Circumstances of the Accident

On April 28, 2010, the victims reported to work on the second shift and were

assigned to operate a continuous miner.

The victims were operating the continuous miner in the No. 3 entry, loading draw

rock from the mine floor. The rock had fallen after completion of mining the cut. A slicken

sided area (slip) was present in the mine roof above the anchorage point of the permanent

roof supports (roof bolts). The victims were struck by the rock while positioned in an area of

supported mine roof. The rock had fallen from an area of unsupported mine roof and

continued into the area of supported roof where the victims were located.

The mining section (unit) was located approximately 4.5 miles from the elevator

shaft (entrance) and approximately 880 feet below ground level, the mining height was 67

inches. The collapsed mine roof measured approximately 19 feet 9 inches wide by 10 feet

thick and extended for an unknown length.

The victims received fatal injuries when struck by the collapsed mine roof.

The unit was advance mining on 70 feet by 70 feet centers.

The fall was 10 feet thick and 19 feet and 9 inches wide. The total length of the fall was not determined due to the area being inaccessible.
