Plaintiff is a South Carolina Lim- ited Liability Company who pur- chased the property that is the subject of this matter at a tax sale conducted by the Charleston County Delinquent Tax Collector. Upon information and belief, De- fendant Turner, “Turner” is a resi- dent of Charleston County, South Carolina. Defendant was the for- mer owner of the subject property prior to losing it for failure to pay the annual ad valorem taxes for Charleston County. Upon information and belief, de- fendant CFNA Receivables, Inc. “CFNA” changed its name from Citifinancial, Inc. Upon information and belief, CFNA is the same en- tity, a South Carolina corporation in good standing, that was Citifinan- cial, Inc. , previously located at 921-B Houston Northcutt Blvd., Mt. Pleasant, SC 29464. CFNA is named as a Defendant in this case to adjudicate its rights in the sub- ject property, if any based on a mortgage signed to Citifiancial, Inc. by previous owners of the property, Frank Turner and Celes- tine W. Turner on February 6, 2003 that was recorded in the Charleston County RMC Office in Book E436, Page 460 on February 7, 2003. Jurisdiction and venue is proper as the property that is the subject of this matter is in Charleston County, South Carolina. Plaintiff is the owner of this prop- erty by virtue of a “tax” deed from Daniel M. Gregory, Delinquent Tax Collector Charleston County, dated February 4, 2014, recorded February 14, 2014, RMC Office, Charleston County, Book 388, Page 582. The property that is the subject of this action is described below here as well as the Lis Pendens: All that lot, piece, parcel or track of land, situate, lying, and being known as Lot E-2, .292 acres, being a portion of Lot E, Christ Church Parish, Charleston County, South Carolina, as shown and designated on a plat named, “Plat showing the subdivision of Lot E into Lot E-1 and E-2, Christ Church Parish, Charleston County, South Carolina”, by ARC Surveying Com- pany, Inc., dated March 22, 1990, and recorded in the RMC Office for Charleston County on April 19, 1990 in Plat Book BY, Page 192. TMS No. 577-05-00-044 Upon information and belief, De- fendant Turner, was the sole owner of this property for the entire time of this action that is relevant from on or near 2002 until Febru- ary 14, 2014, the date of the recording of the “tax” deed men- tioned in No. 6 above. That Defendants, nor any of its successors, or agents failed to pay the real property taxed levied and assessed against the subject prop- erty for the tax year 2011 by the duly authorized political subdivi- sions of the State of South Car- olina, including, but not limited to, County of Charleston, for taxes to be collected by the County of Charleston. That on or near May 21, 2012, Charleston County Delinquent Tax Office, issued its tax execution for the tax year 2011 on the subject property against Defendant Turner after Defendants continued to fail to pay the taxes. A Copy of this Execution is attached with the Complaint as Exhibit A. That said execution strictly charged and commanded the Delinquent Tax Collector and/or Charleston County Treasurer to levy by distress and sell so much of the property the subject of this action as necessary to satisfy the delinquent taxes, assessments, penalties and costs then due as re- quired by SC Code of Laws §12- 51-40a. The taxes, assessments, penalties and costs were still not paid by on or near June 15, 2015. Therefore and thereafter, the Charleston County Delinquent Tax Collector, successfully took exclusive pos- session of the subject property by mailing the Official Notice of Levy to the Defendant “Certified Mail- Return Receipt Requested- Re- stricted Delivery” to Defendant at the address he gave to Charleston County for notices, which was 2145 Josephine Drive, Mt. Pleas- ant, SC 29466. This notice was re- turned by the Post Office signed by Defendant Turner on June 20, 2012. A copy of the Notice and the “Green Card” that Ms. Turner signed is included with this Com- plaint as Exhibit B. At that time, the Delinquent Tax Office took ex- clusive physical possession of the subject property. That on or near November 5, 2012, the Office of the Charleston County Delinquent Tax Office sold the subject property for the contin- ued failure to pay the ad valorem taxes of 2011. The Delinquent Tax Office sold the property during the normal hours of sale and after due advertisement of same in the Post and Courier. The winning bidder was Plaintiff for the sum of FIVE THOUSAND DOLLARS ($5,000.00). Plaintiff or his agent paid this sum to the Charleston County Delinquent Tax Collector on the same date as the sale. A copy of the advertisements in the Post and Courier advertising the property for sale on October 15, 22, and 29, 2012 are attached as Exhibit C of this Complaint. Notice of the sale and redemption amount was mailed to Defendant Turner on or just after December 4, 2012. A copy of this Notice is in- cluded with this Complaint as Ex- hibit D. That on or near October 11, 2013, between 20 and 45 days before the expiration of the one year re- demption time period, the Office of the Delinquent Tax Office for Charleston County sent the “Final Notice- Ending of the Redemption Period” that is required by §12-51- 120, SC Code of Laws. This No- tice was sent “Certified Mail- Return Receipt Requested, Re- stricted Delivery”. The Notice to Defendant Turner was returned “Unclaimed- Unable to Forward” . A copy of this letter and the at- tempted delivery is attached as Ex- hibit E. Further, notice was sent to Citifi- nancial, Inc, at the last known ad- dress for it, the address (921-B Houston Northcutt Blvd., Mt. Pleasant, SC 29466) listed for it on the Mortgage on the property that is the subject of this matter that was signed to them. This notice was returned “Undeliverable as Addressed- Unable to Forward”. Exhibit F is the letter to Citifinan- cial and the Green Card that shows the Delinquent Tax Office used to attempt delivery on Citifi- nancial. That no one, no Defendant, nor anyone on their behalf, redeemed the subject property during the one year redemption period. That Plaintiff is now the owner of the subject property in fee simple absolute. That, upon review of the records of the Charleston County Delinquent Tax Office and the Treasurer of Charleston County, all relevant facets of Charleston County gov- ernment followed all requirements under statutory and common law in all material respects with regards to this tax sale. That the duly assessed real prop- erty taxes, together with all assess- ments, penalties and costs, constituted a first lien on the prop- erty and was senior to all other liens against the said property. That, by virtue of the failure of De- fendants to pay the taxes on the subject property for the year 2011, by virtue of Plaintiffʼs successful bid at the delinquent tax sale on or near November 5, 2012 by virtue of Defendantsʼ failure to redeem the subject property, and by virtue of the conveyance of the subject property to Plaintiff mentioned pre- viously in this Complaint, any and all interests of Defendants in the property have been extinguished. Plaintiff is unaware of any other party that may have a valid claim on the subject property other than the Defendants, their heirs and as- signs. That, upon information and belief, Plaintiff is entitled to judgment de- claring himself the sole owner of the subject property in fee simple and the interests of Defendants should be barred forever. Upon information and belief, De-fendant Turner, was the soleowner of this property for the entiretime of this action that is relevantfrom on or near 2002 until Febru-ary 14, 2014, the date of therecording of the “tax” deed men-tioned in No. 6 above. That Defendants, nor any of itssuccessors, or agents failed to paythe real property taxed levied andassessed against the subject prop-erty for the tax year 2011 by theduly authorized political subdivi-sions of the State of South Car-olina, including, but not limited to,County of Charleston, for taxes tobe collected by the County ofCharleston.That on or near May 21, 2012,Charleston County Delinquent TaxOffice, issued its tax execution forthe tax year 2011 on the subjectproperty against Defendant Turnerafter Defendants continued to failto pay the taxes. A Copy of thisExecution is attached with theComplaint as Exhibit A. That said execution strictlycharged and commanded theDelinquent Tax Collector and/orCharleston County Treasurer tolevy by distress and sell so muchof the property the subject of thisaction as necessary to satisfy thedelinquent taxes, assessments,penalties and costs then due as re-quired by SC Code of Laws §12-51-40a. The taxes, assessments, penaltiesand costs were still not paid by onor near June 15, 2015. Thereforeand thereafter, the CharlestonCounty Delinquent Tax Collector,successfully took exclusive pos-session of the subject property bymailing the Official Notice of Levyto the Defendant “Certified Mail-Return Receipt Requested- Re-stricted Delivery” to Defendant atthe address he gave to CharlestonCounty for notices, which was2145 Josephine Drive, Mt. Pleas-ant, SC 29466. This notice was re-turned by the Post Office signed byDefendant Turner on June 20,2012. A copy of the Notice andthe “Green Card” that Ms. Turnersigned is included with this Com-plaint as Exhibit B. At that time,the Delinquent Tax Office took ex-clusive physical possession of thesubject property. That on or near November 5,2012, the Office of the CharlestonCounty Delinquent Tax Office soldthe subject property for the contin-ued failure to pay the ad valoremtaxes of 2011. The Delinquent TaxOffice sold the property during thenormal hours of sale and after dueadvertisement of same in the Postand Courier. The winning bidderwas Plaintiff for the sum of FIVETHOUSAND DOLLARS($5,000.00). Plaintiff or his agentpaid this sum to the CharlestonCounty Delinquent Tax Collectoron the same date as the sale. Acopy of the advertisements in thePost and Courier advertising theproperty for sale on October 15,22, and 29, 2012 are attached asExhibit C of this Complaint. Notice of the sale and redemptionamount was mailed to DefendantTurner on or just after December4, 2012. A copy of this Notice is in-cluded with this Complaint as Ex-hibit D. That on or near October 11, 2013,between 20 and 45 days beforethe expiration of the one year re-demption time period, the Office ofthe Delinquent Tax Office forCharleston County sent the “FinalNotice- Ending of the RedemptionPeriod” that is required by §12-51-120, SC Code of Laws. This No-tice was sent “Certified Mail-Return Receipt Requested, Re-stricted Delivery”. The Notice to

Defendant Turner was returned“Unclaimed- Unable to Forward” .A copy of this letter and the at-tempted delivery is attached as Ex-hibit E. Further, notice was sent to Citifi-nancial, Inc, at the last known ad-dress for it, the address (921-BHouston Northcutt Blvd., Mt.Pleasant, SC 29466) listed for it onthe Mortgage on the property thatis the subject of this matter thatwas signed to them. This noticewas returned “Undeliverable asAddressed- Unable to Forward”.Exhibit F is the letter to Citifinan-cial and the Green Card thatshows the Delinquent Tax Officeused to attempt delivery on Citifi-nancial. That no one, no Defendant, noranyone on their behalf, redeemedthe subject property during the oneyear redemption period.That Plaintiff is now the owner ofthe subject property in fee simpleabsolute. That, upon review of the records ofthe Charleston County DelinquentTax Office and the Treasurer ofCharleston County, all relevantfacets of Charleston County gov-ernment followed all requirementsunder statutory and common law inall material respects with regardsto this tax sale.That the duly assessed real prop-erty taxes, together with all assess-ments, penalties and costs,constituted a first lien on the prop-erty and was senior to all otherliens against the said property.
