    THE ADMINISTRATIVE CODEThe Arizona Administrative Code is where the official rules of thestate of Arizona are published. The Code is the official codificationof rules that govern state agencies, boards, and commissions.Virtu-ally everything in your life is affected in some way by rules pub-lished in the Arizona Administrative Code, from the quality of airyou breathe to the licensing of your dentist. This chapter is one ofmore than 230 in the Code compiled in 21 Titles.

    ADMINISTRATIVE CODE SUPPLEMENTSRules filed by an agency to be published in the AdministrativeCode are updated quarterly. Supplement release dates are printed onthe footers of each chapter:

    First Quarter: January 1 - March 31Second Quarter: April 1 - June 30Third Quarter: July 1 - September 30Fourth Quarter: October 1 - December 31

    For example, the first supplement for the first quarter of 2016 iscited as Supp. 16-1.

    HOW TO USE THE CODERules may be in effect before a supplement is released by theOffice. Therefore, the user should refer to issues of the ArizonaAdministrative Register for recent updates to rule Sections.

    ARTICLES AND SECTIONSRules in chapters are divided into Articles, then Sections. The “R”stands for “rule” with a sequential numbering and lettering systemseparated into subsections.

    HISTORICAL NOTES AND EFFECTIVE DATESHistorical notes inform the user when the last time a Section wasupdated in the Administrative Code. Be aware, since the Officepublishes each quarter by entire chapters, not all Sections areupdated by an agency in in a supplement release. Many times justone Section or a few Sections may be updated in the entire chapter.

    ARIZONA REVISED STATUTE REFERENCESThe Arizona Revised Statutes (A.R.S.) are available online at theLegislature’s website, www.azleg.gov.     EXEMPTIONS FROM THE APAIt is not uncommon for an agency to be exempt to the steps outlinedin the rulemaking process as specified in the Arizona Administra-tive Procedures Act, also known as the APA (Arizona Revised Stat-utes, Title 41, chapter 6, Articles 1 through 10). Other agencies maybe given an exemption to certain provisions of the Act.

    An agency's exemption is written in law from the Arizona StateLegislature or under a referendum or initiative passed into law byArizona voters.

    When an agency files an exempt rulemaking package with ourOffice it specifies the law exemption in what is called the preambleof rulemaking. The preamble is published in the Arizona Adminis-trative Register online at www.azsos.gov/rules, click on the Admin-istrative Register link.

    In the Administrative Code the Office includes editor’s notes at thebeginning of a chapter indicating that certain rulemaking Sectionswere made by exempt rulemaking. Exempt rulemaking notes arealso included in the historical note at the end of a rulemaking Sec-tion.

    The Office makes a distinction to certain exemptions because somerules are made without receiving input from stakeholders or thepublic. Other exemptions may require an agency to propose exemptrules at a public hearing.

    EXEMPTIONS AND PAPER COLORIf you are researching rules and come across rescinded chapters ona different paper color, it is because the agency filed a Notice ofExempt Rulemaking. At one time the office published exempt ruleson either blue or green paper. Blue meant the authority of theexemption was given by the Legislature; green meant the authoritywas determined by a court order. In 2001 the Office discontinuedpublishing rules using these paper colors.

    ARTICLE 1. GENERAL PROVISIONSR12-1-101. Scope and Incorporated MaterialsA. Except as otherwise specifically provided, this Chapter applies

    to all persons who receive, possess, use, transfer, own, oracquire any source of radiation.

    B. This Chapter does not apply to any person that is subject toregulation by the Nuclear Regulatory Commission.

    R12-1-102. DefinitionsTerms defined in A.R.S. § 30-651 have the same meanings whenused in this Chapter, unless the context otherwise requires. Addi-tional subject-specific definitions are used in other Articles.

    “A1” means the maximum activity of special form radioactivematerial permitted in a type A package. These values are eitherlisted in 10 CFR 71, Appendix A, Table A-1, or may bederived in accordance with the procedures prescribed in 10CFR 71, Appendix A, revised January 1, 2015, incorporatedby reference, and available under R12-1-101. This incorpo-rated material contains no future editions or amendments.

    “A2” means the maximum activity of radioactive material,other than special form radioactive material, low specificactivity (LSA) material, and surface contaminated object(SCO) material, permitted in a Type A package. These valuesare either listed in 10 CFR 71, Appendix A, Table A-1, or maybe derived in accordance with the procedure prescribed in 10CFR 71, Appendix A, revised January 1, 2015, incorporatedby reference, and available under R12-1-101. This incorpo-rated material contains no future editions or amendments.

    “Absorbed dose” means the energy imparted by ionizing radi-ation per unit mass of irradiated material. The units ofabsorbed dose are the gray (Gy) and the rad.

    “Accelerator” means any machine capable of acceleratingelectrons, protons, deuterons, or other charged particles in avacuum and of discharging the resultant particulate or otherradiation into a medium at energies usually in excess of 1MeV. For purposes of this definition, “particle accelerator” isan equivalent term.

    “Accelerator produced material” means any material maderadioactive by irradiating it in a particle accelerator.

    “Act” means A.R.S. Title 30, Chapter 4.

    “Activity” means the rate of disintegration, transformation, ordecay of radioactive material. The units of activity are the bec-querel (Bq) and the curie (Ci).

    “Adult” means an individual 18 or more years of age.

    “Agency,” or “ARRA” means the Arizona Radiation Regula-tory Agency.

    “Agreement State” means any state with which the UnitedStates Nuclear Regulatory Commission has entered into aneffective agreement under Section 274(b) of the AtomicEnergy Act of 1954, as amended (73 Stat. 689). “Nonagree-ment State” means any other state.

    “Airborne radioactive material” means any radioactive mate-rial dispersed in the air in the form of aerosols, dusts, fumes,mists, vapors, or gases.

    “Airborne radioactivity area” means a room, enclosure, or areain which airborne radioactive materials, composed wholly orpartly of licensed radioactive material, exist in concentrations:

    In excess of the derived air concentrations (DACs)specified in Appendix B, Table I of Article 4 of theserules; or

    That an individual present in the area without respiratoryprotective equipment could exceed, during the hours anindividual is present in a week, an intake of 0.6 percent ofthe annual limit on intake (ALI) or 12 DAC-hours.

    “ALARA” means as low as is reasonably achievable, makingevery reasonable effort to maintain exposures to radiation asfar below the dose limits in these rules as is practical, consis-tent with the purpose for which the licensed or registeredactivity is undertaken, taking into account the state of technol-ogy, the economics of improvements in relation to state oftechnology, the economics of improvements in relation to ben-efits to the public health and safety, and other societal andsocioeconomic considerations, and in relation to utilization ofnuclear energy and licensed or registered sources of radiationin the public interest.

    “Analytical x-ray equipment” means equipment used for x-raydiffraction or x-ray-induced fluorescence analysis.

    “Analytical x-ray system” means a group of components uti-lizing x-rays to determine the elemental composition or toexamine the microstructure of materials.

    “Annual” means done or performed yearly. For purposes ofChapter 1 any required activity done or performed within plusor minus two weeks of the annual due date is considered doneor performed in a timely manner.

    “Authorized medical physicist” means an individual whomeets the requirements in R12-1-711; or is identified as anauthorized medical physicist or teletherapy physicist on:

    A specific medical use license issued by the Agency,NRC, or another Agreement State;

    A medical use permit issued by a NRC master materiallicensee;

    A permit issued by an Agency, NRC, or anotherAgreement State broad scope medical use licensee; or

    A permit issued by a NRC master material license broadscope medical use permittee.

    “Authorized nuclear pharmacist” means a pharmacist whomeets the requirements in R12-1-712; or is identified as anauthorized nuclear pharmacist on:

    A specific license issued by an Agency, NRC, or anotherAgreement State that authorizes medical use or thepractice of nuclear pharmacy;

    A permit issued by a NRC master material licensee thatauthorizes medical use or the practice of nuclearpharmacy;

    A permit issued by an Agency, NRC, or anotherAgreement State broad scope medical use licensee thatauthorizes medical use or the practice of nuclearpharmacy; or

    A permit issued by a NRC master material license broadscope medical use permittee that authorizes medical useor the practice of nuclear pharmacy; or

    Is identified as an authorized nuclear pharmacist by acommercial nuclear pharmacy that has been authorized toidentify authorized nuclear pharmacists; or

    Is designated as an authorized nuclear pharmacist inaccordance with R12-1-311(G).

    “Authorized user” means a physician, dentist, or podiatristwho meets the requirements in R12-1-719, R12-1-723, R12-1-727, R12-1-728, or R12-1-744; or is identified as an autho-rized user on:

    An Agency, NRC, or another Agreement State licensethat authorizes the medical use of radioactive material;

    A permit issued by a NRC master material licensee that isauthorized to permit the medical use of radioactivematerial;

    A permit issued by an Agency, NRC, or another Agree-ment State specific licensee of broad scope that is autho-rized to permit the medical use of radioactive material; orA permit issued by a NRC master material license broadscope permittee that is authorized to permit the medicaluse of radioactive material.

    “Background radiation” means radiation from cosmic sources;not technologically enhanced naturally occurring radioactivematerial, including radon (except as a decay product of sourceor special nuclear material); and global fallout as it exists inthe environment from the testing of nuclear explosive devicesor from past nuclear accidents, such as Chernobyl, that con-tribute to background radiation and are not under the control ofa licensee. “Background radiation” does not include sources ofradiation regulated by the Agency.

    “Becquerel” (Bq) means the International System (SI) unit foractivity and is equal to 1 disintegration per second (dps or tps).

    “Bioassay” means the determination of kinds, quantities, orconcentrations, and in some cases, the locations of radioactivematerial in the human body, whether by direct measurement,in vivo counting, or by analysis and evaluation of materialsexcreted or removed from the human body. For purposes ofthese rules, “radiobioassay” is an equivalent term.

    “Brachytherapy” means a method of radiation therapy inwhich an encapsulated source or group of sources is utilized todeliver beta or gamma radiation at a distance of up to a fewcentimeters, by surface, intracavitary or interstitial application.

    “Byproduct material” means:

    Any radioactive material, except special nuclear material,yielded in or made radioactive by exposure to theradiation incident to the process of producing or utilizingspecial nuclear material;

    The tailings or wastes produced by the extraction orconcentration of uranium or thorium from ore processedprimarily for its source material content, includingdiscrete surface wastes resulting from uranium or thoriumsolution extraction processes. Underground ore bodiesdepleted by these solution extraction operations do notconstitute “byproduct material” within this definition;

    Any discrete source of radium-226 that is produced,extracted, or converted after extraction, for use for acommercial, medical, or research activity; or any materialthat, has been made radioactive by use of a particleaccelerator; and is produced, extracted, or converted afterextraction, for use for a commercial, medical, or researchactivity; and

    Any discrete source of naturally occurring radioactivematerial, other than source material, that the NRC, inconsultation with the Administrator of the EnvironmentalProtection Agency, the Secretary of Energy, the Secretaryof Homeland Security, and the head of any otherappropriate federal agency, determines would pose athreat similar to the threat posed by a discrete source ofradium-226 to the public health and safety or the commondefense and security and; before, on, or after August 8,2005, is extracted or converted after extraction for use ina commercial, medical, or research activity.

    “Calendar quarter” means not less than 12 consecutive weeksnor more than 14 consecutive weeks. The first calendar quarterof each year shall begin in January and subsequent calendarquarters shall be so arranged such that no day is included inmore than one calendar quarter and no day in any one year isomitted from inclusion within a calendar quarter. A licensee orregistrant shall not change the method of determining calendarquarters for purposes of this Chapter except at the beginning ofa calendar year.

    “Calibration” means the determination of:

    The response or reading of an instrument relative to aseries of known radiation values over the range of theinstrument, or

    The strength of a source of radiation relative to astandard.

    “Carrier” means a person engaged in the transportation of pas-sengers or property by land or water as a common, contract, orprivate carrier, or by civil aircraft.

    “Certifiable cabinet x-ray system” means an existing uncerti-fied x-ray system that meets or has been modified to meet thecertification requirements specified in 21 CFR 1020.40,revised April 1, 2013, incorporated by reference, and availableunder R12-1-101. This incorporated material contains nofuture editions or amendments.

    “Certificate holder” means a person who has been issued a cer-tificate of compliance or other package approval by theAgency or NRC.

    “Certificate of Compliance” (CoC) means the certificateissued by the NRC under 10 CFR 71, Subpart D, (Revised Jan-

    uary 1, 2010, incorporated by reference, and available underR12-1-101. This incorporated material contains no future edi-tions or amendments.), which authorizes the design of a pack-age for the transportation of radioactive material.

    “Certified cabinet x-ray system” means an x-ray system thathas been certified in accordance with 21 CFR 1010.2, as beingmanufactured and assembled on or after April 10, 1975, inaccordance with the provisions of 21 CFR 1020.40, both sec-tions revised April 1, 2013, incorporated by reference, andavailable under R12-1-101. This incorporated material con-tains no future editions or amendments.

    “CFR” means Code of Federal Regulations.

    “Chelating agent” means amine polycarboxylic acids,hydroxycarboxylic acids, gluconic acid, and polycarboxylicacids.

    “Civil penalty” means the monetary fine which may beimposed on licensees by the Agency, pursuant to A.R.S. § 30-687, for violations of the Act, this Chapter, or license condi-tions.

    “Collective dose” means the sum of the individual dosesreceived in a given period of time by a specified populationfrom exposure to a specified source of radiation.

    “Committed dose equivalent” (HT,50) means the dose equiva-lent to organs or tissues of reference (T) that will be receivedfrom an intake of radioactive material by an individual duringthe 50-year period following the intake.

    “Committed effective dose equivalent” (HE,50) is the sum ofthe products of the weighting factors applicable to each of thebody organs or tissues that are irradiated and the committeddose equivalent to each of these organs or tissues (HE,50 = SwT,HT,50).

    “Consortium” means an association of medical use licenseesand a PET radionuclide production facility in the same geo-graphical area that jointly own or share in the operation andmaintenance cost of the PET radionuclide production facilitythat produces PET radionuclides for use in producing radioac-tive drugs within the consortium for noncommercial distribu-tions among its associated members for medical use. The PETradionuclide production facility within the consortium must belocated at an educational institution or a federal facility or amedical facility.

    “Curie” means a unit of quantity of radioactivity. One curie(Ci) is that quantity of radioactive material which decays at therate of 3.7E + 1010 transformations per second (tps).

    “Current license or registration” means a license or registra-tion issued by the Agency and for which the licensee has paidthe license or registration fee for the current year according toR12-1-1304.

    “Deep-dose equivalent” (Hd), which applies to external wholebody exposure, is the dose equivalent at a tissue depth of 1centimeter (1000 mg/cm2).

    “Depleted uranium” means the source material uranium inwhich the isotope uranium-235 is less than 0.711 weight per-cent of the total uranium present. Depleted uranium does notinclude special nuclear material.

    “Discrete source” means a radionuclide that has been pro-cessed so that its concentration within a material has been pur-

    posely increased for use for commercial, medical, or researchactivities.

    “Dose” is a generic term that means absorbed dose, doseequivalent, effective dose equivalent, committed dose equiva-lent, committed effective dose equivalent, total organ doseequivalent, or total effective dose equivalent. For purposes ofthese rules, “radiation dose” is an equivalent term.

    “Dose equivalent” (HT) means the product of the absorbeddose in tissue, quality factor, and all other necessary modify-ing factors at the location of interest. The units of dose equiva-lent are the sievert (Sv) and rem.

    “Dose limits” means the permissible upper bound of radiationdoses established in accordance with these rules. For purposesof these rules, “limits” is an equivalent term.

    “Dosimeter” (See “Individual monitoring device”)

    “Effective dose equivalent” (HE) means the sum of the prod-ucts of the dose equivalent to each organ or tissue (HT) and theweighting factor (wT) applicable to each of the body organs ortissues that are irradiated (HE = S wTHT).

    “Effluent release” means any disposal or release of radioactivematerial into the ambient atmosphere, soil, or any surface orsubsurface body of water.

    “Embryo/fetus” means the developing human organism fromconception until the time of birth.

    “Enclosed beam x-ray system” means an analytical x-ray sys-tem constructed in such a way that access to the interior of theenclosure housing the x-ray source during operation is pre-cluded except through bypassing of interlocks or other safetydevices to perform maintenance or servicing.

    “Enclosed radiography” means industrial radiography con-ducted by using cabinet radiography or shielded room radiog-raphy.

    “Cabinet radiography” means industrial radiographyconducted by using an x-ray machine in an enclosure notdesigned for human admittance and which is so shieldedthat every location on the exterior meets the conditionsfor an “unrestricted area.”

    “Shielded room radiography” means industrialradiography conducted using an x-ray machine in anenclosure designed for human admittance and which is soshielded that every location of the exterior meets theconditions for an “unrestricted area.”

    “Entrance or access point” means any opening through whichan individual or extremity of an individual could gain access toradiation areas or to licensed radioactive materials. Thisincludes entry or exit portals of sufficient size to permit humanentry, irrespective of their intended use.

    “Exhibit” for purposes of these rules, is equivalent in meaningto the word “Schedule” as found in previously issued rules,current license conditions, and regulation guide.

    “Explosive material” means any chemical compound, mixture,or device which produces a substantial instantaneous releaseof gas and heat spontaneously or by contact with sparks orflame.

    “Exposure” means:

    Being subjected to ionizing radiation or radioactivematerials.

    The quotient of dQ by dm where “dQ” is the absolutevalue of the total charge of the ions of one sign producedin air when all the electrons (negatrons and positrons)liberated by photons in a volume element of air havingmass “dm” are completely stopped in air. The special unitof exposure is the roentgen (R).

    “Exposure rate” means the exposure per unit of time.

    “External dose” means that portion of the dose equivalentreceived from any source of radiation outside the body.

    “Extremity” means the shoulder girdle to the phalanges andthe lower two-thirds of the femur to the phalanges.

    “Fail-safe characteristics” means a design feature whichcauses beam port shutters to close, or otherwise preventsemergence of the primary beam, upon the failure of a safety orwarning device.

    “FDA” means the United States Food and Drug Administra-tion.

    “Field radiography” means industrial radiography, utilizing aportable or mobile x-ray system, which is not conducted in ashielded enclosure.

    “Field station” means a facility where radioactive sources maybe stored or used and from which equipment is dispatched totemporary job sites.

    “Former U.S. Atomic Energy Commission (AEC) or U.S.Nuclear Regulatory Commission (NRC) licensed facilities”means nuclear reactors, nuclear fuel reprocessing plants, ura-nium enrichment plants, or critical mass experimental facili-ties where AEC or NRC licenses have been terminated.

    “Generally applicable environmental radiation standards”means standards issued by the U.S. Environmental ProtectionAgency (EPA), 40 CFR 190 and 191, revised July 1, 2013,incorporated by reference, and available under R12-1-101,under the authority of the Atomic Energy Act of 1954, asamended, that impose limits on radiation exposures or levels,or concentrations or quantities of radioactive material, in thegeneral environment outside the boundaries of locations underthe control of persons possessing or using radioactive material.This incorporated material contains no future editions oramendments.

    “Gray” (Gy) means the International System (SI) unit ofabsorbed dose and is equal to 1 joule per kilogram. One grayequals 100 rad.

    “Hazardous waste” means those wastes designated as hazard-ous in A.R.S. § 49-921(5).

    “Healing arts” means the practice of medicine, dentistry, oste-opathy, podiatry, chiropractic, and veterinary medicine.

    “Health care institution” means every place, institution, orbuilding which provides facilities for medical services or otherhealth-related services, not including private clinics or officeswhich do not provide overnight patient care.

    “High radiation area” means an area, accessible to individuals,in which radiation levels from radiation sources external to thebody could
