Yes, this issue covers Christmas! I hope you will find several things in thefollowing pages which will make your present buying easier. P.S A little update: starting at the head of the household, DH (darlinghusband) is pleased with me because at the time of writing (end October) Ihave so far resisted making a fuss about putting on the central heating! Lucy Samara of Newbury Solicitors, GardnerLeader discusses the issues that regularlyoccur when moving a loved one into a carehome.

Moving someone you care about into aresidential care home can be a very stressfuland emotional time. I am seeing more andmore clients moving a loved one into carewanting to ensure that their affairs are in placeto reduce the stress and worry of loved ones.

I have detailed below a snapshot of the issueswhich I regularly discuss with clients in thisexact situation.

I strongly advise my clients to ensure that theyhave either a Lasting Power of Attorney (LPA)or an Enduring Power of Attorney (EPA) inplace. A power of attorney enables the clientto appoint one or up to four people to act astheir attorney to help manage their affairsshould they ever require them too.

In October 2007 the EPA was replaced by theLPA. Therefore if an EPA is already in placeand the donor is happy with their choice ofattorneys there is no need to prepare a newLPA.

Gardner Leader

A common requirement of an EPA which isregularly missed by attorneys is the obligationto register the EPA with the Court ofProtection the moment you reasonably believethe donor is losing mental capacity.

If an EPA has not been prepared I would urgeclients to prepare a LPA. There are two typesof LPA’s - one dealing with Property andAffairs enabling the attorney to pay their bills,sell any property and make decisions on theirbehalf with regard to finances i.e. payment ofcare fees.The other dealing with Health and Welfare – Itwill enable the attorney to make health andwelfare decisions.

The attorney will be able to continue to usethe LPA even if the donor should lose mentalcapacity. I have commonly witnessed thescenario where a child is able to access theirparent’s bank accounts to pay for their billsusing a third party mandate or a generalpower of attorney. Many do not realise that themoment the parent starts to lose mentalcapacity these are no longer valid methodsand the third party will be acting illegally if theycontinue to use them, unlike the LPA.

I would advise my clients to ensure that a Willis in place and check that it is up to date. Bypreparing a Will you can select your executorsand determine who will inherit your estate andin what proportions. The Will can also providefor gifts of any specific legacies i.e. a specificitem or some of money. Other advantagesinclude inheritance tax planning and Care Feeplanning to ensure that your estates areprotected for those you leave behind.

Winter Planters - By Pippa Greenwood

If you live in a particularly cold area, orsimply want to decrease the risk of winterdamage further, try to position winterplanters out of the windiest areas. If possibleplace them fairly close to a house wall onthe south or west side as this will help toprovide a little extra warmth.

A visit to your local plant nursery or gardencentre at this time of year should fill you withinspiration as you’ll be amazed at the rangeof plants available for adding winter colourand interest to pots and planters. Some ofmy favourites are the universal or otherwinter flowering pansies or even hardiersmaller flowered violas.

For some seriously sturdy winter colour, trythe winter flowering heathers as these makea good base for the display and you can, ifyou wish, add trailing plants such asvariegated ivies to help provide extra colour,texture and interesting leaf shapes. All theseplants will last for years, not just the wintermonths.

At this time of year you are likely to findmany garden centres offer very tiny versionsof shrubs such as skimmias, Pieris or holliesand many of the dwarf conifers. Althoughthese obviously have the potential to growconsiderably larger, they will provide goodcolour and interest in a container for a yearor two and can then be planted out into thegarden and allowed to reach their full size.

Even if you’re sure you’re notgoing to venture out in toyour garden much in thecolder months, make sureyou have every possibleencouragement by creating awinter planter or two. A prettyplanter on the front steps orgracing the patio will not only look gorgeousfrom the warm comfort of the house, but willalso help to coax you outside from time totime. Grab a container, some compost and aselection of plants and be creative.

Larger is better, as once temperatures drop alarger container is more likely to protect theroots on the plants due to the greater volumeof compost. Frozen roots are fatal, so this isreally worth bearing in mind. I’d avoid anycontainer less than 30cm (12in) diameter ifpossible, unless you live in a very mild area.Remember that summer bedding displayscan be pulled out now, so you can always re-use suitable containers once the plants havebeen cleared.

Any container will insulate the roots a little,but one made from thick wood (such as awooden trough or window box, or a half-barrel) will be very effective. Good quality,fairy chunky plastic also works quite well. Tryto avoid metal as this tends to conduct cold.

Warm undergarments are all the rage forwinter planters. A lining of bubble-wrappolythene or even a few layers of old fabric orcarpet, sandwiched between the sides of thecontainer and the compost will help to keepboth compost and roots warm. I always savepackaging materials from parcels for this sortof thing; why not pull out the bubble-wrapinner lining from a large padded envelopeand use that?

In warmer areas, you will also be able to addbright patches of colour to your display usingthe ‘winter cherry’ or solanum which hasbright yellow and orange fruits and alsomany of the polyanthus whose super-sized,primrose-like flowers come in a wide rangeof really showy colours. You could also usea few winter flowering cyclamen but thesedefinitely need a very sheltered spot such asa window box on a protected wall.

Finally, don’t forget to prolong the time whichthe planter will look gorgeous by adding in afew early spring flowering bulbs such asminiature narcissus, crocus and miniatureiris. There are many different forms, coloursand shapes of all these bulbs available and ifhidden beneath the roots of your winterbedding plants, you will forget they are thereuntil they burst out in spring and produce alovely flush of fresh, pretty colour and oftensome delightful perfume too.

Wintertime is very difficult for birds,especially the further north that they livebecause the weather gets considerablycolder and harsher. The ground oftenfreezes preventing them from accessing thenutritious worms. The insects arehibernating and most hedgerows and treesare dormant for the cold winter months.Birds can find it difficult to find enough foodor even a drink, especially if the winter hasbrought snow.Lots of people help the birds by throwingout stale bread for them to eat. Althoughthis does elevate the birds hunger, breadisn't a very nutritious food source.Most garden bird’s staple diet is usually,fruit and berries, nuts and seeds, insects,worms and grubs, Very tasty.

To really help the bird out this winter you could string up some monkey nuts. Buy somepeanuts in their shells and thread a sharp wool needle with a length of wool with a knot inthe end of it. Push the needle through the middle of the peanut shell and out of the otherside, it's a bit like threading beads. Thread on more monkey nuts in this way until the woolis almost full. Unthread the needle, make a loop in the wool that is left and tie a knot tokeep the nuts and the loop in place. Use the loop to hang the nuts from the bird-table ortree.You could also make a tasty bird-cake...Add to a bowl some chopped up bacon rind, leftover chicken bits from Sunday dinner, afew peanuts, a few raisins and frozen peas, some shelled sunflower seeds if you have any,some diced apple and a couple of heaped table spoons of flour and mix well. Add somewater and mix to create dough.Mould into a ball shape and leave it over night on the kitchen windowsill to dry. Bymorning it will be hard and ready to leave out on a bird table or lawn for the birds to peckat.It's just as important the water is left out as well as food. In the winter, water turns to iceand the birds do not have access to drinking water. Leave a dish with fresh water in it outin your garden for the birds, and check it on really cold mornings to make sure it hasn'tturned to ice.Some of the UK’s bird population are becoming endangered, this means that theirpopulation numbers are falling. Organisations like the RSPB do valuable work to protectand monitor endangered breeds of bird. You could monitor the birds yourself during thewinter months, spend an hour each day for a week recording all the birds that visit yourgarden or bird-table. Bird watching is also known as twitching.There is a chart on the website, a list of UK winter birds that you may see. Each bird hasan illustration to help you to identify which breed it is, and there is some information abouteach birds preferred habitat. Some birds are residents of the UK, which means they livehere all year round, others just visit for the winter.Some birds on the list are endangered, so some of the birds are rarer than others; but youmay be lucky enough to catch a glimpse of them. Maybe you could tempt them into yourgarden with a bit of tasty bird-cake.

A week before Christmas last year a parcelarrived at my door. It wasn’t something I’dordered from Amazon. It was an unexpectedgift hand delivered by the daughter of afriend who had died earlier in the year.‘Olwen wanted you to have this,’ she said,‘it’s from Bethlehem.’

Later I opened the box and discovered insidebeautiful hand crafted nativity charactersmade from olive wood. My friend had boughtthem on a trip to the Holy Land many yearsago.

I took the characters out one by one and setthem up on the table – Mary and Joseph,shepherds, animals, wise men, a camel andof course the baby. The baby lay in a simpleolive wood manger with his armsoutstretched as if he wanted to be held. So Ipicked him up and held him in the palm of myhand. I stared at him. I stared at the scene.

How many times had I heard the Christmasstory? How many times had I sung about it,preached about it, seen pictures of it?But as I stared at this surprise gift from a

departed friend it was as if I were gazing onthe scene for the first time, or rather gazingon it with fresh eyes. How extraordinary, Ithought, how completely and mind-blowinglystrange, and wonderful, that God gave usthis story. A baby born of a woman, a babyborn of God, a baby heralded by angels andworshipped by shepherds and wise men… alight in the darkness, the life of heavenentrusted into our hands.

The day after the delivery of the nativityscene I took my new arrival to church to

show the children.‘He looks as if hewants to be pickedup’, said one girl,echoing my ownthoughts, ‘look athow his arms arereaching out’. Wetook it in turns tohold the baby.‘Revd Becky – can Itake baby Jesus

home?’ the girl asked as I went to put himback in the manger.

I smiled. Of course that’s what every vicarwants - Jesus taken home, Jesus taken outfrom the church, held in people’s hearts andlives, not put back in the dusty cupboard inthe vestry until next Christmas. But I didn’tpreach her a sermon - nor however did I giveher my olive wood hand carved Jesus fromBethlehem! This surprise gift from a muchmissed friend was going to stay on mymantelpiece all year round, preaching me asilent sermon about all kinds of unexpectedgifts, about heaven come to earth, about thisChristmas hope placed in ordinary hands likemine.
