Workers Act, 1979, which has aprovision formandatory regis-tration of interstate migrantworkers, both at the home andhost states, throughcontractorsemploying them, is one of theprimary legislations on labour-ersemployedoutsidetheirstate.The Act also provides for dis-placement and journey al-lowancestobepaidtothework-ersby theirprimaryemployers.“TheActputstheonusonthe

state and the employer... If theemployercannot, thenthestatecan provide assistance to theworker.Butduetoanabsenceofsuchdata,thegrouphasbecomeinvisible in the policy realm,leadingtolackof initiativeattheinterstate level,” Rahul Sapkal,assistant professor at School ofManagement and LabourStudies, Tata Institute of SocialSciences (TISS),Mumbai, said. Ifmigrantworkers had been reg-istered as per the law, Sapkaladded,theycurrentlywouldnothave to register for repatriationbefore thepoliceordistrict offi-cials.So far, district heads across

Maharashtra have received andare verifyingdetails of over twolakh strandedworkers, officialsof the labour department said.Mostof themarelabourerswhohad started to walk to theirhome states but were stoppedby the police and subsequentlyaccommodatedat relief camps.In January 2017, a report of

the Working Group onMigration, submitted bymem-bers of the Ministry of HomeAffairs, Urban Development,Labour and Employment andNITI Aayog, had among its rec-ommendations said that whileworkersdonotmigratethroughcontractors, “simple and effec-tivemodes forworkers to regis-ter, including self-registrationprocesseslikeSMS”couldbeputin place “…to ensure that thedigitisation of registrationrecords is leveraged to effectu-ateinterstateprobabilityofpro-tectionandbenefits”.The report also commented

on the state-level ConstructionWorkers’WelfareBoards,whichcollect one to two per cent cesson construction projects, butthat largely remains unutilised.The Standing Committee onLabour, 2017-18, report hadfoundthatMaharashtrautilisedonly 6.77 per cent of the cessamount.According to the

Commissioner of Labour,Mahendra Kalyankar, said thestate board currently has Rs9,000crorecessamount.“Themoney isbeingutilised

forvariouswelfareschemes, in-cludingmid-daymealsforwork-ers and to disburse Rs 2,000 foreach registered constructionworker,” he said. So far,Kalyankar said, more than 5.10

lakhworkers have received Rs2,000.Anofficialfromthelabourdepartment said other welfareschemes, including for assis-tance in education for children,financialhelpandsocialsecurity,will be implemented after thelockdownis lifted.Experts, however, say this is

drawnablanksincethelockdownis dacoity—where five ormorepersonscommitarobbery–notasingle casehas been reported sofar.WhilethelatterhalfofMarch

was spent under lockdown, thecity spent April entirely underprohibitory orders. The statisticsshowthatinApril,eightmurderswerereported inthecity, includ-ing two double murders inGovandi. Both themurders – inSewriandGovandi–werethere-sult of pettydomestic squabblesbetween twogroups residing inthesamelocality.WhiletheSewrimurderstook

placeasthefamilyofthedeceasedwould sit in front of the victims’housechawl,intheGovandicase,thedeceasedwerekilledoverput-tingupawaterdispensingkiosk.
