    Telcos to pay 5k for pesky call, SMSPhone Connections Of Firms Violating Rules Will BeBlacklisted, Warns TraiPankaj Doval TNNNew Delhi: With no palpable abatement in pesky calls and SMSs despite severalattempts to control the menace, telecom regulator Trai on Thursday mandatedfinancial penalties on telecom service providers whose networks are used for theunwanted communication by marketing companies.

    The Telecom Regulatory Authority of India also warned that phone connections ofbanks, insurance firms and builders will be blacklisted if the mandated rules onunsolicited calls are violated by them or their representatives.

    Trai, which in November of last year eased the process of lodging complaintsagainst unwanted calls and messages, fixed Rs 5,000 as penalty for every complaintreceived on the matter.

    If on verification of a complaint, it is found that the Unsolicited CommercialCommunications (UCC) has been sent by a subscriber who is not registered as atelemarketer, the service provider shall be liable to pay financial disincentives ofRs 5000 on each complaint,Trai said.

    Trai was particularly critical of the cheap SMS packs marketed by service providers.The authority has observed that such telemarketing activities are encouraged byservice providers by providing attractive SMS packages and by allowing bulk/multipleconnections, without following the Customer Acquisition Form (CAF) directives issuedby the department of telecommunication, though they are fully aware that thesecould be used for telemarketing activities. It is the duty and responsibility of theservice provider to ensure that such misuse does not happen in their network, Traisaid.

    It directed the telcos to submit, by the 15th of every month, a list of all bulkconnections provided during the preceding month.

    Trai also came out strongly against the various institutions on whose behalf suchmessages are transmitted or calls made. It pointed out that a large number ofcomplaints pertain to calls or messages received by consumers on behalf of banks,

    insurance companies, builders, etc. These organizations, by engaging such personswho are not registered as telemarketers with Trai, are violating the regulations.These organizations marketing their products through retailers, distributors andfranchisees are thus responsible for the acts of their agents.

    It warned that telecom resources issued to the subscriber/entity for whichcommercial transaction has been solicited, shall be disconnected across all serviceproviders on receipt of a complaint, after serving a notice each on the first and thesecond complaint.

    Trai had in November fixed a daily limit of 100 SMSs that could be sent atconcessional rates and said it wanted a zero tolerance stand on the matter ofunsolicited communication.
