8. THE ABATEMENT CONTRACTOR IS RESPONSIBLE FOR KEEPING THE WORK AREA IN A CLEAN AND SAFE CONDITION. THE CONTRACTOR SHALL ENSURE THAT UNCERTIFIED PERSONNEL OR UNAUTHORIZED VISITORS DO NOT ENTER ACTIVE WORK AREAS AT ANY TIME.
9. ALL ACM MUST BE COMPLETELY REMOVED DOWN TO THE STRUCTURAL SUBSTRATE THAT THEY ARE AFFIXED TO.
10. THE OWNER SHALL PROCURE A NYSDOL CERTIFIED PROJECT AIR SAMPLING TECHNICIAN TO PERFORM PROJECT AIR MONITORING. THE ABATEMENT CONTRACTOR IS RESPONSIBLE FOR PERSONAL (EMPLOYEE) AIR MONITORING.
11. THE OWNER SHALL PROCURE A NYSDOL CERTIFIED PROJECT MONITOR WHO WILL HAVE THE AUTHORITY TO HALT ABATEMENT WORK IF NOT BEING CONDUCTED PER THE CONTRACT DOCUMENTS.
12. BOTH NYSDOL CERTIFIED PROJECT AIR SAMPLING TECHNICIAN AND CERTIFIED PROJECT MONITOR SHALL BE INDEPENDENT OF THE ABATEMENT CONTRACTOR.
13. THE ABATEMENT CONTRACTOR IS RESPONSIBLE FOR ALL TOOLS, EQUIPMENT, AND SUPPLIES. THE OWNER OR OWNER’S REPRESENTATIVE WILL NOT BE LIABLE FOR THEFT OR DAMAGE. THE LOCATION OF ANY SITE STORAGE OF MATERIAL, EQUIPMENT, AND WASTE TRAILER/DUMPSTER SHALL BE COORDINATED WITH AND APPROVED BY THE OWNER OR THE OWNER’S REPRESENTATIVE.
