certify to the Local Finance Board of the State of New Jersey that all members of the governing body have reviewed, as a minimum, the sections of the annual audit entitled “Comments and Recommendations;” and

WHEREAS the members of the governing body have personally reviewed, as a minimum, the Annual Report of Audit, and specifically the sections of the Annual Audit entitled “Comments and Recommendations,” as evidenced by the group affidavit form of the governing body attached hereto; and

WHEREAS, such resolution of certification shall be adopted by the Governing Body no later than forty-five days after the receipt of the Annual Audit, pursuant to N.J.A.C. 5:30-6.5; and

WHEREAS, all members of the governing body have received and have familiarized themselves with, at least, the minimum requirements of the Local Finance Board of the State of New Jersey as stated aforesaid, and have subscribed to the affidavit as provided by the Local Finance Board; and

WHEREAS, failure to comply with the regulations of the Local Finance Board of the State of New Jersey may subject the members of the local governing body to the penalty provisions of R.S. 52:27BB-52, to wit:

R.S. 52:27BB-52: A local officer or member of a local governing body who, after a date fixed for compliance, fails or refuses to obey an order of the director (Director of Local Government Services), under the provisions of this Article, shall be guilty of a misdemeanor and, upon conviction, may be fined not more than one thousand dollars ($1,000.00) or imprisoned for not more than one year, or both, and in addition shall forfeit his office.

NOW THEREFORE BE IT RESOLVED, that the Morris County Park Commission of the County of Morris hereby states that it has complied with N.J.A.C. 5:30-6.5 and does hereby submit a certified copy of this resolution and the required affidavit to said Board to show evidence of said compliance.

Purpose: To provide guidelines for refunds for all Morris County Park Commission facilities and activities.

Policy:

Athletic and Special Event Rentals 1. Cancellations 31-60 days prior to the first rental date on the invoice, 70% of the paid

invoice will be refunded, 30% will be retained for administrative fees.2. Cancellations 30 days or less from the first rental, date on the invoice no refund will be

issued.3. There are no refunds for inclement weather.

All cancellation requests must be made in writing to the Morris County Park Commission.

Deer Management Program 1. Application fees are non-refundable.2. Permit Fees are refunded if permit is forfeited prior to September 30 or before the season

starts in the park for which the permit is for; whichever date comes first.

Historic Sites Reservation Fees Including, but not limited to:

Fosterfields Living Historical Farm Cooper Grist Mill Historic Speedwell

No Refunds, unless the Morris County Park Commission can rebook the indoor facility. The refund would be the new facility rental fee (hours re-rented) less the 10% administrative fee.

Lee’s County Park Marina Daily Launches: No Refunds or rain checks. Slip Rentals: No refunds, unless the Morris County Park Commission can rebook

the slip. The refund will be the prorated amount less the 10% administrative fee.

Mahlon Dickerson Reservation – Campgrounds (RV, Tent, and Adirondack Shelters) No refunds. To receive a credit for future use, campers must notify the campground office no later than 48 hours before their scheduled arrival. A credit for any fees paid less the nonrefundable deposit $5 reservation fee is applied to the household, and it is valid for 1 year from the date issued.

Mennen Sports Arena No refunds on any type of ice rental, unless the Morris County Park Commission can rebook the ice. The refund would be the new rental fee (hours re-rented) less the 10% administrative fee.

Picnic Area/Garden Reservation Fees 1. Cancellations 61 days or more prior to the event 90% of the rental fee will be refunded

10% will be retained for administrative fees.2. Cancellation 31-60 days prior to the event 70% of the rental fee will be refunded 30%

will be retained for administrative fees.3. Cancellations 30 days or less prior to the event there is no refund.4. In the event that it is raining at the start of your rental, in your rental location:

For areas without a shelter - you may reschedule your rental date to occur within 60calendar days of the cancellation, provided that you notify the Reservations Departmentof the cancellation within 48 hours after the start of your scheduled event. If there are noavailable dates in the same calendar year, Commission approval will be required toextend into the next year. Reservations must be made between January 1 and January 31for the approved carry over rental.For rentals with a Shelter - there are no rain dates or refunds.

Sunrise Lake Beach Club – Reservation Fees 1. Deposits are not refundable.2. Cancellations 15 days prior to rental date will receive a refund of the amount paid, less the

nonrefundable deposit.3. Cancellations made 3-14 days prior to the rental date will receive a credit to their

household that it is valid for 1 year from the date issued of the amount paid, less thenonrefundable deposit.

4. Cancellations within 48 hours of the rental date will not receive a refund, rain date orcredit.

OTHER REFUND POLICY ADDITIONS

Birthday Parties: There will be no refunds for cancellations. Cancellations that are 31 or more days prior may be rescheduled based on space and staff availability within 6 months.

WHEREAS, the Morris County Park Commission deems it advisable and in the public interest to recover some costs of operations through the assessment of fees and charges; therefore, it is necessary and in the public interest to establish and adopt a schedule of fees for the use of various facilities, programs, services, and equipment, and

WHEREAS, the Morris County Park Commission had adopted Resolution No. 176-19 on December 16, 2019 to establish the 2020 Fee Schedule, and

WHEREAS, there is a need to amend the 2020 Fee Schedule, NOW THEREFORE

BE IT RESOLVED, that the Morris County Park Commission on this 22nd day of June, 2020 hereby amends the Year 2020 Schedule of Fees and Charges as annexed hereto and made part hereof, and

MORRIS COUNTY PARK COMMISSION RESOLUTION NO. 66-20

WHEREAS, the Morris County Park Commission has deemed it advisable and in the public interest to acquire lands to be designated as part of the Waughaw Mountain Greenway, and

WHEREAS, the Park Commission has deemed it appropriate to acquire lands in the Borough of Kinnelon, County of Morris, State of New Jersey, known as Block 56601, Lot 124 consisting of 12+/-acres, as trailhead parking for the Waughaw Mountain Greenway, and

WHEREAS, the Commission has determined, based upon an appraisal of the property, that the appraised fair market value of said land is $275,000.00, and

WHEREAS, the Treasurer of the Morris County Park Commission has determined that there are sufficient funds available from the Morris County Open Space and Farmland Preservation Trust Fund to acquire said lands, and

WHEREAS, title to said lands has been determined to be in the name of Donald W. Wheeler, Carolyn Garcia & Allison Wheeler, Co-Trustees of the Wheeler Municipals Corporation Profit Sharing Plan, and

WHEREAS, the Land Acquisition Committee of the Morris County Park Commission recommends the purchase of said property and the payment by the Morris County Park Commission out of its allocation from the Morris County Open Space and Farmland Preservation Trust Fund for the $275,000.00 purchase and for the demolition of two structures on the property not to exceed $45,000.00, NOW THEREFORE

BE IT RESOLVED, by the Morris County Park Commission on this 22nd day of June, 2020 that Counsel to the Park Commission be authorized and directed to offer the value of said property to the owners as determined and set forth above, in order to acquire aforesaid property, and

BE IT FURTHER RESOLVED, that the following actions are hereby authorized and directed:

1. That the payment of said $275,000.00 purchase price to acquire the said Donald W.Wheeler, Carolyn Garcia & Allison Wheeler, Co-Trustees of the Wheeler MunicipalsCorporation Profit Sharing Plan Property, Block 56601, Lot 124 in the Borough ofKinnelon, New Jersey, is hereby authorized and approved.

2. That the cost to demolish two structures on the property be paid at closing and not to exceed$45,000.00

3. That this parcel be purchased through funding available from the Morris County OpenSpace and Farmland Preservation Trust.
