this day of April 1868 to report a reasonable allowance for a years support of J.M. KING, MaryKING, Josephine KING, Fester KING, Martha Ann KING, minor children of Erasmus L.KING,under 15 years of age,would respectfully report that they have inquired into the situtationand condition of said children after their father's death and that find that shortly after his deathand before any administration was granted upon his estate or allowance made to his widow forher support,the widow and mother of said children also died, leaving them wholly without amember of the family capable of keeping house and taking care of the children so that theadministrators afterwards proceeded and did sell and convert into money assets the entire estateand no part of it has been applied to the support of said children.But that they were taken andsupported by one of the Administrators and a kinsman who still has them in his charge.Wetherefore consider that seventy-five dollars each would be the least amount reasonably necessaryfor a years support.Submitted April 8th,1868. Elizabeth Rice was the daughter of Charles Rice and Hannah Phillips of Virginia thenMarion county. She was born 10 Jan 1783 in Marion, SC.

She married Thomas Kirton (9 Jun 1788--5 Feb 1823) on 18 Oct 1808.

Elizabeth died 19 Nov 1863 in Lauderdale Tenn.

They were the parents of 6 children: Maria Louisa, Elizabeth Margaret, Philip R., Hannah,Thomas J., and Mary. Mentioned in the will are her brothers: Thomas G. Rice andShadrach Rice of Lauderdale, her grandson, Benjamin Thomas Wilson of Georgetown SC

Elizabeth Kirton’s last will

I, Elizabeth Kirton of Lauderdale county State of Tennessee being of sound disposing mindmemory do make ordains establish and publish this instrument of writing to be my last willand testament hereby and herein revoking all other wills heretofore made by me.

In the first place I direct that my executors here after appointed shall pay all my funeralexpenses out of any money that shall first come into their hands and that all my just debts bepaid by my said executors as soon as possible after my death.

In the second place I give and bequeath to my Grandson Benjamin Thomas Wilson whoresides in Georgetown District South Carolina the sum of ten dollars to be paid out of the firstmoney that shall come into the hands of my said executors after my funeral expenses andjust debts are paid.

Thirdly I give and bequeath to my great granddaughter Ann Elizabeth Walker one bed andbedstead, a mattress, two pillows and a bolster two blankets, two comforts four sheets,twenty-four silver spoons a dozen Small ones and a dozen large ones, and the sum of onehundred and fifty dollars to be used for her schooling.

Fourthly I give and bequeath to my Brothers Thomas G. Rice and Shadrach Rice thefollowing slaves, namely, one Negro woman Nanny and her two children namely Hannah andWilliam and their future increase to be held by them however in trust for the use and benefitof my great granddaughter Ann Elizabeth Walker and her children should she have any. Butshould the said Ann Elizabeth Walker die childless then and in that event the abovementioned Negro slaves Nanny, Hannah and William and their future increases to be givenshare and share alike to her Brothers and sisters free from any trust whatsoever.

Fifthly I give and bequeath to the Said trustee, Thomas G. Rice and Shadrach Rice thefollowing slaves, namely, one Negro woman named Hannah negro boy named Cupid Negroboy named Robert Negro boy named Charles Negro boy named Peter Negro Girl namedZanna Negro Girl named Patty Ann and their future increases to be held by them in trust andnone otherwise for the use and benefit of my granddaughter Maria Louisa Walker wife ofJames P. Walker and her children and for their education and maintenance for and duringher natural life free of all times from the debts contracts and liabilities of her Said husband theSaid James P. Walker, undivided ably by him contracted. And also free from the debtscontracts and liabilities of any future husband she may marry. And at her death Said propertyand all the increases shall go to and be equally divided amongst the children of said MariaLouisa Walker share and share alike except the Said Ann Elizabeth Walker who has beenheretofore provided for in this my last will and testament-and in case of the death of either ofthe children of the Said Maria Louisa Walker bearing a child of children then such child orchildren to take his or her or their deceased parents share.

Sixthly It is my will and desire and I so devise and bequeath and direct, that if either of thechildren of the Said Maria Louisa Walker after the death of her, the Said Maria Louisa Walkershall die having no children-that such share or portion of said property as may be set apartand laid off to such deceased child shall go to the surviving children of the Said Maria LouisaWalker, including the Said Ann Elizabeth Walker, and not to be taken by the Father of Saidchild as next of kin under the Laws.

Seventhly I give and bequeath and devise all the residue of my property, real, personal andmixed of whatever nature and kind, and where ever situated, to my said granddaughter MariaLouisa Walker and her heirs forever.

Lastly I nominate constitute and appoint Thomas G. Rice and Shadrach Rice my executors of

Mr. L. B. Archer died at his home in Ripley, Sunday morning about 9 o'clock after an illnesswhich had confined him to his home nearly four years. Ross W. Dyer, lawyer, former Tennessee Supreme Court chief justice and former state senator,died Sunday at his Lauderdale County home after a long illness. He was 81. Funeral services arescheduled for 2 p.m. today at Halls First United Methodist Church, where he was a member.Burial is in Halls Cemetery. Halls Funeral Home has charge of arrangements. Judge Dyer servedon the state Supreme Court from 1961 to 1974, when the Tennessee Democratic Party failed torenominate him for a third term. He became the court's chief justice in 1969. After his tenure onthe high court, he returned to Halls to practice law. He was born in Lauderdale County in 1911,attended the University of Tennessee and Cumberland University, and received his law degreefrom the old YMCA Law School (now named the Nashville School of Law) in 1937. He servedthree years in the Army Medical Corps in Europe during World War II before returning topractice law in Halls. Judge Dyer was elected a delegate to the Tennessee ConstitutionalConvention of 1953 and served as a state senator representing Lauderdale, Crockett and Dyercounties for one term, 1957-58. He also served as an administrative assistant to the late governorBuford Ellington, who appointed him to the Supreme Court. He was a Mason and a chartermember of the Halls-Gates Rotary. Obion County CoronerBarry WHITE said Dr. SIMMONS, who was 34, died from a self-inflicted gunshot wound in hisleft temple. Mrs. Lyda Murchison Simmons, daughter of William Murchison and wife, was born April 11,1887. She was married to Ira W. Simmons Oct. 26, 1905, and to this union was born two sons,Thomas Hilton Simmons and Wilburn Simmons, She professed faith in Christ about twelve yearsago and joined the Baptist church at Halls, in which church she lived a consistent faithful lifeuntil her death which occurred May 7, 1919. She was 32 years, and 26 days old. Mrs. Simmonswas also a member of the Eastern Star and Woodman Circle. She leaves an aged mother, threebrothers, three sisters, her husband and two sons, together with a host of friends to mourn herdeparture. She was a good Christian woman, a kind neighbor, a loving devoted wife and tendermother. She will be missed; her seat will vacant in the home and in the church, but her sufferingis ended, her troubles are over and she has entered into the realms of peace in the life that knowsno end, Then let us look beyond the grave and think of her as having put on the robe ofimmortality and gone to be a guest of that heavenly city.
