VISION OF THE FACULTY OF LAW To be an internationally renowned law school in research, publication and teaching.

MISSION OF THE FACULTY OF LAW To advanced legal knowledge, learning and skills through quality research, education and training for

the profession, nation and humanity.

HISTORY OF THE FACULTY OF LAW The faculty of law , University of Malaya provides a liberal education in law based on a comprehensive approach to law as an academic discipine. The faculty also equips students with practical professional

skills and professional ethics including a critical study of laws to satisfy the needs of organisations, social changes and justice.

Since its inception in 1972, the Faculty offers its Bachelor of Laws (LLB) programme at the undergraduate

level. The LLB programme represents a combination of the academic and professional discipine which entitiles the holder of the degree to be admitted as an advocate and solicitor of the High Court at the

end of his 9-month pupillage internship.

The Faculty of Law also offers programmes at the postgraduate level consisting of the Master of Laws Programme (LLM), Masters in Criminal Justice (MCJ) Programme, Masters in Commercial Law Programme,

Masters in Legal Studies and the Doctor of Philosophy (PhD) Programme. The University is also empowered to confer the Doctor of Laws (LLD).

The first batch of law students graduated in 1976. Since then, the graduates of the Faculty of Law, University of Malaya, comprise illustrious alumni who are currently in the Judicial and Legal Services

sector, the Governmnet, in Parliament and in the legal and corporate sectors. A number of alumni opted to remain with the Faculty. These are those who had pursue their postgraduate degrees, then joined the

Faculty as academic staff.

The Faculty’s staff strength is about 40. Although the majority of them are Malaysian citizens, from time to time the Faculty receives visiting academics from other countries such as India, Australia, the United

Kingdom, Hong Kong and the United States of America. The visiting Faculty members deliver lectures and seminars to students, particularly at the postgraduate level. External examiners appointed by the faculty

are drawn from illustrious members of academia from Australia, the United Kingdom and other Commonwealth countries and from the Judicial Service of Malaysia and they ensure that the academic

standards of its programmes are maintained.

The Faculty also conducts the Bachelor of Jurisprudence programme, a programme set up to enable working adults to acquire a law degree. The programme is an external (self-study) programme. Degrees are awarded by the University of Malaya at an annual convocation. To assist in the preparation for the

course and the examinations, the Faculty conducts introductory and revision courses for the students conducted by the External arm of the Faculty under the Legal Ecudation Extension Programme (LEEP).

Under the LEEP, the Faculty continues to provide legal education to those who have graduated and

practice, or in other legal careers. LEEP was initiated by the Faculty of Law in 1993 to provide a series of short courses on specific areas of law. The rationale for the initiation of the programme was based on the premise that the role of the Law Faculty should be extended to frontiers beyond merely serving the needs of matriculated students. Due to the dynamic character of law, and the developmental milestones that are fast impacting the law, there is a need to continually keep abreasest of the developments, not just in the academic realm but also to disseminate the developments to the practice world. LEEP courses are thus designed to meet the needs of both legal professionals who wish to keep abreast of the recent

developments, as well as other interested individuals and corporations. The course coordinators are sourced from a pool of academicians, legal practitioners, judiciary and other legal professional

DOCTOR OF PHILOSOPHY MODE OF STUDY : RESEARCH ENTRY REQUIREMENT Applicants for the Doctor of Philosophy programme at the Unversity of Malaya must satisfy the following requirements: a. A Master’s degree by way of research; or b. A Master’s degree by coursework with CGPA of not less than 3.7; or c. A Master’s degree by coursework with CGPA between 2.0 and 3.69 and a Bachelor degree with

e. Applicants with a Bachelor’s Degree with CGPA of not less than a 3.70 or equivalent may be

admitted to the PhD Programme. Candidates are required to present their research proposal in the Proposal Defense not later than the second semester of candidature. These candidates are required to present the research progress in the PhD Confirmation Defense not later than the third semester of candidature. If the research progress is unsatisfactory, the candidature status is changed from Doctor of Phlosophy by research to a relevant Master’s programme.

ENGLISH LANGUAGE ENTRY REQUIREMENT FOR NON-CITIZEN A candidate who is not a Malaysian citizen and who possesses a degree or degrees from a university or an institution of higher education where the medium of instruction is not English language for that degree or degree as the case may be and who wishes to write his/her thesis in English must have obtained a score of 600 for TOEFL or band 6.00 for IELTS (Academic). BAHASA MALAYSIA REQUIREMENT 1. A PhD candidate who is a Malaysian citizen shall be required, before being conferred the degree,

to possess at least a: (a) pass in Bahasa Malaysia or Bahasa Melayu at the Sijil Pelajaran Malaysia level; or (b) level III in the Sijil Bahasa Malaysia or Bahasa Melayu Universiti or at an equivalent level; or (c) Pass the Bahasa Malaysia or Bahasa Melayu exemption assessment as set by the University.

RESIDENTIAL REQUIREMENT PhD candidates shall reside in Malaysia for a period of at least one (1) semester.

PROGRAMME STRUCTURE The PhD programme is a full research programme leading to the submission of a thesis based on an individually supervised research. All research proposals must be approved and research be supervised by the Faculty. PhD candidates are required to :

a) Carry out independent research involving a comprehensive study of a scope and size that can normally be completed between 4 to 12 semesters of full time study, and

b) Make a substantial contribution to learning by, including but not limited to, uncovering new knowledge, concieving new ideas, reinterpreting established theories and approaches;

c) Demonstrate an ability to relate the research done to the broader legal framework at a standard that is internationally recognized.

At the end of the candidature, a candidate is required to produce a thesis not exceeding 100,000 words on the subject of his/her research. The examiners must be satisfied that the thesis is a connected piece of writing that containd original work and critical interpretations worthy of publication and is of sufficient standard and merit to qualify for PhD.

PERIOD OF STUDY The minimum period is four (4) semesters and the maximum period is twelve (12) semesters.

FACULTY SEMINARS All PhD candidates are required to deliver three (3) seminars. The First Seminar, which is a Proposal Defence seminar, is to be delivered within the first two semesters [not later than the second semester of his/her candidature]. Candidates are required to submit a research proposal of 3,000 to 7,000 words on the following:

1. Introduction and scope of the research 2. Objective of the research 3. Conceptual framework or methodology 4. Significance and relevance of the research 5. Time line for the research , including a proposed date of submission 6. Brief bibliography

The Second Seminar which is to be held not later than fifth semester, is a Candidature Defence Seminar which requires a candidate to deliver a research progress report of about 5,000 to 10,000 words on the following:

1. Abstract – 500 words in Bahasa Malaysia and English 2. Objective and Problem Statement 3. Importance and Relevancy of Research 4. Complete literature review 5. Complete research methodology 6. Research outcomes or finding to date 7. Complete bibliography 8. Research plan leading to completion of the thesis on the appointed date; and 9. Publications or conference papers to date (if any)

The Thesis Seminar, which is to be delivered prior to submission of the thesis, requires the candidate to submit a summary of the thesis. Summary of the thesis shall contain an overview of the thesis, purpose and scope, significant research findings, and contents of chapters. PUBLICATION PhD candidates are required to show proof of acceptance at least one (1) paper is ISI (WoS) – Ranked Full Length Journal Paper or at least two (2) papers in the journal category A or B or Chapter in Book that is recognized by the Faculty for publication before the committee of Examiners’ meeting and viva-voce. PROGRAMME STRUCTURE

1. The Master of Laws Degree Programme The Master of Laws Degree Programme by coursework totals forty-four (44) credits. Candidates registered on this programme are required to register for Core Courses which are Research Methodology course with three(3) credits, Research Project course with nine (9) credits with length not exceeding 15,000 words , International Human Rights and Humanitarian Law course with four (4) credits and Malaysian Legal System course with four (4) credits which compulsory for foreign graduates. Synopsis of Course Contents This course examines the contemporary international regime concerning the rights of states and indigenous peoples that have developed within international human rights law. Beginning with the historical context and the developments within the modern era of human rights, it considers the international instruments relevant to indigenous rights, it considers the international instruments relevant to indigenous rights. It looks at the international norms that have developed in the context of indigenous peoples, the concept of self-determination, the duty of states in the implementation of those norms and the international monitoring procedures and the internalization of those rights within the domestic legal system.

Contemporary problem for indigenous peoples, including questions of indigenous governance, collective and community rights, cultural heritage, public participatory rights, the right to sustainable development and protection against discrimination will also be explored.

Synopsis of Course Contents This course will examine the conceptual framework on the rights of minorities and indigenous peoples within the international human rights regime, and to enable them to analyze problems faced by indigenous peoples and minorities in relation to the legal systems in which they live. The course makes a distinction between the terms 'minorities' and 'indigenous peoples' and examines the social and cultural rights of ethnic and religious minorities with references to selected case studies. The major part of the course will be devoted to indigenous conceptions of territorial and proprietary rights to land and natural resources on lands occupied and inhabited by indigenous peoples, and the role of customs, oral traditions and customary laws in the survival of indigenous peoples. ENTRY REQUIREMENT Applicants for the Master of Commercial Law programmes at the University of Malaya must satisfy the following requirements: a. A Bachelor of Laws with honours degree with CGPA of 3.0 and above or its equivalent; or

b. A Bachelor of Laws with honours degree with cgpa from 2.70 to 2.99 or its equiavlent and one (1)

of the following criteria:

(i) Relevant work experience (3 years); or (ii) At least one (1) Publication in the relevant field; or (iii) Applicant is a scholarship holder; or (iv) Applicant is a University of Malaya graduate; or (v) Applicant is a civil servant.

c. A Bachelor of Laws with honour degree with CGPA from 2.50 to 2.69 and two (2) of the following

criteria:

(i) Relevant work experience (3 years); or (ii) At least one (1) Publication in the relevant field; or (iii) Applicant is a scholarship holder; or (iv) Applicant is a University of Malaya graduate; or (v) Applicant is a civil servant.

(Applicants with a Bachelor of Laws degree with CGPA below 2.50 will not be considered for admission) ENGLISH LANGUAGE ENTRY REQUIREMENT FOR NON-CITIZEN A candidate who is not a Malaysian citizen and who possesses a degree or degrees from a university or an institution of higher education where the medium of instruction is not English language for that degree or degree as the case may be and who wishes to write his/her thesis in English must have obtained a score of 600 for TOEFL or band 6.00 for IELTS (Academic). BAHASA MALAYSIA REQUIREMENT 1. A candidate who is a Malaysian citizen shall be required, before being conferred the degree, to

possess at least a: (a) pass in Bahasa Malaysia or Bahasa Melayu at the Sijil Pelajaran Malaysia level; or (b) level III in the Sijil Bahasa Malaysia or Bahasa Melayu Universiti or at an equivalent level; or (c) Pass the Bahasa Malaysia or Bahasa Melayu exemption assessment as set by the University.

D. MASTER OF CRIMINAL JUSTICE MODE OF STUDY : COURSEWORK TOTAL CREDIT : 44 CREDITS INTRODUCTION The Master of Criminal Justice is a multidisciplinary programme offered by the Faculty of Law. Guest lecturers from outside the University will also be invited to teach from time to time. This programme fulfills the need to train professional and skilled personnel who are involved in the criminal justice system. It is suitable not only for trainig practitioners in the Malaysian criminal justice system but also practitioners from overseas. PROGRAMME OBJECTIVES The Master of Criminal Justice programme aims to produce more holistic graduates in terms of human rights who are able to analyze, criticize and contribute towards the development of national criminal justice. ENTRY REQUIREMENTS Applicants for the Master of Criminal Justice programme at the University of Malaya must satisfy the following requirements: (a) A Bachelor’s degree with honours with CGPA of 3.0 and above or its equivalent ; or (b) A Bachelor’s degree with honours with CGPA from 2.70 to 2.99 or its equialnet and one (1) of the

following criteria:

1) Relevant work experience (3 years); or 2) At least one (1) Publication in the relevant field; or 3) Applicant is a scholarship holder; or 4) Applicant is a University of Malaya graduate; or 5) Applicant is a civil servant.

(c) A Bachelor’s degree with honours with CGPA from 2.50 to 2.69 and two (2) of the following criteria:

1) Relevant work experience (5 years); or 2) At least one (1) Publication in the relevant field; or 3) Applicant is a scholarship holder; or 4) Applicant is a University of Malaya graduate; or 5) Applicant is a civil servant.

(Applicants with a Bachelor of Laws degree with CGPA below 2.50 will not be considered for admission) ENGLISH LANGUAGE ENTRY REQUIREMENT FOR NON-CITIZEN A candidate who is not a Malaysian citizen and who possesses a degree or degrees from a university or an institution of higher education where the medium of instruction is not English language for that degree or degree as the case may be and who wishes to write his/her thesis in English must have obtained a score of 600 for TOEFL or band 6.00 for IELTS (Academic). BAHASA MALAYSIA REQUIREMENT 1. A candidate who is a Malaysian citizen shall be required, before being conferred the degree, to

possess at least a: (a) pass in Bahasa Malaysia or Bahasa Melayu at the Sijil Pelajaran Malaysia level; or (b) level III in the Sijil Bahasa Malaysia or Bahasa Melayu Universiti or at an equivalent level; or (c) Pass the Bahasa Malaysia or Bahasa Melayu exemption assessment as set by the University.

2. A non-citizen candidate is required to attend at a satisfactory level a Bahasa Malaysia or Bahasa

Melayu course conducted by the University before being conferred the Degree unless he obtains at least a: (a) pass in Bahasa Malaysia or Bahasa Melayu at the Sijil Pelajaran Malaysia level; or (b) level III in the Sijil Bahasa Malaysia or Bahasa Melayu Universiti or at an equivalent level; (c) pass in the Bahasa Malaysia or Bahasa Melayu course as recognised by the University; or (d) Pass the Bahasa Malaysia or Bahasa Melayu exemption assessment as set by the University.

waived for a candidate who has pursued a programme of study and has been conferred a degree from a Local and Private Institute of Higher Learning where the medium of instruction used was the national language.

E. MASTER OF LEGAL STUDIES MODE OF STUDY : RESEARCH INTRODUCTION The Master of Legal Studies is a full research programme offered by the Faculty of Law. This programme fulfills the need to train professional and skilled personnel who are involved in the legal system. PROGRAMME OBJECTIVES The Master of Legal Studies programme aims to produce graduates who are able to conduct cross-disciplined legal research that are based on the highest level of academic excellence as well as being able to submit academic suggestions to advance legal knowledge and development of useful laws to society and the nation. PROGRAMME OUTCOMES At the end of the programme, students will be able to :

PO1 Expanding the mastery of high-level knowledge in cross-disciplined legal research.

PO2 Apply practical skills in carrying out research and analyzing relevant legal issues.

PO3 Relates knowledge and law-related skills to the benefit of the community and other researchers.

PO4 Apply high research ethics and values.

PO5 Deliver information and results of legal research to audiences in written or oral form

PO6 Analyze critically and submit legal and non-legal solutions through appropriate research methods.

PO7 Managing relevant information from multiple sources as well as expanding research that has a legal impact.

ENTRY REQUIREMENTS Applicants for the Master of Criminal Justice programme at the University of Malaya must satisfy the following requirements: (a) A Bachelor’s degree with honours with CGPA of 3.0 and above or its equivalent ; or (b) A Bachelor’s degree with honours with CGPA from 2.70 to 2.99 or its equivalent and one (1) of the

following criteria:

1) Relevant work experience (3 years); or 2) At least one (1) Publication in the relevant field; or 3) Applicant is a scholarship holder; or 4) Applicant is a University of Malaya graduate; or 5) Applicant is a civil servant.

(c) A Bachelor’s degree with honours with cgpa from 2.50 to 2.69 and two (2) of the following criteria:

1) Relevant work experience (5 years); or 2) At least one (1) Publication in the relevant field; or 3) Applicant is a scholarship holder; or 4) Applicant is a University of Malaya graduate; or 5) Applicant is a civil servant.

(Applicants with a Bachelor of Laws degree with CGPA below 2.50 will not be considered for admission) ENGLISH LANGUAGE ENTRY REQUIREMENT FOR NON-CITIZEN A candidate who is not a Malaysian citizen and who possesses a degree or degrees from a university or an institution of higher education where the medium of instruction is not English language for that degree or degree as the case may be and who wishes to write his/her thesis in English must have obtained a score of 600 for TOEFL or band 6.00 for IELTS (Academic). BAHASA MALAYSIA REQUIREMENT 4. A candidate who is a Malaysian citizen shall be required, before being conferred the degree, to

possess at least a: (d) pass in Bahasa Malaysia or Bahasa Melayu at the Sijil Pelajaran Malaysia level; or (e) level III in the Sijil Bahasa Malaysia or Bahasa Melayu Universiti or at an equivalent level; or (f) Pass the Bahasa Malaysia or Bahasa Melayu exemption assessment as set by the University.

5. A non-citizen candidate is required to attend at a satisfactory level a Bahasa Malaysia or Bahasa

Melayu course conducted by the University before being conferred the Degree unless he obtains at least a: (e) pass in Bahasa Malaysia or Bahasa Melayu at the Sijil Pelajaran Malaysia level; or (f) level III in the Sijil Bahasa Malaysia or Bahasa Melayu Universiti or at an equivalent level; (g) pass in the Bahasa Malaysia or Bahasa Melayu course as recognised by the University; or (h) Pass the Bahasa Malaysia or Bahasa Melayu exemption assessment as set by the University.

6. Notwithstanding the above stated, the Bahasa Malaysia or Bahasa Melayu requirement may be

waived for a candidate who has pursued a programme of study and has been conferred a degree from a Local and Private Institute of Higher Learning where the medium of instruction used was the national language.

PERIOD OF STUDY The minimum period of study for this programme is two(2) normal semesters and the maximum period is eight (8) normal semesters. COURSE FEES Estimated course fees for six (6) semesters for Master of Legal Studies programmes are :

PROGRAMME STRUCTURE After admission, a candidate on this programme shall pursue a programme of advanced research and study leading to a dissertation which shall be a record of original work or an ordered and critical exposotion of existing data on a topic approved by the Faculty. The dissertation for this programme shall not exceed 50,000 words. All candidates on this programme must register for a Research Methodology course with three (3) credits and choose one (1) research field as below:

The First Seminar, which is a Proposal Defence seminar, is to be delivered within the first (1) semester. The candidates are required to submit a research proposal of 3,000 to 5,000 words on the following :

1. Introduction and scope of the research 2. Objective of the research 3. Conceptual framework or methodology 4. Significance and relevance of the research 5. Time line for the research, including a proposed date of submission 6. Brief bibliography

The Second Seminar, which is to be held in the second (2) semester, is a Candidature Defence seminar which requires the candidate to deliver a research progress report of about 10,000 words on the following:

1. Precise research question or objective 2. Complete literature review 3. Complete research methodology 4. Research outcomes or findings to date 5. Complete bibliography 6. Research plan leading to completion of the thesis on the appointed date; and Publications or

conference papers to date (if any).

TAN SRI PROFESOR AHMAD IBRAHIM LAW LIBRARY 1. INTRODUCTION

The Law Library was officially established in 1972 in line with the establishment of the Faculty of Law. Prior to that year, the law collection was placed under the general collection at the Main Library, University of Malaya. On 18 June 1999, the Law Library moved into a new building and named Tan Sri Professor Ahmad Ibrahim Law Library to appreciate his contributions to the Faculty of Law and the Law Library.

3. MEMBERSHIP

Registered students and staff of University of Malaya are eligible to be members of the library. Matric card must be worn at all times within library premises and is not transferrable.

4. COLLECTION

The Law Library’s collection is currently the largest and the most comprehensive collection of legal resources in Malaysia. The collection to date stands as at 124 000 volumes, these collections are divided and stacked into distinct groups:

Ground Floor Malaysiana Collection Books on Malaysia or by Malaysian published locally or overseas, comprising of both primary and secondary sources of law namely legislation, case law, textbook, journals, government gazettes, parliamentary debates, textbook and exam passed year question are housed here. Textbook Collection Textbook covering various legal topics and jurisdictions are arranged according to topic codes. The codes are displayed at the bookshelf for ease of reference. Free Range Reading Collection Materials in this collection comprise of light reading materials covering fiction, general knowledge, health, psychology and motivation. Braille Collection There are up to 300 titles in Braille dedicated for used by the special students with visually impaired. Floor 1 Reference Collection The reference collection comprises of encyclopedias, dictionaries, guide books, Halsbury’s, digests, maxims, handbooks, yearbooks, abstracts, citators, and indexes. This collection consists of court cases from various jurisdictions, namely India, Pakistan, Australia, United Kingdom and United States.

Floor 2 Closed Access Collection This collection can only be accessed by Library staff whom will retrieve the items upon request. It consists of theses and dissertations, research papers, academic exercises, published and unpublished conference papers and loose leaf service. Journal Collection Bound journals and current issues are available here. The journals are arranged according to the title and the list of the journals is available at the Service Counter on the ground floor. Academic Core Collection This collection is put together with the closed access collection. It is a vital collection of textbooks recommended by academics and is loanable for three (3) days. Floor 3 International Law Collection Resources relating to treaties, international courts and tribunals, selected United Nations publications and official documentations and scholarly writings in international law, including journals as well as information on research guides are housed here. Electronic Resources Collection The Library subscribes to major electronic databases in various subject areas. These electronic databases include e-journals and e-books. These databases can be accessed via the Interaktif portal at www.diglib.um.edu.my/interaktif. Among the electronic databases available are:

5. SERVICES

• Library Orientation This service is extended to all new registered students at the begining of their academic

session. Students are introduced to the library collection, services and facilities.

• Document Supply and Inter-Library Loan This document supply service and inter-library loan is provided for all academic staffs, postgraduate students and final year undergraduate students(document supply). The service is provided to obtaining library materials which are unavailable in University Malaya Library. Users who need this service may contact the Reference Librarian at the Ground Floor.

• Pendeta Discovery (pendeta.um.edu.my) Pendeta Discovery is a public access catalogue and resources discovery tool which allows users to search all types of materials in the library collection.

• iMalaysiana Index (pendeta.um.edu.my) The iMalaysiana index is an index of Malaysiana materials available at the University of

Malaya Library. Malaysiana material refers to book chapters, journal articles and conference papers published in Malaysia, written by Malaysian or materials pertinent to Malaysia.

• Updating Malaysian Laws The federal and states laws which represent the primary sources of law in Malaysia are continuously updated with changes made by the Malaysian Parliament and the respective State Legislative Assemblies.

• Loans Open shelf books and range reading collection can be borrowed by undergraduate and post graduate students for one month.

• Reference Services Qualified professional librarians are ready to assist the teaching staff and students of University of Malaya as well as the academicians and researchers from other local and foreign universities, legal practitioners, members of the judiciary and the external members of the Library.

• Information Skills Session Information Skills Session is offered to postgraduate students as well as to the academic members of the Faculty of Law. This session covers on how to look up for materials by using the Pendeta Discovery, learn how to use the e-resources portal and the EndNote management software to organise citations.

• Newspaper Users can read The Sun at the newspaper corner on the Ground Floor.

6. FACILITIES

• Discussion Rooms Four (4) Discussion Rooms which can easily accommodate eight users at any time are available. Kindly proceed to Information Counter for reservation.

• Photocopying Photocopying service is operated by commercial vendors at floor 1. Users are reminded of the relevant provisions of the Malaysian Copyright Act, 1987. Self service photocopying is also available at the Ground Floor and the First Floor.

• Carrels Twelve (12) carrels are available for postgraduate students. Interested students are advised to register at the Information Counter.

• Desktop Computers Computing facilities are available. There are eleven (11) computer workstations for users to access the electronic resources subscribed by the library.

• Lockers Users can store their personal belongings here. However, the Library will not be responsible for any loss.

Moot Room The Moot Room is the latest facility made available for students to prepare for their moot competition.

• Reading Areas Reading Areas are available on every floor. The reading area on Floor 2 is marked as

`Quiet Zone’ in response to requests from students for a silent place to study.

• Wifi The Library is accomodated with wifi. Users need to register with the Information Technology

Use your own member card to enter the library. Using member card belonging to others is prohibited.

Please observe silence in the Library.

Use of hand phones in reading halls is prohibited.

Food and drinks are not allowed into the Library.

Children, pets, bags, zipped files, umbrellas, helmet, bottled drinks and parcels are allowed into the library.

Disciplinary action will be taken against those who are caught tearing, damaging or stealing Library material.

Reservation of seats is not allowed.

Please return the books that have been used to the nearest trolley.

All books, files and handbags are subject to inspection if necessary. The Library staff have the right to ask any Library user to leave the library premises if he/she does not abide by the above rules and regulations.
