OVERVIEW he Public Transportation Division (PTN) of the Texas Department of Transportation (TxDOT) administers the Federal Transit Administration (FTA) Elderly Individuals and Individuals with Disabilities Transportation Program, commonly known as the Section 5310 Program. This program provides funds for

purchasing vehicles, transportation services and other equipment that primarily serve individuals who are elderly and/or disabled.

The Section 5310 Program provides valuable assistance to agencies providing public transportation services for the special needs of elderly and persons with disabilities. This program provides capital equipment such as vehicles and communications equipment to public and non-profit agencies. TxDOT has the responsibility to ensure services are coordinated for persons who are elderly and/or have disabilities. Through the funding and administration of this valuable program, the United States Department of Transportation and the State of Texas are jointly providing increased mobility and accessibility, thus improving the quality of life for Texas elderly and disabled citizens. The guidelines and information contained in this guide are intended to inform the reader about:

• The goals of the program;

• Who is eligible for the program and expectations;

• How the program is administered;

• How to apply for funding;

• Responsibilities of program participants;

• Support and resources.

II PROGRAM DESCRIPTION

ection 5310 of the Federal Transit Act, declares that elderly and persons with disabilities should have the same rights as others to utilize mass transportation services. The purpose of the Section 5310 Program is to provide assistance in meeting the transportation needs of these individuals where public transportation

services are unavailable, insufficient or inappropriate. Federal regulations associated with Section 5310 also allow vehicles to be used for the transportation needs of the general public, providing such usage does not interfere with meeting the transportation needs of elderly individuals and persons with disabilities.

Federal funds are apportioned among the States, which have the primary responsibility for administering the program. In Texas, TxDOT is the agency responsible for overall administration of the Section 5310 Program. PTN of TxDOT administers this Federal program for the State of Texas. FTA provides up to 80 percent of the funding.

Program Goals The overall goal of this program is to provide and strengthen the public transportation services available to meet the special needs of the elderly and persons with disabilities.

The department's goal in administering the Section 5310 program is to promote the availability of professional, cost-effective, efficient, and coordinated passenger transportation services to the elderly and persons with disabilities using the most efficient combination of financial and other resources. To achieve this goal, the objectives of the department are to:

1. Promote the development and maintenance of a network of transportation services for the elderly and persons with disabilities throughout the state, in partnership with local stakeholders;

2. Promote and encourage local participation in decision-making; 3. Fully integrate the Section 5310 program with other federal, state, and local resources

and programs that are designed to serve similar populations;

4. Improve the efficiency, effectiveness, and safety of Section 5310 transit systems through the provision of technical assistance and the establishment of performance goals and management objectives; and

5. Include private sector operators in the overall plan to provide transportation services

for the elderly and persons with disabilities.

Eligible Subrecipients

Existing rural and urban transit districts and metropolitan transit authorities will be the primary subrecipients of funds from this program for their respective service areas. For those areas not covered by transit providers, or in cases where the existing provider is unable to provide the transportation, TxDOT may choose an alternative primary recipient.

Examples of alternative subrecipients include, but not limited to a county agency on aging or subrecipients that the state has identified as the lead to coordinate transportation services funded by multiple federal or state human service programs. Subrecipients who have not received evidence of non-profit status may not apply. Evidence of nonprofit status can be demonstrated by an Internal Revenue Service (IRS) 501(c)(3) Federal income tax exemption letter. Applicants may be able to gain use of a vehicle by coordination with another agency, which has non-profit status, or with a public agency.

Funding Distributions and Priorities The number of agencies funded under the Program ultimately depends upon the funds allocated to the State of Texas by FTA for the current fiscal year program. Funds are allocated according to an administrative formula. The balance of the annual Section 5310 federal apportionment, after the state administrative expenses are set aside, will be allocated to TxDOT districts on a formula basis as follows.

(A) Twenty five (25%) percent of the total available funds will be distributed equally among the districts.

(B) Seventy five (75%) percent of the total available funds will be allocated by population of the elderly and persons with disabilities in each district. Calculations are derived by using the latest census figures for counties available from the United States Census Bureau.

Roles of Participants The Role of the Federal Transit Administration (FTA)

The program is administered by the Federal Transit Administration, which is an agency of the United States Department of Transportation. FTA's responsibilities include providing overall policy and program guidelines, allocating funds to States who administer the Program, reviewing and approving State grant applications. The Role of TxDOT TxDOT has the initial responsibility, as designated by the Governor, to oversee the Section 5310 Program in Texas. TxDOT also has the responsibility to ensure that Federal guidelines are met as well as recommending final approval of applications and projects for funding to the Texas Transportation Commission. The Role of Subrecipients Participating in the Section 5310 Program It is the responsibility of each participating agency hereafter referred to as “subrecipient” to fully comply with all application requirements. Each subrecipient must utilize all awarded equipment as intended and stated in the original application. Awarded equipment must be used for the promotion of and participation in the coordinated efforts of other agencies, and to ensure full compliance with regulations set forth by both FTA and TxDOT.

Subrecipient Responsibilities Vehicles and Related Equipment

Vehicles funded for transporting elderly and persons with disabilities will include modified vans or various size buses. In most cases, vehicles will be wheelchair lift-equipped or have ramps. Other capital expenses eligible to be funded under the Section 5310 program include, but are not limited to:

• Radios and communication equipment;

• Preventive maintenance;

• Computer hardware and software;

• Vehicle procurement, testing, inspection, and acceptance costs;

• Acquisition of transportation services under a contract, lease, or other arrangement;

• Initial installation costs associated with other eligible expenses and;

• Mobility management. (i.e. capital expenses associated with short-range planning and management activities for improving coordination)

Section 5310 funds may not be used for the following specific activities, which include, but are not limited to:

• Acquisition, construction/improvement or operation of public transit facilities without TxDOT approval;

• special vehicles used solely for meal delivery;

• specialized equipment such as racks, heating or refrigeration units related to meal delivery Insurance

TxDOT requires all agencies acquiring vehicles under the Section 5310 Program to purchase and maintain full insurance coverage. Collision and comprehensive insurance must be in force for the market value of the acquired vehicle and related equipment. A certificate of insurance card must be submitted to TxDOT prior to receipt of a vehicle(s). In addition, a current copy of the Certificate must be in the vehicle(s) at all times.

Ownership

Vehicles purchased under the Section 5310 Program are funded on an 80/20 federal/non-federal matching basis. TxDOT holds the original title in the name of the subrecipient. Holding the title enables TxDOT to retrieve the vehicle if the subrecipient discontinues operations or fails to fulfill its contractual requirements.

Vehicle Use

Federal regulations require that all vehicles and/or related equipment acquired under the Section 5310 Program be used by the subrecipient as described in its original application. This includes but is not limited to transportation of people to:

• Shopping

• Medical appointments

• Social services and facilities

• Recreational or social activities

• Employment

• Rehabilitation services

The program is not intended to provide priority medical transport or ambulance service. Subrecipients are encouraged to coordinate services with other agencies as long as these uses do not conflict with providing transportation services to the Section 5310 Program elderly and disabled riders. TxDOT encourages subrecipients to place as much as 12,000 miles per year on a vehicle. Equipment such as computers, radios and other equipment purchased with state or federal dollars must also be used to its maximum capacity.

Disposal of Vehicles and Equipment FTA funded vehicles and related equipment will be disposed under the following circumstances:

1. Subrecipient is terminating the Program for which the equipment was purchased. 2. Subrecipient is in noncompliance

3. Equipment is no longer needed for the originally authorized purpose.

Once disposition is authorized, the subrecipient is required to relinquish title to the property through sale, auction, or transfer to a third party. Change in Vehicle Status or Condition

Any extraordinary change in the status or condition of the vehicle or its equipment must be reported to TxDOT as soon as possible. [Note: Items such as flat tires, minor glass and paint scratches, minor “parking-lot dings,” other incidental body dents, and regular, non-accident related repair are not subject to this requirement].

Preventive Maintenance Program

Preventive maintenance is an area of high importance for Section 5310 subrecipients. Subrecipients are required to meet at least the minimum manufacturer’s recommendations for maintenance. Maintenance schedules and service documentation—including oil changes and other regular service intervals—should be kept on each vehicle, which meet the minimum requirements of the vehicle warranty and provide for the continuous safe operation of the vehicle(s) throughout the life. Subrecipients are required to have a Preventive Maintenance Program that consists of the following elements:

• A written maintenance plan;

• Preventive maintenance inspections and scheduled services, which shall include at a minimum the manufacturers' recommended servicing schedules;

• Provisions for accessible equipment;

• Management of maintenance resources;

• Warranty compliance and recovery; and

• Standards for maintenance subcontractors. Maintenance schedules are subject to review by TxDOT annually.

Procurement

Subrecipients are required to have a procurement policy in place to ensure procurement activities follow all applicable laws and regulations and promote free and open competition.

Subrecipients shall at a minimum provide the following documentation as requested by the department describing the procurement history:

• The rationale the subrecipient used for the method of procurement;

• The rationale the subrecipient used for the selection of contract type;

• The reasons the bidder or Agency was selected; and

• The methodology used to determine the contract price, including a cost justification.

TxDOT will provide technical assistance on vehicle specifications, guidance on competitive procurement procedures, and assistance in developing procurement documentation upon request. If a subrecipient chooses to develop its own specifications, it must ensure procurement guidelines meet Federal regulations specifically, FTA Circular 4220.1E. Safety

Subrecipients awarded Section 5310 vehicles will be required to comply with Federal Motor Carrier Safety Administration requirements for drug and alcohol if it owns a vehicle that requires a commercial driver's license to operate.

Driver Licensing

TxDOT's vehicle contract with subrecipients requires that all drivers--whether they are volunteers or paid employees--have a valid Texas driver's license.

Section 5310 vehicles generally are of a category that does not require a Commercial Drivers License to operate. Driver and Management Training

TxDOT encourages each subrecipient to ensure that all drivers have received appropriate training in the use and operation of the vehicle and all vehicular equipment including but not limited to wheelchair lifts and ramps. TxDOT also encourages all subrecipients to regularly take advantage of additional driver safety courses, including passenger assistance or sensitivity training courses which might be offered in the region.

Accident/Incident Reporting

Any injury requiring hospitalization that results from, or is otherwise related to, vehicle operation (including passenger entry and exit) should be reported immediately to the TxDOT district Public Transportation Coordinator (PTC). Civil Rights

One of the major goals of the Section 5310 Program is “Equal Access” to transportation services provided by awarded subrecipients. It is the intention of this transportation program to promote equal opportunity for access to services provided by agencies receiving Section 5310 Program grant funding and/or equipment, without regard to race, color, religion, ethnicity, national origin, gender, disability or age.

All subrecipients of Section 5310 funding are responsible for compliance with all civil rights requirements applicable to transit-related projects. There are four areas of Civil Rights requirements with which the subrecipient must be familiar and comply:

1. Title VI (of the Civil Rights Act of 1964)

2. Equal Employment Opportunity (EEO)

3. Disadvantaged Business Enterprise (DBE)

4. Americans With Disabilities Act (ADA)

The application contains certifications, which all subrecipients are required to complete. Subrecipients are required to have policies and procedures to ensure compliance with all applicable civil rights and equal employment laws. Subcontractor Requirements

Subrecipients are ultimately responsible for ensuring a subcontractor fulfills all the obligations of its contract. A subrecipient should be able to provide documentation to TxDOT that it has practices in place to fulfill this obligation. Financial Management

Subrecipients are required to have adequate accounting and financial record keeping standards to manage state and federal public transportation grants. Record Keeping

Records must be maintained in an auditable manner during the period of contractual obligation to TxDOT and for four years following the date of release of the title or completion of the project. A subrecipient may be audited without notice at any time during this period. The subrecipient should maintain records regarding vehicle trip logs as well as

information on driver safety records/incidents, vehicle insurance, regular and major maintenance and repair, and operating budget(s). The subrecipient should also keep up-to-date records on such aspects as ADA and other Civil Rights program requirements.

Audits

Subrecipients of federal funds receiving in excess of $500,000 are subject to federal audit requirements specifically, OMB Circular A-133, revised, "Audits of States, Local Governments, Non-Profit Organizations,” Subrecipients should have financial and recordkeeping standards to ensure all funds are traceable to their source.

Restrictions Riders Other than the Elderly and Disabled

The primary service of Section 5310 vehicles must be for the transportation of elderly and persons with disabilities. After the needs of the primary service group have been met, vehicles may be used to transport others on a space-available basis. Although such service must not interfere with the use of the vehicles by the elderly and disabled, the use of the vehicles, when possible, for general public transportation is strongly encouraged. Leasing and Purchase of Service

Vehicles acquired under the Section 5310 Program may be leased when such arrangements result in more efficient and effective service for elderly individuals and persons with disabilities. The original Subrecipient remains the party responsible for TxDOT reporting, monitoring and general compliance with federal and state requirements including, all aspects of vehicle stewardship. Incidental Use

Incidental use of a transit vehicle for non-passenger transportation (such as meal delivery) is allowed as long as the service is used in conjunction with passenger transportation and does not result in a reduction of service quality or availability of public transportation service. Exclusive use of Section 5310 vehicles for the delivery of meals is prohibited. Transportation services using vehicles for general public transportation is considered secondary.

Planning and Coordination Coordination with Other Transportation Providers

Coordination is a key to providing strong and effective transportation networks in communities, both for the elderly and disabled, and for the community as a whole. A comprehensive approach to planning and managing transit services will enable communities

to identify how coordination would permit them to make the best use of the resources and strengthen the programs. The Public Transportation Division is amplifying its focus on coordination to reflect the changing Federal emphasis.

Subrecipients are expected to participate in efforts to foster a regionally coordinated public transit-human services transportation plan between these programs and existing public transportation providers. Such a system will ensure that the maximum amount of transportation service is provided, while maximizing the efficiency of federal and state resources and, to the greatest extent practicable, minimizing costs. Subrecipient Resources

Internal resources are one source of funding for the local match. For a private non-profit subrecipient, these resources include charitable contributions from individuals, agencies, and foundations. As providers of important services to a distinctive population, the potential for private fundraising should not be overlooked as a component of total support. TxDOT will look at dedication of resources as a strong indication of subrecipient commitment to the transportation program. TxDOT will request verification of local resources prior to the execution of a grant agreement. Local Public Support

Local public financial support is a key aspect of developing and maintaining a strong public transportation program. TxDOT would find it difficult to support an application lacking significant local public support. Examples of local government support include, but not limited to:

• Endorsement letters from other organizations or individuals • Fares or contributions received from riders • Revenues from contracts with social service agencies, student fees, and taxes levied

by local cities and counties • Resolutions by local governing bodies

Public Involvement

Subrecipients are required to notify interested parties in the community of their intent to apply for funds through the Section 5310 program. This is done by placing a public notice in a newspaper of general circulation in the vicinity of the project. TxDOT districts are required to hold a public meeting to identify community and stakeholder needs, gaps in service or barriers which may hinder service. In addition, TxDOT districts must also provide an opportunity for a public hearing. Public hearings are a more formal process where citizens can examine and submit comments on proposed program, project and budgets. These are held in a place and time

generally convenient for persons affected by the proposed undertaking and accessible to persons who are elderly or have disabilities.

Application Process and Requirements

The Section 5310 application is a separate part of this package, and is available by contacting the local TxDOT district Public Transportation Coordinator (PTC). Agencies should provide complete and detailed information for each question in the application. Failure to complete all questions will diminish the chance of receiving an award under the program. Completed applications are to be submitted to the local TxDOT district, no later than the application deadline of each funding year. Subrecipients must complete the 5310 Application and all supporting documents and submit the completed application to the TxDOT district by the due date. Subrecipient may contact the local TxDOT district PTC listed in this document for technical assistance.

Time Line (Tentative)

March – August: Evaluation of applications and projects

The Public Transportation Division (PTN) Master Grant Agreement (MGA) is a series of documents that support the issuance of federal and state grant programs from the Texas Department of Transportation to the eligible transit agencies throughout the state. The documents include the MGA Application Part I, the MGA Application Part II, the Budget Sheet, and the Project Grant Agreement (PGA).

• A narrative in which the subrecipient is requested to describe the project

• A budget

• Certifications, assurances, and other attachments Subrecipient should complete all sections concisely and completely. The project description should thoroughly explain to the reviewing committee the capital expense that is requested and how the elderly and disabled are going to benefit from the project. An incomplete application may result in the denial of an award. Additional application information can be obtained by contacting the local PTC. Public Involvement and Award

Stakeholder involvement is the early and extensive engagement of stakeholders in the process of planning, decision making, and implementation. Stakeholders may include community or neighborhood leaders and groups, other government agencies, and traditionally underrepresented groups, among others.

TxDOT districts are required to establishment a stakeholders group with no more than 15 members. Stakeholders are those who effect change and those who are affected by it. The aim of inclusiveness makes the identification of stakeholders important; excluding an important stakeholder can undermine the process. These may include existing transit agencies, governmental agencies, councils of governments, private nonprofit organizations, community and other interest groups, non-government organizations, and citizens. It should be as inclusive as possible, and stakeholders can be added as time goes on. Care must be taken to include groups such as low-income and ethnic populations who traditionally are underrepresented in planning efforts. The group is charged with evaluating subrecipient projects according to the following criteria:

1. The demonstrated need for capital equipment 2. The subrecipient’s financial and managerial capability to maintain and operate the

equipment 3. The subrecipient’s efforts to coordinate services 4. Evidence of local support for the proposal

Approval of projects is contingent upon verification of all information submitted, completion of all required documents, and the TxDOT district office. TxDOT will notify all agencies of the results. Only the highest prioritized projects will be funded.

Obtaining an Application

Applications are available by contacting the local TxDOT district Public Transportation Coordinator. Application forms are available in electronic format. A paper copy of the application must be submitted. Original signatures are required on the certifications and assurances. III FEDERAL and STATE REQUIREMENTS

Restrictions

s a Federal program, Federal legislation and a variety of Federal regulations form the foundation of how the Section 5310 program is operated. The Texas Department of Transportation (TxDOT) has developed procedures on how some of the Federal provisions are enacted in Texas. In other cases, the requirement and

language is straight from the Federal legislation and enabling regulations.

In this section, the basic Federal and State requirements are summarized. In addition to reading the abbreviated summaries in this handbook, subrecipients are urged to read the FTA Program Circular and the applicable Office of Management and Budget Circulars for a more in-depth description of the Federal requirements. These references are listed in Appendix A at the end of the handbook. As the grantee, TxDOT requires subrecipients to document they are meeting all the requirements. In addition to requirements that may be met at the time of application, these State and Federal requirements require on-going management, monitoring and reporting systems to be implemented by the subrecipient in order to ensure continuing compliance. These requirements are also discussed in this section.

Federal Requirements All subrecipients that receive funds under the Federal Transit Act, codified at 49 USC §5301 et seq., are required to adhere to state and federal statutes and regulations. It is important that subrecipients understand these requirements prior to participating in the program. Subrecipients may contact their local Public Transportation Coordinator for additional information on state and federal requirements.

Program Requirements The State maintains ongoing administration and program requirements in addition to those specifically required by Federal legislation. In part to meet its own reporting obligations and fiduciary duty to the FTA, TxDOT requires its Section 5310 subrecipients to have ongoing management and monitoring systems in place. These requirements cover the administration of the subrecipient, operation of vehicles, oversight and state and federal regulations. Program Management

TxDOT is the State agency designated by the Governor to administer the FTA’s Section 5310 program for funding public transportation services for individuals who are elderly and/or have disabilities. TxDOT receives a formula allocation of funds annually which is then utilized to administer the program and procure vehicles and other transportation-related equipment for agencies which provide transportation services or access to social and health services to this population.

In addition to developing the annual statewide Section 5310 Program application for submittal to FTA, the Texas Department of Transportation administers the program at the State level by performing the following activities:

1. Providing program information and technical assistance for project development, implementation and operation

2. Monitoring the progress of each project

3. Integrating the program with other TxDOT administered FTA Programs

4. Assuming responsibility for complying with Federal Certifications and Assurances

5. Networking with the Federal Transit Administration, other federal agencies, state DOTs, and associations, including attendance at regional and national conferences, meetings, and pertinent training forms, to enhance communication with industry peers and remain current in program management developments.

Planning and Coordination

The transportation funding bill, SAFETEA-LU, enacted in 2005, calls for State DOTs to undertake activities to ensure that maximum feasible coordination of transportation programs occurs to optimize Federal grant awards. It also requires that projects be derived from a locally developed plan that coordinates public and human service transportation services.

Subrecipients should contact the local TxDOT representative if they have additional questions regarding how their application fits in with the locally developed transit-human service transportation plan.

District Program of Projects (POP)

Annually, the district submits a program of projects (POP) to PTN that lists the projects selected for funding in a particular fiscal year. The POP:

• Indicates whether the proposed subrecipient is a public entity, private nonprofit agency or Indian tribal agency;

• Designates whether the project serves urbanized and/or nonurbanized populations and;

• Includes a budget of eligible expenses that will be expended on the project. Inventory Management

TxDOT manages an inventory of vehicle information for the Section 5310 fleet. Information is kept up-to-date via annual updates and physical inspections into a database called the Public Transportation Management System (PTMS).

PTMS identifies agencies that may be due for vehicle replacement and ascertains the statewide condition of transit subrecipient fleets. The system also helps determine what current and future strategic actions are most beneficial to ensure overall fleet service viability. Contracting Each successful subrecipient that enters into an award with TxDOT enters into an agreement stating the terms and condition of assistance. This contract, referred to as a Master Grant Agreement identifies the responsibilities of TxDOT and the subrecipient, lists what is expected, and includes all Federal requirements as described in Part IV of this Handbook.

Compliance Monitoring

TxDOT regularly reviews subrecipients and monitors the use of vehicles. Subrecipients should expect a physical inventory of vehicles and equipment every two years. In depth compliance reviews of all agencies receiving Section 5310 funds are completed annually. These reviews include:

• Recent program changes (administrative and service)

• Compliance with Work Scope (i.e., is the vehicle still being used in accordance with the description in the subrecipient’s original or approved-revised application?)

• FTA Requirements, including

Civil Rights (including ADA, Title VI, EEO, DBE participation; and other related activities);

Central to the management responsibilities a subrecipient undertakes when awarded a vehicle is the commitment to required vehicle inspection and annual reports. While these reports are typically quarterly, a new subrecipient should contact the local TxDOT district representative to determine the precise reporting schedule in effect for that year.

an an agency apply if they have not yet received non-profit status? No. Agencies must have completed non-profit status to submit an application. However, agencies may be able to gain use of a vehicle by coordination with another agency, which has non-profit status, or with a public agency.

How large an operation does an agency have to be in order to receive funding? Typically, if service can be obtained by the existing urban or rural subrecipient, the project will be funded. However, applications and project reviews will be reviewed on a case-by-case basis and may vary particularly when subrecipients are unable or unwilling to provide service.

What is a disability? Typically, a disability is defined as an irreparable, chronic or otherwise long-term physical or mental impairment, which impede significant life functions. Temporary injuries such as extremity sprains and fractures are not typically considered “disabilities.” A review of the Americans with Disabilities Act of 1991 provides further clarification on disabilities.

Can a fare be charged? Yes. A fare can be charged.

What uses are not permitted for Section 5310 funds? In all cases, projects are approved based on criteria that will enhance the mobility of the elderly and persons with disabilities. Transportation other than that serving the elderly and people with disabilities is limited to that which does not interfere with the core Section 5310 mission. However, maximizing equipment use is encouraged, if it does not interfere with the Section 5310 use. A vehicle carrying a passenger who is elderly or has a disability may also pick up a general public passenger if there is room available on the vehicle. A vehicle may also be made available for general public passengers during periods of low Section 5310 use. Emergency Transportation: The program is not intended to provide “emergency” medical transport or ambulance service on a regular basis. These types of transportation needs should be left to emergency-specific agencies, the qualified personnel and vehicles that are “purpose-built” and specially equipped for such duty. However, a Section 5310 vehicle can be used—as a private passenger vehicle might—to occasionally and spontaneously transport

critically ill or injured persons when conditions indicate no other resources are available or that other resources are not as appropriate for such transport considering the injury or illness involved.

School Bus Operations: The program is not intended to provide exclusive or regularly scheduled school bus transportation. School bus transportation operates under strict federal and state laws governing the construction of vehicles; lights and other ancillary equipment; and driver training requirements. This notwithstanding, school children may be carried in addition to passengers who are elderly or have disabilities.

An agency delivers meals as part of the operation. Can the agency use a vehicle purchased through this program to both transport seniors and deliver meals? Yes. Meal delivery may occur as an ancillary vehicle function when it is carried out in conjunction with “normal” Section 5310 passenger service.

What does TxDOT expect in a preventative maintenance program? Subrecipients must have documented evidence of a Preventive Maintenance Program that consists of the following:

• A written maintenance plan;

• Preventive maintenance inspections and scheduled services, which shall include at a minimum the manufacturers' recommended servicing schedules;

• Provisions for accessible equipment;

• Management of maintenance resources;

• Warranty compliance and recovery; and

• Standards for maintenance subcontractors.

TxDOT encourages and expects all Section 5310 subrecipients to adopt and adhere to aggressive preventive maintenance schedules to insure long vehicle/equipment service and safe operation of that equipment.

At the time of application, a certification is made that the subrecipient will, at a minimum, have a preventive maintenance program and that maintenance will meet the manufacturer’s recommendations for basic maintenance.
