Mr. Hickman said that the initial cost of instllltion of equipment by the Telephone Co. would be 25.00 and the monthly cost 22.00 plus thIrty cents per call tor all calls made To the crUiser by residents seeking police service. He suggested that the Police Dept. would pay trom '&ts own funds the cost ot installation and the fIrst three months service. After some discussion a pvoposal was made by Council that consideration be given to this service. In view of the controversial nature of the proposal which had been dl'scussed prev1'uosly by -Oouncil much disc*ssiontook place with the result that the City Attorney was directed to look into deed res»rictlon o~cthls lot as well as a stud;v of the zoning ordlnance covering this area and report back to Council at Its next meeting as to a~course to pursue for the p,rotectuon of residents who had earlier vigorously opposed this type ot 'establishment in $ail location

The matter of the operation of the Small Animal Hospital at st. Jos. Lane and the Dixie Hlghway was introduced by Mr. Holt­mann. Mr. P.. W. Clark, Oi*y Attorney,+ who hactbeen instraoted by Counoll to investgate ·the matter "reported as follews: The property was deeded to the present owners by the Sisters at Not're Dame on Aug. 29, 1946. It :was agreed ln the deed that the purchasers could use propety to operate a small animal hospital and clinio. In 1947 this was zoned by the City as bUsiness area but changed to residents! zoning in 1948. Mr. Clark gave the opinion that in view of the deed conveyanoe the City had no right to interfere in :the present operation of a small animal

Arlington Road. Mr. Hanser had indicated that he wished to file suit to have this sttp order removed. The Clerk read the various minutes relating to this p~oject. M~. X.W. Clark City Attorney said that the City might be subject to suit by ,Mr. Hanser in an effort ,to eliminate this stop order. ~After lengthy diSCUssion the Council 1aid the matter aSide pending action by the complaintant. *

was a matter of long and se,rious discus&ion. After this it was decided that the publio Works :Committee in conjunction with the CitY~Engineer would make asurvey of the streets to determine which repairs should be made at this time. They were to contact a local residant don~ractor in an effort to find out approximate costs for various street repairs and report back to Council at the next meeting in order that some definite plan of street repair could be worked out.

Mr. Deister reported that after extensive examination of many makes of eUipment they favored the Wassau plow sold by the Bode-Finn 00. of Cincinnati.

Mr. Smith of the Bode Finn Co. who had been invited to appear before the Board to answer questions did so.

Engineer Report: Mr. Morlidge reported that he had prepared the discription of area needed for the daeding by the City of Covington Park Board of the Park Drive area. He was directed to contact the City Attorney of P~'k Hills on this report

Building Inspector: . Mr. Beckman reported no permits issued for the month of March.

Old Business: , The Clerk reported that he had written Mr. Herbert Elam, as directed, to appear before Gouncil rrelative to the condition of Lower Audubon Road due to cQnstruction of residence and the cutting of alley in rear Qf same.Mr. Elam had called the Clerk and reported that he was ill-and unable to appear at this meeting~and that he had contacted his engineer and was preparing an answer for the city complaint. In the discussion which followed it developed-that Mr. JOS. Lee and+not~Mr. Elam was tle builder of alley way which in the opinion of Council was most-ly repponsible for the street condition. The Clerk was directed to write Mr. Lee a letter asking that he take some immediate action to treat this alley surface so as to cauae the elimination of this difficulty. Mr. Tom Wilde md Audubon Road also appeared before Council to~ protest water and mud in his yard as a result af tais condition en Audubon Road. It was felt by Mr. Wilde and Council that if the prime difficulty of the alley way was remidied that his trouble wo~ld be eliminated.

The Clerk read a-letter from Mrs.·RUth Bun~in asking that the . carry out its agreement made with her relative to putting a

black top gutter in. front of wall be erected by~her in front of her home on Cecelia Ave. This was referred to the publiC Works Dept. for their inspection and action.

New Business: . The Clerk offerea a complaint made by Mrs. Scherrer of Lawton Road that a lot adjacent to her pr~perty was being Used as a dumping place for leaves, twigs, grass etc. This matter was referred to the police Dept. for investigation of the Complaint. The Clerk read the letter of R.B.Boylson asking that a share of the City gasoline, oil and repair business be given him as a tax payer. In the discussion that followed the members of the Safety and publ c Works Depts. were directed Ibo.have their employees g!ve some business.Ib~Mr. Boylson at the Old Mill SerVice Station.-The Clerk read the application of Dennie Hahn to. operate three gasoline pumps, this being a renewal of the license hIed by him. The minutes of the-May 14 meeting and the special meeting on May 21 were approved as corrected.

The regular routine of business was set aside to permit. the consideration of several items of business. Mrs. Englekamp of 1405 Amsterdam Road appeared before Council to protest the keeping of chickens by a resident at 1403, claiming that the noise and odor resultant there~roawas annoying and in her opinion constututed· a nuisance. After discussion, the Chief of police was directed to inform the. owner of said chickens that he was in violation of City Ordinance No.5, 1949, which declared it a nuisance to harbor or keep any dog or other animal of any kind which by loud and frequent, or habitual barking, howl~ng, yelping or otherwise emitting no~se, shall, cause serious disturbance during the day season, or annoying dis~urbance during the night season, to the peace and quiet of the neighborhood, and that said resident must remove the dause of the disturbance by June 19, 1951 or be subject to court action.

At this time the clerk read bids produced in response to adVertisement requesting bids for the repair of various street sections within the City of Park Hills;

The Finance Department--Mr. Savage presented the monthly report of the general fund of the City of Park Hills. He further an­nounced that members of the Finance Department would meet at an early date with the City Clerk and City Assessor for the purpose pf reviewing the financial status of the City and pro­posing ilidi tiona.l ways and means to rai se funds for 1952 to be incorporated in the budget which would be presented later in this year. .

The Building Inspector--Mr. Beckmann, Building Inspector, presented ~wo building permits and two sewer tap permits in the City o,f. Par.k Hills, and fees kk! tn the amount of $46.00. He also acquainted the Coun'cil with an application for the building of a two family apartment house at the intersection of Terrace and Amsterdam Roads, bulding to face Terrace Drive as per deed requirements and being set back 25 feet from this street. The bulding would be s~t five feet from the sidewalk on Amsterdam Road. Since it was the opinion of the City Coun­cil that the building met the deed, building and zoning restric-

OLD BUSINESS--The Clerk announced that no action had been taken by Mr. Joseph Lee in the paying of the alley built at his instigation back of an parallel to a portion of Audubon Road, Park Hills. The Clerk had directed two letters to Mr. Lee and discussed the matter with him by telephone. The Police Department was dieected to notify Mr. Lee that he was in ~iolation of City Ordinances No. 13, 1950 and No.5, 1919, and that he be directed to appear before the Park Hills Police Court on June 13, 1951 to answer complaint arising from the violation of said ordinances.

New Business--The Clerk read a letter from Mr. Ernest DeCoursey of lID02 Park Drive, Park Hills, Ky., protesting the operation of a roadside stand at the Park Drive bus stop. Upon dis.cussion of the matter, it was revealed that the stand in question was operating in a zone not restricted to residences, since this location had been a business establishment prior to the passage of the zoning ordinance by the City of Park Hills. Under these Circumstances,

the City had no right to eliminate this business establishment. CounOil-was unanimous in expressing agreement with Mr~ . DeCoursey's views that legally found itself unable to ~o anyting.about the matter. Complaints made by Mr. DeCoursey as to adJaoent area being used as a dump were referred to the polioe department who direoted the owner of the establish­ment to· remove debris from the area. The Clerk was 4irected to write Mr. DeCoursey informing him of the Counoil's sym­pathy and of the other pertinent faots described above.

The Clerk read the application of Mrs. Johanna Hahn for a license- to sell at retail and buy the drink\ spir1t and vineous,liquors. Applioation was acoompanied by fee of $166.60·whioh would permit sale as described for a period between- July 1, 1951 and April 30, 1952. The regular order of busineas was set aside to permit Mr. Paul Flury of Ludlol-l, Ky. to address the Council. Mr. Flury 't-ll'as seeking the aid of the Council in setting aside a deed restriction on a lot which he had recently purchased. A.fter hearing Mr. Flury, the Council described the deed restriction as beyond the power of the City and. suggested that he. contact the seller of the lot for further relttf.

Mr.Schaffler of Amsterdam Road, Park Hills appeared before council to discuss the complaint which had been made at the June meeting by Mrs. Englekamp.of 1405 Amsterdam Road, Park Hills, relative to Mr. Smhaffler's ~eeping of chickens which the complaintant protested as disturbing and a manace to the health and wel~ being of the . neighborhood. The police , +n keeping with Council instructions,had told Mr. Schaffler that he mus~ ~li@inate th~ nuisance described. Mr. S haffler told Council that he had disposed of the roosters, clean­ed upcruns and in his op~nion the difficulty referr~d to had been eliminatedThe~Chief of police was directed to contact the complaint ant to determine if in her opinion the nuisance had been eliminated and if she was satisfied vii th conditions as there were as of this da!;e.

Committee Reports: Mr. Deister reporting for the public Works Committee: Presented monthly report of the Supt. of this department which was received and filed. _ That the Eaton Oil Works which had been given a contract for certain street repatts had done some of the job, vTidening eurves on Amsterdam Road and sealing the surface of Old State ROad from Terrace to the corporation limit. That· repairs had been made to the pump in. the filtration planD and that it was i..vorking in a satisfactory manner. New sand had been put in the sludge beds. " That the alley to the rear of Audubon Road had been paved as requested by Council and that the mud which was a hazard to the streets and to th disposal plant from this site had been eliminated.

Safety Dept: Mr. Holtmann reporting: The Clerk read the monthly Deports of the Park Hills Police and Fire Depts. were were received and filed.· , police Judge R.G. Grayson submitt~d_~.OO in fines. Mr. Dennie Hahn's, bond as a member of the Volunteer police had been received and signed by Mr. Hahf. Lights pn Scenic, Cecelia and st. Jos. ane not yetv installed. Fire Plugs were installed on st. Jos. Lane and Jackson· Road at a cost low·er that estimated. 109.20 for the former,93.20 for Jackson Road.The plug at Arlington and Hamilton Road was in the pro­cess of being installed but would cost mODe than the others because of the depth ofcthe water main at this pOint.

New business: Mr. Deister submitted a request trom Mr. Morgan o~ Rose Circle to make certain changes on the rear of his property. ~ter thor­o·ugh discussion. a motion was made by Mr. Droege. seconded by Mr. Holtman that the City Clerk write a letter to Mr. Morgan permitting him to make an earth till not to exceed 6 teet in depth over the eXisting sanitary sewer pipe. Also that he shall. at his own expense, raise the existing manhole to clear the heighth of said fill. All work to be done to the satisfaction a'lld under the supervision of the City of Park Hills, It will a'lso be necessary for him to eiXtend the present storm sewer • with the same size pipe. beyond the limit of the proposed fill.

Mr. Deister called Council's attention to a condition existing aD the sewer as it parallels lower Amsterdam Road, atter which ~ motion was made by Mr. Holtman seconded by Mr. Droege and unanimously passed that the Public Works Department be authorized tb make certain repairs to the storm sewer between Amsterdam . Road and the old street car line, opposite the old pump house.

Safety Dept: The Clerk read the monthly reports of the Park.Hills Volunteer Fire Dept. and the Park Hills police Dept. which were recieved and filed. Mr. Holtmann made the follawing report: : 1. That.the poles erecjed by the Citizens Telephone Co. were necessary to supply service to new consumers in a newly developed area and that permission had been granted to the CompanY,for this work. 2. That,a new battery ~ad been purchased for pumper number three. 3. That ~ some building had been started upon the property of the Small Abimal Hospital. upon inquiry it was revealed that no permit had been issued by the Building Inspector. The police were directed to investgate and stop construction , if proceeding, until such time as a building permit had been secured. The Clerk read the resignation of George Biesack as Chief of the Park Hills Volunteer Fire Department due to pressue of personal business. A motion was made by Mr. Savage, seconded by Mr. Steltenkamp that the resignation of George Biesack as Chief.of.the Park.Hills Volun­teer Fire Department be received with regrets, said resignation to be effective as of Jan. 1, 1952. Mr. Steffen of 601 South Arl~ngton Road, Park Hills appeared before, council relative t9 the condition of Cecelia Ave between south Arlington and Rosemont Aves. He complained of the poor condition of this roadway. Mr. Steffen wae informed that this particular portion of Cecelia Ave. was an undedicated street and that as such the City was not permittedto or subject to repairing same. It was suggested to Mr. Steffen that he contact the developers ~f the subdivision for releif. . The City Attorney then read ordinance Number 8, 1951: AN ORDINANCE REGULATING THE.KEZPING OF LIVESTOCK, FOWLS AND ANIMALS WITHIN THE CORPORATE LIMITS OF THE CITY OF PARK HILLS;PROHIBITING THE RUNNING AT LARGE OF SUCH LIVESTOCK,FOWLS AND ANIMALS;EXCEPTING THE KEEPING OF ANIMALS AS P~~:~D PROVIDING A PENALTY FOR THE VIOLATION

The Council deferred aotion on the matter pending an examination of the damages by Mr. Distel" of the public Works Dept. Mr. Deister announced that further aiffiop:lty was being experienced on Lower Audubon Road from mud being deposited on the streets from house excavation, also that this mud was again finding its way into our sewage disposal system. The Clerk gave the report of the Board ~f Equalization which met on Dee. 3 and had two written complaints. NO changes were made in val­uations of real estate.

The Clerk reported on the matter of the possibilty of mailing tax bills in the future. Described the necessary eqUipment which would be ~eeded for ~his job , in thepuDcaase of an addresograph etc. After some discussmon the matter was laid over until a leter date when it would again be ~onsidered in view of tha fact that thetax bills for 1951 were already preapareA.
