Notification No. 174–Rev(LAJ) of 2018

Dated 13–04–2018.

Whereas, the land specifications whereof are given in

“Annexure-A” to this notification is required for public purpose viz. for

construction of road from Marsoo to Charota in Village Charota, Tehsil

Assar, District Doda under PMGSY ;

Whereas, on the basis of an indent placed by Executive

Engineer, PMGSY Division, Doda vide No. PMGSY/D/1891-94

dated 04–11–2011 duly confirmed by Chief Engineer, PMGSY

(JKRRDA), Jammu vide No. CE/PMGSY/J/9847-49 dated

16–08–2017, a notification under section 4 (1) was issued by Collector,

Land Acquisition (ACR), Doda vide No. 628-34/Acq dated

Whereas, the Collector Land Acquisition (ACR), Revenue vide

No. 1762-67/Acq dated 05-02-2018 has reported that the notification

issued under section 4 (1) of the J&K State Land Acquisition Act

was served upon the interested persons for filing objections, if any, to the

proposed acquisition, but no objection was received from the land owners/

interested persons within the prescribed time period as required under

sections 5 & 5-A of the Land Acquisition Act ;

Whereas, the report furnished by Collector, Land Acquisition (ACR),

Doda vide No. referred to above duly endorsed by Deputy Commissioner,

Doda vide No. 672/LAC/D/17 dated 07–02–2018 has been examined and

it has been found that the land owners did not file any objection to the

proposed acquisition ;

Whereas, the Government is satisfied that the land particulars whereof

are given in “Annexure-A” to this notification is required for public purpose

viz. for construction of road from Marsoo to Charota in Village Charota,

Tehsil Assar, District Doda under PMGSY.

Now, therefore, in pursuance of section 6 of the J&K State Land

Acquisition Act, Samvat 1990, it is declared that the land measuring 48

Kanals and 12 Marlas situated in Village Charota, Tehsil Assar, District Doda,

particulars whereof are given in “Annexure-A” to this notification is required

for public purposes viz. for construction of road from Marsoo to Charota in

Village Charota, Tehsil Assar, District Doda under PMGSY. Further, the Collector,

Land Acquisition (ACR), Doda is directed under section 7 of the said Act

to take order for acquisition of the said land after giving prescribed notice to

the interested person(s) as required under the Land Acquisition Act/Rules.

06–11–2009, a notification under section 4 (1) was issued by Collector,

Land Acquisition (ACR), Kishtwar vide No. ACR/LA/1549-54 dated

30-03-2010 for land measuring 03 Kanals and 11½ Marlas, situated

in Village Kishtwar, Tehsil and District Kishtwar ;

Whereas, the Collector Land Acquisition (ACR), Kisthwar vide

No. ACR/LA/2884-87 dated 04-01-2018 has reported that the notification

issued under section 4 (1) of the J&K State Land Acquisition Act

was served upon the interested persons for filing objections, if any, to the

proposed acquisition, but no objection was received from the land owners/

interested persons within the prescribed time period as required under

sections 5 & 5-A of the Land Acquisition Act ;

Whereas, the report furnished by Collector, Land Acquisition, (ACR),

Whereas, on the basis of an indent placed by Executive Engineer,PWD (R&B) Division, Ramban vide No. 7994-98 dated 19-11-2011,a notification under section 4 (1) was issued by Collector,Land Acquisition (ACR), Ramban vide No. Acq/Gen/695-701 dated09–11–2013 for land measuring 58 Kanals and 18 Marlas situatedat Village Tringla, Tehsil Batote, District Ramban ;

Whereas, the Collector, Land Acquisition (ACR), Ramban videNo. Acq/Gen/15/295-98 dated 23-07-2015 has reported that the notificationissued under section 4 (1) of the J&K State land Acquisition Act was servedupon the interested persons for filing objections, if any, to the proposedacquisition, but no objection was received from the land owners/interestedpersons within the prescribed time period as required under sections5 & 5-A of the Land Acquisition Act ;

Whereas, the report furnished by Collector, Land Acquisition(ACR ), Ramban vide No. referred above duly endorsed by DeputyCommissioner, Ramban vide No. DC/LA/Rbn/62-63 dated 29-07-2015,Divisional Commissioner, Jammu vide No. 502/2466/Acq/Tringla/Rbn/15/4402-03 dated 05–02–2018 and by Financial Commissioner, Revenue videNo. FC-LS/LA-4415/2015 dated 19–02–2018 has been examined and ithas been found that the land owners did not file any objection to the proposedacquisition ;

Whereas, the Government is satisfied that the land particulars whereofare given in ‘Annexure “A” to this notification is required for public purposeviz. for construction of road from Amar Chasma to Natha Top in VillageTringla, Tehsil Batote, District Ramban by PW (R&B) Department.


Now, therefore, in pursuance of section 6 of the J&K State LandAcquisition Act, Samvat 1990, it is declared that land measuring58 Kanals and 18 Marlas, situated in Village Tringla, Tehsil Batote DistrictRamban, particulars whereof are given in ‘Annexure “A” to this notificationis required for public purposes viz. for construction of road from AmarChasma to Natha Top in Village Tringla, Tehsil Batote, District Ramban byPW (R&B) Department.

Whereas, Chief Medical Officer, Shopian/Pulwama, placed anindent for acquisition land measuring 48 Kanals, for construction of200 bedded hospital at Hergam, Shopian ;

Whereas, Tehsildar, Shopian furnished the Shajra-i-Khasrafor land measuring 27 Kanals, 01 Marla and the land wasnotified under section 4 (1) of Land Acquisition Act vide this officeNo. DCS/LA/07/728-39 dated 29-11-2007 ;

Whereas, Deputy Director, Health, Kashmir vide his letterNo. DHS/PLG/622/08/919-21 dated 23-06-2008, informed this officethat it would not be possible to provide the funds in one go. Therefore,only 15 Kanals, of land be acquired in first phase and accordinglythe Tehsildar, Shopian was requested to furnish a new Shajra-i-Khasraduly authenticated by Indenting Department for land measuring15 Kanals ;

Whereas, Tehsildar, Shopian furnished a fresh Shajra-i-Khasra forland measuring 15 Kanals, 09 Marlas and 03 Sirsais ;

Whereas, land measuring 11 Kanals, 11 Marlas and 06 Sirsaiswere denotified ;

Whereas, the case was put before DPNC on 24-05-2010 underthe Chairmanship of Deputy Commissioner, Shopian and a rate of10.50 Lacs per Kanal for vacant land excluding the cost of trees wasadopted ;

Whereas, Nazir Ahmad and others residents of Gagren, Shopianrepresented this office along with application on 12-11-2013 requesting

Whereas, the Director, Health Services, Kashmir was requestedto give his comments in light of the application vide this officeNo. DCS/LAC/13/37-38 dated 26-04-2013 ;

Whereas, Director, Health Services, Kashmir released an amountto the tune of 60 Lacs on account of land compensation for theconstruction of 200 bedded hospital at Hergam, Shopian vide hisNo. DHSK/PLG/762/14/4776-82 dated 27-03-2014 ;

Whereas, the land owners have been requested to takethe compensation amount vide this office letter No. DCS/LA/14/27dated 31-05-2014 ;

Whereas, the land owners didn’t agree to take the compensationciting the reason that the rate of acquisition has been fixed beforefour years in DPNC held on 24-05-2010 ;

Whereas, Director, Health Services, Kashmir vide his letterNo. DHSK/PLG/18/DHSOP/6191-94 dated 28-02-2018 appraised thisoffice to go ahead for acquisition of land measuring 01 Kanal,18 Marlas and 03 Sarsais for which funds are available with Collector,Land Acquisition, Shopian and denotify the remaining land in consultationwith District Development Commissioner, Shopian and MedicalSuperintendent, District Hospital, Shopian ;

Whereas, the Tehsildar, Shopian vide this office letter No. DCS/LAC/18/275-77 dated 14-07-2018 was directed to demarcate the landmeasuring 05 Kanals, 09 Marlas and 03 Sarsai which has already beennotified and the patch of land measuring 01 Kanal, 18 Marlas and03 Sarsai which is to be acquired in consultation with DistrictDevelopment Commissioner, Shopian and Medical Superintendent,District Hospital, Shopoian ;

Whereas, the Tehsildar, Shopian vide his No. 482/OQ/Spndated 28-08-2018 has furnished the comprehensive report along withShajri-i-Khasra of the land measuring 05Kanals, 09 Marlas and 03Sarsais under survey No. 13 min at Hergam, Shopian ;


Whereas, the land owner namely Nazir Ahmad and others areapproaching this office time and again for denotifying of their landunder survey No. 13 min as they have not been paid compensationafter the conducting of PNC ;

Whereas, the quantum of land measuring 3 Kanals and 11 Marlasunder survey No. 13 min is proposed to be denotified from thenotification already issued.

In light of above mentioned facts, objections are invited fromthe interested persons, if any, regarding the denotification of aforesaidquantum of land before the undersigned within a period of 15 daysfrom the date of publications of this notice.

An Act to amend the Jammu and Kashmir Panchayati Raj Act, 1989.

In exercise of the powers vested under Proclamation No. P-1/18 of2018 dated 20th June, 2018, the Governor is pleased to enact as follows :––

1. Short title and commencement.––(1) This Act may be called theJammu and Kashmir Panchayati Raj (Fourth Amendment) Act, 2018.

(2) It shall come into force from the date of its publication in theGovernment Gazette.

2. Amendment of section 2, Act No. IX of 1989.––In section 2 of theJammu and Kashmir Panchayati Raj Act, 1989 (hereinafter referred to as‘the principal Act’), clause (mm) shall be omitted.

3. Insertion of Chapter I-A, Act No. IX of 1989.––After Chapter Iof ‘the principal Act’, the following Chapter shall be inserted, namely :––

“CHAPTER I-A

Ward Majlis and Halqa Majlis

3-A. Ward Majlis (Ward Sabha).––(1) For every ward of the HalqaPanchayat as may be determined in accordance with the provisions of clause(f) of sub-section (1) of section 2, there shall be a Ward Majlis.

(2) All adult persons of the ward whose names are included in theelectoral rolls relating to Halqa Panchayat shall be deemed to be constitutedas Ward Majlis of such Halqa Panchayat.

(3) The Ward Majlis shall meet at least once in three months. Theprocedure for convening and conducting the meeting of the Ward Majlis shallbe such as may be prescribed :

Provided the Ward Majlis can meet more often for implementingGovernment programmes.

(4) The meeting of the Ward Majlis shall be presided over by the Panchor in his/her absence by a member of the Ward Majlis, to be elected for thepurpose, by the majority of the members present in the meeting.

(5) The quorum of the meeting of the Ward Majlis shall be not less thanone-tenth of the total members.

(6) All resolutions in respect of any subject in the meeting held underthis section shall be passed by a majority of the members present and voting.

(7) Notwithstanding anything contained in sub-section (1) a specialmeeting of Ward Majlis shall be convened where atleast ten per cent of thevoters of the ward make a request in writing specifying the subject for themeeting :

Provided that no two special meetings shall be held within a period ofthree months.

3-B. Functions of the Ward Majlis.––The functions of the Ward Majliswithin its respective jurisdiction shall be to assist the Halqa Majlis and alsoinclude the following functions :––

(i) to render assistance to the Halqa Panchayat in collection andcompilation of details required for formulation of developmentplans ;

(ii) to generate proposals and fix priorities for developmentschemes and programmes to be implemented in the area of theWard Majlis ;

(iii) to identify beneficiaries in order of priority, for the implementationof development schemes pertaining to the area ofWard Majlis ;

(iv) to render assistance in effective implementation of developmentschemes ;

(v) to suggest the location of public utilities, amenities and serviceslike street lights, community water taps, public wells, publicsanitation units, irrigation facilities etc. ;

(vi) to formulate schemes and impart awareness on matters of publicinterest like cleanliness, preservation of environment, preventionof pollution, guarding against social evils etc. ;

(vii) to promote harmony and unity among various groups of people ;

(viii) to verify the eligibility of persons getting various kinds of welfareassistance from Government such as pensions and subsidies ;


(ix) to collect information on the detailed estimates of works proposedto be taken in the area ;

(x) to undertake social audit of all works implemented in the areaand award completion certificate for such works ;

(xi) to promote literacy, education, health, childcare and nutrition ;

(xii) to assist the activities of parent-teacher associations in thearea ; and

(xiii) to exercise such other functions as may be prescribed.

3-C. Halqa Majlis (Gram Sabha).––(1) There shall be a HalqaMajlis for each Halqa Panchayat consisting of such persons whose nameshave been included in the electoral rolls relating to the village or the group ofvillages comprised within the area of the Halqa Panchayat.

(2) The meetings of the Halqa Majlis shall be convened by the Sarpanchof the Panchayat or, in his absence, by the Naib-Sarpanch of such Panchayat.In the event of both, the Sarpanch and the Naib-Sarpanch being absent, ameeting of the Halqa Majlis shall be presided by one of the Panch authorizedby the Halqa Majis.

(3) The procedure for convening and conducting the meeting of theHalqa Majlis shall be such as may be prescribed.

(4) There shall be at least two meetings of the Halqa Majlis every year,one in the first and the other in the last quarter of the financial year :

Provided that in case of urgency, the meeting of the Halqa Majlis maybe convened earlier in accordance with the procedure as may be prescribedin this behalf.

(5) Secretary Panchayat shall record the minutes of the meeting ofHalqa Majlis and shall be responsible for the correct recording of the minutesof the meetings.

(6) The quorum of the meeting of the Halqa Majlis shall be not less thanone-tenth of the total members.


(7) Any resolution relating to the matters entrusted to the Halqa Majlisunder this section, shall have to be passed by a majority of votes of the memberspresent and voting in the meeting of the Halqa Majlis.

3-D. Functions of the Halqa Majlis.––The functions of the HalqaMajlis within its respective jurisdiction shall be to assist the Halqa Panchayatand also include the following functions :––

(i) to approve the plans, programmes and projects for social andeconomic development in order of priority, out of the plans,programmes and projects approved by the Ward Majlis beforesuch plans, programmes and projects are taken up forimplementation by the Panchayat ;

(ii) to identify or select persons as beneficiaries under povertyalleviation and other programmes, in order of priority out of thepersons identified by the various Ward Majlis coming under itsjurisdiction ;

(iii) to conduct social audit as per prescribed procedure in respect offunds utilized under different schemes in wards ;

(iv) To mobilize voluntary labour and contribution in kind or cash orboth for the community welfare programmes ;

(v) to promote literacy, education, health and nutrition ;

(vi) to promote unity and harmony among all sections of the societyin such area ;

(vii) to seek clarifications from the Sarpanch and members of thePanchayat about any particular activity, scheme, income andexpenditure ;

(viii) to identify and approve development works in order of priorityfrom out of the works recommended by the Ward Majlis ;

(ix) to plan and manage minor water bodies ;

(x) to manage minor forest produce ;

(xi) to exercise control over institutions and functionaries in all socialsectors ;


(xii) to exercise control over local plans and resources for such plansincluding tribal sub-plan ;

(xiii) to consider and approve the recommendations made by eachWard Majlis in the area of such Panchayat Halqa ; and

(xiv) such other functions as may be prescribed.”

4. Amendment of section 7, Act No. IX of 1989.––In section 7 of‘the principal Act’, in clause (iv), for the words “six consecutive meetings”,the words “three consecutive meetings” shall be substituted.

5. Omission of section 8-A, Act No. IX of 1989.––Section 8-A of‘the principal Act’ shall be omitted.

6. Substitution of section 9, Act No. IX of 1989.––Section 9 of‘the principal Act’ shall be substituted by following section, namely :––

“9. Appointment of Administrator .––(1) (a) If the Governmentis satisfied that a Halqa Panchayat for a village or a group of villagesimmediately after the establishment of such Halqa Panchayat cannotbe constituted by reason of,––

(i) any difficulty in holding the election of the members of theHalqa Panchayat ; or

(ii) failure to elect such members at two successive electionsheld under the provisions of this Act ; or

(iii) any other sufficient reason whatsoever or,

(b) If at any general election to a Halqa Panchayat no member iselected or less than one-third of the total members are elected ;

the Government shall by notification appoint an administrator, who isan employee of the Government.

(2) If in the opinion of the Government, or any other officer authorizedby it, but not below the rank of Additional District Magistrate, aHalqa Panchayat is incompetent to perform or persistently makesdefault in the performance of duties imposed on it by or under anyof the provisions of this Act, or otherwise through Government


instructions, the Government or such officer after the approval ofthe Government may, by notification, based on the recommendationsof the Ombudsman, supersede such Halqa Panchayat and appointan Administrator, who is a employee of the Government for carryingout the work of Halqa Panchayat :

Provided that no order under this sub-section shall be passed unlessHalqa Panchayat is called upon to show cause why such order shallnot be passed :

Provided further that explanation tendered by the Halqa Panchayatshall be forwarded to the Ombudsman appointed under the Jammuand Kashmir Ombudsman for Panchayats Act, 2014 for considerationand recommendation to the Government or officer authorizedby it.

(3) The period of supersession shall not exceed six monthsduring which the elections for the said Halqa Panchayat shall beheld.

(4) The Administrator appointed under this section shall hold officefor such period not exceeding six months as the Government or officerauthorized by it, may specify in the notification under sub-section (1)or sub-section (2).

(5) On the appointment of an Administrator under this section :––

(i) the persons, if any, chosen as members of Halqa Panchayat,including Sarpanch before such appointment shall cease tobe members of Halqa Panchayat and all the powers and dutiesof the Halqa Panchayat including Sapranches shall beexercised and performed by such Administrator ;

(ii) the funds and other property vested in the Halqa Panchayatshall, during the period of supersession, vest in theAdministrator appointed under this section.

(6) The Administrator shall be deemed to be duly constituted HalqaPanchayat for the purposes of this Act, notwithstanding anythingcontained in the foregoing provisions.”


7. Substitution of section 10, Act No. IX of 1989.––Section 10 of‘the principal Act’ shall be substituted by the following section, namely :––

“10. Remuneration to Sarpanch and Panches.––Every Sarpanchand Panch shall be entitled to such monthly honorarium as may bespecified by the Government.”

8. Amendment of section 11, Act No. IX of 1989.––In section 11 of‘the principal Act’, for the words “resign his office and”, the words “resignhis office and on acceptance of his resignation by such authority”, shall besubstituted.

9. Substitution of section 12, Act No. IX of 1989.––Section 12 of‘the principal Act’, shall be substituted by the following section, namely :––

“12. Powers and functions of Halqa Panchayat.––(1) The HalqaPanchayat shall perform the functions specified in Schedule I-A :

Provided that where the Government provides funds for theperformance of any function specified in Schedule I-A, the HalqaPanchayat shall perform such function in accordance with theguidelines or norms laid down for performing such function.

(2) Notwithstanding anything contained in sub-section (1) andSchedule I -A subject to the provisions of this Act, it shall be the dutyof each Halqa Panchayat to make provision for the following subjectto, the availability of funds at its disposal––

(i) to prepare the plans for the development of the Halqa inconsultation with Halqa Majlis and their timely submission toBlock Development Council for consolidation ;

(ii) to undertake measures for the implementation of thedevelopment plans ;

(iii) to specifically deal with the problems of soil conversation,water management, social forestry, rural industrialization,agriculture, sheep and animal husbandry, sanitation, healthand other welfare programmes ;


(iv) regulation of buildings, shops and entertainment houses andchecking of offensive or dangerous trades ;

(v) construction and maintenance of slaughter houses, regulationof sale and preservation of meat and processing of skins andhides ;

(vi) regulation of sale and preservation of fish, vegetables andother perishable articles and food ;

(vii) regulation of fairs and festivals ;

(viii) preparation and implementation of special development plansfor alleviating poverty and employment generation as maybe notified by Government from time to time ; and

(ix) all matters involving regulation, supervision, maintenance andsupport, incidental to, or necessary for the more efficientdischarge of the above functions and those which may beentrusted to Halqa Panchayat under the provisions of theAct.

(3) The Halqa Panchayat shall also conduct concurrent and quarterlysocial audit of all works/schemes/projects being implemented in thePanchayat area as per procedure to be notified by the Government.

(4) The Halqa Panchayat shall also perform such other functionsand duties as may be assigned or entrusted to it by the Government,the District Planning and Development Board and the BlockDevelopment Council within the area in which Halqa Panchayat isconstituted.”

10. Amendment of section 14, Act No. IX of 1989.––In section 14 of‘the principal Act’, after sub-section (1), the following sub-section shall beinserted, namely :––

“(2) The Halqa Panchayat shall have power to operate the funds,grants etc. specified in Schedule I-C in the manner prescribed.”

11. Substitution of section 15, Act No. IX of 1989.––Section 15 of‘the principal Act’ shall be substituted by following section, namely :––

“15. Imposition of fee by the Halqa Panchayat.––(1) Every HalqaPanchayat shall in such a manner and in accordance with such rules as may

Provided that where an owner of the building has left the Panchayatarea or cannot otherwise be found, the occupier of such building shall beliable for the fee leviable on such owner.

(2) A Halqa Panchayat may also levy fee on all or any of the followingitems at such rates as may be determined by the Halqa Panchayat andsubject to such exemptions as may be notified by the Government from timeto time, namely :––

(a) Fee on entertainment ;

(b) Fee on advertisements and hoardings ;

(c) Fee on commercial tractors kept in area of the HalqaPanchayat ;

(d) Fee on business and professions within the jurisdiction of HalqaPanchayat like on rice husking mills, saw mills, Flour mill/ricemills, Gharats, Brick Kilns, Oil Mills, Slaughter houses, PetrolPumps, Private hospitals/labs/diagnostic-centre, Soda/ice/ice-cream factory, Spice grinding mills, Motor Vehicle/Tractordealers, Liquor Shops, Hot wet mix plant/Stone crushers, Poultry/Dairy Farms/Horse Traders, small scale industrial units,Mobile towers, power plants printing presses, Kerosene Oil/Rationdealers etc.

(e) Fee on contractors for executing such works allotted to them bythe Government within the jurisdiction of Halqa Panchayat ;

(f) Fee on travel agents/transport agencies ;

(g) Fee for organizing Melas, festivals etc. where necessaryarrangement for the water supply, health and sanitation are to bemade by the Halqa Panchayat or where such Melas or festivalsare held on Panchayat lands ;

(h) Fee on registration of shops/other commercial establishments inthe jurisdiction of Halqa Panchayat ;


(i) Fee on Buses, other passenger vehicles and commercial vehicleson account of haltage within the jurisdiction of Halqa Panchayatfor providing adequate facilities for the travelers by the GramPanchayat ;

(j) Fee on cattle pounds ;

(k) Fee on road cutting for laying optical fiber cable ;

(l) Royalty for extraction of minor minerals from local nallahs notfalling under the ambit of Geology and Mining Department andnot exempted from royalty under any specific provision of law ;

(m) Penalty for use of plastic or polythene and for open defecation ;

(n) Sanitation cess ;

(o) Such other fee as may be approved by the Government :

Provided that the Government may at any time after giving anopportunity to the Halqa Panchayat cancel or modify or alterrate of any fee imposed under this section”.

12. Insertion of section 15-A, Act No. IX of 1989.––Aftersection 15 of ‘the principal Act’, following section shall be inserted,namely :––

“15-A. Revision of Fee and Rates.––The Halqa Panchayat mayrevise the fees and rates leviable under section 15, at the most once,in a two year period.”

13. Amendment of section 16, Act No. IX of 1989.––In section 16 of‘the principal Act’, for the word “Sarpanch”, the words “Halqa Panchayat”,shall be substituted.

14. Amendment of section 19, Act No. IX of 1989.––In section 19 of‘the principal Act’, the full stop (.) at the end shall be substituted by colon (:)and thereafter following proviso shall be added, namely :––

“Provided that no such revision shall be made unless an opportunityof being heard is provided to the Halqa Panchayat which has madeassessment under this Act.”


15. Amendment of section 26, Act No. IX of 1989.––In section 26 of‘the principal Act’, after sub-section (2), the following sub-section shall beinserted, namely :––

“(3) The Government shall also provide the staff to the HalqaPanchayat as specified in Schedule I-B for carrying out the purposesof this Act.”

16. Amendment of section 30, Act No. IX of 1989.––In section 30 of‘the principal Act’, for the words “Panches and Sarpanches”, the words“Sarpanches”, shall be substituted.

17. Substitution of section 31, Act No. IX of 1989.––Section 31 of‘the principal Act’, shall be substituted by the following section, namely :––

“31. Powers and functions of Block Development Council.––(1) The Block Development Council shall perform functions specifiedin Schedule II-A :

Provided that where the Government provides funds for theperformance of any function specified in Schedule II-A, the BlockDevelopment Council shall perform such function in accordance withguidelines or norms laid down for performing such function.

(2) Notwithstanding anything contained in sub-section (1) andSchedule II-A, and subject to the provisions of this Act, it shall be theduty of each Block Development Council to perform the followingfunctions :––

(i) compilation of all Panchayat level plans and their timelysubmission to District Planning and Development Board forintegration with District Plan ;

(ii) preparation of all Block Level Plans and timely submissionof the same to the District Planning and Development Boardfor integration with District Plan ;

(iii) construction, maintenance and supervision of Inter-HalqaPanchayat Communication System ;

(iv) administrative and technical guidance to Halqa Panchayatsand review of their work ;


(v) to supervise plans relating to agriculture, rural development,animal husbandry/sheep husbandry, social forestry, educationand public health ;

(vi) monitor such programs as may be notified by the Governmentfrom time to time, including MGNREGA, National RuralLivelihood Mission, Prime Minister Awas Yojna, IntegratedWatershed Management Programme, Mid-day Meal Schemeand Integrated Child Development Services ;

(vii) undertake measures for effective supervision and monitoringof various developmental programmes ; and

(viii) to carry out such other functions as may be entrusted to it bythe Government or by the District Planning and DevelopmentBoard.

(3) In order to carrying out the functions under this section, theGovernment shall provide the staff as specified in Schedule II-B tothe Block Development Council.”

18. Amendment of section 34, Act No. IX of 1989.––In section 34 ofthe ‘the principal Act’ after sub-section (2), the following sub-section shall beadded, namely :––

“(3) The Block Development Council shall have power to operatefunds, grants etc., specified in Schedule II-C in the mannerprescribed.”

19. Amendment of section 46, Act No. IX of 1989.––In section 46 of‘the principal Act’, in sub-section (1) clause (ii) shall be substituted by thefollowing clauses, namely :––

“(ii) to review periodically progress and achievements ofdevelopmental plans and schemes and make recommendationsto the Government and Halqa Panchayats as it considersappropriate.

(ii-a) to receive all Block Level Plans and Consolidated PanchayatPlans from Block Development Council; compile, consolidateand integrate all plans into the District Plan and forward to the


State Finance and Planning Department which shall form thebasis for the State Plan.”

20. Amendment of section 61, Act No. IX of 1989.––In section 61 of‘the principal Act’, for the words “fifteen years of age”, the words “eighteenyears of age”, shall be substituted.

21. Insertion of section 79-A, Act No. IX of 1989.––After section 79of ‘the principal Act’, the following section shall be inserted, namely :––

“79-A. Government’s power to specify the role ofPanchayats.––(1) The Government may, by general or special order,specify from time to time, the role of Halqa Panchayats, BlockDevelopment Council, in respect of the programmes, schemes andactivities related to the functions specified in the Schedules, in orderto ensure properly coordinated and effective implementation of suchprogrammes, schemes and activities.

(2) The Government may, by notification, in the Government Gazetteadd any activity, programme or scheme to those covered by ormentioned in Schedules. On the issue of such notification, theSchedules shall be deemed to have been amended accordingly. Everysuch notification shall be placed before each House of the StateLegislature.”

22. Insertion of Schedules I-A, I-B, I-C, II-A, II-B, II-C, Act No. IXof 1989.––After Schedule appended to the Act, the following Schedules shallbe added, namely :––

“SCHEDULE I-A

(See Section 12)

General

I. It shall be the duty of the Halqa Panchayat, to meet the requirements ofthe Halqa Panchayat area, subject to availability of funds, in respect ofthe matters enumerated in this Schedule and also as elaborated in theresponsibility mapping in respect of Halqa Panchayats.

II. Subject to the other provisions of this Act and the guidelines and withthe assistance of Government, financial, technical or otherwise, the Halqa


Panchayat shall have the power to administer the matters enumeratedin this Schedule and to prepare and implement schemes relating theretofor development and social justice purposes. Planning and implementationof all Centrally Sponsored Schemes in the Halqa Panchayat which arein operation or to be launched by the Government of India, as the casemay be shall also be the responsibility of the Panchayats.

III. Halqa Panchayat shall prepare the plans for and to implement allschemes in accordance with the provisions contained in the guidelinesof the schemes and instructions issued by the Government of India andState Government from time to time.

IV. The Halqa Panchayat shall carry out its functions in accordance withthe set of guidelines for estimation of the projects as well as expendituresanction issued by the Government.

(A) General Functions :––

(i) Preparation of annual plans for the development of thePanchayat area in general and separately under allschemes/programmes as per the targets assigned by theDistrict Planning and Development Board (DP&DB).

(ii) Preparation of annual budget.

(iii) Providing relief in natural calamities.

(iv) Removal of encroachments on public properties.

(v) Organizing voluntary labour and contribution forcommunity works.

(vi) Maintenance of essential statistics of the villages.

(vi) Identification of beneficiaries for all beneficiary orientedprogrammes/schemes.

(vii) Repair/maintenance/upkeep of all Government assets.

(viii) Supervision and inspection of all primarily level institutionslike primary schools, primary health centers, primaryveterinary centers/veterinary dispensaries, artificialsemination centres, first aid centers etc.


(ix) To act as Grievance Redressal Forum for the HalqaPanchayat.

(x) To undertake constructions from Halqa Panchayat fund(own resources) within the area of the Halqa Panchayat.

(xi) To undertake awareness generation and mobilization ofcommunity for all Government priority areas likesanitation, renewable energy, sex ratio improvement, skilldevelopment, water conservation, waste to energy,financial inclusion etc. as prescribed from time to time.

(B) Specific Functions :––

1. Agriculture, Horticulture, Animal Husbandry, SheepHusbandry and Fisheries :––

(i) Preparation of and supervision of activities undera comprehensive village Horticulture/Agriculture/Sericulture plan in consultation with Halqa Majlis(Gram Sabha) so as to increase production.

(ii) Preparation of Annual plans and identification ofbeneficiaries under ATMA, MIDH, PMGSY, BlueRevolution, PMKSY or any other scheme in forceor introduced in future and their submission toBlock Development Council.

(iii) Preparation of plans regarding development ofwaste lands and grazing lands to ensure optimumutilization of land.

(v) Preparation, recommendation and supervision ofplan for farm mechanization.

(vi) Preparation and supervision of plans for soil, waterconservation and seed protection.

(vii) Preparation of watershed management plans andtheir implementation.


(viii) Supervision of Agriculture Insurance Plans andtheir implementation.

(ix) Facilitate agriculture/horticulture extensionactivities including farm schools, exposure visits,crop protection and pest management campaigns,demonstrations etc.

(x) Supervise preparation of loss statements in theevent of disasters.

(xi) Distribution of inputs.

(xii) Promote the formation of milk/wool/poultryfarming/co-operative societies.

(xiii) Monitoring and supervision of milk collectionscenters/societies.

(xiv) Identification of sites for establishment andmanagement of public market facilities (mandies)at Halqa Panchayat for promotion of rural farmproducts, craft products and display of marketprices at such mandies.

(xv) Regulation and conduct of fairs and festivalsincluding cattle fair.

(xvi) Providing storage and cold storage facilities foragro/horticulture products.

(xvii) Facilitate farmers for direct marketing ande-Marketing of agriculture/horticulture produce.

(xviii) Preparation of plan to enhance milk/broiler/eggproduction and its by-products

(xix) Facilitate hand holding of private entrepreneurs.

(xx) Promote collaborative co-operative model fordairy farmers.


(xxi) Promote fodder development, vermi-compostingand organic farming in the area.

(xxii) Supervision of Primary Veterinary Centers,Veterinary dispensaries and first aid centers.

(xxiii) Construction and maintenance of buildings of theDepartment in the panchayat areas, wherevertransferred to the Halqa Panchayats.

(xxiv) Identification of fish farmers for training in fishculture and arranging their training with theassistance of Department of Fisheries.

2. PHE, Irrigation and Flood Control Department :––

(i) Planning, construction, renovation and maintenanceof all minor irrigation projects with 0-5 hectaresarea within the Halqa Panchayat area.

(ii) Maintenance and implementation of timely andequitable distribution and full use of water of allsuch minor or micro irrigation projects within 0-5hectares at Halqa Panchayat level.

(iii) Development of plan for and implementing groundwater recharging and rain water harvestingschemes/projects.

(iv) Mapping and management of records of all watersources within the Halqa Panchayat area.

(v) Maintenance of hand pumps through manpowerprovided by the department.

(vi) Maintenance of irrigation channels and khuls.

(vii) To take measures for prevention and control ofwater pollution.

(viii) Identification and supervision of potential/existingschemes.


(ix) Preparing a chlorination roster for all water supplyschemes/reservoirs within Halqa Panchayat areaand ensuring display of dates of chlorination.

(x) Collecting the required data/information forplanning on quality and coverage of drinking waterschemes.

(xi) Maintenance of traditional drinking water sources.

(xii) Collection of water samples from drinking watersources for testing.

(xiii) Assisting authorities to regulate over exploitationof ground water.

(xiv) Collection of user charges, where necessary.

(xv) Maintenance of piped water supply schemes tothe extent transferred to the Halqa Panchayats.

(xvi) Provision and maintenance of water purificationdevices in schools/anganwadi centers/healthinstitutions out of own resources.

3. Forest/Social Forestry :––

(i) Afforestation on waste land.

(ii) Development of social forestry and farm forestry,disposal of social forestry produce.

(iii) Growing trees for cattle feed, fire wood and fruits.

(iv) Implementation of farm forestry.

(v) Establishment of nurseries and their management.

(vi) Management of minor forest produce excludingreserved forest, protected forest and wildlifeprotected area.

(vii) Planning and implementation of social forestry andfarm forestry projects.


(viii) Planting and preservation of trees on the road sideand other public places under control of HalqaPanchayat.

(ix) Protection of forest area from encroachments andreporting of any illegal activity to the concernedofficer/official.

(x) Identification of sites for CAMPA/afforestationactivities under different schemes/plans.

(xi) Supervision/protection of wildlife.

(xii) Constitution of fire protection committees to assistForest Department in extinguishing forest fires incoordination with the local people.

4. Tourism :––

(i) Identification and proposing development of touristspots in the Halqa Panchayat area.

(ii) Facilitation of tourism activities.

(iii) Providing and maintenance of basic amenities attourist centers entrusted to Halqa Panchayat.

(iv) Collection of entry fees, parking fees other thanat places maintained by Archaeological Survey ofIndia or by other local authorities or GovernmentDepartments.

5. Public Works (R&B Department) :––

Planning and construction of works transferred to HalqaPanchayats.

6. Rural electrification, power and energy :––

(i) Installation and maintenance of street lights atpublic streets and places.

(ii) Planning, establishment, maintenance andpromotion of small conventional and


non-conventional energy units like solar, includingroof top solar panel installation, bio-gas, wind mill,micro hydro electricity plants with HalqaPanchayat funds.

(iii) Sale of excess non-conventional energy to others.

(iv) Identification of left out houses/new constructionsfor electrification.

(v) Collection of user charges on behalf of PowerDevelopment Department on an incentive basisto be decided and notified and ensuring 100%metering in its area.

7. Disaster Management :––

(i) Conducting survey to identify disaster pronelocalities.

(ii) Creation and maintenance of disastermanagement facilities.

(iii) Identification of local resources in the form ofmanpower and funds to meet the eventuality ofdisaster.

(iv) Creation of disaster management committees atvillage level; identification and registration of civildefense personnel.

(v) Identification of youth for disaster managementtraining.

(vi) Providing relief and compensation to victims ofdisasters with Halqa Panchayat’s own resourcesand as per guidelines issued by Government.

8. Libraries :––

Creation, management and monitoring of HalqaPanchayat level libraries and reading rooms includingproviding of seating facilities, books and theircomputerization through own resources.


9. Sports and Cultural Activities :––

(i) Establishment and maintenance of play fieldsinside schools and on village lands.

(ii) Protection and reviving cultural activities at HalqaPanchayat level.

(iii) Promotion of youth clubs.

(iv) Assisting poor and indigent artists.

(v) Maintenance of communal and religious harmony.

(vi) Construction and management of cultural centers,community halls, open air theatres at HalqaPanchayat and cluster level.

(viii) Organization of youth festivals/sport events, artand culture events, plays, dramas at HalqaPanchayat and cluster level.

(ix) Providing life skill education, leadership trainingand conducting recreational activities for youth.

10. Health and Family Welfare Department :––

(i) Forwarding of proposals and getting sanctionsfrom competent authority for the establishmentof dispensaries/health sub-centers at HalqaPanchayat level.

(ii) NOC for Licensing of eateries and entertainmentestablishments.

(iii) Management of stray dogs/street dogs/stray cattle;identification of sites for management of animalpounds.

(iv) Implementation of preventive and remedialmeasures against epidemics.

(v) Monitoring of maternity and child welfare centersand ensure 100% vaccination of all children andpregnant ladies.


(vi) Regulation of sale of meat, fish and otherperishable food articles.

(vii) Constitution of “H ealth and Family WelfareAdvisory Committee” consisting of Panch ofvillage/ward, opinion leaders, trained birthattendant, Male/Female Health Worker, ASHA(Member-Secretary), Government employees andhonorarium paid-staff viz. school teacher,Anganwadi worker etc., NGO/Women SHG/Community based organization representatives etc.to oversee the functioning of each healthinstitution and improvement thereof; to ensure thatthe functionaries of the sub-centres are residingat the place of posting; the committee shall bechaired by Sarpanch of the Halqa Panchayat inwhose area the institution falls; the committee shallsubmit a Quarterly Accountability Report to theBlock Development Council.

(viii) The above committee shall also function as VillageHealth Sanitation and Nutrition Committee underNHM. The funds allocated to the VHSNC underNHM shall be operated through a joint accountheld by PRI member and ASHA as provided underNHM guidelines.

(ix) Registration of all pregnant ladies with thenearest health centre through ASHA’s andensuring anti-natal and post natal care and benefitsunder Janani Suraksha Yojana, Janani ShishuSuraksha Karyakram are extended to the motherand child.

(x) Supervising and facilitating “School Health Checkup Programmes” under RBSK or any otherscheme and monitoring that all childrenrecommended for next level of care avail of thesame.

(xi) Chlorination of wells/bowlies; cleaning of roadsand drains ; sanitation and restrain of stray dogs


cattle (As per Prevention of Cruelty to AnimalsAct, 1960 with amendments thereof).

(xii) Reporting the outbreak of Gastroenteritis/malaria/dengue and/or any other epidemic/diseaseoutbreak and starting measures for containmentwith the assistance of Health Committees.

(xiii) Educating the community for adopting FamilyPlanning methods/immunization etc. and organizingcamps thereof.

(xiv) Reporting of Births and Deaths.

(xv) Identify sub-centre for upgradation to healthand wellness centers under Ayushman Bharat andmonitoring of services provided by them.

(xvi) Introduction of Participatory Rural Appraisal(PRA) for all Health Programmes and their properimplementation.

(xvii) Field visit report to be submitted to BDC onmonthly basis.

11. Social Welfare Department :––

(i) Identification of beneficiaries and implementationof the Supplementary Nutrition Programme underICDS.

(ii) Identification of sites for construction ofAnganwadi Centres.

(iii) Supervision and management of AnganwadiCentres to the extent transferred to HalqaPanchayat.

(iv) Construction/repair/renovation of buildings forAWCs to the extent transferred to HalqaPanchayat.


(v) To coordinate with Mahila Mandals in smoothfunctioning of the programme.

(vi) Identification of beneficiaries under PradhanMantri Matritva Vandana Yojna (PMMVY) andScheme for Adolescent Girls (SAG)

(vii) Identification of beneficiaries under NationalSocial Assistance Programme (NSAP) andIntegrated Social Security Scheme (ISSS);verification of existing pensioners and weeding outof dead/non-eligible cases.

(viii) To disburse all payments under NSAP and ISSS.

(ix) Identification of beneficiaries for Bal Ashrams/Nari Niketans and other childcare institutions.

(x) Identification of children in need of care andprotection under Integrated Child ProtectionScheme through child welfare committees andDistrict Child Protection units.

(xi) Coordinate with Block Development Council inexecution of schemes for the welfare of SCs/STs/OBCs/Minorities/Disabled/Old aged/Destitutes/Widows/Children.

(xii) Identify discriminatory practices against SCs/STsand report to Block Development Council/DistrictPlanning and Development Board/concernedauthorities for action.

(xiii) Identify Scheduled Caste/Scheduled Tribe bastiesand suggest measures for their socio-economicupliftment.

(xiv) Coordinate with Block Development Council andDistrict Planning and Development Board increating awareness among the people about theill effects of drug abuse/female feticide/domestic


violence and also implementation of all schemesincluding Poshan Abhiyan, Ladli Beti, One StopCentre, Beti Bachao Beti Padhao or any otherscheme introduced in future .

(xv) Coordinate with Block Development Council andDistrict Planning and Development Board increating awareness among the people about lawsenacted to prevent domestic violence againstwomen.

12. Consumer Af fairs and Public DistributionDepartment :––

i. To act as grievance redressal agency and issuedirectives to Fair Price Shops/Government SaleCentres as and when required.

ii. To identify and recommend elimination of bogusration cards and issue new ration cards.

iii. Supervise functioning of the Fair Price Shops/Government Sale Centres under the jurisdictionof the Halqa Panchayat.

iv. To assist Block Development Council in preparingplans of action to link Public Distribution Systemwith Integrated Child Development Scheme andMid-Day Meals Scheme etc.

v. Identification of beneficiaries under differentcategories on yearly basis i. e. AAY, PHH, NPHHand deletion.

vi. Recommend opening of new fare price shops/kerosene oil depots wherever required.

13. Rural Development Department :––

(a) General Functions––

1. Cleaning and preservation of public roads,drains, bathing ghats, tanks, wells, ponds andother public places.


2. Establishment and maintenance of burial andcremation grounds.

3. Lay emphasis on natural resourcemanagement works, water conservation,watershed management, vermi-compostingetc.

4. Construction and maintenance of cattle farm,community cattle sheds, pounds, village busstand, rickshaw stand, taxi, auto stand, cartstand, slaughter houses and commercialcomplexes and collection of user fee for thepurpose.

(b) MGNREGA :––

i. Preparation of labour budget, shelf of projectsand Annual Action Plan in coordination withGram Sabha through regular Gram Sabhameetings and implement MGNREGA in theHalqa Panchayat strictly as per guidelinesprescribed.

ii. Execution of works in accordance with theAnnual Action Plan/District ConvergencePlan approved by District Planning andDevelopment Board (80% of the district planto be devolved to Panchayats and 20% to theDistrict Development Commissioner for Inter-Panchayat works)

iii. Convening the Halqa Majlis (Gram Sabha) forsocial audit under the scheme and providingall information to the social audit team requiredfor audit.

iv. Receiving applications for job cards and labourdemand for work and issuing dated receiptagainst the same.


v. Issuance of job cards to the households withinone month of application.

vi. Ensuring the applicants who demand labourget work within the statutory period of 15 daysand pay unemployment allowance from ownfunds in case of failure to do so.

vii. Ensuring preparation of Muster-sheet within15 days of start of work and preparation offortnightly Muster-sheets thereafter.

viii. Ensure wage payment to wage seekers within15 days of preparation of muster-sheets andpay delay compensation from own resourcesin case of failure to do so.

ix. Organization of Gram Rozgar Diwas on 1stof every month and Mahila Mazdoor Diwason 15th of every month.

x. Provision of work site facilities like drinkingwater, first aid, childcare facilities in case of10 children or more being present on site etc.

xi. Accord administrative approval for and makepayments for the works under MGNREGAas per rules prescribed.

xii. Act as custodian of all panchayats relatedrecords and ensure maintenance ofPanchayat Asset Register, case records foreach individual work and Registers asprescribed under MGNREGA.

xiii. Maintenance of 60:40 (labour material ratio)at GP level under MGNREGA.

xiv. Awareness generation and social mobilizationunder scheme.

xv. Registration of vendors for supply of KeyMaterial viz. sand, stone, bajri at GP level.


(c) Rural Sanitation (SBM) :––

(i) Development of health and sanitation policyand its implementation.

(ii) Planning and implementation of HalqaPanchayat level sanitation programme forhouseholds, public places and all localinstitutions and collection of user charges forthe same where necessary.

(iii) Sensitization of community towardsmaintenance of sanitation/Solid, Liquid WasteManagement (SLWM)/waste to energy.

(iv) Identification of land and establishment ofSolid Liquid Waste Management Unit inconsultation with State Technical AdvisoryCommittee, District Water and SanitationCommittee and Block Level Committee.

(v) Collection, segregation and transport of solidwaste to multi village solid waste managementplants.

(vi) Construction and maintenance of individual,community toilets and bathrooms and sanitarycomplexes.

(vii) Disposal of unclaimed corpses and carcasses,regulation of curing, tanning and dyeing of skinsand hides.

(viii) Survey of quantity and type of wastegeneration and assessment of demand forestablishment of Solid Liquid WasteManagement Unit.

(ix) Sensitization and policy planning aboutmenstrual health; implementation andconstruction of pink toilets; regular refillingand operation and maintenance of vendingmachines and incinerators in pink toilets.


(d) Pradhan Mantri Awas Yojana (PMAY) :––

i. Verification of PMAY SECC lists throughHalqa Majlis (Gram Sabhas) and set prioritiesfor grant of houses.

ii. Identification and uploading of non-SECCbeneficiaries into Awaas plus software.

iii. Prepare special lists for disaster affectedfamilies within the SECC list.

iv. Identification of persons for mason trainingand ensure conduct of mason trainings as perguidelines.

v. Ensure timely sanction of houses and disbursalof installments to the beneficiaries. Allbeneficiary funds under PMAY shall bedevolved to the Halqa Panchayats.

vi. It shall be responsibility of the Panchayats toensure completion of houses within ninemonths of disbursal of first installment.

(e) IWMP :––

i. Identification of water shed areas, ponds,barren lands etc. for development underIWMP.

ii. Creation of Water Shed DevelopmentCommittees in the project area through HalqaMajlis (Gram Sabha).

iii. Identification of works to be taken up underWater Shed Project Area.

iv. Execution of works at the Panchayat levelthrough Water Shed DevelopmentCommittees.


14. Education Department :––

i. Ensure 100% enrolment of school age children inPrimary Schools and ensure transition of studentsfrom one class to another without drop-outincidence.

ii. Oversee the utilization of School MaintenanceGrant (SMG), Teaching Learning Material (TLM)and Teacher Learning Equipments (TLE) as pernorms in Primary Schools.

iii. Oversee and monitor the distribution of studymaterial, uniform and scholarships to the targetgroup students in Primary Schools.

iv. Preparation and distribution of Mid-Day Meal inPrimary Schools through local Self Help Groups(SHGs)/NGOs/Community Level Organizationsfor which the funds shall be transferred toPanchayats. The Halqa Panchayat shall alsoensure weekly quality check of the Mid-Day Mealthrough designated agencies and take immediateaction, if any, adverse reports are received.

v. Ensure regular meetings of the Village EducationCommittees and School Management Committeesat primary school level and report on theirfunctioning.

vi. Assess and plan requirement of drinking waterand toilet facilities in Primary Schools and ensureit is met.

vii. Monitor regular attendance of Primary School andMiddle School teachers, non-teaching staff andstudents and report to ZEO/CEO/DDC.

viii. Construction of Primary/Middle Schools to theextent transferred to Halqa Panchayat.


ix. Planning, establishment and management ofhostels for backward classes/groups, girls,specially abled, minority groups and orphans atPrimary School level through NGOs/SHGs/community level organizations.

15. Revenue Department :––

i. To assist the Local Administration in periodicupdating of land records relating to actual statusof village common lands, waste land, Kacharailand, water ways, roads, embankments and toassist in encroachment removal.

ii. Ensure the Patwari pastes his monthly workingchart on the notice board of Patwar Khana andPanchayat Ghars indicating the working days hewill visit the Panchayat Halqa areas.

iii. The concerned Halqa Panchayats will ensure thatall eligible Kisans are issued Kisan Pass Booksas required under the Jammu and Kashmir LandRevenue Act and that the same are updatedregularly by the concerned Revenue FieldFunctionaries.

iv. To act as a grievance redressal mechanism in caseof any difficulty being faced by the land ownersin getting the extracts of Revenue Records andrefer the matter to the concerned Tehsildar/Sub-Divisional Magistrate/District Collectordirecting the concerned Patwari to the issue theRevenue Records through, Panchayat, as earlyas practicable.

v. Providing necessary assistance to theAdministration in providing relief to the effectedfamilies/persons in case of disaster.

vi. To report regarding wrong entries in revenuerecords, malpractices, tampering of records land


conversion to the Tehsildar/SDM/DistrictCollector or higher authorities as the casemay be.

vii. Assisting the local administration and revenuefunctionaries in periodic updating of land recordsviz-a-viz changes in the situation on groundthrough the conduct of the annual girdawari,preparation of jamabandi and all other revenuedocuments.

viii. Identification of landless families for allotment ofland under any prevalent scheme.

16. Issue of certificates :––

i. Issue of NOCs for Geology and MiningDepartment activities, Electrification, biodiversity,land conversion, Licenses for Home stay, resorts,bar and restaurants, hotels, liquor shops, Burial/cremation grounds, crematoriums, slaughterhouses etc.

ii. Issuance of birth, death, Character, dependent,marriage certificates and ration cards inaccordance with procedure as notified by theGovernment from time to time.

17. Statistics and Planning :––

(i) Collection, tabulation, updating of all statisticsrelating to the village.

(ii) Setting up of teams/committees for preparationof perspective plans and Annual Plans inaccordance with statistics collected.

18. Co-operation :––

Preparation and implementation of programmes topopularize and strengthen co-operative activities.


19. Rural Environment and Ecology :––

(i) Planning and implementation for protection andpreservation of rural environment and ecology inconformity with National and State policy.

(ii) Establishment of GP biodiversity managementcommittee.

(iii) Preparation of Peoples’ Biodiversity Register.

(iv) Preparation and implementation of plans andprogrammes for the Biodiversity Act, 2002.

(v) Protection of ecologically sensitive areas.

(vi) Preparation and implementation of plans for theprotection of environment.

(vii) Maintenance of parks, regulation of manure pitsin public places.

20. Knowledge Management :––

(i) Collection and compilation of household data andmaintaining database.

(ii) Recording of the history, culture, heritage of thevillage.

(iii) Conducting surveys and studies to determine thehuman development of the village.

(iv) Periodical calculation of human developmentindex.

(v) Making available all data to the people of HalqaPanchayat.

(vi) Awareness generation and Information, Educationand Communication activities for all Governmentschemes.


21. Community Asset Management :––

(i) Protection, conservation and management ofcommunity assets within the Halqa Panchayatarea, their mapping, measurement, comprehensivedocumentation and maintenance.

(ii) Systematic documentation and protection ofrecords of all assets such as ponds, water grooves,canals, agriculture pits, wells, bore-wells and otherwells, pastures, forests, plantations etc.

SCHEDULE 1-B

(See Section 26)

1. As per the provisions of this Act, Halqa Panchayat shall have the powersto carry out various duties/functions for the Socio EconomicDevelopment and Social Justice of the area. For this Halqa Panchayatrequires staff for providing necessary help and guidance in carrying outthe duties imposed on it by this Act.

2. Every Halqa Panchayat shall have a Member-Secretary who shall bean employee of Rural Development and Panchayati Raj Department(to be specified by the Department).

3. The employees of the departments contained in the Schedule I-Aassociated with the implementation of the various schemes at HalqaPanchayat level shall be the staff of Halqa Panchayat for helping themin carrying out various functions as per the Schedule I-A which shallinclude Junior Agriculture Extension Officer/Rehbar-e-Zerat, VeterinaryPharmacist/Stock Assistant, Flock Supervisor, Stock Assistant, ExtensionOfficer (Fisheries), Teacher/RETs, Horticulture Technician, JuniorEngineers/Supervisors of Engineering Departments and Pharmacistsin Sub Centre/Dispensaries, Asha Worker, ANM and FMPHW.

4. The dedicated staff engaged for the subject contained in the ScheduleI-A under Centrally and State Sponsored Schemes shall also be thestaff of Halqa Panchayat :

Provided that the pay, dues and other allowances of the permanentstaff shall be drawn and disbursed by the respective department as perthe procedure in vogue. The Honorarium of the dedicated staff shallbe drawn and disbursed by the departments as per the procedure laiddown in the guidelines by the respective departments :

Provided that the salary/honorarium (as applicable) of Village LevelWorker, Auxiliary Nurse Midwife (ANM), Female Multipurpose HealthWorker (FMPHW) Accountant-cum-Data Entry Operator, AganwadiWorker/Helper, Asha Worker, shall be drawn by the Halqa Panchayatas per the prescribed procedure.

5. Halqa Panchayats may engage staff at its level only after formal sanctionfrom the Government for such engagement.

SCHEDULE I-C

(See Section 14)

1. Every Halqa Panchayat shall have a fund, to be called, the HalqaPanchayat Fund which shall be operated by the Secretary Panchayatand Sarpanch as per the procedure to be notified by the Department ofRural Development and Panchayati Raj.

2. As per the provisions of this Act, Rules thereunder and Governmentdirections issued from time to time, the Halqa Panchayat shall have thepower to operate the fund strictly as per procedure to be notified by theGovernment which shall include :––

i. Funds related to the subjects contained in the Schedule I-A,including funds under Centrally Sponsored Flagship Schemes astransferred to the Halqa Panchayats by respective AdministrativeDepartments.

ii. Grants of State and Central Finance Commission.

iii. Outlays transferred to the Halqa Panchayat by the Governmentfrom time to time.

iv. Untied grants made available to the Halqa Panchayat by theGovernment to meet out the exigency of development works ofPanchayat Halqas.

v. Own resources generated through building permission fee, annualcharges and fee levied under section 15, fee for the certificatesissued, user charges collected, incentives and other sources.

vi. The salary/honorarium as applicable of Village Level Worker,Auxiliary Nurse Midwife (ANM), Female Multipurpose HealthWorker (FMPHW), Accountant-cum-Data Entry Operator,Aganwadi Worker/Helper and Asha Worker.

vii. 80% funds under Annual Action Plan for MGNREGA .

viii. 100% funds under PMAY (construction component only),IWMP (works component only), Mid-day Meal, ICDS (Nutritioncomponent only), NSAP and ISSS.


3. The Halqa Panchayats shall strictly follow the financial rules/instructionsguidelines issued by the Central and State Government while utilizingthe funds under different programmes.

4. Halqa Panchayats shall prepare a statement of annual accounts to beaudited in the prescribed manner.

5. The guidelines prescribed by the Central or State Government shall bestrictly adhered to while incurring expenditure on a scheme funded byCentral Government or State Government as the case may be.

I It shall be the duty of the Block Development Council to meet therequirements of area in respect of the matters contained in thisSchedule II-A and also prepare plan of activity in respect of inter HalqaPanchayat areas/matters subject to the availability of funds under thevarious schemes.

II Subject to the other provisions of this Act and directions/guidelinesissued by the Government from time to time, the Block DevelopmentCouncil shall administer the matters contained in this Schedule II-A andprepare plans and implement the schemes on the subjects specifiedherein for the economic development and social justice purpose.

III The Block Development Council shall perform its functions strictly asper the guidelines for estimation of the projects as well as expendituresanction issued by the Government.

(A) General Functions :––

i. Preparation of annual plans in respect of the schemesentrusted to it by virtue of the Act and those assigned toit by the Government/District Planning and DevelopmentBoard and their submission to the District Planning andDevelopment Board within a prescribed time forintegration with district plan.

ii. Consideration and consolidation of the Annual Plans ofall the Halqa Panchayats in the Block and submission ofthe consolidated plans to District Planning andDevelopment Board within a prescribed time forintegration with district Plans.

iii. Preparation of the Annual Budget of the BlockDevelopment Council and it submission to DistrictPlanning and DevelopmentBoard.

iv. Assisting the administration in distribution of relief andcompensation during the natural clamities/disaster.


v. Performing such functions and executing such works asmay be entrusted to it by the Government or the DistrictPlanning and Development Board.

vi. Construction and upkeep of block level Governmentfacilities as transferred.

(B) Specific Functions :––

1. Agriculture, Animal, Sheep, Fisheries and HorticultureDepartment :––

i. Prepare agriculture plan in consultation with thefield functionaries of the Agriculture ProductionDepartment, at Block level for submission tothe ‘District Planning and Development Board’for approval.

ii. Consolidate demand received from HalqaPanchayats and submit to the District Planningand Development Board.

iii. Monitoring of agriculture extension activities.

iv. Monitoring of ongoing schemes under technicalguidance of departmental staff.

v. To ensure close surveillance of spread of diseasesand timely liaison with the District Planning andDevelopment Board/State Headquarter for controlmeasures.

vi. Facilitating and supervising general and technicaltraining at the Gram Panchayat level forpreparation of comprehensive agricultural andhorticultural plans.

vii. Maintenance of agriculture seed farms includingHorticulture Nurseries.

viii. Conducting exhibitions of vegetable, fruits andother crops through Kisan Melas.


ix. Providing technical support to GPs throughtechnical personnel and trainings to increase theincome of improved methods of cultivation andtraining of farmers.

x. Consolidation of data collected by GramPanchayats and preparation of block level plansfor agriculture/horticulture production.

xi. Monitoring the distribution of insecticides,pesticides and other inputs.

xii. Coordination in respect of policy planning ofanimal/sheep husbandry programmes at blocklevel.

xiii. To recommend holding of animal sterility/healthcamps.

xiv. To conduct exhibitions, livestock shows, animalfairs, milk yield competitions and calf rallies.

xv. Providing vaccines, medicines, medical aid toGram Panchayat to take preventive measures tocontrol epidemics and contagious diseases inanimals.

xvi. Recommend measures for improvement of breedof Cattle, Poultry and other livestock.

xvii. Encourage promotion of co-operative societies foractivities of Animal Husbandry, Dairies, Fisheries,marketing of agricultural/horticulture produce etc.

xviii. Collection of demand and distribution of seedlingsto the fish farmers through Halqa Panchayats withtechnical support of officials of the FisheriesDepartment.

xix. Monitoring and reviewing of all functions andactivities entrusted to Halqa Panchayats.


xx. Coordinating with the Agriculture/HorticultureDepartment in assessing the demand andorganizing inputs, wherever made available by thedepartment.

xxi. Coordinating with the Agriculture/HorticultureDepartment in organizing farmers training camps,study tour, seminars etc.

xxii. Organizing of demonstrations on improved varietiesand technology through the Departments.

xxiii. Ensuring conduct of village-wise horticultural/agriculture/animal/sheep census.

xxiv. Preparation of Action Plan for each interpanchayat water-shed through the concerneddepartment.

2. Consumer Af fairs and Public DistributionDepartment :––

(i) Monitoring of the public distribution systemincluding movement and availability of commodities

(ii) To take steps for identification and elimination ofbogus ration cards.

(iii) To coordinate in the establishment of linkage ofPublic Distribution System Schemes with otherwelfare schemes.

(iv) To send periodical reports and returns about PublicDistribution System to the District Planning andDevelopment Board Distribution.

(v) Disseminate information and create awarenessabout Consumer Protection and WelfareSchemes.

3. Education Department :––

i. To assess the drop-out position and initiateappropriate action to reduce it.


ii. Oversee the utilization of School MaintenanceGrants (SMG), Teaching Learning Material(TLM) and Teaching Learning Equipments (TLE)as per norms in Middle Schools.

iii. Assist in identification and enrolment of studentsfor Government Middle Schools.

iv. Oversee distribution of study material, uniformsand scholarship to the target group students inMiddle Schools.

v. Preparation and distribution of Mid-day Meal inMiddle Schools through local SHGS/NGOs/Community Level Committees for which the fundsshall be transferred to Block Development Council.Block Development Council shall also ensureweekly quality checks of the Mid-day Mealsthrough designated agencies and take immediateaction, if any, adverse reports are received.

vi. Oversee and report on the functioning ofVillage Education Committee (VECs)/SchoolManagement Committees (SMCs) at MiddleSchool level.

vii. Assess and plan requirement of drinking waterand toilet facilities in Middle Schools and ensurethat it is met.

viii. Promotion of adult literacy and planning andmonitoring both conventional and non-conventionaleducation at block level.

ix. Coordinating Centrally and State SponsoredPrograms relating to Education.

x. Construction and maintenance of Middle SchoolBuildings as transferred by the Government.

xi. Promotion of social education through youth clubsand Mahila Mandals.


xii. Planning, establishment, management of hostelsat middle school level for backward class andgroups, girls, specially abled, minority groups andorphans.

4. Forest Department :––

(i) Preparation of action plans for afforestration inrespect of lands identified by the HalqaPanchayats in consultation with concerned RangeOfficers. This will also include nursery raising.

(ii) Monitor execution of micro plans through HalqaPanchayat as per approved physical and financialtargets.

(iii) Submission of periodical consolidated accounts andreports to District Planning and DevelopmentBoard.

(iv) Monitor cases of over exploitation and submitrecommendations to Forest Department for itsregulation.

(v) Supervision of soil conservation works of ForestDepartment.

(vi) Supervision of afforestation, plantation and nurseryworks within their area.

(vii) Supervise the protection of wildlife and assistWildlife Department in addressing Man-Animalconflict.

(viii) Produce and distribute saplings and seedlings toGram Panchayat when required from Block LevelNurseries for promotion of farm forestry.

(ix) Conducting trainings, workshops for providingtechnical knowledge to Gram Panchayat in thefield of fodder development and fuel plantation.


(x) Planting and maintenance of trees on the sides ofroads and other public lands under its control.

5. Health and Family Welfare Department :––

(i) Constitution of Health and Family WelfareAdvisory Committees for Community HealthCenters.

(ii) To create awareness among the masses about theNational Health Programmes by way of organizinghealth and family camps, exhibitions and Melas.

(iii) Construction and maintenance of CommunityHealth Centers, staff quarters and other healthfacilitates as transferred by the Government.

(iv) To take all effective measures with the assistanceof health functionaries to control epidemics in theBlock Development Council areas.

(v) Promotion of immunization and vaccinationprogrammes and ensure 100% children andpregnant woman are immunized.

(vi) Establishment of a system/mechanism forcontinuous support to Gram Panchayat to managehealth services and sanitation programmes.

(vii) Setting up and managing facilities and centers forspecially abled and mentally challenged people.

(viii) Planning and implementation of family welfareprogrammes at Block Development Council level.

(ix) Ensuring all constructions/offices/procedureswithin the block are specially-abled friendly.

6. Industries and Commerce Department :––

(i) Assistance in the recovery of loans by Banks/Government Institutions/Departments.


(ii) Provide information with regard to availability ofskills in the area and future demand.

(iii) Identify the locations and target groups in theirrespective area of operation where there is apotential of conducting Industrial AwarenessProgrammes/Entrepreneurship DevelopmentProgrammes/awareness camps for artisans,weavers, craft persons etc.

(iv) Assist in the identification of beneficiaries underPMEGP/JKEGP.

(v) Identify land for establishing Industrial Areas/Estates within their jurisdiction and submit theproposal to District Planning and DevelopmentBoard for consideration.

(vi) Organization of conferences, seminars, trainingprogrammes agricultural and industrial exhibitions.

(vii) Establishment of mini industrial estates.

(viii) Formation and implementation of self employmentschemes.

(ix) Creation of input services and common facilitycentres for Gram Panchayat Clusters or for groupof Gram Panchayats.

(x) Providing financial support to cluster level commonfacility centers.

7. Public Works (R&B) Department :––

(i) Monitoring of constructions by Halqa Panchayatsand other agencies.

(ii) Identification of inter-panchayat link roads andtheir inclusion in the Block Development CouncilPlan.


(iii) Maintenance of such rural roads which may betransferred by Public Works Department to BlockDevelopment Council.

(iv) To keep vigil and bring to the notice of appropriateauthority of the Public Works Department thecases of gross mis-utilization of funds, corruptpractices etc. by the staff of department,contractors and sub-contractors while executingvarious schemes and the encroachments on theroads/other structures.

(v) Maintenance of any building or other propertyvested in Block Development Council.

(vi) Identify black spots (frequent accident sites) andrecommend remedial measures to DistrictPlanning and Development Board.

8. Public Health Engineering and Irrigation and FloodControl Department :––

(i) Identification of potential schemes including waterharvesting covering more than one HalqaPanchayat within the jurisdiction of BlockDevelopment Council.

(ii) To take measures for prevention and control ofwater pollution.

(iii) To keep vigil and bring to the notice of appropriateauthority of all Departments the cases of grossmis-utilization of funds, corrupt practices etc. bythe staff of the Departments, contractors and sub-Contractors while executing various schemes.

(iv) Prevention and control of water pollution.

(v) Implementation of community and individualirrigation works.


9. Revenue Department :––

(i) To help revenue officials in identification oflandless/houseless families/persons for formulationof a policy regarding utilization of waste/vacantState land, identification thereof, which is howevernot required for any other public purpose at blocklevel.

(ii) Supervise the work entrusted in revenue mattersto Panchayats and formulation of policy at theblock level for removal of encroachments on State/Kahcharai/Water bodies/common land.

(iii) Assistance to the legal machinery in conduct oflegal proceedings (e. g. publication of notices inthe entire area, identification of vacant State landin different Halqa Panchayats areas etc.)

(iv) To report regarding wrong entries in revenuerecord, malpractices, tampering of records, landconversion to the Tehsildar/SDM/DeputyCommissioner or higher authorities as the casemay be.

(v) Assisting the local administration and revenuefunctionaries in periodic updating of land recordsviz-a-viz changes in the situation on groundthrough the conduct of the annual girdawari,preparation of jamabandi and all other revenuedocuments.

10. Social Welfare Department :––

(i) Guide and assist the staff of the departments inimplementing the various schemes in the BlockDevelopment Council area as per the guidelinesof the schemes.

(ii) Assist in providing logistic support to facilitatesmooth implementation of the programmes.


(iii) Coordinate with District Planning andDevelopment Board and Panchayats inimplementation of schemes for the welfare ofDisabled/Old-Aged/Destitutes/Widows/Children/Minorities/SCs/STs/OBCs.

(iv) Coordinate with District Planning andDevelopment Board in creating awareness amongthe people against social evils of drug abuse, femalefeticide, domestic violence and also inimplementation of all schemes like Beti BachaoBeti Padhao/Ladli Beti, One Stop Centre,PMMVY etc.

(v) Organize camps for creating awareness amongthe women about the laws enacted to preventdomestic violence against women and promotion,implementation and monitoring of programmes inrelation to development and empowerment ofwomen and children at block level.

(vi) Planning and management of hostels for scheduledcastes, scheduled tribes and backwardcommunities, Bal Ashrams, Blind homes, NariNiketan, One stop homes, juvenile justice homesand other such social justice institutions throughSHGs/NGOs/Community Level Organizations.

(vii) To prevent, through awareness campaigns, social,cultural practices against Scheduled Tribes andScheduled Castes and backward communitieswhich undermine freedom and dignity of individualand community.

(viii) Monitoring old-age, widow pension and pensionfor handicapped/disabled and scholarships by theHalqa Panchayats.

11. Tourism Department :––

(i) Identification and proposing development in interHalqa Panchayats tourist spots in BlockDevelopment Council area.


(ii) Promotion of tourism activities in BlockDevelopment Council.

(iii) Providing basic amenities at tourist centers underthe jurisdiction of Block Development Council.

(iv) Development and maintenance of tourist attractiondestinations under the ambit of BlockDevelopment Council to the extent of transferredto Block Development Council.

12. Disaster Management :––

(i) Creation and maintenance of disastermanagement facilities at Block DevelopmentCouncil level.

(ii) Creation of disaster management committees atblock level and identification, registration of civildefence committees.

(iii) Identification of youth for disaster managementtraining at block level.

(iv) Assisting district administration and HalqaPanchayat in providing relief and compensationto the victims of disasters.

(v) Conduct of mitigation programmes with regard todisasters.

13. Libraries :––

(i) Creation, management and monitoring of librariesand reading rooms including providing of seatingfacilities, books etc. at block level.

14. Sports and Cultural activities :––

(i) Organization of art and culture programmes atinter-panchayat level.

(ii) Promotion of youth clubs at block level.


(iii) Maintenance of communal and religious harmony.

(iv) Construction and management of cultural centres,community halls and open air theatres at blocklevel for organizing different inter-panchayatfunctions.

(v) Organization of youth festivals/other events atinter-panchayat level.

(vi) Providing of life skill education, leadership trainingand conducting recreational activities for youth atinter-panchayat level.

15. Rural Development Department :––

(i) Consolidation of Annual Action Plans of HalqaPanchayat under different schemes to the extenttransferred as per the Schedule I-A and monitor/supervise the implementation of variousprogrammes at the Halqa Panchayat level.

(ii) Preparing and implementing of Inter-PanchayatPlans under different schemes to theextent transferred by the Government as perSchedule II-A.

(iii) Monitor the distribution of job cards to the eligiblehouseholds under MGNREGA.

(iv) Monitoring and evaluation of all poverty alleviationprogrammes and coverage of women SC, ST andother beneficiaries through different programmes.

(v) Organizing the auction of the produce from thecommunity assets to the extent powers transferredby the Government as per the rules madethereunder.

(vi) Development and maintenance places for fairs/mandies/other events.


(vii) Supervision and monitoring of rural sanitationprogrammes and its execution by the HalqaPanchayats.

(viii) Prevention of misuse of community assets of theBlock Development Council.

(ix) Organize training and awareness camps fordifferent schemes and programmes.

(x) Monitor the use of community assets created undervarious Rural Development Schemes.

(xi) Establishment and maintenance of solid and liquidwaste management projects.

(xii) Provide technical support to the Gram Panchayat.

16. Other functions :––

(i) Facilitate promotion of block level co-operativesocieties .

(ii) Providing technical support to Gram Panchayatsfor the protection of environment and ecology.

(iii) Collection and compilation of block data andmaintaining data base.

(iv) Recording of the history, culture, heritage of theblock.

(v) Conducting surveys and studies to determine thehuman development of the block.

(vi) Periodical calculation of human developmentindex.

(vii) Making available all data to the people.

(viii) Awareness generation and information, educationand communication activities for all Governmentschemes.


(ix) Maintaining all community assets vested in theblock as are transferred by the Government orany local authority or organization.

(x) Preservation and maintenance of communityassets.

SCHEDULE II-B

(See Section 31)

1. As per the provisions of this Act Block Development Council shall havethe powers to carry out various duties/functions for the Socio EconomicDevelopment and Social Justice of the area. For this Block DevelopmentCouncil requires staff for providing necessary help and guidance incarrying out the duties imposed on it by this Act.

2. Every Block Development Council shall have a Member-Secretary whoshall be the Block Development Officer of Rural Development andPanchayati Raj Department as contained in sub-section (3) of section28. The office of the Block Development Officer shall function as BlockDevelopment Council Secretariat.

3. The Block Level Officers of the departments contained in the ScheduleII-A associated with the implementation of the various schemes at blocklevel and providing technical guidance to the Halqa Panchayat forcarrying out various duties shall be the staff of Block DevelopmentCouncil for helping them in carrying out various functions as per theSchedule II-A including and not limited to Sub-Divisional AgricultureOfficer, Live Stock Development Officer, Sheep Development Officer,Block Veterinary Officer, Tehsil Supply Officer, Inspector LegalMeteorology, Zonal Education Officer, Zonal Planning Officer, HeadMasters/Mistresses of Middle Schools, Field Supervisor of FisheriesDepartment, Range Officer, Horticulture Development Officer, BlockMedical Officer, ANM/Medical Superintendent/Female and MaleMultipurpose workers of CHCs, Assistant Handicraft Training Officerand Instructor of Industries and Commerce Department, AssistantExecutive Engineers/Assistant Engineers of all EngineeringDepartments.

4. Dedicated staff engaged for the subject contained in the Schedule II-Aunder Centrally and State Sponsored Schemes functioning at block levelshall also be the staff of Block Development Council :

Provided that the pay, dues and other allowances, of the permanentstaff shall be drawn and disbursed by the respective department as perthe procedure in vogue. The honorarium of the dedicated staff shall


be drawn and disbursed by the departments as per the procedure laiddown in the guidelines by the respective departments.

5. Block Development Council may engage staff at its level only afterformal sanction from the Government for such engagement.

SCHEDULE II-C

(See Section 34)

1. Every Block Development Council shall have a ‘Block DevelopmentCouncil Fund’ which shall be operated by the Secretary BlockDevelopment Council (Block Development Officer) and Chairpersonof the Block Development Council as per the procedure to be notifiedby the Government.

2. As per the provisions of this Act the Block Development Council shallhave the power to operate upon the “Block Development Council Fund”comprising of grants made by the Government under different schemeskeeping in view the number of Halqa Panchayats in the Block and thefunds assigned by the Government or the District Planning andDevelopment Board.

3. The funds related to the subjects contained in the Schedule II-A includingfunds under Centrally Sponsored Flagship Schemes transferred to theBlock Development Council by respective Administrative Departmentsas per the procedure to be notified by the Government excluding fundstransferred to Halqa Panchayats. The Block Development Council shallfollow the financial rules/instructions/guidelines issued by the Centraland State Government while utilizing the funds under differentprogrammes.

4. Block Development Councils shall prepare a statement of annualaccounts to be audited in the prescribed manner.

5. The guidelines prescribed by the Central or State Government shall bestrictly adhered to while incurring expenditure on a scheme funded byCentral Government or State Government as the case may be.”

Whereas, the objections/suggestions and recommendations wereexamined and disposed of in light of provisions of J&K Panchayati RajAct, 1989 and Rules.

Now, therefore, in exercise of powers conferred under sub-section(3) of section 4 of Jammu and Kashmir Panchayati Raj Act, 1989 amendedup to 2018 and sub-rule (1-A) of rule 4 of Panchayati Raj Rules, 1996amended up to September, 2018 and as per SRO–181 dated 18th June,2004, I, Director, Rural Development, Kashmir hereby reserve and allotSarpanch Seats for SC/ST/Women & ST in each Halqa Panchayat of DistrictAnantnag, Bandipora, Baramulla, Budgam, Ganderbal, Kargil, KulgamKupwara, Leh, Pulwama, Shopain and Srinagar as per the details given inthe enclosed statement forming Annexure to this notification. Whereas, the objections/suggestions and recommendations wereexamined and disposed of in light of provisions of J&K Panchayati RajAct, 1989 and Rules.

Now, therefore, in exercise of powers conferred under sub-section(3) of section 4 of Jammu and Kashmir Panchayati Raj Act, 1989 amendedup to 2018 and sub-rule (1-A) of rule 4 of Panchayati Raj Rules, 1996amended up to September, 2018 and as per SRO–181 dated 18th June,2004, I, Director, Rural Development, Kashmir hereby reserve and allotSarpanch Seats for SC/ST/Women & ST in each Halqa Panchayat of DistrictAnantnag, Bandipora, Baramulla, Budgam, Ganderbal, Kargil, KulgamKupwara, Leh, Pulwama, Shopain and Srinagar as per the details given inthe enclosed statement forming Annexure to this notification. To this office Notification No. 324-DRDK of 2017dated 01.03.2017 issued under endorsement No. DRDK/Pyt/35576-35723 dated 01.03.2017 and Notification No. 02-DRDK of 2018dated 10.01.2018 issued under endorsement No. DRDK/Pyt/Res/Women/29957-30153 dated 10.01.2018.

1. Whereas, the Director, Rural Development, Kashmir is prescribedauthority for reservation and allotment of Sarpanch andPanch Seats for SC/ST/Women & ST as per sub-section (3) of

section 4 of Jammu and Kashmir Panchayati Raj Act, 1989amended up to 2018 and Sub-Rule (1-A) of Rule 4 of PanchayatiRaj Rules, 1996 amended up to September, 2018.

2. Whereas, this office has furnished some new proposals ofPanchayats/Wards received from concerned Districts to ChiefElectoral Officer, J&K, Srinagar vide this office letter No. DRDK/Pyt-Elec/19899-19910 dated 01.08.2018 for necessary notificationin this behalf.

3. Whereas, the General Administration Department has formed acommittee for analysis/scrutiny of new proposals regardingexamining of issues of Rural Development/Urban Developmentareas for notification/de-notification and re-notification, videGovernment Order No. 1210-GAD of 2018 dated 31.07.2018.

4. Whereas, the Administrative Department vide letter No. RD/Panch/41/2018 dated 1l.08.2018 and letter No. RD/Panch/41/2018 dated 20.08.2018, has furnished the new proposals to theChief Electoral Officer, J&K, Srinagar for issuance of necessarynotification/de-notification and re-notification, in pursuance of theapproval given by the standing committee in this behalf.

5. Whereas. the Chief Electoral Officer, J&K, Srinagar has issuednotification under endorsement No. 5402/Pyt/CEO/2018/2151dated 24.09.2018 and Director, Rural Development, Kashmir’sNotification No. 02-DRDK of 2018 dated 14.08.2018 issuedunder endorsement No. DRDK/Pyt/Elec/Gnl/23562-70dated 14.08.2018 and Notification No. 03-DRDK of 2018dated 24.08.2018 issued under endorsement No. DRDK/Pyt/Elec/Gnl/25248-55 dated 24.08.2018 regarding new proposals ofPanchayats/Wards for notification/de-notification andre-notification of areas falling under the jurisdiction of RuralDevelopment Department.

6. Whereas, the Government has issued SRO vide No. 334dated 03.08.2018, regarding rationalization of Panchayat Halqa,Vijpara fr om CD-Block Naidkhai to CD-Block Hajin andas such Panchayat Halqa, Vijpara has been excluded fromCD-Block Naidkhai and included in CD-Block Hajin,District Bandipora.

7. Whereas, the District Panchayat Officers, Anantnag/Kulgam andKupwara reported to this office for issuance of corrigendum inGazette Notification dated 23.12.2017 in Panchayat Halqa,Kreeri (Block Shangus)/Panchayat Halqa, Nagam 1-A(Block D. K. Marg)/Panchayat Halqa, Cherkoote (BlockRamhal) and Panchayat Halqa, Mudiyan (Block Keran).The District Panchayat Officer, Kupwara has also reportedthat one Panch Constituency namely “PC-VII Yahama B”in Panchayat Halqa, Yahama B (Block Mawar Qalamabad)is missing in the Gazette Notification dated 23.12.2017 andas such may be incorporated in the Gazette Notificationdated 23.12.2017. Besides the District Panchayat Officer,Kupwara vide his letter No. DPO (K)/927-28 dated 28.09.2018communicated to this office that the Constituency No. PC-IXGogal “B” in Panchayat Halqa, Gogal “B” (Block Wavoora)may be unreserved from ST category to General as only 18 soulsare existing in the said Panchayat Halqa as per Census-2011 andas such necessary corrigendum to the earlier notification may beissued in light of the public representation received in this behalf.

8. Whereas, the issues needs rectification in the Gazette Notificationdated 23.12.2017 was examined and putforth by this office, beforeChief Electoral Officer, J&K, Srinagar for issuance of necessarycorrigendum in this behalf.

9. Whereas, the Chief Electoral Officer, J&K, Srinagarapproved the above rectifications in the Gazette Notificationdated 23.12.2017 and issued formal corrigendum vide notificationissued under endorsement No. 5402/CEO/LS/Pyt/2018/71dated 10.10.2018.

10. Whereas, the District Panchayat Officer, Bandipora vide his letterNo. DPO/Bdpr/Camp Bandipora dated 03.10.2018 reported thatthe revised Panch reservation for SC/ST/Women & ST in respectof Block Arin and Bonkoot may kindly be considered andnecessary corrigendum may be issued in this behalf. The DistrictPanchayat Officer, Bandipora has further reported thatthe population figures communicated earlier were reflectedvice-versa in population file, which now have been rectified as

per Census-2011 population figures in proper columns and as perletter No. DPO/Bdpr/2018-19/1503 dated 15.10.2018 in respectof Panchayat Halqa, Ongam B of Block Bandipora/PanchayatHalqa, Neeru and Zadigay A of Block Tulail, the DistrictPanchayat Officer, Bandipora reported that the Panchreservation were wrongly reflected in I, IV & VII wards insteadof II, V & VIII, the same have been corrected and recommendedfor issuance of corrigendum.

11. Whereas. the District Panchayat Officer, Anantnag vide his letterNo. DPOA/Pyt Elec/2018-19/2464 dated 15.10.2018 reportedthat the revised Panch reservation for SC/ST/Women & ST inrespect of Block Breng, Hiller and Qazigund may kindly beconsidered and necessary corrigendum may be issued in thisbehalf. The District Panchayat Officer, Anantnag has furtherreported that the population figures communicated earlier werereflected vice-versa in population file in respect of PanchayatHalqa, Nussu of Block Qazigund, which now have been rectifiedas per Census-20l1 population figures in proper columns and inrespect of Panchayat Halqa, Sundbrari B of Block Breng andPanchayat Halqa, Manzmoh of Block Hiller , the DistrictPanchayat Officer, Anantnag reported that the Panch reservationwere wrongly reflected in I, IV & VII wards instead of II, V &VIII, the same have been corrected and recommended forissuance of corrigendum.

12. Whereas, the Government had de-notified Ward No. VIII ofPanchayat Halqa, Shankerpora Block B. K. Pora, DistrictBudgam vide SRO-383 dated 07.09.2018 and as such the revisedreservation for SC/ST/Women & ST (Panch) of PanchayatHalqa, Shankerpora Block B. K. Pora is issued accordingly.The District Panchayat Officer, Budgam reported vide his letterNo. DPO/Budgam/res/pc dated 14.10.2018 that the Panchreservation for SC/ST/Women & ST in respect of PanchayatHalqa, Nagbal Block Khag, District Budgam has not beenreserved till date and recommended for reservation of PanchWard No. II, V & VIII as General Women and the DistrictPanchayat Officer, Budgam further recommended to incorporatethe panch reservation of said Panchayat Halqa in the GovernmentGazette.

THE LADAKH AUTONOMOUS HILL DEVELOPMENTCOUNCIL (AMENDMENT) ACT, 2018.

(Governor Act No. XIX of 2018)

[6th October, 2018.]

Enacted by the Governor in the Sixty-ninth Year of the Republic ofIndia.


An Act to amend the Ladakh Autonomous Hill Development CouncilAct, 1997.

In exercise of the powers vested under Proclamation No. P-1/18 of2018 dated 20th June, 2018, the Governor is pleased to enact as follows :—

1. Short title and commencement.—(1) This Act may be called theLadakh Autonomous Hill Development Council (Amendment) Act, 2018.

(2) It shall come into force from the date of its publication in theGovernment Gazette.

2. Amendment in Section 2, Act No. XXXII of 1997.— In section 2 ofthe Ladakh Autonomous Hill Development Council Act, 1997 (hereinafterreferred to as ‘the principal Act’) after clause (f), following clause shall beinserted, namely :—

“(ff) “Deputy Chairman” means the Deputy Chairman of theCouncil.”

3. Amendment in section 9, Act No. XXXII of 1997.—In section 9of ‘the principal Act’, in proviso thereto for the words “as soon as maybe” the words “ordinarily within three months and for reasons to be recordedin writing not later than six months” shall be substituted.

4. Amendment in section 15, Act No. XXXII of 1997.— In section 15of ‘the principal Act’, after sub-section (2), the following sub-section shall beadded, namely :—

“(3) If for a period of six successive months a member of the Councilis, without the permission of the Council, absent from all the meetingsthereof, the Election Authority may declare his seat vacant :

Provided that in computing of said period of six months noaccount shall be taken of such absence caused by reasons beyondhis control.”

5. Amendment in section 23, Act No. XXXII of 1997.––In section 23of ‘the principal Act’,––

I. the words, “and any general or special direction by theGovernment” shall be omitted.


II. for clause (xii), the following clause shall be substituted,namely :––

“(xii) water supplies, irrigation and canals, drainage andembankment, water storage, flood control, protection of waterbodies and use of water canals or water courses for purposeof agriculture.”

III. for clause (xiv), the following clause shall be substituted,namely :––

“(xiv) public health and sanitation, health services, hospitals,dispensaries and family welfare.”

IV. for clause (xv), the following shall be substituted, namely :––

“tourism and tourism development authorities”

V. in clause (xxvi) for the words, “cottage industries” the words“cottage industries, handicrafts and handlooms” shall besubstituted.

VI. after clause (xxvii), the following new clauses shall be inserted,namely :––

“(xxvii-a) science and technology ;

(xxvii-b) promotion and development of traditional AmchiSystem of Medicine ;

(xxvii-c) food, civil supplies and public distribution ;

(xxvii-d) rural development ; and

(xxvii-e) power development ;”

6. Amendment in section 24, Act No. XXXII of 1997.––In section 24 of ‘the principal Act’,––

I. in sub-section (1), clause (i) shall be substituted by the followingclause, namely :––

“(i) collect within the District such taxes and fees payableunder any state law or rules and credit the same to the Council


Fund except the taxes, toll, levy or duty to be collected underthe following Acts :––

(a) Goods and Services Tax under the Jammu andKashmir Goods and Services Tax Act, 2017 ;

(b) Stamp Duty under the Stamps Act, 1977 Samvat(1920 A. D.) ;

(c) Excise Duty under the Jammu and Kashmir ExciseAct, Samvat 1958 ;

(d) Toll under the Jammu and Kashmir Levy of TollAct, Samvat 1995 ;

(e) Passenger Tax under the Jammu and KashmirPassengers Taxation Act, 1963 ;

(f) Taxes under the Jammu and Kashmir Motor Spiritand Diesel Oil (Taxation of Sales) Act, Svt. 2005(1948 A. D.).

(g) Token Tax under the Jammu and Kashmir MotorVehicles Taxation Act, 1957.”

II. in sub-section (2) for clauses (i) and (ii), thefollowing clausesshall respectively be substituted, namely :––

“(i) taxes on any trade, calling or profession within jurisdictionof the Council ;

(ii) a tax payable by the owner thereof on animals and vehicleskept within the district and plied for hire.”

III. sub-section (3) shall be substituted by the following sub-section,namely :––

“(3) the scales of taxes, tolls or rates and terms and conditionsfor imposition thereof shall be finalized by the Council.”

7. Amendment in section 25, Act No. XXXII of 1997.––In section 25of ‘the principal Act’, in sub-section (1) for the words “The members of thecouncil”, the words “The elected members of the Council”, shall be substituted.


8. Amendment in section 27, Act No. XXXII of 1997.––In section 27of ‘the principal Act’, in sub-section (2), for the word “members”, whereveroccurring, the words “elected members”, shall be substituted.

9. Insertion of sections 28-A, 28-B and 28-C, Act No. XXXII

of 1997.––After section 28 of ‘the principal Act’, the following sections shallbe inserted, namely :––

“28-A. Deputy Chairman of the Council.––(1) The Council

shall have a Deputy Chairman to be elected by its electedmembers from amongst themselves in its first meeting after the

general election.

(2) On the occurrence of vacancy in the office of DeputyChairman for any reason whatsoever, the Council shall within

one month of the date of occurrence of vacancy elect one of itsmembers as Deputy Chairman.

28-B. Term of office, resignation and removal of DeputyChairman.––The provisions of section 26 and section 27 shallapply in relation to the Deputy Chairman with the substitution of

words “Chairman” with “Deputy Chairman”, wherever theyoccur in these provisions.

28-C. Powers, functions and duties of the DeputyChairman.––The Deputy Chairman shall,––

(a) preside over meetings of the Council in absence of theChairman ;

(b) exercise such other powers, perform such other functions

and discharge such other duties as the Council may fromtime to time direct ; and

(c) exercise such of the powers, perform such of the

functions and discharge such of the duties of the ChiefExecutive Councillor, as the Chief Executive Councillor

may from time to time subject to approval of the Councildelegate to him by order in writing.”



I. in sub-section (1), in clause (a), the word “and” appearing at itsend shall be deleted and thereafter the following new clause shallbe inserted, namely :––

“(aa) the Deputy Chairman of the Council ; and”

II. in clause (b) for the words “four”, the words “three”, shall besubstituted.

11. Amendment in section 34, Act No. XXXII of 1997.––In section 34 of ‘the principal Act’ the full stop (.) at the end shall besubstituted by a colon (:) and thereafter the following proviso shall be inserted,namely :––

“Provided that in absence of the Chief Executive Councillor, theDeputy Chairman shall preside over meetings of the ExecutiveCouncil.”

12. Insertion of section 34-A, Act XXXII of 1997.––After section 34 of ‘the principal Act’, the following section shall be inserted,namely :––

“34-A. Committees.––The Council may, from time to time, appointfrom amongst its members such number of committees for theefficient discharge of its duties/functions as may be necessary andmay also appoint any professional, technocrat or academician of highrepute to assist any such Committee on such terms and conditions asmay be fixed by it subject to the regulations made in this behalf.”

13. Amendment in section 35, Act No. XXXII of 1997.––In section 35 of ‘the principal Act’ for the words “Chief Executive Councillor”wherever occurring, the words “Chief Executive Councillor, the DeputyChairman” shall be substituted.

14. Amendment in section 40, Act No. XXXII of 1997.––Section 40of ‘the principal Act’ shall be substituted by the following section, namely :––

“40. Government employees to be employees of theCouncil.–(1) All Government employees in the District except thejudicial employees and police personnel shall be deemed to be the


transferred employees on such terms and conditions, to be notifiedby the Government from time to time :

Provided that the terms and conditions of service of an employee ofthe Government transferred to the Council shall not be varied to hisdisadvantage.

(2) The Chief Executive Officer may with the prior approval of theExecutive Council take action against any employee transferred to itunder sub-section (1), under rules governing their service conditions,including instituting a departmental inquiry and taking disciplinaryaction in accordance with such rules.

(3) The Chief Executive Officer may with prior approval of theExecutive Council transfer any employee transferred to Council undersub-section (1) within the District.

(4) The Chief Executive Officer shall be the reporting authorityfor all District Level Officers/Officials transferred undersub-section (1).”


I. in sub-section (2) for the words ‘for the efficient use andmanagement of the land’, the words “for the efficient useand management of the land for public purpose”, shall besubstituted ; and

II. after sub-section (3), the following sub-section shall be added,namely :––

“(4) Subject to such restriction or conditions as the Governmentmay think fit and proper, all properties of the nature specifiedbelow and situated in the District shall vest in and belong tothe Council with all other properties which may become vestedin the Council and shall be under the direction, managementand control of the Council and shall be held and applied for thepurpose of this Act––

(a) all public buildings constructed and maintained outof the fund of the Council ;


(b) all public roads which have been constructed ormaintained out of the fund of the Council and stonesand other materials thereof and also trees, erections,materials, implements and things for such roads.”


I. in sub-section (1) after clause (a), the following clause shall beinserted, namely :––

“(aa) all taxes and fees that are assigned to be collected bythe Council under section 24.”

II. in sub-section (5) for the words “the Government may makerules”, the words “the Council, with the approval of theGovernment may make rules”, shall be substituted.

17. Amendment in section 44, Act No. XXXII of 1997.––Section 44of ‘the principal Act’, shall be substituted by the following section,namely :––

“44. Allocation of funds by the Government.–– (1) TheGovernment shall allocate the Council all funds of the Districtunder :

(a) any budget head of the State, revenue or CAPEX ; and

(b) Centrally Sponsored Schemes and other CentralGovernment Schemes, which do not involved direct anddesignated flow of funds to executing agencies/beneficiaries, shall be transferred directly by the StateGovernment to the Council Fund.

(2) The allocation sanctioned in the Budget of the Council whichremains unspent at the close of the financial year shall be carriedforward as an additional resource available for the Budget of thefollowing year.

(3) The funds shall be released by the Government as per normalbudgeting procedure.”


18. Insertion of section 51-A and section 51-B, Act No. XXXIIof 1997.––After section 51 of ‘the principal Act’, the following sections shallbe inserted, namely :––

“51-A. Panchayats to follow directions of the Council.––Allpanchayats in the district at all levels shall follow directions issuedby the Council from time to time under the provisions of this Act.

51-B. Chairman of Tourism Development Authorities .––Notwithstanding anything to the contrary contained in any law forthe time being in force, the Chief Executive Councillor shall be theChairman of all Tourism Development Authorities within the district.”

19. Amendment in section 54 and 57, Act No. XXXII of 1997.––In section 54 and section 57 of ‘the principal Act’, for words “ChiefExecutive Councillor” the words, “Chief Executive Councillor, the DeputyChairman” shall be substituted.

20. Amendment in section 60, Act No. XXXII of 1997.––In section 60 of ‘the principal Act’, in sub-section (2), in clause (iv), for thewords “Chief Executive Councillor” the words, “Chief Executive Councillor,and the Deputy Chairman” shall be substituted.
