En Gaceta Oficial N° 39.804, de fecha 21 de noviembre de2011, fue publicada la Resolución conjunta de los Ministeriosdel Poder Popular para la Planificación Finanzas y para lasndustrias Básicas y Minería, mediante la cual se establecenos mecanismos de aplicación transitoria del Decreto conRango, Valor y Fuerza de Ley Orgánica que Reserva alEstado las Actividades de Exploración y Explotación de Oro,con respecto al control y fiscalización de las regalías y lasventajas especiales previstas en dicho instrumento, así comoel régimen tributario aplicable, hasta tanto se finalice elproceso de migración y sea organizada y estructurada laSuperintendencia Nacional del Oro.

De acuerdo al artículo 2 de dicha Resolución, corresponde aas Inspectorías Fiscales de Minas, Inspectorías TécnicasRegionales y la Dirección General de Fiscalización y ControlMinero del Ministerio del Poder Popular para las IndustriasBásicas y Minería, el ejercicio transitorio de las funciones decontrol y fiscalización de las actividades, así como laiquidación de las regalías y ventajas especiales previstas enel correspondiente Decreto Ley, sin perjuicio del ejercicio deas funciones establecidas en el Reglamento General de laLey de Minas, y el Reglamento Orgánico del Ministerio dendustrias Básicas y Minería, de fecha 28 de marzo de 2005.

Reserves to the State the Gold Exploration

and Exploitation Activities

Joint Resolution of the Ministries of Popular Power forPlanning and Finance and for Basic Industries and Miningwas published in Official Gazette N°39.804 of November 21,2011, establishing the mechanisms for transitory applicationof the Decree with Rank, Value and Force of Master Law thatReserves to the State the Activities of Gold Exploration andExploitation, in relation to the control and audit of the royaltiesand special advantages set forth in such instrument, as wellas the applicable tax system, until completion of the migrationprocess and until the Office of the National Superintendent forGold is organized and structured.

According to Article 2 of such Resolution, the FiscalInspectorate for Mines, the Regional Technical Inspectorates,and the General Direction for Mining Control and Audit areresponsible for the transitory exercise of the functions ofcontrol and audit of the activities, as well as for the settlementof royalties and special advantages set out in the respectiveDecree Law, without prejudice to the exercise of the functionsestablished in the General Regulations to the Mines Law, andthe Master Regulations of the Ministry for Basic Industriesand Mining of March 28, 2005.

In this regard, the Ministry of Popular Power for BasicIndustries and Mining will prepare the instruments necessaryfor compliance with Article 2.

The Resolution became effective from its publication onOfficial Gazette.
