• Created by the State Legislature in 1963

• One LAFCo in each county

• Oversees boundary changes and spheres of influence for cities and special districts

• Decisions based on state law and guided by local conditions and circumstances

• School Districts not under LAFCo review

Recommendations:

• LAFCos are neutral, independent

• LAFCos power should be strengthened to discourage urban sprawl and ensure the orderly extension of governmental services

• SOI Updates based on Municipal Service Reviews

• Policies to protect agricultural and open space lands strengthened

Focus on service delivery such as: Growth and population projections; Adequacy of public services; Infrastructure needs or deficiencies; Financial ability to provide services; Opportunities for shared facilities or services; Accountability for community service needs

Municipal Services & Infrastructure such as: Water; Wastewater; Solid Waste; Stormwater Drainage; Streets, Street Lighting; Landscaping; Parks, Recreation, and Open Space; Law Enforcement; Fire Protection, Rescue, and Ambulance; Flood control; Levee maintenance; Dredging

Information generated as part of the study will be used by the LAFCo in:

• Guiding subsequent sphere of influence updates

• Informing future boundary changes, such as annexation of new areas, as appropriate

• Initiating government reorganizations, as appropriate, such as consolidations, mergers, activation of latent powers, or separation of powers

Must conduct municipal service reviews before or in conjunction with updating spheres of influence

• Prior to official start of process: Meet with each jurisdiction to discuss process; find out any changes occurred since last MSR; Foresee any changes needing to occur over the next 10 years.

• Identify any unincorporated islands.

• Once started: Reach out to community leaders/groups to talk about MSR process to gather public feed back.

• Create check-list and workplan for possible follow up work identified by MSR such as updating SOI

• (a) In order to carry out its purposes and responsibilities for planning and shaping the logical and orderly development and coordination of local governmental agencies subject to the jurisdiction of the commission to advantageously provide for the present and future needs of the county and its communities, the commission shall develop and determine the sphere of influence of each city and each special district, as defined by Section 56036, within the county and enact policies designed to promote the logical and orderly development of areas within the sphere.

• (b) Prior to a city submitting an application to the commission to update its sphere of influence, representatives from the city and representatives from the county shall meet to discuss the proposed new boundaries of the sphere and explore methods to reach agreement on development standards and planning and zoning requirements within the sphere to ensure that development within the sphere occurs in a manner that reflects the concerns of the affected city and is accomplished in a manner that promotes the logical and orderly development of areas within the sphere. If an agreement is reached between the city and county, the city shall forward the agreement in writing to the commission, along with the application to update the sphere of influence. The commission shall consider and adopt a sphere of influence for the city consistent with the policies adopted by the commission pursuant to this section, and the commission shall give great weight to the agreement to the extent that it is consistent with commission policies in its final determination of the city sphere.

• (g) On or before January 1, 2008, and every five years thereafter, the commission shall, as necessary, review and update each sphere of influence.

TECHNICAL USES:

• The SOI is used to determine what areas the jurisdiction may want, or is looking at growth in the future, up to 10 years out (Marin LAFCo policy).

• Decision Making Tool – not actual land use approval.

• SOI does not require an annexation to take place.

• Any property being annexed must be within SOI.

ADDITIONAL USE:

• If a jurisdiction is going through a planning process for land within your SOI that jurisdiction should inform you and allow the ability to comment on plans. SOI holder support is not needed to approve in this case, other judication simply needs to inform and allow for comment.

• Start with current SOI boundary.

• For expansion of boundary determine if Sausalito looking to expand city boundaries in the next 10 years.➢Has the County agreed and does it fit orderly growth plans?➢Review if any other jurisdiction currently covers same area and would services

provided be duplicative in nature?➢No unincorporated island are being created?➢Are Disadvantaged Unincorporated Communities (DUC) being avoided?

• For contraction of boundaries determine that Sausalito, and any people living in area to be contracted, have no plans to be incorporated to the City in the foreseeable future. ➢Is it removing a DUC from SOI boundary (contraction could still occur in this case

but further review and discussion would need to take place if it did)?

WHEN THEY IMPACT EACH OTHER:

• Provide all the same services – i.e. two cities would not have the same area in their SOI.

• Provide some, but not all the same services.

• If annexation of the area impacted the financials of another jurisdiction.

WHEN THEY DON’T IMPACT OTHER:

• Provide completely different services; and

• Have completely different governing bodies.
