As requested / required by vendor(s) for the technical requirement including PQC, scope for supply etc., IOCL clarified as below:

IOCL informed that above points will be checked and revert back.

2. IOCL clarified that payment term shall be as per tender document only. 3. Vendors have also informed that they have understood the tender requirement and they have no

further queries. 4. All Vendor(s) agreed for best delivery period, without any deviation, as within 4 months from the

date of LOI / LOA on FOR Dispatch Point basis for indigenous vendor and on FOB International

Seaport of Exit basis for foreign vendor. And best completion period for complete Site Work (i.e. Installation, Testing & Commissioning etc.) as within 6 month from the date of date of LOI / LOA on FOR Gujarat Refinery Site basis.

5. IOCL clarified that Part Order clause is not applicable for this tender. 6. All vendors have requested IOCL that in case complete Site Work (i.e. Installation,

Commissioning, testing etc.) is delayed more than 4 months from the date of receipt of material at IOCL Gujarat Refinery due to fault of IOCL, then balance 15% of supply portion payment shall be released to vendor against additional Bank Guarantee of equivalent amount initially valid for a period of 6 months. IOCL agreed.

7. All vendors agreed that “If any Service(s) is / are not complete within the Completion date(s) stipulated in respect thereof, IOCL shall be entitled to a discount by way of price adjustment in a sum equivalent to 0.5% (one half percent) of the price of such Service(s) per week or part thereof that the Service(s) remain(s) undelivered beyond the stipulated Completion period in respect thereof, subject to a maximum discount of 5% (five percent) of the Total Site Work Contract Value. Such discount shall be given by the Vendor by equivalent reduction in the invoice value before presentation of documents to the Bank/IOCL for payment. Should the Vendor fail to complete the Service(s) or to make such adjustment, the discount may be recovered by any other means.”

8. All vendors noted that they shall quote the prices in the priced BOQ attached with the E-tender meeting all tender scope requirements and above clarifications. Evaluation shall be done on overall lowest basis considering all components of price BOQ after considering loadings and applicable & available CENVAT benefits.

9. All vendors agreed that quoted prices shall be firm & fixed till complete execution of order. 10. With above, all vendors agreed IOCL payment terms for Supply Portion as well as for Site Work

Payment terms, as per IOCL tender conditions under “5. SPECIAL TERMS AND CONDITIONS”. 11. Against bidder’s query on issuance of C form and form 403, IOCL clarified that C form and form

403 can be issued by IOCL. 12. Against bidder’s query on CENVAT credit, IOCL clarified that IOCL will be able to avail CENVAT

credit on Excise Duty as well as service tax. Bidder to indicate the same accordingly as per tender requirement.

13. Sl nos. under “5. SPECIAL TERMS AND CONDITIONS” as 5.6 to be read as Techno-Commercially acceptable bids shall be evaluated on the basis of Total Cost at IOCL Site (including P&F, Freight, Taxes & Duties, Transit Insurance, Engineering, Mandatory & Commissioning Spares, Installation, Testing & Commissioning, SAT, FAT, Training and PWCAMC Charges and Techno-Commercial loadings for deviations to our tender terms) after considering applicable & available CENVAT benefits. Evaluation / ordering shall be done on overall basis. All bidders to note.

14. In case, any vendor is interested to do site visit, they can do so in consultation with the Technical Persons at IOCL to understand the site conditions.

15. All bidders to upload the PQC documents as well as other documents per tender requirement in the appropriate format during uploading of their offer as indicated in cover details in e-tender website.

16. All other terms and conditions shall be as per IOCL General Purchase Conditions with other tender conditions. A copy of tender document and this MOM shall be submitted by the vendor along with their technical bid as a token of acceptance of the same.

17. All vendors noted that DSC registration with IOCL E Tendering website is must for participation in future tender enquiries at IOCL. Otherwise, they shall be missing the opportunities for tender participation at IOCL.

With the above, all the vendors have confirmed that all techno-commercial points are clear to them and they will submit their complete firm offers online as per IOCL Specification & tender documents and also EMD etc. as per tender requirements within the extended Bid Submission End date & time of 3.00 PM on 20.04.2015.
