1 TERMS AND CONDITIONS RED BULL 111 Megawatt 2017 English version, 19.07.2017 I. Preliminary Provisions 1. These Terms and Conditions set out the rules for participation in the motorcycle Hard Enduro competition under the name Red Bull 111 Megawatt, which allows both amateurs (without a special licence) and professional athletes to compete in the Hard Enduro event on a specially prepared off-road courses. 2. The purpose of the competition is to promote motor sports and active leisure pursuits. The race will determine the best rider among the registered participants. II. Definitions 1. Terms and Conditions – Terms and Conditions for the Competition, this document; 2. Competition – the Red Bull 111 Megawatt 2017 competition, the rules of which were set out in these Terms and Conditions; 3. Competition Organiser / Organiser - Aorta Event sp. z o.o. with its registered office in Warsaw, ul. Nowolipki 17/86, 00-151 Warsaw, which runs the Competition by order of the Project Organiser; 4. Project Organiser - Red Bull sp. z o.o. with its registered office in Warsaw, ul. Wyścigowa 8a, 02- 681 Warsaw; 5. Competition Website – official website of the Competition at www.redbull.pl/111megawatt; 6. Participant – participant of the Competition; 7. Sports Director – Competition course designer who has final say on all sporting matters. The position is held by Bartosz Obłucki. III. Time and Place 1. I.PreliminaryProvisions

1. TheseTermsandConditionssetouttherulesforparticipationinthemotorcycleHardEndurocompetitionunderthenameRedBull111Megawatt,whichallowsbothamateurs(withoutaspeciallicence)andprofessionalathletestocompeteintheHardEnduroeventonaspeciallypreparedoff-roadcourses.

2. Thepurposeofthecompetitionistopromotemotorsportsandactiveleisurepursuits.Theracewilldeterminethebestrideramongtheregisteredparticipants.

II.Definitions

V.Qualification

1. QualificationwilltakeplaceontwospeciallypreparedQualifyingStages:• QualifyingStage1–Crosscourse• QualifyingStage2–EnduroCrosscourse

2. Every Participantwill get a chance to complete two runs on each of the Qualifying Stages,providedthat:

• inthe1stroundofQualificationtheParticipantshavetocompletebothQualifyingStagesonebyone–aftercompletingthe1stStagetheyhavetoimmediatelymoveontothe2ndStage;

• inthe2ndroundofQualificationtheParticipantscancompletebothQualifyingStagesonebyoneoronlyonechosenStage.

3. In the1st roundofqualifying runs, there is a time limitmeasured from the start lineof theQualifyingStage1tothefinishlineoftheQualifyingStage2.Itisalimitof40minutesandafteritisexceededtheParticipant’sresultforthelaststartedQualifyingStageismarkedasDNF(DidNotFinish).

4. TheParticipantsshouldstarttheirqualifyingrunsaccordingtothestartingnumbers(firstround–from#1upwards,secondround–from#1200downwards).TheParticipantswhoarriveattheQualificationstartlinelatewillbemovedtotheendoftheround.

5. TheOrganiserreservestherighttoallowtopinternationalriderstocompletetheirqualifyingrunsatanygiventime.

6. ThefinalQualificationresultisthesumoftwotimeresults:thebesttimeachievedatStage1plusthebesttimeachievedatStage2.

7. 500ParticipantswiththebestQualificationresultswilladvancetotheFinalRace.

8. Participants’attempttorideontheracecourseasidefromtheirownqualifyingrunwillleadtodisqualification.

9. Qualificationformatissubjecttochangeforsafetyreasons.DetailedqualificationprocedurewillbepresentedtotheParticipantsintheRaceOffice.

10. FullqualificationresultswillbeannouncedinwritingintheRaceOfficeimmediatelyafterthefinalresultsaredetermined.

11. Starting numbers for the Final Race and the Consolation Race remain the same as forQualification.

12. ByenteringQualification,theParticipantdeclaresthathe/sheisabletocompeteintheFinalRaceonSeptember10,2017.

VI.FinalRace

1. 500ParticipantswiththebestQualificationresultswilladvancetotheFinalRace.

2. All Participants qualified for the Final Race must go to the Race Office to collect stickersspecifyingtheirstartingrow.

3. TheFinalRacewillbeabout90kmlongandwillrequirecompletingthreelaps(eachabout30kmlong)aswellasthefinalobstacle(“FinalChallenge”).

4. TheFinalRacefeaturesamassstart.TheParticipantswillbepositionedinafewrows,accordingtotheirqualifyingtimes.EachrowwillstartatthesametimeaftertheOrganiser’ssignal.Thetimedifferencebetweenthestartofparticularrowswillamounttoafewminutesandwillbeadjustedtotheconditionsonthecourse.Thefirstrowwillstartat1:11pm.

5. Theabovetimesareapproximateonlyandmightbeslightlychanged.TheOrganisershallinformtheParticipantsaboutanychanges.

6. TheOrganiserreservestherightto:

a. enable top international riders who did not take part in Qualification or theirQualificationresultdidnotallowthemtoadvancetotheFinalRacetoparticipateintheFinalRace;

b. postpone, cancel or interrupt the Final Race due to weather conditions that mightendangertheParticipants’safetyorotherreasonsbeyondthecontroloftheOrganiser.Incase theFinalRace is interrupted, theOrganisercanconsidercurrent results final,accepting the standings from themoment of interruption, provided that the leadingParticipanthascompletedatleast1/3ofthetotaldistance(1lap).

VII.TermsofParticipation

1. InordertobegrantedpermissiontotakepartintheCompetition,theParticipantshavetosatisfyallofthefollowingeligibilitycriteria:

a. Aged18orabove(theOrganiserallowsforparticipationofminorswhoareatleast16-year-oldonSeptember9,2017,providedthattheyhavewrittenconsentfromparentsorlegalguardians–theformisavailablefordownloadontheCompetitionWebsite);

b. Complete registration for the Competition, i.e. correct submission in the registrationsystemandpaymentoftheentryfeeaccordingtotheprocedurespecifiedintheTermsandConditionsofRegistration;

c. AppearingintheRaceOfficeonSeptember9or10,2017inpersonwithinthespecifiedopeninghourstobeginthestartreadinessprocedure;

d. ReadingandacceptingtheseTermsandConditions,followedbywrittenconfirmationofthis fact in the Race Office as well as reading, accepting and signing the ParticipantDisclaimeravailableintheRaceOffice;

e. Validthirdpartyandaccidentinsurancecoveringparticipationinmotorcycleraces(noracinglicencenecessary);

f. Fullyoperationaloff-roadbike(enduro,motocross,trial)thatwillpasstheOrganiser’sstandardtechnicalcontrol.Opencategory,nodivisionsorcapacitycategories;

g. Certifiedmotorcyclehelmetandprotectivegear(goggles,gloves,boots,pads);

h. Completingthestartreadinessprocedureinvolving:

i. Appearing inperson intheRaceOffice,signingtheParticipantDisclaimer,andpresentinginsurancedocuments;

ii. Passingtechnicalcontrol;

iii. Collectingstickerswiththestartingnumberandtimingtransponders;

i. ThingstobekeptduringtheentireCompetition:

i. startingnumberonthebike(stickers:frontandbothsidesofeverymotorcycle);

ii. transponderattachedtotheleftorrightleginbetweenthekneeandthefoot.

2. LendingorexchangingbikesmarkedwithcorrectstartingnumbersprovidedbytheOrganiserwithanotherParticipantwillresultinimmediatedisqualificationofbothParticipants.

3. Registeringasparebikeforthestart,incasethebikethatwasinitiallyacceptedandmarkedbytheOrganiser’stechnicalcontrolbrokedownandthefailure is impossibletofix,willonlybepossibleafternewpaidregistrationandpassingtechnicalcontrol.

4. TheParticipantscannotcompeteundertheinfluenceofanysubstancesthataffecttheirabilitytorideamotorcycleandassessthesituation,suchasalcohol,drugs,ormedication.

5. TheoverallhealthconditionofeveryParticipantmustallowthemtocompeteinsportsevents.In particularly justified cases, due to safety concerns related to the Participant or otherParticipants, the Organiser may require that the Participant provides his/her Primary CarePhysician’sconsentforparticipationintheCompetition.Incasesuchconsentisnotprovided,theOrganiserisentitledtoexcludetheParticipantfromtheCompetitionwithouttherighttoentryfeerefund.

VIII.Registration

1. RegistrationfortheCompetitioncanonlybedoneonlineatwww.redbull.pl/111megawatt

2. Completeregistrationcomprisescorrectsubmissionintheregistrationsystemandpaymentoftheentryfee.

3. ThefullregistrationprocedureisspecifiedintheTermsandConditionsofRegistration.

4. Theentryfeecoversastarterkit(numbers,timingtransponders,drinks,agift–anofficialeventgadget,meals)andacampingspot(spacetoparkavehicleand/orsetupatent)providedbytheOrganiser.

5. TheOrganiser does not provide: accommodation, fuel, bike service and/or parts, any traveland/orparticipationcostrefunds,insurance.TheParticipantisobligedtopersonallyinsureandprotect his/her vehicles and property from theft or damage. The ProjectOrganiser and theCompetitionOrganiserbearnoresponsibilityfortheftordamageofthevehiclesusedbytheParticipantsduringtheCompetitionoranyotherpropertybroughtbytheParticipantstothepaddock,themasseventortheCompetitionarea.

IX.Prizes

1. FinalRacePrizes:

a. 1stplace–PLN10,000andin-kindprizes

b. 2ndplace–PLN7,000andin-kindprizes

c. 3rdplace–PLN5,000andin-kindprizes

d. 4thplace–PLN2,000andin-kindprizes

e. 5thplace–PLN1,000andin-kindprizes

2. Incaseofeveryin-kindprizeworthmorethanPLN760grosstheProjectOrganiserwilladdprizemoneyamountingto11.13%ofthevalueoftheprize.

3. TheadditionalprizemoneymentionedabovewillnotbegiventothewinnersbuttransferredbytheOrganiserasataxremitter,accordingtoart.41section7oftheActof26July1991onnaturalpersons’ incometax,asregardsflat-ratetaxonprizesmentionedinArt.31section1point2oftheActonnaturalpersons’incometax.TheOrganiserwillpaythetaxandsubmittherighttaxdeclarationtotheheadoftherighttaxoffice.

4. Nocashalternativeswillbeprovidedandprizesarenon-refundable.

X.Categorization

1. TherearenocategoriesorgenderdivisionsduringQualificationandFinalRace.

XI.CourseParameters:

1. The designed Final Race coursewill have a form of a 30-km long loop thatwill have to becompletedthreetimes.Eachlapwillfeaturethreesuccessivesections:cross,enduro-cross,andextreme-enduro.

2. TheexactdescriptionofthecourseaswellascompetitionruleswillremainclassifieduntiltheCompetitiondateandwillbepresentedbytheSportsDirector,BartoszObłucki,duringtheridersbriefing,priorthestartoftheCompetition.

3. Anyattemptstogetfamiliarisedwiththecourse individuallyandenterthecompetitionareawithoutpermissionmight result in (besidesotherconsequences regarding intrusion into thecoalmine)refusaltoparticipateintheCompetitionandlosingtheentryfee.

XII.DidNotFinish–Procedure

1. The Participant who is not able or does not want to continue the race should inform theCompetitionstaffpresentalongthecourseaboutthatfactandfollowtheirinstructions.

XIII.Protests

1. Any protests should be filed togetherwith all proofs inwritingwithin 15minutes from theannouncementofunofficialresultsintheRaceOffice.AwrittenprotestmustbeaccompaniedwithmoneydepositofPLN300.Materials(videos)personallyrecordedbytheParticipantscanbeusedaspartialproof/materialonlyincaseofprotestsfiledinwriting.Whentheprotestisacknowledged,thedepositwillbereturned.Incasetheprotestisrejected,thedepositgoestotheOrganiser.

XIV.OfficialEventPartners

1. ThelistoftheOfficialEventPartnersincludes:RedBull,KTM,Fox,GoPro,PGE–PolishEnergyGroup,KleszczówCommune,FoundationfortheDevelopmentoftheCommuneofKleszczów.

2. DuringtheCompetition,itisforbiddentoactivelypromoteproductsandbrandstheproducersofwhicharenottheofficialeventpartnerswithouttheOrganiser’sconsent.ForthepurposeoftheseTermsandConditions,suchpromotionincludessampling,productdistributionandsales,activepromotion,hangingoutbanners,postersetc.

XV.UseofFlyingDevices

1. The Competition will be recorded by authorised flying equipment owned by the Organiser(includinghelicopters).AnyformsofuseofflyingdeviceswithouttheOrganiser’spermission(includinggliders,paragliders,dronesetc.)constitutedangerandareforbiddenacrosstheentirecompetitionarea.

2. IntheeventofascertainingthataParticipantorhis/hercompanionsusedflyingdevicesthatwereunauthorizedbytheOrganiser,theParticipantshallbedisqualifiedandhastoimmediatelyleavethepaddockandtheCompetitionarea.

XVI.FinalProvisions

1. AllParticipantsconfirmthattheyareawareoftherisksassociatedwithparticipationinamotorcyclecompetition,andregisterandcompeteintheraceontheirownresponsibility.

2. TheProjectOrganiserandtheCompetitionOrganiserareinnowayliableforinjuryordamageincurredtotheParticipantsatanystageoftheCompetition.DuringtheCompetition,alongtheracecourse,notrafficregulationsareinforce.

3. EveryParticipantregisteredforparticipationintheCompetitionisobligatedtogettheappropriateaccidentinsuranceaswellasliabilityinsurance.Thepolicymustbevalidonthedayofqualificationandfinals.

4. Every Participant is responsible for everyone‘s safety and security at every stage of theCompetition.

5. TheseTermsandConditionsaresubjecttochangeintermsofdate,placeandwayoforganizationoftheCompetition,ifnecessarytoprovidesafetyoftheCompetitionandtheParticipants.ThecurrentversionoftheseTermsandConditionsisavailableatwww.redbull.pl/111megawatt.AnychangestotheseTermsandConditionsintroducedduringtheCompetitionwillbecommunicatedtotheParticipantsbytheOrganiserintheRaceOffice.

6. TheOrganizerreservestherighttocanceltheCompetition,ifunfavourableweatherconditionsorothercircumstancesbeyondtheOrganiser’scontrolhinderorpreventorganizationoftheeventasplanned.Allupdatesregardingpossiblechangeswillbepublishedatwww.redbull.pl/111megawatt.

7. AnydisputesnotcoveredbytheseTermsandConditionsshallbesettledbytheProjectOrganizer.
