NOTICE INVITING TENDERS (NIT)
(1) Director Medical Services, In charge Procurement, Directorate of Health Services, Government of Madhya Pradesh, for and on behalf of Governor of Madhya Pradesh invites Online Tenders, from eligible and qualified bidders for “Empanelment of Analytical laboratories accredited by “National Accreditation Board for Testing and Calibration” (NABL) for the analysis of samples of drugs for a period of 3 years”.

(3) Tender Documents may be viewed or purchased online by interested and eligible bidders from the website www.mpeproc.gov.in on the above mentioned dates after online payment of Tender fee of Rs.1,000 and processing fee of Rs. 281. Tender document may also be viewed from the website www.health.mp.gov.in.
(4) The Pre-bid meeting shall be held on the date and time given above to provide clarifications to prospective bidders regarding terms and conditions given in Tender Document. The value of pre-bid meeting shall be 4th Floor, Meeting Hall at the address below.
(5) Bidders can submit its tender online at www.mpeproc.gov.in on or before the ‘End of Bid Submission’ date and time given above. The Physical copy of the Technical Bid only should also be submitted at the address below latest by 11:30 hrs on 04/03/2014.
(6) All further notifications/amendments, if any shall be posted on www.mpeproc.gov.in and www.health.mp.gov.in only. No separate communication shall be made with individual Bidders

analysis of samples of drugs ,Surgicals and Suture items for a period of 3 years”.
The Director Medical Service, (In-charge, Procurement) , Government of Madhya Pradesh (GOMP), (hereinafter referred as Tender Inviting Authority and
also called the Tender Acceptance Authority unless the context otherwise requires) invites online TENDER FOR EMPANELMENT OF ANALYTICAL LABORATORIES ACCREDITED BY “NATIONAL ACCREDITATION BOARD FOR TESTING AND CALIBRATION” (NABL) FOR THE ANALYSIS OF SAMPLES OF DRUGS FOR A PERIOD OF 3 YEARS”.
1. LAST DATE FOR ONLINE RECEIPT OF TENDERS.
(a) The last date for online receipt of tenders shall be as per “Schedule of E-
Tendering Activities” given above. (b) The bid will be valid for a period of 180 days from the date of opening of
Cover A (Technical Bid). Prior to expiration of the bid validity the Tender Inviting Authority may request the bidders to extend the bid validity for further period as deemed fit.
2. Qualification Criteria / Requirements:
a) The Analytical Testing Laboratory should be accredited by “National
Accreditation Board of Laboratories” (NABL) and such accreditation should be
valid on the date of submission of Tender. Tenderer should submit copy
certificate of Accreditation issued by NABL (duly certified by a Chartered
Accountant) for Chemical/ Biological testing including testing of drugs and
medical supplies as the case may be.
b) The Analytical Testing Laboratory should have approval under the Drugs and
Cosmetics Act, 1940 (including its amendments) and should comply with
Schedule L-1 of Drugs and Cosmetic Act. A valid document issued from regulatory
authority in support of this should be provided.
c) The Analytical Testing Laboratory should have at least 5 (five) years experience in
the analysis of drugs (biological and/or non-biological). The bidder should
provide details of past experience in the proforma given in Annexure - I.
d) The Analytical Laboratory should have achieved an average annual turnover of at
least Rs.25 Lakhs during last three years i.e. 2010-11, 2011-12 and 2012-13. The
Government Laboratories, Research & Development Laboratories, Laboratories
run by Co-operative body & Educational Institutions are exempted from the
turnover criteria
e) Analytical Laboratory, which has manufacturing activity, shall not be eligible to
participate in the tender. Agents of Analytical Testing Laboratories are not
eligible to participate in the tender.

f) All those bidders shall be disqualified for all quoted products if any person (s) (i.e
partner (s) in case of a partnership firm, member (s) in case of a company or the
proprietor in case of a proprietorship firm, as the case may be) holds 20% or
more share (ownerships) in more than one bidding entities who have quoted for
same product (s).
3. Instructions to Tenderers.
A. GENERAL CONDITIONS.
Tender documents can be purchased only online from www.mpeproc.gov.in by making
online payment. The tender document can also be downloaded from the website
http://health.mp.gov.in for purpose of viewing only and it shall not be entertained as VALID
download of tender document. To participate in tender bidder should complete stages of
PURCHASE, DOWNLOAD & FINAL BID SUBMISSION through www.mpeproc.gov.in. Bid
Submitted only on-line will be accepted. No objections related to technical evaluation
would be accepted after the price bid opening.
(i) Tender documents may be purchased only Online from www.mpeproc.gov.in
on mentioned dates as in the ‘Schedule of E-Tendering Activities’ given above.
Tender inviting Authority will not be responsible in any way for any delay.
(ii) All tenders must be accompanied with Earnest Money Deposit as specified in
clause 4.1(a) of the Tender document. Scan copy of the earnest money
instrument should be uploaded online.
(iii) Tenders will be opened online in the presence of bidders / authorized
representatives who chooses to attend on the specified date and time given in
‘Schedule of E-Tendering Activities’ at Meeting Hall ,4th
Floor, Satpura Bhawan
,Bhopal -462 004.
(iv) (a) At any time prior to the date of submission of Tender, Tender Inviting
Authority may, for any reason, whether on his own initiative or in response to a
clarification requested by a prospective Bidder, modify the condition in Tender
documents by an amendment. All the prospective bidders who have received
the tender document will be notified of the amendment only through website,
i.e. www.mpeproc.gov.in and that will be binding on them. In order to provide
reasonable time to take the amendment into account in preparing their bid,
Tender Inviting Authority may at his discretion, extend the date and time for
submission of tenders.
(b) Any person who has purchased/downloaded the tender document
should watch for amendment, if any, on the website of
GOMP/www.mpeproc.gov.in and Tender Inviting Authority will not issue
separate communication to them.
Interested eligible bidders may obtain further information in this regard from
the office of the Tender Inviting Authority or in person on the day of pre bid
meeting.

B. Earnest Money Deposit (EMD)
(i) All tenders must be accompanied with EMD of Rs. 5000/- in the form of
unconditional irrevocable Bank Guarantee issued from a scheduled bank
or Demand Draft or Fixed Deposit Receipt (FDR) and should be in the
name of “Director Medical Services (Incharge Procurement), Directorate
of Health Services, Madhya Pradesh which will also be uploaded online
www.mpeproc.gov.in . (ii) In case of EMD in form of Bank Guarantee (BG), the BG should be valid
for 180 days from the date of technical bid opening.
(iii) No exemption from submission of EMD is permitted and the bids found
without EMD as above will be summarily rejected.
(iv) Bids submitted with short validity of EMD may be rejected.
(v) Bid Security may be forfeited.
(a) If a Bidder withdraws its bid during the period of bid validity ; or
(b) In case of successful Bidder, if the Bidder fails;
(i) To sign the Contract / Agreement in accordance with clause
3.K; or
(ii) To furnish performance security in accordance with clause 3.L
(c) If the Bidder does not accept the corrected amount of Price Bid,
as the case may be, the Bid will be rejected, and the Bid security
may be forfeited.
C. Pre-bid meeting, Clarifications and Amendments:
(i) Interested eligible tenderers may obtain further information from the
office of the Tender Inviting Authority or in person on the day of pre bid
meeting. After pre-bid meeting, the prospective bidders can seek
clarification within next two days either through e-mail or through
written request. No clarification shall be provided subsequently.
(ii) At any time prior to the date of submission of Tender, Tender Inviting
Authority may, for any reason, whether on his own initiative or in
response to a clarification requested by a prospective Tenderer, modify
any condition in Tender documents by an amendment. All the
prospective tenderers who have received the tender document will only
be notified of the amendment through publication on the website, i.e.
http://health.mp.gov.in and www.mpeproc.gov.in that will be binding on
all the Tenderers. In order to provide reasonable time to take the
amendment into account in preparing their bid, Tender Inviting
Authority may at his discretion, extend the date and time for submission
of tenders.
(iii) Any Tenderer who has purchased the tender document should watch
for amendment, if any, on the website given at para 3. C(ii) above.
Tender Inviting Authority will not issue separate communication to the
bidders in this regard.

D. Preparation of Bid: The bids should be prepared in ‘Two Covers’ i.e. “Technical Bid
(Cover-A) – ‘Online’ and ‘Physical’ and “Price Bid (Cover-C) – Online”. The following
instructions should be followed:
TECHNICAL BID - COVER “A”
The Tenderer should submit the Technical Bid online as well as physical copy. All pages
of the Technical Bid should be signed and sealed by the Tenderer. All documents
submitted as part of the Technical Bid, which are photocopy should be attested by the
Tenderer and also be notarized on each page.
The tenderer shall submit a checklist of documents enclosed with page in the
enclosed proforma in Annexure VIII.
The following shall constitute Technical Bid:
a) The EMD (in original) as mentioned in para 3. B should submit manually as part of
Technical Bid.
b) Documentary evidence for the constitution of the company /Firm such as
Memorandum and Articles of Association, Partnership deed etc. with details of the
Name, Address, Telephone Number, Fax Number, e-mail address of the firm and of the
Managing Director / Partners / Proprietor.
c) The list of present Directors in the board of the Company duly certified by a Company
Secretary of a Company/Practicing Company Secretary/Chartered Accountant to be
furnished.
d) Bidders should submit copy of Certificate of Accreditation issued by NABL (duly
certified by a Chartered Accountant) for Chemical/ Biological testing including testing
of drugs and pharmaceuticals as well as mechanical testing (as the case may be).
e) The tenderer should furnish self attested and notarized photocopy of Analytical
License under Rule 150(B) duly renewed up to date, issued by the Drugs Controller
for testing and licensed in biological, non-biological drugs duly attested by Chartered
Accountant.
f) The instruments such as power of attorney / resolution of board etc., authorizing an
officer of the tenderer to sign the bid on behalf of Tenderer should be enclosed with
the tender.
g) Authorization letter nominating a responsible person of the tenderer to transact the
business with the Tender Inviting Authority
h) The Laboratory should be operating under Quality Assurance Programme and in
support; the bidder shall provide Quality Manual, Quality Policy and Master List of
Standard Operating Procedures along with name of Quality Assurance Manager
indicating his qualification and experience.
i) The Tenderer should submit an undertaking that they will retain residual sample for
six months after submission of report and agree to undertake analysis in the
presence of the representative(s) of Directorate of Health Services Madhya Pradesh
in case of doubt or otherwise.
j) Self attested and notarized copy of certificate of registration for service tax should
be enclosed Annexure - II.

k) Self attested and notarized documents of the following should be furnished in the
formats given in Annexure III.
a. The list of qualified personnel employed in the laboratory.
b. The list of sophisticated instruments available in the laboratory.
c. Micro Biological facilities available in the laboratory.
l) A declaration in the proforma given in Annexure IV duly signed and notarized.
m) Details of Laboratory in Annexure – V.
n) Non Conviction Certificate for the last three years, i.e., 2010-2011, 2011-12 and
2012-2013 issued by the competent authority.
o) Annual turnover statement certified by the auditors for last three years i.e., 2010-
2011, 2011-12 and 2012-2013. Balance Sheet and Profit and Loss Account duly
certified by the Auditors for the last three years i.e., i.e., 2010-2011, 2011-2012 and
2012-2013.
p) Documentary evidence, if any, for having undertaken testing of products for exports.
q) A declaration that the bidder has not been blacklisted by any State / Central
Government Organization.
r) The list of Drugs (along with Item Code) quoted for analysis should be given in
Annexure VI. Please note that this list should not mention testing charges.
s) The specifications of drugs for testing are tentative they can be changed before the
samples are being sent for testing.
Price Bid(Envelope code ‘C’):
a) The Price Bid has to be submitted online with “Cover C” Price Bid in excel format. b) The Bidder should submit Price Bid by giving the rate of Testing Charges for the
complete analysis of “single sample” of an item and not for individual test to be
performed on the sample.
c) The rates quoted should be inclusive of all taxes but exclusive of service tax. The
Service tax as per prevailing rate shall be paid to the Laboratory upon submission of
claim and proof of Service Tax Registration
d) The rates quoted and accepted will be binding on the tenderer for the stipulated
period and on no account any revision will be entertained till the completion of the
contract period.
E. Taxes and Duties:
(i) The Service tax as per prevailing rate shall be paid to the Laboratory upon
submission of claim and proof of Service Tax Registration.
(ii) Further the tenderers are requested to note that any taxes to be deducted
at source at the rate fixed by the appropriate Govt. in i.e. State / Central,
shall be deducted at the time of payment against the services.
F. Submission of Bids:
(i) The bid submission date/time shall be as per Table given under “Schedule of
E-Tendering Activities”.

(ii) The bid submission date/time could be amended at the discretion of Tender
Inviting Authority in case of technical problems. Tender inviting Authority will
not be responsible in any way for any delay.
(iii) The Physical Copy of the Technical Bid documents must also be submitted in a
sealed cover and superscribed as “Tender for empanelment of Analytical
laboratories for the analysis of samples of drugs for a period of 3 years”.
(iv) The Physical Copy of the Technical Bid should reach the Director Incharge
Procurement at the Directorate of Health Services , 4th
floor Satpura
Bhawan,Bhopal 462 004 on or before the time and date given in “Schedule
of E-Tendering Activities.
G. Modification and Withdrawal of Bids
(i) The Bidder may modify or withdraw its bid prior to bid opening,
provided that written notice of the modification or with drawl is
received by the Tender Inviting Authority prior the deadline
prescribed for submission of bids.
(ii) No bid can be modified subsequent to the deadline for submission of
bids. No bid can be withdrawn in the interval between the deadline
for submission of bids and expiration of period of bid validity specified
by the bidder on the bid form. With drawl of bid during this interval
may result in the Bidders forfeiture of its bid security.
H. Tender Opening:
(i) Tenders will be opened in the presence of tenderers / authorized
representatives who choose to attend as per date/time specified in the
Table given under “Key Dates” above at “Meeting Hall, 4th
Floor,
Satpura Bhawan, Bhopal, Madhya Pradesh. Only one person carrying
authorization letter from the bidder will be allowed to attend the bid
opening.
(ii) If the office happens to be closed on the key dates specified above, such
events shall happen on the next working day at the same time and
venue.
(iii) The Cover “A” will be opened first, and after scrutiny and
confirmation of the documents and the information furnished therein,
including inspection of the laboratory, if required, eligible and
qualified laboratories will be shortlisted and will be commutated
through health web site or email.
(iv) The price bid of technically qualified bidders shall be opened on the
date/time specified in the Table given under “Key Dates /
Information”.
(v) The acceptable rates for analysis will be decided and communicated
on website http://health.mp.gov.in and by email. I. Validity of Bids
The bids will be valid for a period of 180 days from the date of opening of Cover “A”
(Technical Bid). In exceptional circumstances, the Tender Inviting Authority may
solicit the Bidder’s consent for an extension of the period of validity. The request and
response thereto should be made in writing (or by e-mail), the bid security provided

shall be suitably extended. Bidder may refuse the request without forfeiture of its
bid security
J. Acceptance of Tender
a) Acceptance of tender will be communicated based on the lowest rates quoted by
different firms and subject to the approval of competent authority,
b) The Tender inviting authority, reserves the right to accept or reject any tender for
any one or more of the items tendered for, without assigning any reason.
c) Number of laboratories to be empanelled shall be decided, at the time of finalization
of tender, based on work load of Tender Inviting Authority. No
appeal/representation from the bidder (s) shall be accepted on number of
laboratories to be empanelled by the Tender Inviting Authority.
d) All The L-2 and L-3 bidders will be invited to match the rate quoted by the L1 Bidder.
In case, L-2 and L-3 agree so, they shall also be empanelled.
e) The Tender inviting authority will reject the tenders of blacklisted Laboratories and
reserve the right to reject those whose past performance with TNMSC/GoMP was
poor.
K. Agreement
a) All tenderers who are empanelled will have to execute an agreement in a non-
judicial stamp-paper of value Rs.100/- (Stamp duty to be paid by the tenderer), in
favour of Director Medical Services (Incharge Procurement), Directorate of Health
Services, Madhya Pradesh.
b) Tenderer has to execute the agreement within 15 days from the date of receipt of
the intimation by tender inviting authority informing that their tenders have been
accepted. The format of agreement will be as per Annexure IX
c) If the successful tenderer fails to execute the agreement and payment of security
deposit within the time specified or withdraws the tender after intimation of the
acceptance of the tender has been sent or owing to any other reasons, the tenderer
is unable to undertake the contract, the empanelment will be cancelled and the
Earnest Money Deposit of the tenderer shall stand forfeited. Such tenderer(s) will
also be liable for all damages sustained by the Tender Inviting Authority / Ordering
Authority by reasons of breach of tender conditions. Such damages shall be
assessed by the Tender Inviting Authority, Directorate of Health Services, and
Government of Madhya Pradesh whose decision shall be final.
L. Performance Security Deposit
The successful tenderers shall be required to pay a performance security deposit of
Rs.50,000/- at the time of execution of the agreement reference in clause 3.B.(iv) (ii)
above in the form of Unconditional Irrevocable Bank Guarantee issued by a
Scheduled Bank (Pledged to DIRECTOR MEDICAL SERVICES, (INCHARGE
PROCUREMENT), Directorate of Health Services, Madhya Pradesh payable at Bhopal.
M. Payment Provisions
(i) No advance payment towards any analysis will be made to the empanelled tenderer.
(ii) No payment will be made for the incomplete analysis or incomplete report.

(iii)Payments towards the analysis of Drugs will be made, strictly as per rules of the
Directorate of Health Services, Government of Madhya Pradesh.
(iv) Payment will be made centrally by the Tender inviting authority.
(v) The payment shall be released within 45 days of receipt of claim from Laboratory
upon submission of Test reports of the samples tested and soft copy of related
chromatograms.
N. Description of Services and Performance Requirements:
a. The analysis will be carried out as per Pharmacopoeial monographs with the use of
Pharmacopoeial Reference Standards. In case of non pharmacopoeial methods the
laboratory can use methods that are validated as per ICH guidelines. The validation
protocols and Master list of Reference Standards shall be available for examination
of the representatives of Directorate of Health Services Madhya Pradesh.
b. The analysis will be carried out on the calibrated equipment and the laboratory will
provide the Master list of calibration for the examination to the representatives of
Directorate of Health Services Madhya Pradesh/Food and Drug Administration.
c. On empanelment and entrustment of the job, the Analytical Laboratory should
furnish the test reports within.
i) 10 days of receipt of the sample in case of Tablets, Capsules, Pessaries,
Ointments, Powder and Liquid Oral Preparations.
ii) 25 days of receipt of the sample in the case of I.V. Fluids, Injections, eye/ear
drops Disinfectants and those items requiring sterility testing.
iii) For any delay more than stipulated in 3.N.c.(i) & c.(ii) as the case
may be, 1% of the testing charges per week and the part there of would be
deducted as penalty. If consecutively for 4 times or more than 8 times in a year,
stipulated in 21 a(i)/a(ii) then the penalty for subsequent delays would be 2% of
testing charges per week and part thereof.
d) The laboratory should report on packaging and general description of the product.
All the tests mentioned in IP/BP/USP/Drugs & Cosmetics Act/BIS/ISO. Etc., (as the
case may be) should be carried out for each and every sample. The results obtained
in the test should be mentioned in figure (wherever possible). In case of a non-
pharmacopoeial drug, the laboratory should follow standards and validated
protocols as per ICH guidelines including stability indicating assays and provide the
details with the report. In all those cases where sustained release or delayed release
profiles are claimed, dissolution should invariably be performed.
e) “COMPLIES” or “PASS” in the result column of the report is treated as incomplete
report, if the result has some value. Every test report must have specific remarks
(i.e.) Standard Quality or Not of Standard Quality.
f) All test reports should be mailed to the ordering Authority and report should also be
uploaded on the website of SDMIS (State Drug Management Information System)
and simultaneously be E-Mailed to head office on
g) The Analytical Laboratory used for analysis of sample of a particular batch for pre-
delivery testing, either at the request of supplier or ordering authority, shall not be

given work for analysis of the same item with same batch during post-delivery
testing.
h) In case of failure of a sample, the result should be communicated immediately to the
Ordering Authority and to the head office or the manufacturer as the case may be
through phone / E-mail and the report should be sent with protocols.
i) If in any circumstances (like break down of instrument, non availability of reference
standard etc.) The Analytical Laboratory is unable to undertake analysis for a
sample, the same should be reported within 24 hours of receipt of such a sample by
E-mail and the sample should be returned to the concerned Ordering Authority of
the District.
j) If any sample is received in a damaged condition by the laboratory, the sample
should not be analyzed and the information should be sent immediately to the the
concerned Ordering Authority of the District by FAX or E-mail with a copy to head
office.
k) The Director Medical Services, (Incarge Procurement) or his authorized
representative(s) has / have the right to inspect the laboratories of the tenderers
who have submitted tenders, before taking any decision regarding empanelment.
Similarly, the Director Medical Services, (Incharge Procurement) ,Directorate of
Health Services, Madhya Pradesh or his authorized representatives may also inspect
any laboratory empanelled, at any point of time during the continuance of the
tender and terminate / cancel its empanelment or any orders issued to the
laboratory or not to entrust any further testing job to the laboratory based on facts
brought out during such inspections.
l) Non performance of any tender or empanelment conditions will disqualify a
laboratory to participate in the tender for the next five years.
m) To assess the correctness of the test results being given by the Empanelled
laboratories, at random, the Tender inviting Authority can exercise the option of
witness testing by its authorized representatives from the residual sample or
alternatively the residual samples may be sent to the Government Analyst for
testing and if any variation is found the result would be informed to empanelled
laboratories. If there is any variation in the test data more than 5% in the analytical
reports furnished by the empanelled laboratories (either pass or fail) with the
Government Lab for 3 times in assay test and 4 times for other than assay, in a year,
the empanelled laboratory will be blacklisted for a period of 5 years after following
the due process.
n) If it is revealed that the analytical Laboratory is involved in any form of fraud and
collusion with the suppliers of Directorate of Health Services, MP, the Analytical
Laboratory will be black listed for a period of 5 years. The tenderers shall also be
liable for action under criminal law and the matter will be notified to the concerned
Director of Drugs Control for penal action against them.

AGREEMENT
THIS AGREEMENT made the ........... day of ......................... , 2014 between ___________________ (hereinafter "the Purchaser") of the one part and ____________________ (hereinafter called "the Service Provider") of the other part : WHEREAS the Purchaser is desirous that certain services viz;. Laboratory Analysis of Drugs and Medical Supplies of the items as per the tender Reference No. ___/GOMP/LAB/2014, Dt._______ and has accepted a bid by the Service Provider for the Laboratory Analysis. NOW THIS AGREEMENT WITNESSETH AS FOLLOWS:
1. In this Agreement words and expressions shall have the same meanings as are respectively assigned to them in the Conditions of Contract referred to, and they shall be deemed to form and be read and construed as part of this agreement.
2. The following documents shall be deemed to form and be read and construed as part of this Agreement, viz.:
a) The Letter of Acceptance issued by the purchaser.
b) The Terms and Conditions of Tender
c) The Service Provider’s bid including enclosures, annexures, etc.
d) The Terms and Conditions of the Contract
e) The Schedule of Requirement
f) The Technical Specification
g) Any other document listed in the Service Provider’s bid and replies to
queries, clarifications issued by the purchaser, such confirmations given by
the Service Provider which are acceptable to the purchaser and the entire
Addendum issued as forming part of the contract.
3. In consideration of the payments to be made by the Purchaser to the Service Provider as hereinafter mentioned, the Service Provider hereby covenants with the Purchaser to provide, the services in conformity in all respects with the provisions of the Contract.
4. The purchaser hereby covenants to pay the Service Provider in consideration of the provision of the services, the Contract Price or such other sum as may become payable under the provisions of the Contract at the times and in the manner prescribed by the Contract.

Performance Requirements: The Service Provider should furnish the test reports within:
(i) 10 days of receipt of the sample in case of Tablets, Capsules, Pessaries, Ointments, Powder and Liquid Oral Preparations.
(ii) 25 days of receipt of the sample in the case of I.V. Fluids, Injections, eye/ear drops Disinfectants and those items requiring sterility testing.
