HER MAJESTY, by and with the advice and consent ofthe Legislative Assembly of Manitoba, enacts asfollows:

Definitions1 In this Act,

"association" means the Association of ManitobaLand Surveyors; (« Ordre »)

"board" means the board of examiners of theassociation; (« comité des examens »)

"council" means the executive council of theassociation; (« conseil »)

"Manitoba land surveyor" means an individualwho has received a commission to practise as asurveyor of lands and is registered under this Act;(« arpenteur géomètre du Manitoba »)

"practice of land surveying" means

(a) the determination, establishment, location,demarcation or definition of boundaries of land,land covered by water or air space, or a right orinterest in land or in air space,

(b) the determination of the location of anythingrelative to a boundary for the purpose ofcertifying the location of the thing,

including the preparation of maps, plans anddocuments and advising and reporting with respectto any of the matters described in clauses (a) and (b);(« exercice de la profession d'arpenteur-géomètre »)

Association continued2 The Association of Manitoba LandSurveyors is continued as a body corporate.

Who may be members3 All persons before or after the coming intoforce of this Act duly registered under this Act are,while they continue so registered, members of, andform, the association.

Power to hold property4(1) The association may acquire and hold realand personal property for its corporate purposes but notfor any other purpose.

Power to dispose of property4(2) The association may, under the authority ofa by-law of the association, sell, mortgage, lease, orotherwise dispose of any real or personal property.

By-laws that may be passed5(1) The association may pass by-laws notinconsistent with this Act for

(a) the government, discipline, honour, and ethics ofits members, including, without limiting thegenerality of the foregoing, providing a code ofethics for its members;

(b) the management of its property;

Preparation and enactment of by-laws5(2) All by-laws shall be prepared by theexecutive council of the association and, beforebecoming effective, shall, except as hereinafterprovided, be ratified by the association at the annualgeneral meeting, or at a special general meeting to becalled for the purpose.

Notice of meeting to ratify by-law5(4) The notice of any general meeting of theassociation, at which ratification of a by-law is to bevoted upon shall set out particulars of the by-law.

COUNCIL CONSEIL DE L'ORDRE

Executive council, how composed6(1) There shall be an executive council for themanagement of the association, to consist of thepresident, immediate past president, and vice-president,the secretary-treasurer of the association, and four otherelective members, to be elected and hold office ashereinafter provided.

Quorum of council6(2) Five members of the council are a quorumfor the transaction of business at meetings of thecouncil.

Calling of meetings6(3) Meetings of the council may be called by thechairman and shall be called by the chairman at therequest of any two members of the council.

Presiding officer6(4) Each meeting of the council shall bepresided over by the president or, in his absence, by thevice-president or, in the absence of both the presidentand the vice-president, by a chairman to be elected bythe members of the council present at the meeting.

Notice of meetings of council, how to be given6(5) Due notice of each meeting of the council,as shall be provided by by-law, shall be given by thesecretary-treasurer to each member thereof, and also tosuch members of the association as may have businesstherewith, by mailing the notice to the registeredaddress of each member at least two days previous tothe time of the meeting.

Election of other officers6(6) At the first meeting of the council followingthe annual election of officers by the association, thecouncil shall appoint such other officers as may benecessary to carry out this Act; and the officersappointed under this subsection hold office during thepleasure of the council.

Annual General meeting7(1) The annual general meeting of theassociation for the transaction of business and theelection of officers and members of council shall beheld in Manitoba on a date in each year determined bythe council, at such place and hour as the council mayappoint, and may be continued from day to day as maybe necessary.

Notice7(2) Due notice of the meeting shall be given bythe secretary-treasurer to each member of theassociation by circular letter mailed to his registeredaddress at least two weeks previous to the meeting.

Special general meetings, calling of7(3) Special general meetings of the associationmay be called when deemed necessary by the council oron a written request of ten members of the association,including at least three members of the council,addressed to the secretary-treasurer, setting forth theirreasons and object for the special meeting.

Notice7(4) The secretary-treasurer shall thereupon giveat least six days' notice of the meeting by circular lettersetting forth the object of the meeting, mailed to theregistered address of each member of the association.

Election of officers at annual meeting8(1) At each annual meeting of theassociation there shall be elected a president, avice-president, a secretary-treasurer, a registrar,two auditors, and two elective members of the

Election by ballot9(1) All elections under this Act shall be byballot if demanded, and in the manner required underthe by-laws of the association.

Majority required9(2) Each person elected shall have at least amajority of the votes cast at such election.

Scrutiny of ballots10(1) Where a ballot is demanded, the presidentshall forthwith appoint two members as scrutineers toreceive and count the ballots.

Excess of names10(2) Where an elector places upon a ballot papermore than the required number of names in any case,the first names only, not exceeding the required number,shall be counted.

Declaration of result10(3) Upon completion of the scrutiny, thepresident shall forthwith declare the result of theelection; and the secretary-treasurer shall cause thenames of the officers elected to be published in the nextensuing issue of The Manitoba Gazette.

Person qualified to vote or hold office11 No person is qualified to vote at an election,or is eligible for election or appointment to any office orposition in the association or the executive council, orto hold any office or to fill any vacancy, unless all hisfees have been paid and he is duly qualified under thisAct and by the by-laws of the association.

Disposal of disputes as to elections12 In the case of doubt or dispute as to who hasor have been elected to any office, or as to the legalityof the election, the other duly elected officers are acommittee to hold an inquiry and decide who, if any, isor are the legally elected officer or officers; and theperson or persons, if any, whom they decide have beenelected, shall be deemed to be the officer or officerslegally elected; and, if the election is found to have beenillegal, the committee may order a new election.

Contentieux électoral12 En cas de doute ou de contestation sur lerésultat d'une élection ou quant à la légalité del'élection, les dirigeants dûment élus forment un comité,font enquête et décident qui, le cas échéant, estlégalement élu. Council to fill vacancies13 In case of the resignation, death, suspension,dismissal, disqualification, or inability to act, of anyofficer of the association or any elective member of thecouncil, the council, or the other members thereof, asthe case may be, except as in this Act otherwiseprovided, may fill any vacancy so caused for theunexpired portion of the term.

BOARD OF EXAMINERS COMITÉ DES EXAMENS

Board of examiners, how composed and appointed16(1) There shall be a board of examiners for theexamination of candidates for admission to study, andfor commissions to practise as land surveyors; and theboard shall consist of the registrar and four other dulyqualified members of the association, two of whomshall be appointed each year by the council at its firstmeeting after the annual election of officers by theassociation, to hold office for two years.

Annual examinations17(1) The board shall annually meet and holdregular examinations of candidates in Winnipeg at aplace appointed by the board on the Monday of the firstcomplete week in April that does not contain a holiday,and may adjourn the meeting from time to time as itmay deem necessary.

Special examinations17(3) A special examination for commission topractise as a surveyor may be held at any time at thediscretion of the board on the payment in addition to theregular fees prescribed by this Act, of a fee notexceeding $25. for each paper written by the candidate.

Assistants to board of examiners19(1) The council may appoint competent personsto assist the board of examiners in any of the subjects ofexamination and shall fix the fees and expenses to bepaid for such assistants.

Standards of admission of students20 A person who has a grade 12 universityentrance standing in Manitoba or a school standingequivalent thereto from some other province or country,may be admitted as a student, but before filing hisarticles he shall submit evidence of the standingsatisfactory to the board.

(a) he is serving as a student of a Manitoba landsurveyor under articles in writing in Form B in theSchedule or under articles to the like effect;

(b) he produces a certificate in Form D in theSchedule signed by the Manitoba land surveyor withwhom he served as a student, or, if for a reasonsatisfactory to the board the certificate cannot beproduced, he proves to the satisfaction of the boardthat he has served a full period under articlesmentioned in clause (a);

Assignment of articles23 A Manitoba land surveyor may, with theconsent of the student, assign to another Manitoba landsurveyor the articles of service of a student articled tohim, by an instrument in writing in Form C in theSchedule and the student may complete his term ofservice under articles with that other Manitoba landsurveyor; but the student shall be required to produce acertificate from each of the surveyors for the purposesof clause 21(1)(b) or in default thereof such otherevidence of service under articles as is satisfactory tothe board.

Filing of articles24(1) A copy of the articles of service of a studentsigned by all parties thereto, and a copy of everyassignment of such articles of service signed by bothparties thereto together with a consent thereto signed bythe student shall be filed with the registrar within twomonths of the date thereof to be kept by him with therecords of the association, and the fees prescribedtherefor under section 51 shall be paid to the registrar.

Examination for admission to practise26(1) No person shall be admitted to practise as aland surveyor in Manitoba until he has attained the fullage of 18 years, and, except as hereinafter provided, haspassed an examination satisfactory to the board inbotany, geology, algebra, geometry, plane and sphericaltrigonometry, astronomy, levelling and curves, practicalcomputations, descriptions, laws relating to surveys andplans made or required in Manitoba, manuals of survey,practical surveying, town planning, photogrammetry,field work and observing, and such other subjects as theassociation may from time to time prescribe.

Other requirements26(2) Before receiving a commission to practise asa land surveyor in Manitoba, an applicant shall performsuch practical operations as the board may require todemonstrate his familiarity with surveying operationsand his capability of intelligently reporting thereon, andshall answer under oath, which may be administered byany member of the board, such questions as the board orany member thereof may require, as to his actualexperience in the field and with instruments.

Commission to practise as surveyor, and security tobe given and oaths to be taken28(1) Every person who passes the examinationsand fulfils the requirements of this Act shall receive acommission from the association in Form E in theSchedule, authorizing him to practise as a surveyor oflands in and for Manitoba; but before receiving thecommission he shall, with two sufficient sureties, to thesatisfaction of the board, enter into a bond, in duplicate,in Form F in the Schedule, jointly and severally, in thesum of $1,000 to Her Majesty, her heirs and successors,conditioned for the due and faithful performance of theduties of his office, and shall take and subscribe theoath of allegiance in Form G in the Schedule and theoath of office, in Form H in the Schedule.

Acquiring foreign citizenship29 Any surveyor, registered or unregistered,who becomes a subject or citizen of any foreignsovereign or a country other than Canada, or who hasformally declared an intention to become a subject orcitizen of a foreign sovereign or a country other thanCanada, and who afterwards wishes to begin or resumethe practice of land surveying in Manitoba, shall

(a) become re-naturalized under the Citizenship Act(Canada) or by other sufficient legal process; and

(b) furnish the bond and take the official oathsprescribed by this Act.

Appeal of requirements by board31 Where, under subsection 26(3), the boardrequires a person to serve a period of articles or write anexamination, the person affected thereby may appeal therequirement to the council which may confirm, vary orquash the requirement; and the person affected mayappeal the decision of the council in respect thereof asprovided in section 44 and section 44 applies, with suchmodifications as the circumstances require, to theappeal of the decision of the council.

Special requirements for certain graduates32 A graduate from any Canadian university orcollege which included a regular course of study in thetechnical and academic subjects in which candidates fora commission are required to be examined may

(a) be admitted to service under articles as a studentof a Manitoba land surveyor without being requiredto pass the examination to which reference is madein subsection 27(1);

(b) write such examinations as may be prescribed bythe association;

(c) serve under articles as a student of a Manitobaland surveyor for such period of not less than 18months, of which not less than twelve months shallbe actual practice in the field, as the board maydirect; and

(d) upon passing an examination and complyingwith the requirements set out in clauses 21(1)(b)and (d), receive a commission authorizing him topractise as a surveyor of lands.

Commission to practice33 A person

(a) who has successfully completed a course of twoor more years study and training in surveying at aprovincial institute of technology in Manitoba, or ata similar institution in Canada with standardsacceptable to the board, and who has been grantedhis diploma by such institute;

(b) who has served a term of service under articlesas a student of a Manitoba land surveyor for suchperiod of not less than two years, of which atleast 12 months shall be actual practice in the field,as the board may direct;

Register of surveyors to be kept34 The secretary-treasurer shall make and keepa correct register in Form I in the Schedule, of allpersons who are entitled to be registered under this Act,and shall enter opposite the names of all registeredpersons who have died a statement of the fact, and makethe necessary alterations in the addresses of personsregistered, and, subject to this Act, keep the register inaccordance with the by-laws of the association and theorders and regulations of the council.

Manner of keeping register35 No name shall be entered in the registerexcept of a person authorized by this Act to beregistered, nor unless the secretary-treasurer is satisfiedby proper evidence that the person claiming to beregistered is so entitled; and any appeal from thedecision of the secretary-treasurer shall be decided bythe council, and any entry that is proved to thesatisfaction of the council to have been fraudulently orincorrectly made shall be erased from, or amended in,the register by order of the council.

Penalty for procuring registration by falsestatements36 Any person who wilfully procures, orattempts to procure, registration under this Act bymaking or producing, or causing to be produced ormade, any false or fraudulent representation ordeclaration, either orally or in writing, that he is entitledto registration, is guilty of an offence and is liable, onsummary conviction, to a fine of not less than $25. andnot more than $100., and, in default of payment, toimprisonment for a period not exceeding six months;and the council may remove the name of the offenderfrom the register.

Penalty if register falsified37 If the secretary-treasurer wilfully makes, orcauses or allows to be made, any falsification in anymatters relating to the register, he is guilty of anoffence, and is liable on summary conviction, to a fineof not less than $25. or more than $100., and, in defaultof payment, to imprisonment for a period not exceedingsix months.

Removal of names from register38(1) A registered surveyor who desires to ceasepractice may have his name removed from the registerat any time by giving to the secretary written notice ofhis desire and paying up all fees due from him to theassociation to date of notice; and upon receiving thenotice and payment of the fees the secretary shallremove the name of the surveyor from the register andthereafter the surveyor shall not be liable to theassociation for annual or other fees.

Restoration of names38(2) Where a person whose name has beenremoved from the register in accordance withsubsection (1) or with section 45 desires to resumepractice as a registered surveyor, he may apply to thecouncil to be registered, and upon

(a) passing such examinations as the council mayprescribe;

(b) paying an amount determined by the council,which shall not exceed the total of the annual feesfor the period since his name was removed from theregister; and

(c) otherwise complying with this Act; his namemay be re-registered.

Effect of resignation or withdrawal39 The resignation or withdrawal as aforesaidof any registered surveyor does not operate to releasethe surveyor or his sureties, or either of them, from anyobligation incurred or resulting in consequence of anyprofessional negligence or misconduct of the surveyorduring the time he was so registered.

Suspension for conviction for crime40 Where a member has been convicted of anindictable offence carrying a maximum penalty inexcess of two years imprisonment, the council may,after holding a hearing to which sections 42, 43, and 44apply with such modifications as the circumstancesrequire, suspend or expel the member from theassociation and cause his name to be removed from theregister.

Inquiry and summons where no complaint made41(1) Although no complaint has been madeagainst a member of the association, the council may

(a) inquire into any suspected unprofessionalconduct of the member or suspected breach of aby-law of the association by the member; and

(b) summon the member to appear before thecouncil for examination as to any such matterspecified in the summons.

Summons proceeded with as complaint41(2) Where a summons has been issued undersubsection (1), the council may deal with the matterspecified in the summons as though it had been raisedby a complaint against the member summoned; and theprovisions of this Act referring or applying to acomplaint against a member refer and apply with suchmodifications as the circumstances require to the matterspecified in the summons.

Complaints against members42(1) The council may hear and determine anycomplaint made against a member respecting a violationof any provision of this Act or of the by-laws or of therules of professional ethics of the association, orcharging gross negligence or corruption in theexecution of the duties of his office, or professionalmisconduct, or conduct likely to bring the profession ofland surveying into disrepute.

Hearing42(2) Upon receipt of a complaint the councilshall fix a time and place for hearing the complaint, andat the time and place so fixed, the council shall meetand hear the evidence adduced and if the council issatisfied as to the truth of the complaint, it may, in itsdiscretion, reprimand, fine, or suspend or fine andsuspend, the accused person or expel him from theassociation.

Discipline committee42(4) Notwithstanding anything contained herein,the council may appoint a discipline committee ofmembers of the association, not less than three innumber, of whom three shall constitute a quorum, forthe purpose of ascertaining the facts of any matter ofcomplaint, and may alter the number, constitution andtenure of office of such committee.

Powers and duties of discipline committee42(5) The discipline committee shall meet fromtime to time for the dispatch of business and, subject toany rules made by the council, may regulate theconvening, notice, place, management and adjournmentof such meetings, the appointment of a chairman, themode of deciding questions, and generally thetransaction and management of business and if there isa quorum the committee may act notwithstanding anyvacancy in the committee, and in case of a vacancy mayappoint a member of the association to fill the vacancyuntil the next meeting of the council.

Complaint against member42(6) The discipline committee, of its own motionor upon the application of any person, may, and uponthe request of the council shall, inquire into anddetermine any matter of complaint against any memberwhere it is alleged, or the committee has reasonableground for believing, that the member has been guilty ofany of the matters mentioned in subsection (1).

Notice of hearings42(7) Before the holding of an inquiry by thediscipline committee or the council under this Act, anotice shall be served upon the person whose conductis the subject of inquiry, and where there is acomplainant, upon the complainant, and the notice shallembody, or be accompanied by, a copy of the chargesmade or a statement of the subject matter of the inquiry,and shall also specify the time and place of the inquiry,and shall be signed by the chairman of the disciplinecommittee or by the secretary-treasurer.

Time and service of notice42(8) A notice under subsection (7) shall beserved by sending it by registered mail in an envelopeaddressed to the person to be served at his address asshown in the annual register, or in the complaint, atleast 15 days before the date of the inquiry by thediscipline committee or the council, and proof that thenotice or document was so sent shall be proof ofservice.

Proceeding in absence of persons concerned42(9) If a complainant or the person whoseconduct is the subject of inquiry fail to attend, thediscipline committee or council may, upon service ofthe notice mentioned in subsection (7), being proved byaffidavit or statutory declaration or viva voce evidenceunder oath, proceed with the inquiry and, withoutfurther notice to that complainant or person, make areport of its findings or take any other action authorizedby this Act.

Evidence under oath42(10) The testimony of witnesses shall be takenunder oath, which the chairman or acting chairman ofthe discipline committee or of the council is herebyauthorized to administer, and there shall be full right tocross-examine and re-examine all witnesses called andto adduce evidence in defence and reply, and any partyto the inquiry shall have the right to be represented bycounsel.

Notice of appeal44(2) Notice of an appeal shall be served on thepresident or vice-president or secretary-treasurer of theassociation.

Copies of proceedings, etc.44(3) The secretary-treasurer shall, upon therequest of any person desiring to appeal, furnish himwith a certified copy of all proceedings, reports, ordersand papers before the discipline committee and thecouncil in the matter in respect of which the appeal istaken.

Misconduct of members46(1) A member who

(c) does any act or thing calculated to lead thepublic or any person to believe that an unqualifiedperson is a land surveyor or authorized to practise assuch; or

(d) certifies any plan of survey not made under hisown personal supervision; or

(e) falsely certifies as to the service of a studentunder articles when such service has not been bonafide performed in the manner required by this Act;or

(f) knowingly acts as the professional agent of aperson who is not duly qualified to practise as a landsurveyor;

is guilty of misconduct in the execution of the duties ofhis office and is liable to proceedings under section 42in addition to any other liability that he may incur byreason of such misconduct.

Acts of students on behalf of principal46(2) Subsection (1) does not prevent a memberfrom permitting a student serving under articles toperform for and in his name, and under his supervision,any work that the student is capable of performing; butthe member is liable for any damage caused by thestudent or resulting from lack of knowledge or skill onhis part.

Annual register of members to be kept48(1) The secretary-treasurer shall in each year,under the direction of the council, keep for inspection,at his office, free of charge, a correct register of names,in alphabetical order according to the surnames, withthe respective residences or post office addresses, inForm J in the Schedule, of all persons appearing on thegeneral register on the third Wednesday in January inevery year, who are not in arrears for any fees.

Annual membership fees49 Every Manitoba land surveyor shall pay tothe secretary-treasurer, or any person deputed by him toreceive it, such annual fee, as may be determined by theassociation at the previous annual meeting; and the feeis payable on or before the Tuesday after the firstMonday in January in each year.

Consequences of non-payment of fees50 A member of the association who omits orneglects to pay his annual fees to the association is notentitled to any of the rights and privileges conferredunder this Act as long as the omission or neglectcontinues and his name shall be removed from theregister; and he is liable to the penalties provided in thisAct for practising as a Manitoba land surveyor withoutbeing qualified to do so.

Unauthorized practice prohibited54(1) No person shall engage in or hold himself orherself out as engaging in the practice of land surveyingunless the person is registered under this Act or isacting under the direct supervision of a personregistered under this Act.

(a) the practice of architecture by an architectpractising under the authority of The Architects Act;or

(b) the practice of professional engineering and thepractice of professional geoscience under theauthority of The Engineering and GeoscientificProfessions Act.

Evidence of want of authority or non-payment offees54(7) The certificate of the secretary-treasurer,under the seal of the association, is conclusive evidenceof such non-registration or non-membership ornon-payment of fees, as the case may be.

Offence and penalty58(1) Every person who knowingly or wilfullydefaces, alters, or removes, any mound or landmark,post or monument, placed by, or under the supervisionand on the instructions of, a Manitoba land surveyor ora Dominion land surveyor under the Canada LandsSurveys Act (Canada), to any limit, boundary, or angle,of any township or section, or any legal subdivision, lot,parcel of land, in Manitoba is guilty of an offence andliable, on summary conviction, to a fine of not morethan $100. or to imprisonment for a term of not morethan three months or to both.

Temporary removal of marks58(3) Nothing in this Act prevents a Manitobaland surveyor or a Dominion land surveyor or the dulyauthorized assistant of a Manitoba land surveyor orDominion land surveyor, in his operations, from takingup posts and other boundary marks when necessary,after which he shall carefully replace them as they werebefore or renew them.

Right of entry on lands for purpose of makingsurvey59(1) Any Manitoba land surveyor or the dulyauthorized assistant of a Manitoba land surveyor whenengaged in the performance of his duties may pass over,measure along, and ascertain the bearings of, any line orlimit whatsoever; and for those purposes may pass overthe lands of any persons whomsoever, doing no actualdamage to the property of the person.

Order for entry59(3) Where a Manitoba land surveyor, or the dulyauthorized assistant of a Manitoba land surveyor, ishindered in doing anything that he is authorized to dounder subsection (1) or (2), he may apply to a judge ofthe Court of Queen's Bench for an order restrainingsuch hindrance and the judge may make such order asto him seems just.

Compelling attendance before surveyor60 Where a Manitoba land surveyor is in doubtas to the true corner, boundary or limit of any township,section, lot or tract of land which he is employed tosurvey, and has reason to believe that any person ispossessed of any important information touching thatcorner, boundary, or limit, or of any writing, plan, ordocument tending to establish the true position of thecorner, boundary, or limit, if the person does notwillingly appear before, and submit to examination bythe surveyor, or does not willingly produce to him thewriting, plan, or document, the surveyor may apply toany justice of the peace for a subpoena accompanyingthe application by an affidavit or solemn declaration, tobe made before the justice, of the facts on which theapplication is founded; and the justice may issue asubpoena accordingly.

Method of sending notices and documents65(1) Subject to the other provisions of this Act,all notices and documents required by, or for thepurposes of, this Act to be sent, may be sent by post, byletter, and shall be deemed to have been received at thetime when the letter containing them would be deliveredin the ordinary course of mail; and, in proving thesending, it is sufficient to prove that the lettercontaining the notice or document was prepaid andproperly addressed and mailed.

Sending of notices, etc., to municipal councils, etc.65(2) The notices and documents may be inwriting or in print, or partly in writing and partly inprint; and, when sent to a municipal council or anotherauthority, shall be deemed to be properly addressed ifaddressed to the council or authority, or to some officerof the council or authority, at the principal place ofbusiness of the council or authority, and, when sent toa person registered under this Act, shall be deemed tobe properly addressed if addressed to him according tohis address registered in the register of the association.

That E.F., of his own free will, and by and with the consent of C.D., doth, by these presents, place andbind himself student to A.B., to serve him (as such) from the day of the date hereof, for and during and until the fullend and term of years from hence next ensuing and fully to be completed and ended. In consideration whereof and of one dollar of lawful money by C.D. to A.B. paid at or before the sealingand delivery of these presents (the receipt whereof is hereby acknowledged), A.B. for himself, his heirs, executorsand administrators, doth covenant with C.D. his heirs executors and administrators, that he, A.B., will accept andtake E.F. as his student, and that he, A.B., will by the best ways and means he may or can, and to the utmost of hisskill and knowledge, teach instruct, or cause to be taught and instructed, E.F. in the course of study prescribed byThe Land Surveyors Act, in practical surveying operations, and in the use of instruments, and generally in the art,practice and profession of a Manitoba land surveyor, which he, A.B., doth now and at all times during said term shalluse and practise, and also will provide E.F. with all the necessary and reasonable expenses incurred in transactingor performing the business of A.B., and also will, at the expiration of the said term, give to E.F. the certificate ofservice required by The Land Surveyors Act, and use his best means and endeavours, at the request, cost and chargesof C.D. and E.F. or either of them, to cause and procure him, the said E.F., to be examined before the board ofexaminers of candidates for commissions as Manitoba land surveyors; provided E.F. shall have well, faithfully anddiligently served his intended service under articles.
