For the past 10 years, September has been REALTOR® Safety Month and we all need to make a commitment all year long to have a plan and avoid risky situations. The Risk Management Forum Group Steve Owen and the Appraisal Committee presented Joining Forces, How can we BE BETTER. His suggestion is Agents and Appraisers have to work together and help each other by communicating more effectively. He said legally after an appraisal is completed Appraisers can’t go back and make changes. But, an Agent can provide an Appraiser with comps at the beginning of the transaction, when a copy of the contract is sent to the Appraiser, this allows the Appraiser to take the Agent’s opinion into consideration. Mr. Owen also suggested local MLS’s might look into using the UAD guidelines so Agents and Appraisers are on the same page, using the same terms when describing homes. From the Fannie Mae Website: To improve the quality and consistency of appraisal data for loans delivered to the government-sponsored enterprises (GSEs), Fannie Mae and Freddie Mac, at the direction of the Federal Housing Finance Agency (FHFA), developed the Uniform Appraisal Dataset (UAD), which defines all fields required for an appraisal submission for specific appraisal forms and standardizes definitions and responses for a key subset of fields. The Risk Management Group also discussed Video Surveillance: There was discussion about a Buyer that had been recorded on a “baby monitor” or “nanny cam” while viewing a home. The Buyer made an offer and when the Listing Agent presented the offer, the Seller said he knew the Buyers would pay more because of what they had said on the video, while in the Seller’s home. the conversation consents. See Mo. Rev. Stat. § 542.402.2. On the other hand, what

about Buyers recording a home they are viewing and then they post it on YouTube or

Facebook to show their friends, should they have permission to post someone else’s

property? There was discussion about getting some legal advice on these matters and

possibly creating a form that says buyer can video and share.

In the Residential Forms Group there was an update on several forms that had been

reworked by the committees as well as a Proposed New Index of the MAR Forms

Library to make it easier for Realtors® to search for a form and group a type of

transaction. It was requested by the Group that Steve Graham (MAR’s Legal Council)

create short videos (similar to his “Keeping it Legal” videos) discussing changes to

MAR forms to help explain the changes to Missouri Realtors®. This should help all

of us stay up to date on the many changes to the forms throughout the year.

On Friday, I attended the Board of Directors meeting where the 2015 Budget was

presented and approved, New MR Directors were inducted, and LaNora Kay from Tri-

Lakes Board of Realtors® was elected as Missouri’s new NAR Director.

A final quote from a favorite TV show from the 80’s, Sergeant Phil Esterhaus always

ended his briefings by saying, “Hey, let's be careful out there.” I agree. Please, be

careful and have a plan when you are meeting customers away from your office.

Board of Directors Meeting

September 10, 2014

The meeting was called to order by Beth Riggins at 9:10 a.m.

Present: Beth Riggins, Nancy Rogers, Phyllis Flinn, Susan Stoltman,

Mickey LaFerla, Anita Horn, Barb Stockwell, Bill Johnson, Vicki Brown, and

Linda Yelton.

Absent: Kevin Winters

The minutes of the August 13, 2014 meeting were approved.

No MLS Committee Recommendations.

No new offices.

New Members: A motion was made, seconded and passed to accept

Karin Brambilla as a new member.

Finance committee: The proposed 2015 budget was discussed. An

increase is being proposed for key pad and e-key rental as Supra is

increasing its rates. A motion was made, seconded and passed to submit

the proposed budget to the membership.

Review of new (work-in-progress) Board website: The Board looked

at the mock up and discussed the site and possible changes. The website

committee will talk to the web designer about any changes.

LOBR Logo contest: Linda has not received any LOGO submissions at

this time. Creator of chosen logo would get one free meal at every dinner

meeting next year.

Property Management Output Group The property management section is looking for a new logo. If you have any ideas

for the logo please feel free to contact me and I will get it to the Chair. After the

business of approving minutes and the budget it was decided to put together a

Property Management Summit, details to be worked on and developed for a time

in 2015. Through the research for the summit it was decided that we really would

like a guide for property management. After much discussion a proposal was

made to speak with Steve Graham for guidance on how to prepare this “How-to”

book which will list examples with statutes, etc.

Commercial Output Group

After introductions and approval of minutes there was a lengthy discussion on the

upcoming Commercial Day in Columbia, MO. This is an excellent program in

combination with Missouri University. A lot of time has been put into developing

this program and we look forward to your attendance and feedback. The

Commercial forms group has been absorbed by the Commercial Output Group.

Currently there are 4 forms we are editing: Letter of Intent to Lease Commercial

Property; Letter of Intent to Purchase Commercial Property; Commercial Lease-

Multi-Tenant; and Commercial Lease- Single Tenant. Your feedback will be

greatly appreciated.
