VARIANCE

PURSUANT TO section 15.1 of the Alberta Land Stewardship Act, S.A. 2009, c. A-26.8, as amended, (the “Act”), I, Diana McQueen, Stewardship Minister responsible for the Act, have considered the application for a variance made by AltaLink Management Ltd. (the “Applicant”) on August 13, 2013. The Applicant applied for a variance to the Lower Athabasca Regional Plan (Order in Council 268/2012) to build a new 240kV transmission line (1117L) parallel to its existing transmission line (789L) at Township 73, Range 9, West of the 4th Meridian within their existing

disposition (EXE 810133) through the Clyde Lake Provincial Recreation Area, as established under the Lower Athabasca Regional Plan.

I am of the opinion that:

a) the variance is consistent with the purposes of the Act;

b) the variance is not likely to diminish the spirit and intent of the Lower Athabasca Regional Plan; and

c) refusal to grant the variance would result in unreasonable hardship to the Applicant without an offsetting benefit to the overall public interest.

Therefore, pursuant to section 15.1 of the Act, I hereby issue a variance upon the terms and conditions attached as Schedule 1.

TERMS AND CONDITIONS OF THE VARIANCE

The Applicant is hereby granted a variance under the Act to build a new 240kV transmission line (1117L) parallel to its existing transmission line (789L) at Township 73, Range 9, West of the 4th Meridian within their existing disposition (EXE 810133) through the Clyde Lake Provincial Recreation Area, as established under the Lower Athabasca Regional Plan, subject to the following terms and conditions:

1. The Applicant is responsible for obtaining all necessary approvals from any other regulatory agency (federal or provincial) to construct and operate all facilities and infrastructure at or related to the 240kV transmission line (1117L).

2. This variance expires:

(a) upon the expiry, cancellation or termination of the Applicant’s existing disposition (EZE 810133), as amended, under the Public Lands Act, R.S.A. 2000, c. P-40; or

(b) upon the Government of Alberta identifying and dedicating a multi-use corridor in the Clyde Lake Provincial Recreation Area that includes the 240kV transmission line (1117L), its facilities and associated dispositions.
