Director, All India Institute of Medical Sciences (AIIMS), Bhubaneswar, Odisha, an apex healthcareinstitute, established by an Act of Parliament under aegis of Ministry of Health & Family Welfare,Government of India, invites sealed tenders in two-bid system from Institutions affiliated to KVIC/KVIBor sponsored through PMEGP by Khadi and Village Industries Commission (KVIC), Government ofIndia for supply of the following items at AIIMS, Bhubaneswar. Bidders are requested to quote theirbest offer along with the complete details of specifications, terms & conditions.

The sealed Bid should reach the Institute, latest by 22.06.2018 at 12.00 hrs. The technical bid will beopened on 22.06.2018 at 03:00 PM in the Board Room, Academic Block of AIIMS, Bhubaneswar of theInstitute in the presence of the bidder(s) or their authorized representative(s), who may remainpresent at the scheduled date and time. The list of technically qualified bidders with the date ofopening of financial bid shall be hoisted in the official website of AIIMS, Bhubaneswar. No paperpublication shall however be made for this.

Clarification of bidding documents (Pre-Bid Conference) :All the prospective bidders shall attend the Pre-Bid Conference at Board Room, Academic Block, AIIMS,Bhubaneswar on 28.05.2018 at 3:00 pm. Changes if any, may be incorporated in the bidding documentafter the Pre-Bid conference and will be uploaded on our official website as “Corrigendum”. Therefore,bidders are requested to submit their bids accordingly to revised changes after PBC. No pressadvertisement will be made for corrigendum.

Terms & Conditions:

1. The Tender shall be valid initially for a period of 1(One) year and extendable to another 1 (One) yearon mutually agreeable conditions.

2. Earnest Money Deposit and Tender Fee : The bidder shall be required to submit the Earnest MoneyDeposit (EMD) for an amount of Rs.50,000/- (Rupees Fifty Thousand only) by way of BG/FDR only infavour of “All India Institute of Medical Sciences, Bhubaneswar”. The demand drafts for EarnestMoney Deposit must be enclosed in the envelope containing the Technical Bid.

The EMD of the successful bidder shall be returned after the successful completion of contract /order and for unsuccessful bidder(s) it would be returned after award of the contract. Bid(s) receivedwithout EMD shall be liable for rejection.

The firms who are registered with National Small Industries Corporation (NSIC/ DGS&D / or MSEsregistered under MSMED Act are exempted to submit the EMD (Copy of registration must beprovided along with) the Tender document.

3. Rate: Rates should be quoted in Indian Rupees (INR) on F.O.R Basis at AIIMS, Bhubaneswar, Odisha,Inclusive of all statutory levy / taxes /charges/ GST etc.

4. Validity: The quoted rates must be valid for a period for 180 days from the date of closing of thetender. The overall offer for the assignment and bidder(s) quoted price shall remain unchangedduring the period of validity.

In case the bidder withdraws, modifies or changes his offer during the validity period, bid is liable tobe rejected and the earnest money deposit shall be forfeited without assigning any reason thereof.The bidder should also be ready to extend the validity, if required, without changing any terms,conditions etc. of their original tender.

5. Delivery:

The Period of delivery for supply of items will be 30 (Thirty) days from the date of Receipt ofacceptance of supply order

6. Penalty ClauseIf the delivery is not done on or before the due date, AIIMS, Bhubaneswar will have the right toimpose Late Delivery charges (LD)as under:a. 0.5% per week or part thereof exceeding 3 days (date of order & date of delivery being

excluded) subject to maximum of 10%.b. In case the items are not delivered within 30 days without any valid reason , AIIMS,

Bhubaneswar will have the right to procure the ordered items from open market /anotherparty at their own risk and expenses under risk purchase clause, which shall be chargedagainst the performance security submitted by the bidder.

c. No payment shall be made for rejected material. (Found poor in quality of fabric & logoprinting). The supplier will remove rejected items within one week of the date of rejection attheir own cost and replace the same immediately. In case these are not removed, then it willbe disposed off in a manner as deemed fit by the authorities at the risk and responsibility ofthe supplier without any further notice. Every substandard supply will attract penalty asdeemed proper and will be deducted from their performance security. The Institute alsoreserves the right to take appropriate action like debarring /blacklisting etc, in such cases, ifnecessary.

7. Performance Security: The supplier shall require to submit the performance security in the form ofFixed Deposit Receipt (FDR) issued by any Nationalised Bank for an amount Rs.50,000/- and shouldbe kept valid for a period of 60 days beyond completion of all the contractual obligations.

8. Parallel Rate Contract/ Purchase: The AIIMS Bhubaneswar reserves the right to place an order for supply ofany items mentioned in the rate contract, Proprietary Items or otherwise, to any other firm(s) inemergency/unavoidable situation. In case of emergency or non-supply of items from the rate contract holder,AIIMS, Bhubaneswar may purchase Rate Contract items from other sources without any information to theRate Contract holder.

9. Payment Term:100% payment of the total order value shall be released after receipt of materials in good andacceptable condition.

10. Bidders shall submit a copy of the tender document and addenda thereto, if any, with each page ofthis document to be signed and stamped to confirm the acceptance of the entire terms & conditionsas mentioned in the tender document.

11. After evaluation of the Technical Bid, the List of technically bidders shall be hoisted in the officialwebsite of AIIMS, Bhubaneswar.

12. After due evaluation of the Bids Institute will award the contract to the lowest evaluated responsivebidder, quoting the total price of materials and GST.

13. FALL CLAUSEThe rate contract will be guided by “Fall Clause”. The fall clause provides that if the rate contractholder reduces its price or sells or even offers to sell the rate contracted goods following conditionsof sale similar to those of the rate contract, at a price lower than the rate contract price, to anyperson or organisation during the currency of the rate contract, the rate contract price will beautomatically reduced with effect from that date for all the subsequent supplies under the ratecontract and the rate contract amended accordingly.

14. AIIMS Bhubaneswar shall be the final authority to reject full or any part of the supply which is notconfirming to the specification and other terms and conditions.

15. The bidder is also required to submit performance report(s) from other similar organizations (atleast two hospitals with a minimum of 250 bedded capacity) where the firm has been ordered forsupply of Linen Items(Khadi) and to submit the documentary evidence of last two years .The firmshould also submit list of organizations where the material has been supplied in the last two yearsalong with complete details of items supplied. Failure to fulfil this condition will entailrejection of bids summarily and no correspondence will be entertained in this regard.( ANNEXURE-IV)

16. Rates quoted should remain unchanged during the entire rate contract period.

17. The Institute shall be at liberty to place the supply order depending upon the actual requirementof the Institute.

18. Only one best quality item (according to our specification) should be quoted against each item. Onno account should different qualities e.g. A, B, & C of items be quoted. Those items that havebeen quoted as per different qualities (In contravention to the specifications) will not beconsidered at all and will be summarily rejected.

19. Before making any supply of the item, the design & dimensions may be approved from the user.20. The proof of the design linen to be printed will be checked & approved by user before printing.21. Conditional bid will be treated as unresponsive and it may be rejected.22. Any action on the part of the tenderer to influence anybody in the said Institute will be taken as an

offence and the tender submitted by the firm will subsequently be rejected.23. A prospective bidder requiring any clarification of the bidding documents shall contact the purchaser

in writing at the purchaser’s e-mail address i.e. aso@aiimsbhubaneswar.edu.in &spo@aiimsbhubaneswar.edu.in. The purchaser will respond in writing (e-mail) to any request for

clarification, provided that such request is received not later than 10 (ten) days prior to the deadlineof submission of bids.

24. TENDER EVALUATIONTenders evaluation will be done in two stages:

a. Technical bidb. Financial bid.

Each bid to be submitted in separate sealed envelopes super-scribed as “Technical Bid” and “FinancialBid” respectively. All these 2 envelopes should be put in another envelope marked as “For Supply ofHospital Linen Items(Khadi) on Rate Contract Basis to AIIMS, Bhubaneswar” and to be duly sealed.

(A) TECHNICAL BID:

The firm should submit the Technical Bid in a sealed cover separately super-scribed “For supply ofHospital Linen Items on Rate contract to AIIMS, Bhubaneswar” along with Name and address of theBidder. Technical bid should contain:a. Entire tender document including Technical Bids (PART A, B, C)b. Samples of all the items ( from sl.no. 1 to sl. No.48) should be submitted along with the technical

bid (duly labelled and sealed).c. Lowest Quoted Bidder ‘s Selection will be made purely on sample quality basis, technically

qualified evaluation and lowest quoted price of individual item basis respectively.The items accepted technically will only be considered for financial evaluation (financial bid). Priceshould not be quoted with technical bid.

B. FINANCIAL BID:

Should be submitted in a separate sealed envelope super-scribed the word “For supply of HospitalLinen Items(Khadi) on Rate contract to AIIMS, Bhubaneswar” along with Name and address of theBidder.

The price should be quoted as “Total Cost” basis to be delivered at AIIMS Bhubaneswar. The ratesquoted in ambiguous terms such as “Freight on actual basis” or “Taxes as applicable extra” or “Packingforwarding extra” will render the bid liable for rejection.

25. Debarment from bidding.

(i) A bidder shall be debarred if he has been convicted of an offence-(a) under the Prevention of Corruption Act, 1988; or(b) the Indian Penal Code or any other law for the time being in force, for causing any loss of life orproperty or causing a threat to public health as part of execution of a public procurement contract.

(ii) A bidder debarred under sub-section (i) or any successor of the bidder shall not be eligible toparticipate in a procurement process of any procuring entity for a period not exceeding three yearscommencing from the date of debarment. Department o f Commerce (DGS&D) will maintain such listwhich will also be displayed on the website of DGS&D as well as Central Public Procurement Portal.(iii) A procuring entity may debar a bidder or any of its successors, from participating in any procurementprocess undertaken by it, for a period not exceeding two years, if it determines that the bidder hasbreached the code of integrity. The Ministry/Department will maintain such list which will also bedisplayed on their website.

(iv) The bidder shall not be debarred unless such bidder has been given a reasonable opportunity torepresent against such debarment.25. Code of Integrity:

No official of the bidder shall act in contravention of the codes which includes

(i) Prohibition of(a) making offer, solicitation or acceptance of bribe, reward or gift or any material benefit, eitherdirectly or indirectly, in exchange for an unfair advantage in the procurement process or to other wiseinfluence the procurement process(b) any omission, or misrepresentation that may mislead or attempt to mislead so that financial orother benefit may be obtained or an obligation avoided.(c) any collusion, bid rigging or anticompetitive behaviour that may impair the transparency, fairnessand the progress of the procurement process.(d) Improper use of information provided by the procuring entity to the bidder with an intent to gainunfair advantage in the procurement process or for personal gain.(e) Any financial or business transactions between the bidder and any official of the procuring entityrelated to tender or execution process of contract; which can affect the decision of the procuring entitydirectly or indirectly.(f) Any coercion or any threat to impair or harm, directly or indirectly, any party or its property toinfluence the procurement process.(g) Obstruction of any investigation or auditing of a procurement process.(h) Making false declaration or providing false information for participation in a tender process or tosecure a contract;(ii) Disclosure of conflict of interest.(iii) Disclosure by the bidder of any previous transgressions made in respect of the provisions of sub-clause with any entity in any country during the last three years or of being debarred by any otherprocuring entity.

The purchaser will reject a proposal for award if it determines that the bidder recommended foraward has, directly or through an agent, engaged in corrupt, fraudulent, collusive or coercive practicesin competing for the contract in question.

26. Applicable Law:

• The contract shall be governed by the laws and procedures established by Govt. of India, withinthe framework of applicable legislation and enactment made from time to time concerning suchCommercial dealings / processing.

• Any disputes are subject to exclusive jurisdiction of Competent Court and Forum inBhubaneswar, Odisha, India only.

• The Arbitration shall be held in accordance with the provisions of the Arbitration andConciliation Act, 1996 and the venue of arbitration shall be at Bhubaneswar. The decision of theArbitrator shall be final and binding on both the parties.

• Force Majeure: Any delay due to Force Majeure will not be attributable to the supplier on Basisof proper justification & evidence to be produced by the supplier.

The Director, AIIMS Bhubaneswar, India has the full and exclusive right to accept or reject,increase or decrease order quantity, any or all the tenders without assigning anyreasons thereof and also to cancel the supply at any time without assigning any reason.

Sir/Madam,

1. The undersigned certify that I/we have gone through the entire tender documents including terms andconditions mentioned in the tender document and undertake to comply with them. I have noobjection for any of the content of the tender document and I undertake not to submit anycomplaint/ representation against the tender document after submission date and time of thetender. The rates quoted by me/us are valid and binding on me/us for acceptance till the validityof tender.

2. I/We undersigned hereby bind myself/ourselves to ALL INDIA INSTITUTE OF MEDICAL SCIENCES,BHUBANESWAR, ODISHA-751019 to supply the approved awarded Hospital Linen(Khadi)items in theapproved prices to AIIMS Bhubaneswar.

3. The items shall be of the best quality and of the kind as per the requirement of the institution.The decision of the Director, AIIMS Bhubaneswar, India (herein after called the said officer) as regardto the quality and kind of article shall be final and binding on me/us.

4. I/we undertake to arrange for a demonstration of the items, if required. Failure to arrange for ademonstration on the given date may lead to cancellation of the bid. Cost of such demonstration shallbe borne by me/us.

5. Performance security of 10% of the cost of the supply value shall be deposited by me/us in the formof FDR/Bank Guarantee in the name of All India Institute of Medical Sciences, Bhubaneswar onaward of the contract from a Nationalised / Commercial Bank and shall remain in the custody ofthe Director, AIIMS BBSR till the validity of the Rate Contract period plus two months.

6. If it is deemed necessary to change any item on being found of inferior quality, it shall be replaced byme/us free of cost in time to prevent inconvenience.

7. I/We hereby undertake to supply the items during the validity of tender as per directions given insupply order within stipulated period positively.

8. If I/We fail to supply the Khadi items in stipulated period the AIIMS Bhubaneswar has fullpower to compound or forfeit the Bid Security/security deposit.

9. I/We declare that no legal/financial irregularities are pending against the proprietorPartner/Director of the Institution.

10. I/we undertake to supply the ordered items within stipulated period and if fail to supply duringthe stipulated period the necessary action can be taken by the Director, AIIMS Bhubaneswar, India.

11. I/We undertake that if the rates of any items are lowered due to any reason, I will charge the lowerrates.
