WAIVER ON LAND RATES PENALTIES

NOTICE is given that the County Executive Committee Member

for Finance and Economic Planning in exercise of powers conferred by section 5 of the Nairobi City County Tax Waivers Administration Act,

2013, with the concurrence of the Governor shall waive penalties on

rates for those who will pay such rates in full within the period of 15th May and 23rd July, 2017 inclusive.

The payments must, however, be accompanied by 10% of the

applicable penalty being administrative charges and any other

expenses incurrent as court and legal fees, where applicable.

The waiver intends to encourage rate defaulters to regularize their accounts and to improve revenue collection from rate defaulters. The

collections will enhance service delivery.

The Water Services Regulatory Board has pursuant to Section 73(5) of the Water Act 2002 approved a Regular Tariff increase for water tariffs for Nakuru Rural Water and Sanitation Company (NARUWASCO)

(i) Annual Budgets: The WSP shall adhere to the budgetary levels set in the tariff.

(ii) Bulk Agreements: All existing and future bulk sales of water shall be supported by bulk sale agreement/s issued by WASREB.

(iii) NRW reduction plan: The WSP shall submit a NRW reduction plan before the tariff is approved for gazettment.

(iv) Performance Evaluation: Performance targets to be met and ascertained by WASREB, at the end of the 1st year of the tariff period. Non achievement of the set targets without justifiable cause shall lead to penalty.

(v) SPA Revision: The clause on tariffs and licensee remuneration levy which is the equivalent of Clause 9 of the Model Service Provision Agreement (SPA) on ―Tariffs, Remuneration and Financial Arrangements‖, shall be amended to conform with the approved tariffs: The agent shall remit fixed annual payments to Licensee, which shall be paid on equal monthly rates, at the end of respective months according to the amount in section 3.

(vi) Regulatory Levy: The WSP shall remit the regulatory levy on monthly basis being 1% of the billing as per Legal Notice No. 36 of

2008.Arrears of the levy shall be paid up before approval of the gazette notice of the tariff.

(vii) Loan Repayment: NARUWASCO shall immediately establish a standing order with RVWSB where it shall remit on monthly basis, equal installments for the semi - annual repayments.

ENVIRONMENTAL IMPACT ASSESSMENT STUDY REPORT FOR THE PROPOSED SMALL SCALE PRIVATE POWER PLANT ON PLOT L.R. NO. 145/R SECTION IV MN, KIKAMBALA, KILIFI

COUNTY

INVITATION OF PUBLIC COMMENTS

PURSUANT to regulation 21 of the Environmental Management and Co-ordination (Impact Assessment and Audit) Regulations, 2003, the National Environment Management Authority (NEMA) has received an Environmental Impact Assessment Study Report for the above proposed project.

The proponent, Pwani Oil Products Limited, is proposing to construct a small scale private power plant on plot L.R. No. 145/R Section IV MN, at Kikambala area, along Mombasa Malindi Highway in Kilifi County. The area set aside for the proposed small scale private power plant is currently undeveloped, the vegetation mainly consists of grass and marsh, and no trees were spotted on site. The existing facility is fenced all round and all proposed activities will be within the precincts of the facility. The Neighborhood depicts a mix of land uses, i.e. commercial for the immediate neighbor to the North, residential, and retail businesses across the highway

The proposed power plant will have an output of 1.5Mw and will mainly comprise of a boiler, turbine and Alternator (Generator) aimed at reducing production costs and reliance on the national grid. The

turbine will be run by steam generated at the rate of 9.8 MT/hr. at 46.1 bar pressure. Bleed steam from the turbine at 1 MT/hr. at 9.56 bar pressure and extraction steam from the turbine at 3.48 MT/hr. at 3.6 bar pressure will be used for powering the Pwani oil plant. Exhaust steam from the turbine will be 5.32 MT/hr. and will condense using cooling tower and fed back to the boiler.

The following are the anticipated impacts and proposed mitigation measures:

Water demand The contractor will ensure water conservation and in all activities.

Water will be recycled as far as is practice without compromising on quality and health.

The contractor to ensure prudential use of water resources during construction by avoiding wastage such as running pipes and taps.

The proponent in collaboration with WRMA will determine the yields of the borehole and its capability to accommodate the elevated demands.

Physical environment Compacted areas to be ripped to prevent erosion.

Restore degraded areas through landscaping using trees and sediment binding grasses.

Controlling of earthworks to prevent compacting the loose soils.

Air pollution The contractor will implement sound project management strategies to ensure that installation works are completed in the shortest possible time taking advantage of low wind velocities.

Contractor to deploy fine dust screens at the site during construction.

Sprinkle dust producing materials such as ballast with water on site.

Use low Sulphur fuels to power delivery vehicles and site machinery.

Truck drivers will maintain low speeds to avoid raising dust.

Employees will be provided with dust masks and goggles.

Adherence to Air Quality Regulations, 2014.

Noise and excessive vibrations

Serviceable machines will be used for excavation to ensure vibrations are kept at below risk levels.

Construction work and delivery of raw materials will be limited to daytime on weekdays only.

The contractor will deploy compact machinery and fit them with mufflers and vibration dampers.

The contractor will deploy acoustic screens around noisy working areas to contain noises.

Comply with the provisions of Noise and excessive Vibration Pollution Control Regulations of 2009.

Solid wastes The contractor will install segregation bins and a receptacles that encourage separation of wastes at source to promote re-use and re-cycling.

The contractor will adhere to the 6Rs principle of waste management (i.e. Refuse, Reduce, Reuse, Recycle Recover energy and Rot).

The contractor will endeavor to comply with the Waste Management Regulations.

Procure the services of a NEMA licensed waste handler to manage solid wastes from the construction site.

Adherence to Waste Management Regulations, 2006.

Occupational Health and Safety

Provision of adequate and appropriate Personal Protective Equipment (PPE) including safety shoes, helmets, gloves and overalls.

Employees to be given the correct tools and equipment for the jobs assigned.

Employees to be trained in the use of all equipment that they will be required to operate.

First aid services and an emergency vehicle to be readily available at site.

Moving parts of machines and sharp surfaces to be securely protected with guards to avoid unnecessary contacts and injuries during installation phase.

Comply with the provisions of OSHA 2007.

Traffic impact Heavy commercial vehicles delivering material shall observe designated speed limits for the area.

Proper signage and warnings shall be placed at appropriate places along the Mombasa- Malindi Road to forewarn other motorists of HCVs turning and transportation of abnormal loads.

Delivery of material for the installation shall only be undertaken off-peak hours

Deploy flagmen at the entrance to guide traffic.

INVITATION OF PUBLIC COMMENTS

PURSUANT to regulation 21 of the Environmental Management and Co-ordination (Impact Assessment and Audit) Regulations, 2003, the National Environment Management Authority (NEMA) has received an Environmental Impact Assessment Study Report for the above proposed project.

The proponent, Paddock Investments Limited, is proposing to develop a residential hotel and hotel suites in Runda Estate off the Northern Bypass. The hotel will sit on 3.4 Ha of land that is in fifteen plots of approximately ½ acre each. Paddock Investments Limited has applied for land amalgamation of the 15 plots into one, and further a change of the use of the land from residential to commercial user. The commercial development will be for a residential hotel and hotel suites that will enhance sustainable development and promote a livable city and neighborhood in the North of Nairobi City County

The following are the anticipated impacts and proposed mitigation measures:

The contractor must ensure that all hazardous chemical substances are labeled, packed, transported and stored in order to avoid the spread of contamination.

loads of soil being transported must be watered to reduce dust.

All areas disturbed during construction that are not required for a specific activity must be vegetated.

Diesel exhaust emissions from heavy machinery on site (excavators, front end loaders and hauling trucks) must be controlled and minimized by regular checks and servicing of vehicles.

Adherence to Air Quality Regulations, 2014.

Noise Construction should take shortest time possible.

Adherence to Noise And Excessive Vibration Pollution (Control) Regulations, 2009.

Ground water If construction activities take place in the wet months’ appropriate measures must be taken to control storm water and implemented to prevent erosion.

Vegetation clearance must be kept to a minimum to reduce the risk of siltation.

Adequate provision must be made for sanitation for the construction workers. Chemical toilets on site are to be emptied weekly.

Waste

To prevent the deterioration of surface water quality, the contractor must provide adequate ablution facilities. Toilets are to be serviced twice a week a minimum and as and when required thereafter, throughout the construction phase.

THE following notes are for the guidance of persons submitting ―copy‖ for

inclusion in the Kenya Gazette, Supplement, etc.:

(1) The Kenya Gazette contains Notices of a general nature which do not

affect legislation. They are, therefore, submitted to the Government

Printer directly.

(2) Legislative Supplement contains Rules and Regulations which are

issued by the Central Government. Because of this, they must be

submitted to the Government Printer through the office of the

Attorney-General.

(3) Bill Supplement contains Bills which are for introduction in the

National Assembly.

(4) Act Supplement contains Acts passed by the National Assembly.

All ―copy‖ submitted for publication should be prepared on one side of an

A4 sheet no matter how small the Notice is, each page being numbered and

should be typewritten with double spacing. Copy should be clear, legible and

contain no alterations.

Particular attention should be paid to the following points:

(i) Signature must be supported by rubber-stamping or typing the name

of the signatory in capital letters.

(ii) Must be correct and filled in where necessary.

(iii) Care should be taken to ensure that all headings to Notices and

references to legislation are up to date and conform with the Revised

Edition. of the Laws of Kenya.

EXTRACT FROM THE CODE OF REGULATIONS, SECTION D—

Kenya Gazette

―D 34. (1) Communications for the Kenya Gazette should reach the

Government Printer not later than 9 a.m. on Friday of the week before

publication is desired. The Government Printer will not publish communications

received after that hour until the next subsequent issue of the Gazette.

(2) Ministries will be required to pay for the Kenya Gazette and to meet the

cost of advertising in it.

It is emphasized that these notes are for guidance only, but it is requested

that persons submitting copy for publication first satisfy themselves that such

copy is complete in every respect.
