TICA STATEMENT TENANCY CHECK / APPLICATION OUTCOME

TICA Default Tenancy Control Pty Ltd (ABN 84 087 400 379) is a tenancy database that records a tenant’s personal information, this includes tenancy application inquiries and tenancy history. In accordance with the National Privacy Principles, you are entitled to access any personal information that we may hold on any of our databases.

The personal information TICA may hold is as follows:

Name, date of birth, driver’s licence number, proof of age card number, and/or passport number (except Australian), comments made by a TICA member in relation to your tenancy, which members you rented through and which members you applied to.

TICA collects information from its members on tenancy related matters and provides such information to other members as a risk management system for the purpose of assessing a tenancy application. TICA does not provide any information it collects to any other individual or organisation for any other purpose. The only exceptions are government departments and/or agencies, allowed by law to obtain information from TICA.

As TICA may collect personal information about you, the following details regard- ing the organisation are provided in accordance with the National Privacy Principles, defined in the Privacy Act 1988 (Cth).

To obtain your information from TICA Default Tenancy Control Pty Ltd, proof of identity will be required and the details can be accessed via:

PRIVACY STATEMENT

The agent collects ad uses personal information by you as the applicant to assess your application for a Residential Tenancy Agreement and provide services required by you or on your behalf.

I, the said applicant, authorized the Agent to obtain personal information from: The owner or Agent of my current or previous residence; My personal referees and employer/s; Any record, listing or database of defaults by tenants; My Emergency Contact person if require.

If I default under a rental agreement, the agent may disclose details of any such default to a tenancy default database, and to agents/landlords of properties I may apply for in the future.

I am aware that the Agent will use and disclose my personal information in order to: Communicate with the owner and select a tenant Prepare lease/tenancy documents Allow trades people or equivalent organizations to contact me Lodge/claim/transfer to/ from the Residential Tenancies Bond Authority Refer to Tribunals/courts & Statutory Authorities (where applicable) Refer to collection agents/lawyers (where applicable)

Complete a credit check with TICA, TRA, NTD or any other Tenancy Database accessible to the Agent.

If you have completed the ‘free utility Connection service’ section, you consent to the Agent disclosing your details on to On The Move/or a utility provider for the purpose of enabling connection and disconnection services to you. On The Move and your Agent accept no responsibility for; any loss or failure to connect your utility services. On The Move and your Agent may receive a benefit for providing utility connections services to you.

I am aware that if information is not proved and I do not consent to the uses to which personal information is put, the Agent cannot effectively assess my application and therefore will be unable to proved me with the lease/Tenancy of the premises.

Upon authorisation, your application will be checked against a national tenancy data base – TICA Default Tenancy Control Pty Ltd (TICA) for information. If you have ever had a problem with a previous tenancy, it is imperative that you advise us so that we can discuss this with you. We may also confirm your information details with your employer; and discuss any previous tenancy with a former agent or lessor.

If your application is successful, our office will contact you and make arrangements for the signing of the lease. If your application is unsuccessful, our office will retain your application for only one month from the date of lodgement. At this point, unless otherwise directed, it will be shredded as per our legal obligations.

LETTING POLICY OF THIS OFFICE

This office is aware at all times of its obligation to follow the law. This includes the law regarding discrimination.

We will treat all property owners, their agents and all applicants fairly. This means that we will not discriminate against you, any one of your relatives, friends or colleagues because of your/their race, religion, sex/sexuality, marital status, disability or age.

We will not take instructions from property owners who suggest we break the anti-discrimination law.

We may refuse to take an application from you on the following grounds: If the property is physically unable to accommodate the proposed number of occupants. If the property cannot be modified to suit your particular needs (for example, if you require wheelchair access and the property can only be accessed via two flights of stairs).

In all other cases, when we decide on the suitability of an applicant, we will only assess their ability to pay the rent and maintain the property in its initial condition. We will request references regarding these matters and these will be verified.

We will only refuse your application if your references are unacceptable, or if they were of a lower calibre than that of the successful applicant. Therefore, based on our assessment:

Either you are unable to pay the rent and/or maintain the property. OR

You are less able than the successful applicant, to pay and/or maintain the property.

If you are unhappy with any of our processes or procedures in regards to the letting of property, please contact our office. Your opinion matters to us.
