• provides temporary containment until the response actions are taken
• system capable of containing oil and constructed so that no “discharge” will escape

Why Do You Need Secondary Containment?
• Financial• Political• Environmental

To prevent oil spills from polluting our nation’s navigable waters

What is SPCC 40 CFR 112?
Requires facilities to develop and implement an SPCC plan
![Page 8: The 411 on secondary spill containment and spcc regulations](https://reader033.fdocuments.us/reader033/viewer/2022051516/55ab2a101a28abd6428b4652/html5/thumbnails/8.jpg)
• Operating procedures to prevent an oil discharge
• Control measures to prevent an oil discharge from entering navigable waters
• Countermeasures to contain, clean up and mitigate the effects of any oil discharge that affects navigable waters

What Are Navigable Waters?
• Lakes• Rivers• Streams• Wetlands• Wet meadows• Play lakes• Natural ponds
*As defined by the Clean Water Act

How Does the EPA Define OIL?
• Petroleum• Fuel oil• Sludge• Oil refuse/oil mixed with wastes• Non-petroleum oils• Synthetic oils• Animal fats• Oil and greases• Vegetable oils

“using oil for mechanical or
operational purposes in a manner
that does not significantly reduce
the quality of the oil in electrical
equipment, electric transformers and
hydraulic equipment”

>1,320 gallons of aggregate above ground oil storage capacity, or>42,000 gallons of completely buried oil storage, and>55 gallon capacity in any single container*
*Containers include: bulk storage, oil-filled equipment, mobile/portable equipment

If the facility total aboveground oil storage capacity is 10,000 gallons or less ...
And ... And the facility has ... Then the facility is a:
Within 3 years prior to the Plan certification date, or since becoming subject to the SPCC rule if in operation for less than 3 years, the facility has not had:• A single discharge of oil to
navigable waters exceeding 1,000 gallons, or
• Two discharges of oil to navigable waters exceeding 42 gallons within any 12-month period
No individual aboveground oil containers greater than 5,000 gallons
Tier I Qualified Facility:Complete and self-certify Plan template in lieu of a full PE-certified Plan or other self-certified plan
Any individual aboveground oil container greater than 5,000 gallons
Tier II Qualified Facility: Prepare a self-certified Plan in accordance with all applicable requirements of 112.7 and subparts B or C of the rule, in lieu of a PE-certified Plan.

What is an SPCC Plan?
Do you have a history of spills?
Do you have over 1,320 gallons of oil in one substation?
Are you near navigable waters?
Is there a reasonable expectation of a “discharge”?
![Page 17: The 411 on secondary spill containment and spcc regulations](https://reader033.fdocuments.us/reader033/viewer/2022051516/55ab2a101a28abd6428b4652/html5/thumbnails/17.jpg)
• Hazard identification• Vulnerability analysis• Risk assessment• Response actions• Geographical details

• Physical layout of facility• Commitment of manpower, equipment & materials
Regular inspections, tests and records• Personnel, training and discharge prevention
procedures• Designated person for each facility who is accountable
for discharge prevention• Type of oil in each container and its storage capacity• Discharge or drainage controls, secondary containment• Countermeasures – discovery, response and cleanup• Contact list for contractors, responders, NRC

What is “Discharge”?
“Discharge causing a film or sheen upon or discoloration of the surface of the water or causes a sludge or emulsion to be deposited beneath the surface of the water or upon the adjoining shorelines”
![Page 20: The 411 on secondary spill containment and spcc regulations](https://reader033.fdocuments.us/reader033/viewer/2022051516/55ab2a101a28abd6428b4652/html5/thumbnails/20.jpg)
SPCC 40 CFR 112.7 addresses
discharges from regulated parts of
a facility. Containment design
and capacity are determined by
“good engineering practices.”
What are the types of Secondary Containment?
![Page 21: The 411 on secondary spill containment and spcc regulations](https://reader033.fdocuments.us/reader033/viewer/2022051516/55ab2a101a28abd6428b4652/html5/thumbnails/21.jpg)
SPCC 40 CFR 112.8 addresses discharges from specific parts of a facility. Containment design, sizing and freeboard requirements are specified by SPCC rule.

systems• Weirs, booms, barriers• Spill diversion ponds• Retention ponds• Sorbent materials• Drip pans• Sumps and collection systems
