THE TOURISM ACT

ESTABLISHMENT OF THE NATIONAL TOURISM AND HOSPITALITY PROTOCOLS TASKFORCE

IT IS notified for the information of the general public that the Cabinet Secretary for Tourism and Wildlife has established the National Tourism and Hospitality Protocols Taskforce (“Taskforce”).

1. The Taskforce is established to develop Tourism and Hospitality protocols and guidelines in response to COVID-19 pandemic and to support tourism operations as a result thereof.

2. The Taskforce shall comprise the following:

(a) Principal Secretary for the State Department of Tourism who shall be the Chair;

(b) Chief Executive Officer, Kenya Association of Hotel Keepers and Caterers;

(c) Chief Executive Officer, Kenya Association of Tour Operators;

(d) Chief Executive Officer, Pubs, Entertainment and Restaurants Association of Kenya

(e) Chief Executive Officer, Kenya Association of Air Operators

(f) Chief Executive Officer, Events Management Association of Kenya

(g) Chief Executive Officer, Tour Operators Society of Kenya

(h) Representative of Adventure Tourism

(i) Chief Executive Officer, Retail Traders Association of Kenya

(j) Chief Executive Officer, Kenya Wildlife Conservancies Association

(k) Chief Executive Officer, Kenya Professional Safari Guides Association

(l) Director, Tourism Research, Policy and Innovation Directorate, State Department of Tourism

(m) Director-General, Tourism Regulatory Authority

(n) Director-General, Kenya Civil Aviation Authority

(o) Chief Executive Officer, Kenya Airports Authority

(p) National Co-ordinator, Kenya National Convention Bureau

(q) Three representatives of international airlines in Kenya

3. The Taskforce will undertake the following—

(a) Develop tourism and hospitality health and safety protocols.

(b) Develop guidelines for the implementation of the protocols.

(c) Propose implementation approach for the protocols.

(d) Make recommendations for effective compliance and self-regulations of the industry in the implementation of the protocols.

(e) Identify and recommend areas of support needed during implementation of the protocols.

(f) Compile and submit to the Cabinet Secretary a Taskforce Report and the Draft Protocols.

(g) Any other task assigned by the Cabinet Secretary to fulfil the objective for which the Taskforce has been established.

4. The Taskforce may establish sub-committees.

5. The Taskforce may, with the approval of the Cabinet Secretary, co-opt such persons with relevant skills or expertise, to assist it on specialized aspects of its mandate

6. The Secretariat of the Taskforce shall be the Tourism Regulatory Authority.

7. The Task Force shall undertake and complete its work within seven (7) days.

INVITATION OF PUBLIC COMMENTS

Pursuant to regulation 21 of the Environmental Management and Co-ordination (Impact Assessment and Audit) Regulations, 2003, the National Environment Management Authority (NEMA) has received an Environmental Impact Assessment Study Report for the above proposed project.

The proponent, Savanna Clinker Limited, is proposing a Staroot Company Limited, proposes to construct of residential apartments on L.R. No. 1/183 in Kilimani area along Argwings Kodhek Road in Nairobi City County. The twin tower buildings with two level basements will be established on a 1.02 Acres of land in Kilimani area, with a total of 320 residential units that include 1, 2 and 3 bedrooms. The development will have 336 parking slots. The development will have two basements and ground floor parking spaces with apartments from 1st floor to 16th floor. Other supporting infrastructure include swimming pool, children play area, gym, management office, lifts, landscaped flower gardens and roadways.

The following are the anticipated impacts and proposed mitigation measures:

• Adhering to waste management regulations of 2006.

Public health and occupational safety

• Provide adequate waste collection facilities that are protected from animals, rains and are well covered.

• Provide suitable safety gear for all personnel.

TAKE notice that Dagoretti Nyakinyua Savings and Credit Co-operative Society Limited (CS No. 2258) (under Liquidation) having been dissolved in accordance with section 62 (1) (a) (b) (c) of the Co-operative Societies Act (Cap. 490) by the Commissioner for Co-operative Development and Hesbon Mbuthia Kiura having been appointed the Liquidator by the Commissioner for Co-operative Development pursuant to section 65 of the Co-operative Societies Act (Cap. 490) and that pursuant to section 66 (1) (a) (b) (c) (f) (h) (i) of the Co-operative Societies Act, Rule 48 of the Co-operative Societies Rules, the Order given and issued on the 28th November, 2019, in the Environment and Land Court Civil Application (Miscellaneous) No. 17 of 2019 at Nakuru directing and compelling the Chief Land Registrar, Nairobi, the Land Registrar, Nakuru and the Land Registrar, Naivasha to facilitate and effect the National Land Commission’s recommendation in the Gazette Notice of 1st March, 2019 to the effect that all titles emanating from the fraudulent transaction undertaken by the Dagoretti Nyakinyua company to be revoked and the same be allocated to the members of the Dagoretti Nyakinyua Savings and Credit Co-operative Society Limited who are the bonafide owners under the supervision of the Commissioner of Co-operatives and/or compelling the Chief land Registrar, Nairobi, the Land Registrar- Nakuru and the Land Registrar, Naivasha to facilitate and effect the National Land Commission’s recommendation as contained in the Kenya Gazette of 1st March, 2019 in Table 2-Nairobi, Kiambu, Nyeri and Muranga counties, case number and County namely NLC/HL1112/2017 Nairobi City County in the matter of the Dagoretti Nyakinyua Savings and Credit Co-operative Society Limited (Claimant) and Dagoretti Nyakinyua Company (Respondent) of that Kenya Gazette, the Order given at Nakuru this 19th May, 2020, in the Environment and Land Court ELC (Miscellaneous) No. 7 of 2020 at Nakuru to the effect that the existing beacons and boundaries for all title deeds arising from the subdivision and/or survey of the Mau Summit/Molo Block 3 (Formerly L.R. No. 10224(IR 16461) and the Gilgil/Gilgil Block/Kikopey Ranch (Formerly L.R. No. 9361/5) be and are declared null and void forthwith and that the applicant is at liberty to engage new surveyors to carry out fresh survey for purposes of re-establishing the beacons and boundaries of the resultant subtitles, the Liquidator through M/s Joseph C.K. Cheptarus & Company Advocates, Musco Towers, Mezzanine Floor, Rm 4, Elgeyo Street, opposite Sirikwa Hotel, P.O. THE following notes are for the guidance of persons submitting “copy” for inclusion in the Kenya Gazette, Supplement, etc.:

(1) The Kenya Gazette contains Notices of a general nature which do not affect legislation. They are, therefore, submitted to the Government Printer directly.

(2) Legislative Supplement contains Rules and Regulations which are issued by the National or County Governments. Because of this, they must be submitted to the Government Printer through the office of the Attorney–General.

(3) Bill Supplement contains Bills which are for introduction in the National Assembly, Senate or County Assemblies.

(4) Act Supplement contains Acts passed by the National Assembly, Senate or County Assemblies.

All “copy” submitted for publication should be prepared on one side of an A4 sheet no matter how small the Notice is, each page being numbered and should be typed with double spacing. Copy should be clear, legible and contain no alterations.

Particular attention should be paid to the following points: (i) Signature must be supported by rubber–stamping or typing the name

of the signatory in capital letters. (ii) Must be correct and filled in where necessary. (iii) Care should be taken to ensure that all headings to Notices and

references to legislation are up to date and conform with the Revised Edition of the Laws of Kenya.

EXTRACT FROM THE CODE OF REGULATIONS, SECTION D— Kenya Gazette

“D 34. (1) Communications for the Kenya Gazette should reach the Government Printer not later than 9 a.m. on Friday of the week before publication is desired. The Government Printer will not publish communications received after that hour until the next subsequent issue of the Gazette.

(2) Ministries will be required to pay for the Kenya Gazette and to meet the cost of advertising in it.

It is emphasized that these notes are for guidance only, but it is requested that persons submitting copy for publication first satisfy themselves that such copy is complete in every respect.
