As more than 1,460 students and professors at 150 of the nation’s law schools—representing all 49 states with law schools, and the District of Columbia—we are united in opposition to President Trump’s nomination of CEO Andrew Puzder to lead the U.S. Department of Labor. Mr. Puzder is a fast-food CEO who led a company with a well-documented record of labor violations, wage suppression, and sexist advertising. He is unfit to lead a Department that is supposed to uphold basic labor and workplace safety standards for the nation’s wage earners.

Mr. Puzder’s history makes it clear that as Secretary of Labor he would be hostile to working people. Working families need a Labor Secretary who will look out for them—not undermine them. If confirmed, Mr. Puzder will make workplaces worse.

Mr. Puzder’s contempt for the rules of the agency he would run is unprecedented. During Mr. Puzder’s tenure as CEO of CKE Restaurants, dozens of his company’s directly-owned and franchise restaurants were found by regulators to have violated wage and hour laws and occupational health and safety laws.1 Since 2009, sixty percent of Department of Labor investigations of CKE restaurants found labor law violations.2 Mr. Puzder has even complained about having to provide rest and meal breaks for his workers.3 Multiple class-action lawsuits have accused CKE of wage theft, including by routinely forcing workers to skip breaks, altering time records, and

placing caps on manager pay while requiring them to work unpaid hours.4 Through his actions and words Mr. Puzder has demonstrated that he can’t himself abide by labor rules. We do not see how working people can trust Puzder to look out for them now in enforcing labor laws. Mr. Puzder has shown a disregard for women in the workplace.

The fast-food restaurant industry relies on women’s work to succeed, but Puzder opposes policies that would raise women’s earnings and close the gender wage gap, and he has attacked women’s health care. Sixty-six percent of women working in Mr. Puzder’s chains report unwanted sexual harassment5 and his companies have been subject to numerous sexual harassment and sex discrimination lawsuits.6 Moreover, Mr. Puzder has made the objectification of women central to the brands of Carl’s Jr. and Hardee’s, including through ads featuring highly sexualized images of women.7 Mr. Puzder opposes policy changes that could actually help workers. Mr. Puzder grew his fortune while underpaying the people who worked for him, and fighting against ways to help Americans climb the economic ladder and close the wage gap.8 Although he earned $4.4 million in 2012—294 times what the average person earning the minimum wage makes a year—he strongly opposes meaningful increases to the minimum wage,9 overtime protections,10 paid sick time,11 and other popular measures that help working people earn a fair return on their work.12 Mr. Puzder also speaks enthusiastically about replacing workers with machines, which he says are “always polite . . . they never take a vacation . . . there's never a slip-and-fall, or an age, sex, or race discrimination case.”13 This is not the track record of someone who will be a Secretary of Labor who advances the interests of working people. We therefore urge you to stand on the side of working families and vote against the nomination of Andrew Puzder for Secretary of Labor.
