This statement i s made on behalf of Mr. Seymour Weitzman on his

request and with his consent.

Mr. Seymour Weitzman, born January 28, 1922, in h is capacity of

deputy constable of the Sher i f f ' s Office, personally an d from close

distance witnessed the events that resul ted in the death of former

President John F. Kennedy. His testimony and account of what he

observed were collected by the Invest igators of the Police Department of Dallas, Office of the Sheriff of the Dallas County, and

the Warren Commission. His testimony is a ~ a t t e r of record, and

he has no new or addi t ional information to add to the statements

made a t that t ime.

Since that time Mr. Weitzman was t reated for emotional i l lness

fo r many years, an d is presently a member of the Veterans

Administration Domiciliary at th is Sam Rayburn Memorial Veterans

Administration Center in Bonham, Texas. I t is of great importance

for his welfare an d emotional well-being to excuse Mr. Weitzmanfrom par t ic ipa t ion in any fur ther invest igat ions of the events

he witnessed; any information sought from him should be extracted

Roy Vaughn s ta ted t h a t on November 22, 1963, he was

in p a t ro l working in a tw o man c a r . G.W. Temple was h is

p a r tn e r . They worked the South Dal las a r ea . The a te lunch

a t Vaughn's house and then were c ru i s ing in the area of

Hatcher and Colon ia l . They decided to swi tch over to channel 2

to see how the motorcade was coming along and heard what sounded

l i ke mass confus ion . They switched back to Channel 1.

d ispa tcher sen t a l l squads in the downtown area to Elm and

Houston, Code 3 (Emergency). Someone on the a i r asked what

happened. The d ispa tcher s a id Signa l 19 (Shooting) involving

the Pre s iden t . They proceeded to the a rea and pu l led up on

Houston St r e e t , on the west s ide o f the T.S.B.D. Afte r VaughnI

and Temple got out o f the c a r , Vaughn l o s t t rack of Temple.

Vaughn s tayed on the e a s t s ide of th e T.S.B.D. he had parked

the ca r on the curb on the e a s t s ide o f the T.S.B.D. A

secur i ty guard came o ~ t o f the bui ld ing across from the T.S.B.D. ,

now the Museum, and had_a man in custody. The guard to ld

vaughn t h a t he took the man in to cus tody because he d i d n ' t

belong in the bu i ld ing . The guard tu rned the man over to

vaughn. vaughn took the man to the S h e r i f f ' s of f ice and

turned him over to a deputy she r i f f (name unknown) . Vaughn

then re turned to the T.S.B.D. he heard someone say t h a t some

men had jumped in to a box car down by Union Sta t ion . He to ld

a Sergeant in front o f the T.S.B.D. Vaughn, Bi l l Bass , Marvin

Wise and another o f f i c e r (name unknown) ran down th e t racks

fo r 3 or 4 blocks to the gra in ca r s near Union te rminal .

Vaughn'climbed up and went to the rea r of a ca r . He looked

i n to an open ca r and sa w th reemen

a t the opposi te end o f

the c a r , kind o f ly ing down. Vaughn pul led h is revolver and

ordered the men o u t o f the c a r .. .

The men came out o f the ·ca r .

Bass and Wise took the men to the Sher i f f ' s o f f i ce . V a u g h n ~and the o ther o f f i c e r rode the Caboose back to the area o f

the T.S.B.D. and got of f . Vaughn sa id t h a t he did not look

in any o ther gra in c a r . He s tayed in the a rea of the T.S.B.D.

and heard on po l i ce radio t h a t an of f i ce r had been sho t . He

c ou ldn ' t ge t h i s ca r out o f the parking jam to go to Oak C l i f f .

At some po in t , he went in to the T.S.B.D. and was on the f loo r

where the r i f l e was found. He remained in the area of the

T.S.B.D. u n t i l re l eased .

On Sunday, November,24, Vaughn was working r e l i e f .

Sometime in the morning he got a ca l l to go to the Pat ro l Off ice .

on the 2nd f loo r of the Court Bui ld ing. On a r r iva l , there

were severa l o ther of f i ce r s t he re . Lieut . R.S. Pearce came

in and to ld him to see Sgt . P.T. Dean in the basement and g e t

was busy and c ou ldn ' t t a lk to him. Vaughn to ld Sgt . Putnam

what Lt. Pearce had to ld him and Sgt . Putnam made the ass ign-

ments. Vaughn was ass igned to the ~ a i n St r e e t entrance to

the basement. He was no t to l e t anyone without a Press Pass

in to the basement. As he s ta r t ed up the ramp, he met a man

coming down. ,He chal lenged the man, who produced i den t i f i ca t ion

from the Department of Publ ic Safe ty . Vaughn went up the

ramp to Main St ree t , where he observed former Dallas po l i ce

o f f i c e r N.J. Danie l s s tanding outs ide the Main St r e e t entrance

to the basement. He ta lked to Daniels a whi le . Later on

Sgt . P.T. Dean came up the ramp and to ld Vaughn t h a t two

armored cars would come in to th e basement but he d i d n ' t k n ~which s ide they were coming in . Vaughn checked severa l I . D . ' s .

An armored t ruck came and backed down the Commerce S t r e e t

s ide . The t ruck cou ldn ' t ge t a l l the way down. Vaughn saw

what he descr ibed as confus ion in the basement. Vaughn saw

a po l ice car with i t s red l i g h t f l a sh ing , back up in the

basement and s t a r t up the Main St r e e t ramp. In the ca r was

Lieut . Pearce, Sgt . Maxey and Sgt . Putnam. Vaughn had to s tep

as ide to l e t th e car out . Pr io r to L t. Pearce ' s car coming

ou t , a man pul led up to t.he ent rance in a squad c a r . This

man was Tommy Chibo l t , a mechanic in the pol ice garage .

Chibol t to ld Vaughn t ha t he was supposed to check th e parking

s i tua t ion in the basement. Vaughn to ld Chibol t to park the

ca r on the s t r e e t and he then l e t him walk down the ramp.

Vaughn stepped back i n to the ent rance way a f t e r Pearce ' s car

went by. In a few minutes , Vaughn heard someone in th e base-

ment say , "here he comes." There was mass confus ion and a

br igh t l i g h t came on in the basement. Shor t ly , t h e r e a f t e r ,

Vaughn heard a muffled noise and saw a s c u f f l e . He saw a

hand come ou t o f the crowd and another hand t r i ed to grab

the hand as if s t rugg l ing fo r a weapon. Short ly t he rea f t e r ,

a man broke loose from the crowd and s t a r t ed running up the

ramp toward Vaughn. A reserve o f f i c e r grabbed the man.

Vaughn drew h is r evo lver . The man i de n t i f i e d himsel f as

Detec t ive D.M. Burgess , now deceased, was re leased and came

up to Vaughn. He t o ld Vaughn t ha t a r e p o r t e r had shot Oswald.

Vaughn and mentioned Ruby's name and sa id he wanted to t a lk

to someone. Vaughn took the man to the in fo rmat ion c le rk and

turned the man over to a de tec t ive . In a s h o r t whi le , Vaughn

was re l i eved . La te r in the day, Capt . Talber t ca l l ed Vaughn

and asked if he knew Jack Ruby. vaughn sa id t ha t he d id know

Ruby. On Tuesday, November 26, Lieu t . Pearce ca l l ed Vaughn

a t home and to ld Vaughn to come in and wri te a spec ia l repor t

on the i nc iden t . Tuesday and Wednesday, Vaughn worked ex t ra

with NBC newstream. Sometime Honday o r Tuesday, Vaughn became

aware t h a t Ruby had supposedly en te red the basement through

the Main St r e e t ramp. Vaughn s ta ted tha t he ca l l ed N.J . Daniels

and asked him if he saw anyone go down the ramp when Lt . Pearce ' s

\'lednesday n igh t , Lieu t . Pearce ca l l ed Vaughn and to ld

him to come in Thursday, Thanksgiving Day, the Chief wanted

to ta lk to him. Thursday morning, he was to ld to r e p o r t to

the Pat ro l Off i ce . On h is a r r i v a l , Chief Fisher , cap t . Ta lb e r t

and Lieut . Pearce were in the Pat ro l Off i ce . They a l l went

in to Chief Fi s he r ' s o f f i c e , where Vaughn verba l ly r e l a t e d h is

act ions on the day of the Oswald shoo t ing . Chief Fisher asked

Vaughn if he would take a Polygraph. Vaughn was upse t because

he f e l t they doubted h is i n t eg r i t y , but agreed to take a

Polygraph. Vaughn went to the 4th f loor and was given a

Polygraph by Paul Bent ley . It was qu i te l eng thy . Afte r

f in i sh ing the t e s t , vaughn went back to the pa t ro l o f f i c e and

asked i f he could go home because it was Thanksgiving, and was

given permiss ion to go home.

The FBI came to h is home on two d i f f e r e n t occas ions and

in te rv iewed him. He was ca l l ed to t e s t i f y a t the Federa l

Building in Dal las and was in te rv iewed by a Warren Commission

a t to rney . The a t to rney showed Vaughn both o f h is FBI in te rv iews ,

Vaughn s ta ted t h a t the f i r s t in te rv iew was no t exac t ly as he

had re l a t ed to them. vaughn made no ta t ions on the f i r s t

in te rv iew where he cor rec t ed it. He sa id the second in terv iew

was cor rec t . The a t to rney quest ioned him about knowing Ruby.

Vaughn s ta ted t ha t he knew Ruby from ge t t ing ca l l s to thewas

Vegas Club. He/never in the c lub on a so c i a l v i s i t . He had

t a lked to Ruby on a few occas ions and def i n i t e l y knew Ruby

when he saw him.

unknown) to book a pr i soner . Off ice r Bass cannot remember i f

he drove h is ca r o r the o ther o f f i c e r drove. After having the

su b j e c t booked, the of f i ce r s headed back to t h e i r work area .

They stopped fo r the motorcade a t Cedar Spr ing .

Afte r a r r iv ing back in t he i r a rea , they got in to t h e i r own

veh ic les . He was c ru i s ing south on Harry Hines Blvd. near

Wolfe St ree t when the d ispa tcher came on the a i r and to ld

Bass to repor t to Elm and Houston (Code 3- Emergency).

Afte r d r iv ing se v e ra l blocks , Bass asked the d i spa tcher what

th e nature of h is c a l l was. The d i spa tcher sa id e i t he r shoot ing

a t th e Pres iden t or shots f i red a t the Pres iden t . The

Bass sa id t h a t he bel ieves he was one o f the f i r s t un i t s

to a r r ive a t the scene. He parked h i s ca r headed nor th a t the

southwest corner of th e T.S.B.D. He took the shotgun out o f

Somebody pointed to the T.S.B.D. and sa i d : "He's still in the

bu i ld ing ." Bass took a pos i t ion on the s.w. corner of th e

T.S.B.D. so t h a t he could see anyone running o ut o f the b u i ld in g .

Somebody, Bass sa id it may have been Sgt . Dave Harkness ,

sa id three men ran down the ra i l road yard and got in to a gra in

c a r . qave Harkness , Marvin Wise, Roy Vaughn and Bass ran down

the ra i l road t racks about one -qua r t e r mile to the gra in c a r s .

Roy Vaughn climbed up the l adder on one o f the cars and sa w

th ree men huddled in the corner o f the f r e igh t ca r . Vaughn

ordered the men o ut onto the ground and th e men cursed a t

Vaughn. Off ice r Vaughn then jacked a s h e l l in to the chamber

o f h is shotgun, pointed it a t the men and ordered them ou t o f

the car . When the men got on the ground, they were given a

good pat-down fo r weapons - bu t none were found. The men were

marched up the ra i l road t r acks to Elm S t r e e t , across the

f ro n t of the T.S.B.D. , across the s t r e e t to the county jail,

and turned over to a Deputy Sher i f f (name unknown). Bass

went back to the f ron t of the T.S.B.D. and shor t ly t he rea f t e r

heard a c a l l come over poLice radio t h a t an o f f i c e r had been

sho t in Oak Cl i f f . Bass s t a t ed t ha t he c o u l d n ' t g e t h is c a r

o ut o f the parking jam-up to go to Oak Cl i f f . He s tayed

around the area of the s.w. corner of the T.S.B.D. u n t i l about

5 p.m. when an orde r came out fo r the day s h i f t of f i c e r s to

r e p o r t to the garage .

the three men were apprehended.

He observed t h a t the three men had hobo type c lo th ing on,

bu t from the neck up were c lean shaven and had good ha i r c u t s .

The men did not say anything while being taken to the

S h e r i f f ' s o f f i c e .

was sending all c a r s to Elm and Houston, with th e excep t ion o f

one c a r in each p a r t o f th e c i ty to remain and p a t r o l its a rea .

in h is ca r and a man working in the Rai l road Bui lding waved

a t him. Wise and another o f f i c e r (name forgot ten) were

to ld by the man t ha t th ree men got in to a boxcar about four

or f ive hundred yards down the t rack . Wise, in company with

Bi l l Bass, Roy Vaughn and Middleton, went to the boxcars

and took the men o ff the boxcar . Wise s ta ted the men ac ted

scared and he could smel l wine on the breath of one o f them.

Wise took the men over to the Sher i f f ' s of f i ce and, whi le

wai t ing to turn them over , asked the men fo r i d e n t i f i c a t i 9 n .

'Wise s ta ted tha t he be l ieves two of the men had documented I D s ~.:He wrote the i den t i f i ca t i ons down on paper and pu t them in

h is hat . He tu rned the men over to the Sher i f f ' s o f f i c e

(Deputy ' s name unknown) and went back to h is radio . He

heard over the pol ice radio t ha t a policeman had been s h o ~ and

a little l a t e r heard t h a t it was J .D. Tipp i t . He was to ld to

remain a t the T.S.B.D. and s tayed the re u n t i l re l i eved . Wise

s t a t e d t ha t he put the paper with the t ramps' i den t i f i ca t i on

on it in h is locker , where it remained fo r over a yea r . He

cleaned h is locker o u ~ and j u s t a f t e r t h a t people began

asking him for the informat ion - bu t he had thrown it ou t .

On November 24, Wise was or ig ina l ly assigned in the basement

behind a TV camera. Then he was moved to the corner of Elm

and St. Paul fo r secur i ty and to hold t r a f f i c when the armored

Harkness was in te rv iewed a t 9:20 a.m. on 10/26/77 a t the

County o f Dal las ?robat ion Office on Thornton Expressway. He

s p e n ~ 27 years with the Dal las P.D. and has been r e t i r ed fo r

the ~ a s t four yea rs .

Harkness was ques t ioned about h is a c t i v i t i e s in

connec t ion with the JFK motorcade in Dal las on 11/22/63 .

Harkness road a th ree wheel motorcyc le . He says t h a t h is

funct ion on t ha t day was to supervise the areas Main t o F ie ld

St r e e t s and Elm and Houston St r e e t s on the parade route to

see t h a t no obs t ruc t ions to th e parade were permi t ted . " Ju s t

before the motorcade was due, a man su f fe red an e p i l e p t i c

s e i z u re . We ca l l ed an ambulance from Parkland fo r him. This

i n c i d e n t took place near the pool on the West s ide of Houston.

I went to the corner o f Main and Houston and the' motorcade

came by. I parked my bike and s t a r t ed to cu t diagona l ly across

the grassy area when I heard the sho t s . The Pres ident ' s c a r

s lowed, a lmost s topped . A second and t h i rd sho t came c lose

t oge the r . I cou ldn ' t t e l l where they came from. I went back

to my bike and drove to Indus t r i a l Blvd.

was a school boy. He sa id he saw a r i f l e come from the

window o f the School Book Deposi tory. The boy gave no

d e sc r i p t i o n of a person, he j u s t ta lked abou t the r i f l e .

I took him to the TSBD and turned him over to Inspec tor

Sawyer;" Harkness to ld us .

Ei the r Sawyer o r Lumplain gave him an assignment to

search the ra i l road cars and he helped ro u s t the " three

t ramps ." He did not know t he i r names or what happened to

them. They were taken to the Sher i f f ' so f f i ce . He r eca l l s

t h a t the names o f two escor t ing pol icemen were Wise and Bass .

Harkness then t o ld us t h a t on Saturday morning, Nov. 23,

1963, he was again a t Houston St r e e t across from the county

j a i l . It was no t known when Oswald was to be t rans fe r red

from Pol ice Headquarters to the county and they were guarding

the area in f ron t o f the a l ley-way ent rance to the j a i l .

Jack Ruby came up and was at tempting to ge t pas t the po l ice

b a r r i e r s . Harkness , who knew Ruby, ordered him behind the

rope a t Elm and Houston S t r eeG d iag o n a l l y across the s t r e e t

from th e TSBD. At t ha t t ime, a lumber t ruck came by and

dropped a load of 2x6 ' s on th e s t r e e t . While Harkness was

ye l l i ng a t the d r i v e r , a man from CBS News was s tanding

t he re watching Harkness ' discomfor t . He sa id : "Don ' t worry ,

Sgt . w e ' l l know when he ' s being t r ans fe r red long before you

Harkness touches upon another po in t of i n t e r e s t in

connect ion w1th Lee Harvey Oswald. Marina Oswald (Porter)

in her book "Marina & Lee" says t h a t on only one day Oswald

handed o ut Fair Play For Cuba l e a f l e t s in Dal las . Harkness

says he received a c a l l from a DPD o f f i c e r Walter Finigan

one day t ha t a man was handing o ut pro Castro l i t e r a t u r e

downtown. When Harkness a r r ived a t the scene which he says

was near the Piccad i l ly Hotel a t Main and Ervey St ree t s , th e

person was running away. Finigan asked Sgt . Harkness i f he

should go a f t e r the sub jec t . Harkness to ld him "No, j u s t

l eave him a lone ." Harkness to ld us t he re was no complainant

and there was nothing he could charge the man with . He says

he never saw the man's f ace ,bu t he knows it was Oswald.

t h i s r e s t a u ra n t s ince h is re t i remen t from the Dal las Pol ice Depar t -

ment in 1967. Sawyer r eca l l s t ha t on November 22, 1963, he was

ass igned to be in charge o f a d e t a i l of men on the upper por t ion

of the Pre s ide n t i a l Motorcade. A few minutes a f t e r the Pres iden t .

had passed him, he heard over th e radio t ha t sho t s were f i red from

th e Texas School Book Depos i to ry . Sawyer, who held the rank .of

Inspec to r , immediately rushed to t h i s b u i l d i n ~ and had it secured .

He· then organized a group of law-enforcement of f i ce r s from the

Dallas Pol ice Department , FBI, Secre t Serv ice and the S h e r i f f ' s

Off ice i n s t ruc t i ng them to f ind witnesses and poss ib le suspec t s .

These witnesses were brought to the S h e r i f f ' s of f i c e where a f f i -

dav i t s were taken. Sawyer had also s en t a team to search the r a i l -

road yards as t he re were r e p o r t s t h a t shots may have come from

t h a t d i rec t ion · 'and also it was good inves t iga t ive procedure to

cover a l l sur rounding a reas . He r eca l l s h is men f inding the t h ree

by S t a f f Invest iga tor Harold Rose. The only requirement th e DPDmakes as to shoes i s t ha t they must be black and t h i s o f f i c e r was

wearing black shoes . Las t ly , DPD requ i res only t ha t o f f i c e r s must

be armed with a 38 ca l ibre o r more gun. This o f f i c e r was armed

with a 45 automatic which i s not an uncommon weapon for Dal las

po l i ce o f f i c e r s . This po l i c e o f f i c e r was l a t e r iden t i f i ed as

Marvin Wise.

Although Sawyer was picked to head th e u n i t i n v e s t i -

gat ing the opera t iona l secur i ty involving the t r a ns f e r of Lee

Harvey Oswald, he had very little to do with it as he was hosp i -

t a l i zed a week a f t e r it was formed. Sawyer did s t a t e t ha t he was

kept wel l appr i sed of the progress of the i nves t iga t ion and d id

a s s i s t Captain Baker who prepared the f i na l r e p o r t on th e conc lus ion

of th e i nves t iga t ion . Sawyer had rece ived per iodic informat ion

from h is men and a f t e r reading a l l repor t s submit ted concern ing

the i nve s t i ga t ion , he was pos i t i ve t h a t th e shoot ing of Lee Harvey

Oswald by Jack Ruby was n ot planned because o f the fo l lowing

reasons :
