It didn't take long for new FCC Chairman Reed Hundt to reveal what was on top of his agenda: EEO Compliance. The Commission issued a policy statement reaffirming its commitment to EEO compliance for broadcast and cable this week as they came down hard on 26 stations, handing out over $250,000 in fines, only granting short -term license renewals, and even designating one combo's license for hearing because the numbers of minority recruits reported to the FCC didn't match what actually took place. One cable system in Florida got hit for over $120,000. The sale of KRTH Los Angeles to Infinity Broadcasting has been approved, but not until the FCC fined four of Infinity's stations a total of $400,000 for indecency complaints against Howard Stern. KFBI -FM Las Vegas, an affiliate of the Stern show, was also fined $37,500.

The NAB has endorsed the FCC's proposed use of a new RF energy safety standards. Currently the FCC uses an ANSI /IEEE standard that was established in 1982. The NAB states that they support efforts that "would allow most broadcasters to determine compliance using charts and graphs instead of more expensive measurements." The NAB also urged the FCC to do something about the growing problem of state and local regulations that delay or halt the construction of FCC - licensed stations.

ELSEWHERE

What's in a name? WIOT's former morning jock Jeff Lamb left to go to WXKR -FM and brought his show with him, character voices and all. WIOT's owner, Reams Broadcasting, took Lamb to court, claiming the characters and voices he used remain the intellectual property of WIOT. Lawyers from both sides could not find precedence, so the judge ruled that when there is no specific written agreement then all materials (characters) belong to the employer. Lamb's attorney, WXKR's Thomas Zraik, is still deciding on whether or not to fight the ruling. Lamb does not walk away empty handed, he still has his characters he created before employment.

The two hour "Love Phones" that began on Z -100 New York is slated to be syndicated. Interested stations can have a special Valentines Day prerecorded show to air and get feedback before committing to the show. If interested contact Cathy Donovan at WHTZ at (212) 239 -2300.

Alliance Broadcasting will pick up KYA -FM San Francisco from First Broadcasting for around $17 million to combo with KFRC -AM & FM. KSFO (AM) will stay with First Broadcasting.

In the Long Island market, Greater Media is selling WGSM Huntington and WMJC Smithtown to Gary Starr for $5 million. Starr already owns WRHD /WRCN Riverhead (Eastern Long Island) and WINE /WRKI Brookfield Danbury), CT.

Capital Cities /ABC, Inc. has entered into an LMA -to- purchase KRXX -FM Minneapolis from Entercom to combine with KQRS -AM & FM Golden Valley (Minneapolis), MN. Price was not disclosed. Entercom will keep KRXX (AM) Richfield, MN. Although not part of the LMA or sale, KRXX(AM) will continue to simulcast for the time being.

Three "Writing Creative Radio Ads" forums will be held this year at the RAB MSC & Executive Symposium in Dallas. Forum leaders will include Dan O'Day, founder of O'Liners, who will conduct "What Sales Managers Need to Know About Creating Radio Commercials that Sell." Jeffrey Hedquist from Hedquist Productions will conduct "Radio Creativity: The Key to Repeat Sales." And Bruce Bendinger, founder of the Copy Workshop, will conduct "Copy Camp." Coors Brewing Company's Peter Coors will keynote the radio luncheon at the spring NAB convention. Coors is to address the threat that alcohol ad warnings pose to both the broadcasting and brewing industries. If legislation sponsored by Senator Strom Thurmond (R -SC) passes, it would require all broadcast beer and wine advertisements to carry warning messages. The proposed legislation titled "The Sensible Advertising and Family Education Act" has been revised, but not to any satisfaction of NAB President Eddie Fritts. In a letter to Wendell H. Ford and all senate commerce committee members Fritts stated, "While these changes seek to make the warnings less intrusive...we continue to believe emphatically that warnings in advertising are not the solution to the problem of alcohol abuse." Fritts suggested that solutions would come from other activities including better education, PSAs, and tougher law enforcement.

The Radio Advertising Bureau reports a "Blockbuster Year" as 1993 figures show radio advertising climbed 9.3% to an estimated $9.6 Billion. Here are the figures:

These new agreements come with many names; Local Marketing Agreement (LMA), Joint Operating Venture (JOV), Time Brokerage Agreement and "sales" LMA. The difference is often just a word or two in the contract or simply the implied "intent" of the deal. For many stations there is no formal operating agreement, the stations co- exist and are operated together but are owned by different family members. It is clear that the FCC's legal definition of "control" and the real world applications of the word are very different.

Here is a look at four ways it is being done:

Where U.S. Radio had in effect "leased" WSVY -FM in the past it now has a sales brokerage agreement for sales and sells its programming to JH Communications. As we see more and more of these "special" arrangements, it is becoming harder and harder to classify what is a duopoly and what is a LMA. UNISTAR DISSOLVES NEWS DIVISION Now that the Unistar- Westwood One marriage has been consummated, Unistar will be shutting down its news operation. Unistar- distributed CNN Radio will not be affected. Unistar estimates the closing will effect 400 Unistar news affiliates and will leave close to two dozen employees on the streets in Arlington. The shutdown is to occur sometime in the next two months.

IT'S BEEN A ROUGH MONTH... As we're putting this issue to bed, we're getting an inch of snow an hour in New York. By the time this gets to the post office, we'll have almost 1 1/2 feet of snow on the ground (that's a big deal here.) Flights out of the city have been delayed which, we expect, will delay the Journal again this week. We say "again" because issue 1104 was delayed by weather -related airport delays. Issue 1103 was delayed when th:e_post office lost our outgoing mailbag in the post office. (Those of you who have seen the main Manhattan P.O. can understand why this might happen.) The FCC's budget will be helped out quite a bit this year from the new "cost of regulation" fees that were passed last year. According to Radio Business Report, as much as 35% of their $175 million budget will come from the new fees.

ELSEWHERE

In Phoenix, Sandusky Radio will be buying KUKQ and KUPD -FM Tempe from G & C Broadcasting for a whopping $20 million to put the market's album rock all under one roof. The purchase will create a duopoly with Sandusky's KDKB Mesa (Phoenix).

There's a lot of activity in the Indianapolis market this week as a brand new station signed on. WGGR Greenwood IN is on 106.7 as Rebel Country --that market's third country station. Inside Radio reports the station will soon be in an LMA -to- purchase with CHR WHHH. Also, MyStar Broadcasting, which owns AC WTPI, will be buying CHR WZPL Greenfield, IL from Booth American. No price was mentioned. The LMA begins February 28. Booth American had to sell WZPL because of their deal to merge with Broadcast Alchemy, who already owns rock WFBQ and new rock WRZX.

Jacor announced they will be buying CHR WWZZ Karns TN (Knoxville) for $1.8 million. They'll pair it with AC- oldies WMYU Sevierville for the duopoly.

Jim Quinn and Joe O'Donnell, who have LMA'd all- sports WSKR Petersburg NJ on the Jersey Shore for the last two years, will finally purchase the station from current owner Joseph Powers. Price was not disclosed. Quinn & O'Donnell also own WREY Millville NJ.

The Country Radio Seminar (March 2 -5, Opryland Hotel, Nashville, TN) Opening Day will feature the popular Artist Radio Tape Session, Video Artist Tape Session and Artist Attendee Reception. The Artist Radio Tape Session (ARTS) is a one -on -one opportunity to tape customized ID's, spots and promos with a wide variety of artists. Due to the extreme popularity of ARTS, there will be two sessions held on opening day. One running from 3:30 -5:30 and another from 5:30 -7:30. For more information contact CRB at 615 -327 -4488.

USA Overnight, the all- night, satellite -delivered personality AC format has been sold to Capital City Advisors in Atlanta. All offices and studios will remain in Dallas. The new president is Dep Kirkland. Look for the network to expand its offerings soon.

In the "taste buds on loan from God" department, Rush Limbaugh starts his million - dollar job Monday, February 14 as the pitchman for the Florida Citrus Commission- -the same board which decided Anita Bryant and Burt Reynolds were too controversial to promote orange juice. According to the Associated Press and the Miami Herald, Democratic Florida Governor Lawton Chiles was not pleased with the Commission's choice.

RAB is to include "Urban Day" at the 1994 MSC and Executive Symposium in Dallas, TX. February 18th "Urban Day" will feature full -day workshops and a cocktail reception. There'll be a featured panel discussion on the following topics: an overview of the African -American consumer, effectively positioning the African - American consumer to advertisers and agencies, and overcoming the bias against Urban radio -- your best success story. Update to The Outer Limita

New South called us to say that they are still in an LMA with KLIP, pending purchase. They also stated that, although co- located with KRVV and previously in an LMA with the station, KRVV maintains a separate sales and operational staff. They claim that the sale of KLIP was filed before the station had any ratings and, although it is now over the FCC 25% limit, it was not at the time of the sale.

It took $25 million, but George Beasley will have his duopoly in Philadelphia as he purchases Gospel WDAS -AM and Urban AC WDAS -FM from Unity Broadcasting. Beasley owns country WXTU in the market.

The L.A. Jazz combo of KAJZ Santa Monica and KBJZ Newport Beach, both on 103.1 MHz, have entered into a sales -only LMA with Bonneville's AC KBIG. The jazz combo is counting on KBIG to give them a little more muscle with advertisers, since KBIG has consistently been in the threes in the last few books.

Shamrock Communications will be doubling up in the Wilkes- Barre /Scranton market as they've announced their intent to purchase Frank & Maley's standards WBAX and oldies WYOS Nanticoke PA. Terms were not disclosed. Shamrock already owns adult standards WEJL and album rock WEZX Scranton.

Ron Cowan's KJAZ Alameda CA, San Francisco's mainstream jazz station, has been put on the block to raise cash for the development of his jazz radio network the station started last year. KJAZ is a class A on 92.1 MHz, and covers the Bay area surprisingly well for that class. KJAZ is being uplinked by United Video to cable systems in nine other U.S. cities.

The NAB announced that the chairman and two commissioners from the FCC, the deputy administrator of the National Telecommunications Information Administration (NTIA), key FCC and NTIA staff, and the nation's top communications lawyers will be featured speakers at the NAB Broadcasters' Law and Regulation Conference, March 21 -23, in Las Vegas, NV. FCC Chairman Reed Hundt will keynote the opening ceremonies of NAB '94. FCC Commissioner Andrew Barrett will join Commissioner Quello and NTIA Deputy Administrator Tom Sugrue for the "Policymakers Breakfast." Other key conference session will include an update on stations cable carriage under the new must carry and retransmission consent law and an assessment on radio duopolies.

The NAB and Radio Business Report (RBR) have come together to help promote the 1994 NAB Radio Show, October 12 -15 at the Los Angeles Convention Center. RBR will host its Fifth Business Breakfast Panels. The panels will address the most pressing and controversial issues facing the radio industry. The panelists will be announced later.

Broadcast Data Systems has opened new offices in Los Angeles and Chicago. The Los Angeles office will be supervised by John A. Ferrari, formerly of the Arbitron Company. The Chicago office will be supervised by Jeffrey Swanberg also from Arbitron. BDS electronically monitors television and radio broadcasts in selected markets.

The Country Radio Broadcasters announced that Kathy Mattea and Ricky Van Shelton will be the featured performers at this years ASCAP luncheon showcase during the Country Radio Seminar (March 2 -5). The luncheon will be held Friday, March 4 at 12:30 pm.

EVERGREEN AND FCC SETTLE, NEW INDECENCY "GUIDELINES" SOON. The suit that began the challenge of the FCC's definition of indecency, Evergreen Media v. FCC, has been dropped as part of an out -of -court settlement reached this week between the parties. The Commission has agreed to drop the claim that WLUP's (now WMVP) Steve & Garry show aired indecent material back in 1989 and the Kevin Matthews show in 1991. In exchange, Evergreen has dropped its claim that the FCC's enforcement efforts of allegedly indecent broadcast speech is unconstitutional. The Commission has further agreed to issue new guidelines regaLding its interpretation of federal law regulating indecent broadcast material within six months. According to Inside Radio, the suit cost Evergreen $500,000. The $40,000 worth of fines have been dropped. But, Evergreen has agreed to pay the FCC $10,000 without admitting any liability.

NEW YORK GETS NEW MARKET Arbitron has garnered enough subscriber support to measure the Elmira- Corning, NY market, beginning with the Spring '94 book. Arbitron has defined the market as Chemung and Steuben counties, with a 12+ population of 160,100, and a ranking of #191 out of 264 measured markets. The three stations that will subscribe to the book are news /talk WCLI and adult hits WNKI (both Corning NY), and oldies WGMM, Big Flats NY.

Inside Radio reports that WBBM -FM in Chicago was slapped with a $5,000 fine when it failed to run sufficient information in its disclaimers on a cellular phone contest. It seems the promo ran between Midnight and 5 a.m. but the contest ran between 6 p.m. and Midnight. The FCC wants at least some announcements during the actual promotion hours. The listener complaint was settled with the station long before the FCC got in the act. Apparently, the mother of the winner wrote to the FCC about how her daughter couldn't get her prize because she had to pay an activation fee. When she did, but tried to terminate the service a bit later she got slapped with a cancellation fee. So the moral of this story is: 1. Make sure you run sufficient announcements during the contest hours, 2. Make sure all parts of the contest agreement are announced and 3. Create a "complaint sheet" so problems can be handled immediately.

Two Reading PA stations have been sued for reading their local newspaper verbatim on the air. WIOV (AM) (formerly WAGO) and WIOV -FM were reading the stories as part of their local newscasts without attribution, according to the lawsuit filed in U.S. District Court by the Reading Eagle and Times. The station has denied the allegations that WIOV AM & FM have no news department and do not develop local stories on their own. A spokesperson for the newspaper stated, "It seems amazing that they could run a news operation on 35 cents a day " --the price of the paper.

After almost a year of negotiations, Zapis Communications- backed Zebra Communications has finally closed on WJMO (AM) Cleveland Heights OH and WJMO -FM Cleveland. Local black community groups wanted to ensure their interests in the station weren't going to go by the wayside after the station was sold. The unique agreement provides for a community advisory board for the stations, as well as a

long list of programming requirements. Both stations will continue to run out of the building that houses Zapis' WZAK -FM Cleveland.

Great American TV & Radio and Secret Communications will be swapping stations to create duopolies for each group. Great American is selling album rocker KBPI -TM Denver to Secret to combo with AC KMJI, which Secret is in the process of buying as part of the merger between Broadcast Alchemy and Booth American. Secret is

selling AC WWNK -FM Cincinnati to Great American, which will create a combo with CHR WKRQ. Terms of the deal were not disclosed.

Dixie Communications in Charleston, SC will be selling its four -station duopoly intact to Rex Tackett and Craig Klosk for $5.75 million. The four stations are news /talk WTMA, talk WTMZ Dorchester SC, soft AC WSUY, and AC WSSX -FM. Tackett and Klosk also own Wicks Radio's WLMX Chattanooga.

Apogee Communications has announced their intent to buy churban KJYK and AC KKLD Tucson from Behan Broadcasting for $5.3 million. Behan :iad purchased the stations a year ago for $4 million. They'll also assume Behan's LMA with KUDO, which is a

new station not on the air yet. The LMA begins immediately.

The RAB broke records again with an all time high of 1723 radio broadcasters attending the 1994 MSC & Executive Symposium held last week in Dallas. One of the successful sessions entitled "Power Panel: Radio's Leaders with Future Talk" had Bud Paxson, Chairman of Paxson Communications and founder of the Home Shopping Network, urging radio Broadcasters to expand beyond their own industry and acquire local spectrum -- specifically LPTV stations -- in attempt to "ride the wave" of the communications superhighway. Other highlights included day -long forums on Hispanic, International and Urban radio sales and marketing issues. Tapscan, Willhight Research, and CompuSearch have joined forces to start a new program in Canada that will allow Canadian radio stations to use integrated audience figures and retail spending data to show prospects precisely where their customers are found within a given market. The one -year pilot project is being tested by Toronto -area broadcasters on a cash and barter basis. For more information call (416) 221 -9944.

The L.A. Times reports Radio & Records will finally be sold after Westinghouse Credit took back the paper last year. Perry Partners, a New York -based financial group will pick it up for between $12 million and $15 million. Norm Pattiz's Westwood One originally valued the paper at $50 million when it put it on the block a couple of years ago. According to the Times, Pattiz refused a $40 million offer from a European company in 1992. Bob Wilson, R & R's publisher, is rumored to remain on the board after the transaction.
