Back Ground Information

The Ministry of Panchayat Raj, Government of India, has accorded sanction for theimplementation of various activities under Rajiv Gandhi Panchayat Sashakthikaran Abhiyan tostrengthen the Gram Panchayat administration by providing necessary administrative and technicalfunctionaries in the state.

The RGPSA approved action plan envisages establishment of one Gram Panchayat ResourceCentre (GPRC) in each Mandal Head Quarters to act as a “Nerve Centre” for providing hand holdingsupport to the Gram Panchayats in managing the affairs like village spatial planning, assessment oftaxes, maintenance of Database, up keeping of Panchayat accounts in online PES applications,execution of civil works etc.,

The GPRCs shall be assisted by the Technical personnel viz., Social Mobiliser &DecentralizedPlanning expert , Town Planning & Building Overseer, Civil Supervisor (Engineering), Accountant-cum-DEO. The services of the technical personnel shall be accessed through a man-power supplyagency on Out sourcing basis.

SCOPE OF WORK AND GENERAL INSTRUCTIONS FORBIDDERS

1. Commissioner, PR&RD, AP, Hyderabad requires the services from reputed, well established andfinancially sound Manpower Service Providers to provide man power to work as Social Mobiliser &Decentralized Planning expert , Town Planning & Building Overseer, Civil Supervisor(Engineering), Accountant –cum- DEO for the proposed Gram Panchayat Resource Centers onoutsourcing basis.

2. The contract for providing the aforesaid manpower is likely to commence from a suitable dateand would continue for a period of 1 Year. The period of the contract may be curtailed/terminatedbefore completion o f the contract period , owing to deficiency in service or substandard qualityof manpower deployed by the selected Service Provider or because of change in requirementof manpower of the Commissioner, PR&RD, AP, Hyderabad or change in Government rules fromtime to time. Further, the Commissioner, PR&RD, AP, Hyderabad reserves the right to terminate theinitial contract at any time after giving 15 days notice to the selected Man power Service Provider.

4. The approximate cost of the contract is Rs.34.00 crores (Rupees Thirty Four Crores only) for theperiod of one year.

The interested Manpower Service Providers may submit the tender document in allrespects along with Earnest Money Deposit (EMD) of Rs. 68.00 lakhs (Rupees Sixty Eight lakhs only )and other requisite documents on or before 07.03.2015 up to 1.00 pm at the O/o Commissioner,PR&RD, AP, Urdu Hall Lane, Himayat Nagar, Hyderabad 500029, by Registered post /Speed post /Byhand.The tender documents can be downloaded from the website www.appr.gov.in or can be obtained fromO/o Commissioner, PR&RD, AP, Urdu Hall Lane, Himayat Nagar, and Hyderabad- 500029. Wherever thedownloaded document is used a DD drawn in favour of Commissioner, PR&RD, A.P., Hyderabad forRs.25,000/-(Rupees twenty five thousand shall be enclosed)

NOTE:i. The Tender proposal and the other related documents shall be in English language only.

ii. The Bids received after the due date and the specified time (including the extended periodif any) for any reason what so ever, shall not be entertained and shall be returnedunopened.

iii. The Bids submitted by Telex/Telegram/Fax/e mail etc., shall not be considered. Nocorrespondence will be entertained on this matter.

iv. Commissioner, PR&RD, Govt. of Andhra Pradesh, Hyderabad, shall not be responsible forany postal delay or non-receipt/non-delivery of the documents. No furthercorrespondence on the subject will be entertained.

v. Commissioner, PR&RD, Govt. of Andhra Pradesh, Hyderabad, reserves the right to modify

and amend any of the above stipulated condition/criterion depending upon the projectpriorities vis-à-vis urgent commitments. Such amendments shall be posted in thedepartment website and shall be published in the same news paper in which the tendercall notice is published.

vi. The proposals received without or with inadequate fees shall be rejected.

6. The tender has been invited under two bid system i.e. Technical Bid and Financial Bid. Theinterested agencies are advised to submit tender papers in two separate sealed envelopessuper scribing “ Technical Bid for providing Manpower Services to Commissioner, PR&RD,AP Hyderabad” and “Financial Bid for providing Manpower Services to Commissioner, PR&RD,AP, Hyderabad” . Both sealed envelopes should be kept in a third sealed envelope super scribing“Tender for Providing Manpower Services to Commissioner, PR&RD, AP, Hyderabad”. TenderDocuments received after 04.03.2015, 1.00 PM will not be considered.

7. The Earnest Money Deposit (EMD) Rs.68.00 lakhs (Rupees Sixty Eight Lakhs) at the rate of2% of the project cost which is refundable (without interest), should be necessarilyaccompanied with the Technical Bid of the service provider in the form of Demand Draft fromany Nationalised Bank drawn in favour of Commissioner, PR&RD, AP, Hyderabad, Payableat Hyderabad and shall be valid for 90 days from the date of opening of the tender, failing whichthe tender shall be summarily rejected.

8. EMD of all the unsuccessful bidders would be refunded by the Commissioner, PR&RD, Govt. ofAP, Hyderabad within 90 days of the bidder notified as being unsuccessful. The EMD amount forthe amount mentioned above of the successful bidder would be kept as a part of PerformanceGuarantee till the acceptance of final deliverable.

9. The EMD amount is “Interest free” and will be refundable to the unsuccessful bidders withoutany accrued interest on it.

10. The EMD may be forfeited:

i. if a bidder withdraws its bid during the period of bid validity,ii. in case of a successful bidder, if the bidder fails to sign the contract in accordance with

the tender document,iii. if found to have a record of poor performance such as having abandoned work, having

been black listed, having inordinately delayed completion and having faced commercialfailures etc.

iv. In case of a successful tenderer, if the agency fails to deploy the required manpoweragainst the initial requirement within 30 days from the date of placing the order, theEMD shall stand forfeited without giving any further notice.

11. The successful tenderer will have to deposit a Performance Security Deposit of Rs.3.40Crores (Rupees Three crores forty lakhs only) , i.e., 10% of the total project cost over a period ofone year, in the form of Fixed Deposit Receipts (FDR) made in the name of agency andhypothecated to the Commissioner, Panchayat Raj and Rural Development, AP, Hyderabad, or in the

form of Bank Guarantee from any Nationalized Bank in favour of the Commissioner, PR&RD,AP, Hyderabad covering the period of contract. Agreement shall be executed uponconfirmation of the Performance Bank Guarantee received for the above mentioned amountfrom the concerned bank.

12. The Manpower Service Providers participating in the tender process are required to enclosephotocopies of the following documents (dully attested by Gazette Officers of the State Governments/Central Government), along with the Technical Bid, failing which their bids shall be summarily/outrightly rejected and will not be considered any further:

(a) Registration certificate of the applicant organization

(b) Copy of TIN/GIR/PAN card of firm;

(c) Copy of the IT return filed for the last three financial years;

(d) Copies of EPF and ESI certificates;

(e) Copy of the Service Tax registration certificate;

(f) Certified extracts of the Bank Account containing transactions during last three years

13. The conditional bids shall not be considered and will be out rightly rejected in very first instance.

14. All entries in the tender form, in figures and words, should be legible and filled clearly. No overwritingor cutting is permitted in the Bid forms. In such cases the tender shall be summarily rejected.

15. The Technical Bid shall be opened on the scheduled date and time, in the office of theCommissioner, PR&RD, Hyderabad in presence of the representatives of the Manpower ServiceProviders or his authorized agents , if any, who wish to be present on the spot at that time.

16. The Financial Bid of only those tenderers will be opened whose Technical bids are found inorder. The Financial bids shall be opened at the scheduled date and time in the office ofCommissioner, PR&RD, AP, in presence of the representatives of the Manpower Service Providers, ifany, who wish to be present on the spot at that time.

17. The Successful bidder will enter into agreement with the Commissioner, PR&RD, Govt. of AP,Hyderabad or the nominees authorized by the Commissioner, PR&RD, AP, Hyderabad for the supply of thesuitable and qualified manpower as per the requirement of this office as mentioned in the tenderdocument.

18. The Commissioner, PR&RD, AP, Hyderabad reserves the right to accept or reject any or all bidswithout assigning any reason thereof.

TECHNICAL REQUIREMENTS FOR THE TENDERING MANPOWER SERVICEPROVIDER

1. The tendering Manpower Service Provider should fulfill the following technical specifications.

a) As this tender contract is for entire 659 GPRCs in 13 districts of Andhra Pradesh for providing differentcategories of qualified manpower. Individual company/agency or Two or more agencies can form aconsortium (joint venture) and participate in the tender. However order will be placed on lead partnercompany/Agency as per the consortium agreement. The lead company shall be responsible fordeployment, payment and all other operational activities.

b ) The registered office or one of the branch offices of the Manpower Service Provider should belocated within Andhra Pradesh.

c) They should have been registered with the appropriate registration authority

d) The man power service provider shall possess local labour license for all 13 Districts in Andhra Pradesh

e) The man power service provider shall have district offices in all districts of AP and regional level traininginstitute located for training man power

f) The individual agency shall have a minimum experience of (10) and for consortium at least one membercompany shall have 15 years experience in supplying manpower to Government Departments, PublicCompanies/Banks, etc;

(g) They should have their own Bank Account in the name of company/organization/firm

(h) They should be registered with Income Tax and Service Tax Departments;

(i) They should be registered with appropriate authorities under Employees Provident Fund andEmployees State Insurance Acts.

(j) They should have any other regulatory clearance that may be required for providing manpowerservices.

(k) Average Annual turnover of the service provider during the last 3 financial years 2011-12, 2012-13 and2013-14 should be Rs. 15 crores for individual company /agency and for consortium Rs.20 crores.

(l) For successful bidder EMD will be converted as Security Deposit.

Preferential criteria

Individual company /consortium having labour license in all 13 districts of Andhra Pradesh NSIC registered companies in the relevant field. Company having training institutes in skill development ISO certified companies Company having complaint redressal mechanism (portal). Necessary photographs with URL of the

portal shall be mentioned in the tender.

The age limit will be relaxed by 5 years for SCs/STs and BCs.

Note:The Rule of Reservation in vogue shall be followed in the supply of the outsourcing personnel by the Manpower Service provider to ensure social justice.

Other Essential Requirements for selection of suitable man power

The following criterion and procedures shall be adopted for selection of GPRC resource persons by manpower service provider

Step 1: Inviting applications from eligible candidates through wide publicity in local press/mediaStep 2: Preparation of preliminary merit list of all eligible candidates based on marks obtained inqualifying examinationsStep 3: Short list the candidates from the preliminary merit list as per requirement following transparentselection process . Rule of reservation as per existing government rules shall be followedStep 4: Revenue division shall be the unit of selection/deployment. The candidates shall not be posted intheir native Mandals.

*Any sort of malpractices in the selection process shall become liable for disqualification of theoutsourcing agency and for termination of the contract even before completion of one year agreement.

On receipt of work done certificate from DPO on quarterly basis, the payment will be released to the Man powerservice provider.

The calculation of the commission payable to the man power service provider will be based on the actual amount ofsalary disbursed to the personnel deployed in GPRCs.

If the rate quoted by the bidders is equal, the L1 will be decided based on the merits in the technical bid particularly,based on the audited financial turnover of the previous three years.

TERMS AND CONDITIONSGENERAL:1. The agreement shall likely to commence from suitable date or later and shall continue for a period of 1 Year,unless it is curtailed or terminated by the Commissioner, PR&RD, AP, Hyderabad owing to deficiency of service, sub-standard quality of manpower deployed, breach of contract etc. or change in requirements or Government rules orany other administrative reasons.

2. The agreement shall automatically expire once the contract period is completed, or unless extended further bythe mutual consent of the Manpower Service Provider and the Commissioner, PR&RD, AP

3. The Manpower Service Provider shall not be allowed to transfer, assign ,pledge or sub contract its rights andliabilities under this agreement to any other agency or organization by whatever name be called without the priorwritten consent of the Commissioner, PR&RD, AP, Hyderabad.

4. The Commissioner, PR&RD, Hyderabad at present, has tentative requirement of manpower as mentioned underthe scope of work and general instruction for bidders on urgent basis. The requirement of this office mayfurther increase or decrease, during the period of initial contract also and the Tenderer should have to provideadditional Manpower Service, if required, on the same terms and conditions.

5. The Manpower Service Provider will be bound by the details furnished by it to the Commissioner, PR&RD,AP, Hyderabad while submitting the tender or at a n y subsequent stage. In case, any of such documentsfurnished by it is found to be false at any stage, it would be deemed to be a breach of terms of agreementmaking it liable for legal action besides termination of the Agreement.

6. The Commissioner , PR&RD, AP, Hyderabad reserves the right to terminate the agreement during initialperiod also after giving 15 days notice to the Manpower Service Provider.

7. The persons deployed shall be required to report for work at the scheduled time at Gram Panchayat ResourceCenters located in the respective Mandal head quarters in each Mandal Praja Parishad in Andhra Pradesh Stateor such other office as may have been kept in charge of the Office Establishment of the office concernedand would leave at the scheduled time. In case the person deployed remains absent on a particular day orcomes late/leaves early on three occasions proportionate deduction from the remuneration for one day willbe made.

8. In case the person deployed is called to work on holidays to attend duty he shall be given a Compensatorycasual leave.

9. The Manpower Service Provider shall nominate a coordinator at State as well at each district who shallbe responsible for immediate interaction with the concerned Officers in the O/o Commissioner, PR&RD, AP,Hyderabad and at the O/o respective District Panchayat Officer, so that optimal services of the persons deployedcould be availed without any disruption.

10. The entire financial liability in respect of manpower services deployed in GPRCs shall be that ofthe Manpower Service Provider and the Commissioner, PR&RD, AP, Hyderabad will in no way be liable. Itwill be the responsibility of the Manpower Service Provider to pay to the person deployed a sum not lessthan the minimum rate quoted in the financial bid and produce such evidence as may be required by this office.

11. For all intents and purposes, the Manpower Service Provider shall be “Employer” within the meaning ofdifferent Rules and Acts in respect of manpower so deployed. The person deployed by the Manpower ServiceProvider shall not have any claim whatsoever like employer and employee relationship against Commissioner,PR&RD, Government of Andhra Pradesh, Hyderabad.

12. The Manpower Service Provider shall be solely responsible for the redressal of grievances orresolution of disputes relating to persons deployed. The Commissioner, PR&RD, AP, Hyderabad shall, in noway, be responsible for settlement of such issues whatsoever. In case the grievances of the deployedperson are not attended to by the man power service provider the deployed person can place theirgrievance before a joint committee consisting of a representative of Commissioner, PR&RD, AP,Hyderabad and an Authorized representative of the Manpower Service Provider.

13. The Commissioner, PR&RD, AP, Hyderabad shall not be responsible for any financial loss or any injury/death ofany person deployed by the Manpower Service Provider in the course of their performing the functions/duties, orfor payment towards any compensation.

14. The person deployed by the Manpower Service Provider shall not claim nor shall be entitled to pay, perks andother facilities admissible to regular/confirmed employees during the currency or after expiry of the agreement.

15. In case of termination of this agreement on its expiry or otherwise, the persons deployed by the ManpowerService Provider shall not be entitled to and shall have no claim for any absorption in regular or in any othercapacity.

16. The person deployed shall not claim any benefit or compensation or absorption or regularization ordeployment with this office under the provision of Rules and Acts. Undertaking in the form of an affidavit, fromthe person deployed to this effect shall be required to be submitted by the Manpower Service Provider.

17. The Manpower Service Provider must be registered with the concerned Govt. Authorities, i.e. , LabourCommissioner provident Fund Authorities Employees State Insurance Corporation etc. and a copy of registrationshould be submitted. The Manpower Service Provider shall comply with all the legal requirements for obtainingLicense under Contract Labour (Regulations and Abolition) Act, 1970 if any, at his own part and cost.

18. The Manpower Service Provider shall provide a substitute well in advance if there occurs any probability ofthe person leaving the job due to his/her own personal reasons. The payment in respect of the overlappingperiod of the substitute shall be the responsibility of the Manpower Service Provider. The Manpower ServiceProvider shall be responsible for contribution towards provident Fund and Employees State Insurance, whereverapplicable. The Manpower Service Provider has to submit the list of EPF Account numbers of all the outsourcedpersonnel deployed in GPRCs. The Manpower Service Provider shall produce remittance certificate towards EPF andESI contributions at the time of submitting the bill for the succeeding month. Any excess deductions made by theManpower Service Provider in violation of the government instructions shall result in stringent action.

19. The persons deployed by the Manpower Service Provider should have good police records and no criminalcase should be pending against them.

20. The persons deployed should be polite, cordial and efficient while handling the assigned remuneration workand their actions should promote good will and enhance the image of Commissioner, PR&RD, AP, Hyderabad. The

Manpower Service Provider shall be responsible for any act of indiscipline on the part of the persons deployed.

21. Every page of the tender paper should be signed by the Manpower Service Provider with seal.

22. The rule of reservation and presidential orders shall be followed in the selection of out sourcing personnel bythe agency to ensure social justice.

23. The agency should comply with all instructions issued by the government from time to time for the welfare ofthe out sourcing personnel.

24. If the rate quoted by the bidders is equal, the L1 will be decided based on the merits in the technical bidparticularly, based on the audited financial turnover of the previous three years

LEGAL

25. The persons deployed shall, during the course of their work be privy to certain qualified documents andinformation which they are not supposed to divulge to third parties. In view of this, they shall be required to takeOath of confidentiality and breach of this condition shall make the manpower service provider as well as theperson deployed s hal l be liable for penal action under the applicable laws besides, action for breach of contract.

26. The Manpower Service Provider shall be responsible for compliance of all statutory provisions relating tominimum wages as payable to different types of workers in respect of the persons deployed by it in GramPanchayat Resource Centres. This office shall have no liability in this regard.

27. The Manpower Service Provider shall also be liable for depositing all taxes, levies, cess etc. on account ofservice rendered by it to Commissioner, Panchayat Raj and Rural Development, AP, Hyderabad to the concernedtax collection authorities, from time to time, as per the rules and regulations in the matter. Attested Xerox copiesof such documents shall be furnished to Commissioner, Panchayat Raj and Rural Development, AP, Hyderabad

28.The Manpower Service Provider shall maintain all statutory registers under the Law and shall produce thesame, on demand, to the Commissioner, Panchayat Raj and Rural Development, AP, Hyderabad or any otherauthority under law.

29. The Tax deduction at Source (TDS) shall be done as per the provisions of Income Tax Act/Rules as amended,from time to time and a certificate to this effect shall be provided by the Department of office concerned.

30. In case, the Manpower Service Provider fails to comply with any liability under appropriate law and a resultthereof, the Commissioner, Panchayat Raj and Rural Development , AP, Hyderabad put t o a n y l o s s /obligationmonetary or otherwise, this office will be entitled to get itself reimbursed out of the outstanding bills or theperformance security Deposit of the Manpower Service Provider, to the extent of the loss obligation in monetaryterms.

31. The agreement is liable to be terminated because of non-performance, deviation of terms and condition ofcontract, non-payment of remuneration of employed persons and non - payment of statutory dues. TheCommissioner, Panchayat Raj and Rural Development, AP, Hyderabad will have no liability towards nonpaymentof remuneration to the persons employed by the Manpower Service Provider and the outstandingstatutory dues of the service provider to statutory authorities. If any loss is caused to theCommissioner, Panchayat Raj and Rural Development, AP, Hyderabad/GPRCs by the person deployed, the sameshall be recovered from the unpaid bills or adjusted from the Performance Security Deposit.

Any sort of malpractices in the selection process shall become liable for disqualification of the outsourcing agency and fortermination of the contract even before completion of one year agreement.

FINANCIAL

32. The Technical bid should be accompanied with an Earnest Money Deposit (EMD) of Rs. 68.00 lakh (RupeesSixty Eight Lakhs only) at the rate of 2% of the total project cost refundable without interest and cost ofTender Document (receipt/DD), for Rs.25,000/-(Rupees Twenty Five Thousand) only in the form of Demand Draftdrawn in favour of the Commissioner, Panchayat Raj and Rural Development, AP, Hyderabad, payable atHyderabad failing which the tender shall be rejected out rightly.

33. The Earnest Money Deposit in respect of the agencies which do not qualify the Technical Bid (Firststage)/Financial Bid(Second competitive stage) shall be returned to them without any interest. In case ofsuccessful tenderer if the agency fails to deploy the required manpower against the initial requirement within30 days from date of placing the order the EMD shall stand forfeited without giving any further Notice.

34. EMD of all the unsuccessful bidders would be refunded by the Commissioner, PR&RD, Govt. of AP, Hyderabadwithin 90 days of the bidder being notified as being unsuccessful. The EMD amount for the amount mentioned aboveof the successful bidder would be kept as a part of Performance Guarantee till the acceptance of final deliverable. TheEMD amount is “Interest free” and will be refundable to the unsuccessful bidders without any accrued interest on it.

35. The EMD may be forfeited:a. if a bidder withdraws its bid during the period of bid validity,b. in case of a successful bidder, if the bidder fails to sign the contract in accordance with this tender paper,c. if found to have a record of poor performance such as having abandoned work, having been black listed,

having inordinately delayed completion and having faced commercial failures etc.d. in case of a successful tenderer, if the agency fails to deploy the required manpower against the initial

requirement within 30 days from the date of placing the order, the EMD shall stand forfeited without givingany further notice.

36. The successful tenderer will have to deposit a Performance Security Deposit of Rs.3.40crores (RupeesThree Crores Forty Lakhs) only in the form of Fixed Deposit Receipts(FDR)made in the name of agency andhypothecated to the Commissioner, Panchayat Raj and Rural Development, AP, Hyderabad or in the form ofBank Guarantee from any Nationalized Bank in favor of the Commissioner, Panchayat Raj and RuralDevelopment, AP, Hyderabad covering the period of contract. In case the contract is further extended beyond theinitial period the FDR /Bank Guarantee will have to be accordingly renewed.

37. In case of breach of any terms and conditions attached to this agreement, the Performance Security Deposit of theManpower Service Provider shall be liable to be forfeited besides annulment of the Agreement.

38 . The Manpower Service Provider shall raise the bill, in triplicate, along with attendance sheet duly verified andCountersigned by the respective DPOs in respect of the persons deployed and submit the same to the Commissioner,Panchayat Raj and Rural Development , AP, Hyderabad on quarterly basis including the commission. The calculation ofthe commission payable to the man power service provider will be based on the actual amount of salarydisbursed to the personnel deployed in GPRCs.

39. The man power supply agency is responsible for ensuring prompt attendance of the above personnel.

The attendance shall be compiled by the agency under the counter signature of the MPDO and submit to the DistrictPanchayat Officers (DPOs) of the respective districts for release of funds on monthly basis. On receipt of work donecertificate from DPO on quarterly basis, the payment will be released to the agency.

40. The claims in bills regarding Employees State Insurance, Provident Fund, and service Tax etc., should benecessarily accompanied with documentary proof pertaining to the concerned bill month. A requisite portion ofthe bill or whole of the bill amount shall be held up till such proof is furnished at the discretion of theCommissioner, Panchayat Raj and Rural Development, AP, Hyderabad or any other officer authorized on behalf of theCommissioner, PR&RD,AP, Hyderabad.

41. The amount of penalty calculated @ 100 per day on account of delay, if any, in providing suitable substitutefor the period beyond three working days by the Manpower Service Provider shall be deducted from its monthlybills in the succeeding month.

42. The Authority reserves the right to withdraw or relax any of the terms and conditions mentioned above so as toovercome the provision encountered at a later stage.

43. In the event of any dispute arising in respect of the clauses of the agreement of the same shall be resolvedthrough negotiation. Alternatively the dispute shall be referred to the next higher authority or controlling officerfor his decision and the same shall be binding on all parties.

4 4 . All disputes shall be under the jurisdiction of the Honorable Court at Hyderabad.

45. The successful bidder shall execute an agreement within 15 days of finalization of the tender with theCommissioner, Panchayat Raj and Rural Development, AP, Hyderabad or a nominee authorized by the Commissioner,Panchayat Raj and Rural Development, AP, Hyderabad on a Non-Judicial Stamp Paper worth Rs.100/- for supply ofsuitable and qualified manpower as per requirement of this office on the above terms and conditions.

ANNEXURE

TERMS AND CONDITIONS OF THE AGREEMENT

1. This agreement shall be in force for a period of one Year from the date of agreement , unless curtailedor terminated by the authority owing to deficiency of service, sub standard quality ofmanpower deployed, breach of contract etc. or change in requirements or on any otheradministrative reason.

2. This Agreement shall automatically expire once the contract period is completed at the expiry of oneyear.

3. The Agreement may be extended on the same terms and conditions or with someadditions/deletions/modifications for a further specific period mutually agreed upon by theManpower Service Provider and the Authority.

4. Manpower Service Provider shall not be allowed to transfer, assign, pledge or subcontract itsrights and liabilities under this Agreement to any other agency or organization by whatevername be called without the prior written consent of the Authority.

5. The requirement of this office may increase or decrease during the period of initial contract also and the ManPower service provider should provide the man power services, if required on the same terms andconditions.

6. The Manpower Service Provider is bound by the details furnished by it to the Authority whilesubmitting the tender or at a n y subsequent stage. In case, any of such documents furnished byit is found to be false at any stage, it would be de deemed to be a breach of terms of agreementmaking it liable for legal action besides termination of the Agreement.

7. The Authority reserves the right to terminate the agreement during initial period also after giving15 days notice to the Manpower Service Provider.

8. The persons deployed shall be required to report for work at the scheduled time at Gram PanchayatResource Centers located in the respective Mandal head quarters in each Mandal Praja Parishad inAndhra Pradesh State or such other office as may have been kept in charge of the OfficeEstablishment of the office concerned and would leave at the scheduled time. In case theperson deployed remains absent on a particular day or comes late/leaves early on threeoccasions proportionate deduction from the remuneration for one day will be made.

9. The person deployed may be called on holidays to attend duty and shall be given a compensatorycasual leave for attending such duty.

10. The Manpower Service Provider shall nominate one coordinator at state level as well as in eachdistrict who shall be responsible for immediate interaction with t h e Commissioner, Panchayat Rajand Rural Development, AP, Hyderabad at state level and DPOs at district level so that optimal servicesof the persons deployed could be availed without any disruption.

11. The entire financial liability in respect of manpower services deployed in the Gram PanchayatResource Centres shall be that of the Manpower Service Provider and t h e Authority will in no way beliable. It will be the responsibility of the Manpower Service Provider to pay to the person deployed a

sum not less than the minimum rate quoted in the financial bid and produce such evidence as may berequired by the Office concerned.

12. For all intents and purposes, the Manpower Service Provider shall be “Employer” within the meaning ofdifferent rules and acts in respect of manpower so deployed. The person deployed by the Manpower ServiceProvider shall not have any claim whatsoever like employer and employee relationship against the Authority.

13. The Manpower Service Provider shall solely be responsible for the redressal of grievances orresolution of disputes relating to persons deployed. The Authority shall, in no way, be responsiblefor settlement of such issues whatsoever. In case of grievances, the deployed person can placetheir grievance before a joint committee consisting of a representative of t h e Authorityand an Authorized representative of the Manpower Service Provider.

14. The Authority shall not be responsible for any financial loss or any injury/death of anyperson so deployed by the Manpower Service Provider in course of their performing thefunctions/duties, or for payment towards any compensation.

15. The person deployed by the Manpower Service Provider shall not claim nor shall be entitled t o pay,perks and other facilities admissible to regular/confirmed employees during the currency or after expiryof the agreement.

16. In case of termination of this agreement on its expiry or otherwise, the persons deployed by theManpower Service Provider shall not be entitled to and shall have no claim for any absorption in regularor in any other capacity.

17. The person deployed shall not claim any benefit or compensation or absorption orregularization of deployment with office under the provision of rules and Acts. Undertaking in theform of affidavit, from the person deployed to this effect shall be required to be submitted by theManpower Service Provider. The Man Power Service Provider shall inform the candidates that duration forwhich they are being taken on out sourcing basis is for only one year and an undertaking from eachoutsourcing employee to that extent shall be submitted to the authority.

18. The Manpower Service Provider is registered with the concerned Govt. Authorities, i.e. LabourCommissioner, provident Fund Authorities Employees State Insurance Corporation etc. and a copy ofregistration should be submitted. The Manpower Service Provider shall comply with all the legalrequirements for obtaining License under Contract Labour (Regulations and Abolition) Act, 1970if any,at his own part and cost, if required under the Act.

19. The Manpower Service Provider shall provide a substitute well in advance if there occurs anyprobability of the person leaving the job due to his/her own personal reasons. The payment in respectof the overlapping period of the substitute shall be the responsibility of the Manpower Service Provider.The Manpower Service Provider shall be responsible for contribution towards provident Fund andEmployees State Insurance, wherever applicable. The Manpower Service Provider has to submit the list ofEPF Account numbers of all the outsourced personnel deployed in GPRCs. The Manpower Service Providershall produce remittance certificate towards EPF and ESI contributions at the time of submitting the bill forthe succeeding month. Any excess deductions made by the Manpower Service Provider in violation of thegovernment instructions shall result in stringent action.

20. The persons deployed by the Manpower Service Provider should have good police records and nocriminal case should be pending against them.

21. The persons deployed are of proven integrity and competence; should be polite, cordial andefficient while handling the assigned work and their actions should promote good will and enhancethe image of the Institution. The Manpower Service Provider shall be responsible for any act ofindiscipline on the part of the persons deployed.

22. The persons deployed shall during the course of their work to be privy to certain qualifieddocuments and information which they are not supposed to divulge to third parties. In view of this, theyshall be required to take Oath of confidentiality and breach of this condition shall make the manpowerservice provider as well as the person deployed liable for penal action under the applicable lawsbesides, action for breach of contract.

23. The Manpower Service Provider shall be responsible for compliance of all statutory provisions relatingto minimum wages as payable to different types of workers in respect of the persons deployed by it inthe Department or office concerned and also solely responsible to meet any claims of the manpower suppliedby it under any of the Labour Enactments such as Workmen’s Compensation Act etc. The Department or theoffice concerned shall have no liability in this regard.

24. The Manpower Service Provider shall also be liable for depositing all taxes, levies, cess etc. on account ofservice rendered by it to the Authority to the concerned tax collection authorities, from time to time, as per therules and regulations in the matter. Attested Xerox copies of such documents shall be furnished toCommissioner, Panchayat Raj and Rural Development, AP, Hyderabad.

26.The Manpower Service Provider shall, as an employer of the outsourced personnel shall maintain all thepersonnel records such as pay rolls, attendance sheets, leave records, service records etc., and all statutoryregisters under the Law and shall produce the same, on demand for inspection or for scrutiny by the officialsauthorized by the Authority or by any other authority under law.

27. The Tax deduction at Source (TDS) shall be done as per the provisions of Income Tax Act/Rules as amended,from time to time and a certificate to this effect shall be provided by the Department of office concerned.

28. In case, the Manpower Service Provider fails to comply with any liability under appropriate law and a resultthereof, the Authority is put to any loss/obligation monetary or otherwise, the Authority will be entitled toget itself reimbursed out of the outstanding bills or the performance security Deposit of the ManpowerService Provider, to the extent of the loss obligation in monetary terms.

29. The agreement is liable to be terminated because of non-performance, deviation of terms and condition ofcontract, non-payment of remuneration of employed persons and non - payment of statutory dues. TheAuthority will have no liability towards nonpayment of remuneration to the persons employed by theManpower Service Provider and the outstanding statutory dues of the service provider to statutoryauthorities. If any los s is caused to the Authority or at the places where the outsourced personnel aredeployed , the same shall be recovered from the unpaid bills or shall be adjusted from the performancesecurity Deposit.

30. The EMD shall be forfeited: In case, the Man Power Service Provider fails to sign the contract in accordance with the terms and

conditions stipulated If found to have a record of poor performance such as having abandoned work within the period of

contract/ having been black listed/ having inordinately delayed completion of the task entrusted /

having faced commercial failures etc. In case if the Man Power Service Provider fails to deploy the required manpower against the initial

requirement within 30 days from the date of placing the order, the EMD shall stand forfeited withoutgiving any further notice.

31. Performance Security Deposit of Rs.3.40 crores (Rupees Three Crores Forty Lakhs) only in the form ofFixed Deposit Receipts (FDR in the name of Man power Service Provider and hypothecated to theCommissioner, Panchayat Raj and Rural Development, AP, Hyderabad/ the form of Bank Guaranteefrom…..………………………… Nationalized Bank in favour of the Commissioner, Panchayat Raj and RuralDevelopment , Govt.of Andhra Pradesh, AP, Hyderabad covering the period of contract is made by the ManPower Service Provider vide ………………………….. dated………………. and will not carry any interest and will be withthe commissioner, PR&RD, AP, Hyderabad, during the currency of this Agreement.

32. In case the contract is further extended beyond the initial period the FDR /Bank Guarantee shall be renewedaccordingly.

33. In case of breach of any terms and conditions attached to this agreement, the Performance Security Depositof the Manpower Service Provider shall be liable to be forfeited besides annulment of the Agreement.

34. The Manpower Service Provider shall raise the bill, in triplicate, along with attendance sheet duly verifiedand Countersigned by the respective District Panchayat Officers in respect of the persons deployed andsubmit the same to the Commissioner, Panchayat Raj and Rural Development, AP, Hyderabad on quarterlybasis including the commission.

35. The Man Power Supply agency is responsible for ensuring prompt attendance of the above personnel. Theattendance shall be compiled by the agency under the counter signature of the MPDO and submit to the DistrictPanchayat Officers (DPOs) of the respective districts for release of funds on monthly basis. On receipt of workdone certificate from DPO on quarterly basis, the payment will be released to the agency. The calculation of thecommission payable to the man power service provider will be based on the actual amount of salary disbursedto the personnel deployed in GPRCs.

36. The claims in bills regarding Employees State Insurance, Provident Fund, and service Tax etc. Shouldbe necessarily accompanied with documentary proof pertaining to the concerned bill month. A requisiteportion of the bill or whole of the bill amount shall be held up till such proof is furnished at the discretion of theAuthority or any other officer authorized on behalf of the Authority.

37. The amount of penalty calculated @ 100 per day on account of delay, if any, in providing suitable substitutefor the period beyond three working days by the Manpower Service Provider shall be deducted from itsmonthly bills in the succeeding month.

38. The Man Power Service Provider is solely responsible for any loss caused to the Gram Panchayat ResourceCentres / the Authority, when such loss is caused by the gross negligence of the supplied outsourced personnelengaged. The Authority is entitled to recover such loss from the Man Power Service Provider.

39. The Authority, reserves the right to impose penalty for any irregularity committed by the person supplied bythe agency.

40. In case of any over payment or wrong payment made to the Man Power Service Provider due to wronginterpretation of the provisions of this agreement or otherwise due to oversight or calculation error etc., suchpayment will be deducted in the subsequent bills or failing that from the bill or bills or if any balance amount isleft over the same would be recovered from the deposit of the agency available with the Authority.

41. In the event of any dispute arising in respect of the clauses of the agreement of the same shall be resolvedthrough negotiation. Alternatively the dispute shall be referred to the next higher authority or controllingofficer for his decision and the same shall be binding on all parties.

40. The rule of reservation and presidential orders shall be followed in the selection of out sourcing personnelby the agency to ensure social justice.

42. The agency should comply with all instructions issued by the government from time to time for the welfareof the out sourcing personnel.

43. The Authority reserves the right to withdraw or relax any of the terms and conditions mentioned above soas to overcome the provision encountered at a later stage.

44. The Authority reserves the right to enter into similar contract with any other manpower service provider toengage such manpower required by the authority and the man power service provider shall not claim any soleright to provide such man power.

45. It is further agreed between the parties hereto that the Hon. Courts in Hyderabad alone shall havejurisdiction to try and or entertain any proceedings, suits, complaints or any other matter arising out of ortouching or concerning this agreement.

46. Any sort of malpractices in the selection process shall become liable for disqualification of the outsourcingagency and for termination of the contract even before completion of one year agreement.
