Practice — Service of process — Statute of limitations — Waiver.

Defendant sought Summary Judgment based upon a statute of limita-tions defense, due to improper service of the writ of summons and com-plaint. The Court, however, found that the issue of improper service hadbeen waived by the Defendant’s failure to assert the claim in a prelimi-nary objection.

1. Failure to assert a claim of improper service in a preliminary objection amounts to awaiver, which has the effect of validating the otherwise defective form of service andtolling the statute of limitations. Cox v. Hott, 371 A.2d 921 (Pa. Super. 1977)

KLEINFELTER, J., October 4, 2006. – This case comes again1 before thecourt pretrial, this time on the Motion for Summary Judgment filed bydefendant United Water of Pennsylvania.

The premise underpinning United Water’s motion is that the action isbarred by the statute of limitations. The parties seem to agree that theincident on which the claim is based occurred on September 18, 2002.

They also agree that, under the applicable two-year statute, plaintiff’sclaim would be time-barred after September 18, 2004.

Plaintiff initiated her action on September 17, 2003, by filing a writof summons. Plaintiff claims the writ was served on September 13,2004, albeit improperly since service was accomplished by use of a pri-vate process server. United Water denies ever receiving service of thiswrit.

Nevertheless, in response to a rule to file a complaint filed by defen-dant State Farm, plaintiff filed her complaint on October 20, 2004.Although United Water claims never to have been properly2 served withthis complaint, on November 9, 2004, United Water faxed a letter toplaintiff’s counsel seeking a 20-day extension to file an answer. UnitedWater filed its answer on November 23, 2004. The present motion forsummary judgment was filed on August 30, 2006.

As noted earlier, United Water’s motion relies on the tolling of thestatute of limitations as averred in its answer and new matter filedalmost two years ago. The statute of limitations affirmative defenserelies solely on the allegation of improper service of the writ and alsoof the complaint.3 Both sides have offered interesting arguments on thevalidity of service and its effect on the statute. See, e.g., Lamp v.Heyman, 366 A. 2d 882, 889 (Pa. 1976) (writ of summons effective totoll statute only if plaintiff then refrains from course of conduct whichwould serve to stall the legal process just set in motion), and McCreeshv City of Philadelphia, 888 A.2d 664 Pa. (2005). (strict compliancewith rules not required where defendant has had actual notice and isnot prejudiced).

We find it unnecessary to embark on a Lamp-McCreesh analysis in this case because we find that the issue of improper service hasbeen waived by United Water. Pennsylvania Rule of Civil Procedure1028 sets forth the grounds on which preliminary objections may beraised, e.g.:

(1) lack of jurisdiction over subject matter of theaction or the person of the defendant,improper venue or improper form of serviceof a writ of summons or a complaint.

2. A copy of the complaint was served on United Water by regular mail on October 20,2004.

3. Plaintiff concedes that the manner of service for both the writ and the complaint is inviolation of the Pennsylvania Rules of Civil Procedure.

Rule 1032(a) further provides: “A party waives all defenses andobjections which are not presented either by preliminary objection,answer or reply. ...”

While United Water properly raised the statute of limitations as anaffirmative defense in its answer with new matter, this defense restsupon a claim of improper service which claim should have been firstasserted in a preliminary objection. United Water’s failure to do soamounts to a waiver. Cox v. Hott, 371 A.2d 921 (Pa. Super. 1977).United Water’s waiver has the effect of validating plaintiff’s allegeddefective form of service. Id. As such, service was effective to toll thestatute of limitations.

ACCORDINGLY, we enter the following:
