I.INTRODUCTION The sub-project “Rehabilitation and Upgrading of 220kV Phu Lam – Cai Lay 2 Transmission line” is one of the subprojects identified for the first phase implementation under the World Bank financed Transmission Efficiency Project (TEP). The sub-project will be implemented in Binh Tan and Binh Chanh district, Ho Chi Minh City; Ben Luc and Thu Thua districts, and Tan An city, Long An province; Chau Thanh and Cay Lay districts, Tien Giang province. The implementation of the subproject is in line with the national Power Development Master Plan 7 (PDMP7), strengthen the transmission capacity, power network connection capacity and stabilize the power system in the southern-west region.

Activities of the sub-project are toupgrade the exiting 220kV transmission line with the total length of 71.83 km, including(i) maintaining the original status from 500kV Phu Lam substation to tower G1(G1 meansthe first anchor angle of the transmission line) with 2,824 m in length; (ii) stringing 23,627 m of wire on the towers of the 500kV Phu Lam – O Mon transmission line from tower G1 to G7; and (iii) upgrading the current 45,378 m single-circuit to a double-circuit from tower G7 to 220kV Cai Lay substation.These activities could cause negative impacts to environment and local communities during the period of pre-construction, construction and operation.

To ensure the potential negative impacts are identified and mitigated during the implementation period of the sub-project and the project to comply with the Bank’s Policy on Environmental Assessment, an Environmental Management Plan (EMP) of the sub-project has been prepared in compliance with the Environmental and Social Management Framework (ESMF)of the TEP and in connection with the subproject EIA. This EMP is an instrument that details: a) all anticipated adverse and social environmental impacts; b) the mitigation measures to be taken during the implementation and operation of a the subproject to eliminate or offset adverse environmental impacts, or to reduce them to acceptable levels; c) monitoring objectives and type of monitoring with linkages to the impacts assessed in the EIA report and the mitigation measures described in the EMP; d) the actions needed including institutional arrangements to implement these measures; e) capacity development and training to support timely and effective implementation of environmental project components and mitigation measures; and f) implementation schedule and cost estimates for implementing the EMP. The mitigation measures proposed in the EMP shall be integrated into the bidding and contractual documents, and monitored and supervised during all the phases of subproject implementation and operation.

According to Vietnam’senvironmental assessment regulation, the subproject is subject to prepare an EIA for submission to the Ministry of Natural Resources and Environment (MONRE) for appraisal and approval. The report on EIA wassub mitted to MONRE in December 2013 and was approved by MONRE under the Decision No.172/QD-BTNMT on 02nd February 2014.

II. POLICIES, REGULATIONS AND INSTITUTIONAL FRAMEWORKS 2.1.Government’s Environmental Regulations The following national laws and regulations are applied for the subproject: - Environment Protection Law 52/2005/QH11 passed by the National Assembly dated on

29/11/2005 regulating responsibilities of individuals and organizations regarding environmental protection.

- Law on Land passed by the Eleventh National Assembly of the Socialist Republic of Vietnam at its 04th session dated on 26/22/2003.

2.2.WB’s Safeguard Policy The environmental and social screening according to the criteria described in the Bank’s policy on environmental assessment has been carried out, and the result shows that the WB policies on Environmental Assessment (OP 4.01) and Involuntary Resettlement (OP/BP 4.12) are triggered for this subproject. The subproject has also to comply with the WB’s requirements on public consultation and Policy on Access to Information. The implementation of the policy on Involuntary Resettlement (OP/BP 4.12) is addressed in the Resettlement Policy Framework (RPF) of the TEP project and the Resettlement Plan (RP) of this subproject.

Environmental Assessment (OP/BP 4.01):

Environmental Assessment (EA) is an umbrella policy for the Bank’s safeguard policies. The overarching objective is to ensure that Bank-financed projects are environmentally sound and sustainable, and that decision-making is improved through appropriate analysis of actions and of their likely environmental impacts. The EA process is intended to identify, avoid and mitigate potential impacts of Bank operations. EA takes into account the natural environment (air, water, and land); human health and safety; social aspects (involuntary resettlement,

indigenous peoples, and physical cultural resources); and transboundary and global environmental aspects. EA considers natural and social aspects in an integrated way.

This subproject triggers OP 4.01 because it involves the rehabilitation, upgrading, and operation of a high-voltage overhead transmission line, requiring the identification, mitigation and monitoring of potential adverse environmental and social impacts. As required by OP 4.01 and the government EA regulation, the subproject has prepared an EIA and an EMP that meet the Government’s and the World Bank’s safeguards requirements. By the TEP appraisal, the subproject EIA and EMP have been disclosed locally at the subproject sites and at the Bank’s InfoShop on January 24, 2014 as required by OP 4.01 and the Bank’s policy on access to information. The final subproject final EIA and EMP were disclosed locally at the subproject sites, at the Bank’s InfoShop, and the Vietnam Development Information Center on April 18, 2014.

Involuntary Resettlement (OP/BP 4.12)

The Involuntary Resettlement policy seeks to prevent severe long-term hardship, impoverishment, and environmental damage to the affected peoples during involuntary resettlement. OP 4.12 applies whether or not affected persons must move to another location. The Bank describes all these processes and outcomes as “involuntary resettlement,” or simply resettlement, even when people are not forced to move. Resettlement is involuntary when the government has the right to expropriate land or other assets and when affected people do not have the option to retain the livelihood situation that they have.

This policy is triggered because the subproject would have impacts involving the temporary and permanent involuntary taking of land and the loss of structures and assets associated with the land for the power towers and the right-of-way of the transmission line. By appraisal, the subproject has prepared and disclosed a RP locally at the subproject sites and at the Bank’s InfoShop on January 24, 2014. The RP includes the measures to ensure that displaced people are: (i) informed about the options regarding resettlement; (ii) consulted and offered alternative resettlement choices; and (iii) provided with effective compensation and livelihood restoration. The final subproject final RP was disclosed locally at the subproject sites, at the Bank’s InfoShop, and the Vietnam Development Information Center on April 18, 2014.

World Bank Group Environmental, Health, and Safety Guidelines

World Bank-financed projects should also take into account the World Bank Group Environmental, Health, and Safety Guidelines1 (known as the "EHS Guidelines"). The EHS Guidelines are technical reference documents with general and industry-specific examples of Good International Industry Practice.

The EHS Guidelines contain the performance levels and measures that are normally acceptable to the World Bank Group and are generally considered to be achievable in new facilities at reasonable costs by existing technology. The environmental assessment process may recommend alternative (higher or lower) levels or measures, which, if acceptable to the World Bank, become project- or site-specific requirements.

This subproject should conform the Environmental, Health, and Safety Guidelines for Electric Power Transmission and Distribution and the General EHS Guidelines.

III. SUBPROJECT DESCRIPTION 3.1.Objectives of the Subproject 1The EHS Guidelines can be consulted at www.ifc.org/ifcext/enviro.nsf/Content/EnvironmentalGuidelines.

The sub-project “Rehabilitation and Upgrading of 220kV Phu Lam – Cai Lay 2 Transmission Line” will be implemented to meet the following objectives:

- Upgrading the existing transmission line that has been in operationfor many years and with thetechnical and safety conditions being degraded.

- Strengthening the transmission capacity, power network connection capacity and stabilizing the power system in the southern-west region in accordance with the National Power Development Plan for 2011-2020, considering in 2030.

- Creatinga double-circuit axis line with high capacity to transfer electrical power from 500/220kV Phu Lam substation to 220kV Cai Lay substation in order to replace the220kV Phu Lam – Cai Lay 1 and 2 transmission line.

3.2. Scope of the Subproject The scope of subproject is rehabilitation and upgrading of 220kV Phu Lam – Cai Lay transmission line from 500/220kV Phu Lam substation (Ho Chi Minh city) to 220/110kV Cai Lay substation, including: a) rebuilding new tower No.9B at the same position to connect to 500kV Phu Lam – O Mon transmission line; b) stringing 7.27km of double-circuit wire on trible-circuit tower of 500/220kV Phu Lam – O Mon transmission line, section from G1 to G4; c) stringing 16.36km of single circuit on trible-circuit tower of 500/220kV Phu Lam – O Mon transmission line, section from G4 to G7; d) upgrading the current 3.22km single-circuit to a double-circuit from G7 to DC1 to Long An substation; e) upgrading the current 34.77km single-circuit to a double-circuit from Long An substation to DD2 to My Tho substation; f) upgrading the current 7.4km single-circuit to a double-circuit from My Tho substation to DC2 to Cai Lay substation; and g) upgrading two 220kV bays of 500/220kV My Tho substation (being connected from 220kV Cai Lay substation) of 220kV Long An substation.

3.3.Location of the Subproject The transmission route, which is illustrated in Figure 1.1, starts from the 220kV switchyard of Phu Lam substation in quarter 5, Tan Tao ward, Binh Tan district,Ho Chi Minh city. The ending point is connected to the switchyeard of 220kV Cai Lay substation. The route crosses Ho Chi Minh City, provinces of Long An and Tien Giang, wards/ communes as follows:

Ho Chi Minh city:

- Tan Taoward – Binh Tandistrict

- Tan Nhut, Tan Tuccommunes – Binh Chanhdistrict

Long An province:

- Thanh Phu, Thanh Duccommunes – Ben Luc district

- Nhi Thanh, Binh Thanhcommunes – Thu Thua district

- Huong Tho Phu commune, ward 2, 4, Khanh Hauward – Tan An city

Tien Giang province:

It continues to go on ROW of the existing 220kV Phu Lam – Cai Lay 1 transmission line to G8 (tower 64A). From G8 , the route turns left on 55041’58’’ to DC1 (tower 121B). From DC1 the route turns left on 12006’50’’ to enter into bus bar of the 220kV switchyard – Long An substation. This section mainly crosses rice filed, including:

3.5. Subproject Main Activities 3.5.1 Main activities of the subproject before and during construction period

a) Activities before construction period:The following activities to be implemented before the construction phase include:

- Compensation and land clearance;

- Preparation for construction of worker camps, storage facilities.

b) Activities during construction period: The activities to be implemented during the construction include:

- Excavation;

- Transportation of construction materials and equipment;

- Preparation of mortar and concrete;

- Construction;

- Preparation of formworks and steel rods;

- Installation of steel power towers;

- Installation of electrical equipment and stringing of the wires.

3.5.2 Transportation of Construction Materials and Equipment

a) Supply of materials and equipment

The sources of equipment and materials for the subproject include; locally produced equipment and materials; and imported materials and equipment that cannot be domestically produced. The local materials and equipment will be purchased from selling agents of construction materials and equipment in provinces of Long An and Tien Giang. These agents must be in legal operation and have an environmental business license. Specifically, the construction materials and equipment will bebought and transported to the construction sites as follows:

- Sand, stone, gravel, cement will be purchased from local agents in provinces of Long An and Tien Giang.

- Reinforced concrete foundation, grounding, framework will be purchased from agents in the location of the subproject inprovinces of Long An and Tien Giang and manufactured at the site.

- Galvanized steel and bolts are taken from the manufacturer who has a business license in Thu Duc district, Ho Chi Minh city.

- Wires, fittings, insulators, equipment of the subproject which have not been domestically manufactured, SPMB shall prepare bidding document and organize bidding to select foreign suppliers. These equipment and accessories will be imported to

Saigon port and will be transported to SPMB’s warehouse and then will be transported to the site according to the construction schedule.

b) Long-waytransportation

Long-way transportation is applied to convey equipment and materials stored at SPMB’s warehouse such as: steel towers, conductors, insulators, fittings. Transportation vehicles are trucks on national highways with an average length of 100km on road type I for the entire line. The details are as follows:

Long distance transportation from Phu Lam to Cai Lay is around 100km.

Section 1: From starting point - G5, Length (L1) = 17 km, storage at Tan Nhut commune – Binh Chanh district - Ho Chi Minh city; The average distance is 4.56km.

Section 2: From G5 - G7, Length (L2) = 11 km storage at Thanh Duc commune –Ben Luc district, Long An Province; The average distance is 3.07km.

Section 3: From G7 - G14, Length (L3) = 24 km, storage at Binh Thanh commune - Thu Thua district- Long An province; The average distance is 6.49km.

Section 4: From G14 – Ending point, Length (L4) = 24km storage at Nhi My commune - Cai Lay district - Tien Giang province; The average distance is 6.25km.

c) Internal transportation along the line

The internal transportation along the transmission line is calculated from the main warehouse at each construction section to the tower positions. This distance is only determined for equipment and material that are provided by SPMB. These equipment and materials need to be appropriately stored and processed prior to convey to the site such as: steel towers, conductors, insulators, fittings, cement, foundation-casted steel, forms. Equipment and materials at warehouse located at site shall be transported to gathering places by trucks, boats on national highways, provincial roads, big canals and other pathways at local areas with average length of 2.27km.

d) Manual transportation

The transportation of equipment and materials from gathering places to each tower position is mainly performed manually or semi-manually. The costrcution materials will be gathered at the locations along the transmission line and close to the national highways and provincial roads. The average manual transport distance for the entire route is 228.54m

3.6 Employment The construction period is expected in about 12 months (excluding time of site clearance and compensation). About 200 workers will be mobilized for construction activities, and they will bedivided into four construction teams, each will implement two sections. The number of wokers for each section range from 35-50 workers and in smaller groups.

IV. SUBPROJECT ENVIRONMENTAL BACKGROUND 4.1. Geographical Location and Population

4.1.1. Geographical Location

The subproject will be implemented in Binh Tan and Binh Chanh districts of Ho Chi Minh city, Ben Luc district, Thu Thua district in Tan An City of Long An province, and Chau Thanh and Cai Lay districts of Tien Giang province with the details described below:

a) Binh Tan district– Ho Chi Minh city

Binh Tan district has the geographical coordinate from 10027’38” to 10045’30” on North latitude from 106027’51” to 106042’00” on East longitude. The district is administratively bounded by district 12 and Binh Chanh district to the north, district 8 to the south, district 6,8 and Tan Phu district to the east, and Binh Chanh district to the west.

b) Binh Chanh district – Ho Chi Minh city

Binh Chanh district is a suburb district to the West – South West of Ho Chi Minh city. The district is administratively bounded by Hoc Mon district to the north, Binh Tan district, district 7, 8 and Nha Be district to the east of Ho Chi Minh city, Ben Luc and Can Giuoc districts to the south of Long An province and Duc Hoa district of Long An province to the weast.

c) Ben Luc district - Long An province

Ben Luc district is the northern door of the southern west. Ben Luc district is 30km far away from Ho Chi Minh city to the south west.The district is administratively bounded by Duc Hoa and Duc Hue districts to the north, Binh Chanh district to the east, Can Giuoc, Can Duoc and Tan Tru districts to the south and Thu Thua district to the west.

d) Thu Thua district- Long Anprovince

Thu Thua district is 45 km far away from Ho Chi Minh city. The district is administratively bounded by Ben Luc and Tan Tru districts to the east, Tan An and Tan Phuoc districts to the south, Thanh Hoa district to the west and Duc Hue district to the north.

e) Tan An city- Long An province

Tan Ancity is located towards the south west of Ho Chi Minh City, 47km far away from Ho Chi Minh city. The city is administratively bounded by Thu Thua district to the north, Tan Tru and Chau Thanh districts to the east and Tien Giang province to the west and south.

f) Chau Thanh district -Tien Giang Province

Chau Thanh district is located at the west of Tien Giang province. The district is administratively bounded by Cho Gao district and My Tho city to the east, Cai Lay district to the west, Tien river to the south and Tan Phuoc district and Long An province to the north.

g) Cai Laydistrict - Tien Giangprovince

Cai Lay district has shape of rectangle in the map, which is located towards the west of Tien Giang province. The district is administratively bounded by Tan Thanh and Tan Phuoc district of Long An province to the north, Chau Thanh district to the east, Cho Lach district of Ben Tre province to the south and Cai Be district to the west.

4.1.2. Population

* Ho Chi Minh city

Total natural area of Binh Tan district is 51.89 km2, population is 611,170 people. The average population density in the district is 11,778 people/km2.

The population of Binh Chanh district in 2011 is 465,248 people, The population density is 1,841 people/km2. Number of immigration labor is increasing, mainly from the western provinces.

* Long An province

The population of Ben Luc district is 150,053 people in 2011. The population density is distributed uneven, and residents are mainly gathered in the communes in the South (the area bounded by Highway 1 A). The most crowed population density is in Ben Luc town. The average density of the district is 520 people/km2.

* Tien Giang province

The average population of Chau Thanh district is 235,872 people in 2011; it is the second ranked density of the whole province (1,026 people/km2).

Cai Lay: the average population of the district is 307,022 people in 2011; the average density is 704 people/km2.

4.2.Topography Ho Chi Minh city: The city is located in the transition area between the East of South of Vietnam and the Mekong Delta. The topography of HCMC is lower from the North to South and West to East. The higher land is in the North – North East and a part of North West, average from 10m to 25m.

Long An province: Thetopography is mainly flat and horizontal, with features of the Mekong Delta. The low land occupies up to 66% of the natural area with the average level of 0.75m

andthe highest level of 6.5m. The topography is lower from the West to the North, the East and the South.

Tien Giang province: The province is located on a flat relief with a slope of less than 1% and an elevation ranging from 0m to 1.6m compared to the sea water surface, and mainly from 0.8m to 1.1m. The topography is divided into two areas: the south area of Highway 1A bounded by Tien River, characterizeda by abundant year-round fresh water, fertile alluvial soil, a thick river network suitable for irrigation and cultivation.Fruit gardens are alternated with rice field to create a well-off garden area. This area is also a residential area. The North of 1A National Highway is a rice area, towards to the South, it is a wild, alum area, transportation is difficult, residents are a few person.

4.3. Hydro- Meteorological Characteristics

4.3.1 Meteorological Condition

Climate of the subproject area is divided into 2 seasons. Rainy season is from May to November, the weather is affected by south-west monsoon, temperature and air are high, rainfall reaches 80 - 90% of total annual rainfall. Dry season is from December to April; the weather regime is affected by North – East monsoon;temperature and rainfall are low.

Less disasters, flood in the subproject area, therefore it does not affect life and manufacturing operation of residents.

a) Air temperature

The average air temperature in 03 recent years is implemented in Ho Chi Minh city (Tan Son Hoa station), Long An province (Tan An city station and Moc Hoa station), Tien Giang province as follows.

- Ho Chi Minh city area is regularly high in the year, the average temperature of 2011 is 28.10C; the average of the highest month of 2011 is 29.50C (May) and the average of the lowest month of 2011 is 26.90C (January).

- Long An province has subequatorial monsoon tropical climate, the temperature is high and stable. The average temperature of 2011 is 26.30C; the average of the highest month of 2011 is 27.90C (May) and the average of the lowest month of 2011 is 24.60C (January).

- Tien Giang province is divided into rainy reason and dry season. The average temperature of 2011is 26.80C; the average of the highest month of 2011 is 28110C (May) and the average of the lowest month of 2011 is 25.40C (January).

b) Rainfall

The rain regime also affects air quality. The rain quality depends on quality of atmostphere and regional environment. The subproject area has rainy season and dry season. Rain season is normally from May to November and around 70% - 80% of rainfall of the year concentrates in these months.

4.3.2 Hydrological Condition

Hydrological condition of the subproject is found to cross many channels, in which the crossing section of Vam Co Tay river is remarkable. In the investment project stage for design work, the design unit has carried out survey at Van Co Tay river – Tan An hydrological station. Calculation of frequency of peak flood level follows themod of theory frequencty curve, Kritsky Menken, the coordinate result of theory frequency curve is recorded in the following table:

4.5. Environmental Baseline Data In the investment project stage, the subproject’s owner has taken samples and analyzed the quality of the physical environment (including quality of air, noise, surface water, underground water etc). The results of these measurements act as the baseline for identifying and evaluating the components of the physical environment in the subproject area.

4.5.1 Air Environment Quality and Noise Air quality and noise are identified on the basis of the results of sampling 06 locations in the subproject area, including KK1) 220kV Cai Lay substation, KK2) Than Binh hamlet, Than Cuu Nghia commune, Chau Thanh district, Tien Giang province; KK3) 220kV Long An substation, Binh Cang 1 hamlet, Binh Thanh commune, Thu Thua district, Long An province, KK4) hamlet 6, Thanh Duc commune, Ben Luc district, Long An province; KK5) Tan Tuc town, B2/36 Block2, Tan Tuc town, Binh Chanh district, Long An province and KK6) 500kV Phu Lam substation.

The results of the air samples demonstrate that the air quality along the route is quite good. Most of the pollution criteria obtained at the sampling location met permissible limits according to QCVN 05:2009/BTNMT - National technical regulation on ambient air quality. Specially, the dust content at the sampling locations of KK2, KK4, KK5 and KK6 exceeded the permissible limits of 1.03 to 1.4 times (the permissible limits is 0.3 mg/m3). The results have shown that dust pollution was caused by traffic activities because the sampling locations are located near roads and the traffic density is rather high at the period of sampling.

The results of the noise intensity level showed that the sampling location in the region of Ho Chi Minh city is higher than the other locations and also higher than allowed values of 0,1 to 6.8 dBA (the allowed value is 70dBA) according to QCVN 26:2010/BTNMT – National technical regulation on noise. The sampling locations in the provinces of Tien Giang and Long An are lower than the allowed value in QCVN 26:2010/BTNMT.

4.5.2 Water Environment Quality a) Surface water quality

Surface water samples were measured and analized at 5 positions in the subproject region, including NM1) Moi hamlet, Long Dinh commune, Chau Thanh district, Tien Giang province; NM2) Tan An Bridge 2 (Vam Co Tay river); NM3) Ben Luc Bridge (Vam Co Dong river); NM4) Ben Do (Cho Dem channel) and NM5) Ba Hom Bridge (Nuoc Len canal).

The results of the surface water samples shows that the surface water quality at canals along the route have signs of nutrient pollution and microbial contamination. This shows that the specific surface water quality in the agricultural region will be highly affected because there is a surplus of fertilizer and this will result in a high nutrient content in water. Most of the other pollution criteria of the surface water at the sampling locations in the provinces of Long An and Tien Giang met the permissible limits according to QCVN 08:2008/BTNMT – National technical regulation on surface water quality. The position NM5 has signs of organic, nutrient, and microbial contamination caused by industrial production activities.

b) Quality of underground water

Underground water was observed at 03 locations along the transmission line, including NN1) Tran Thanh Du household, 634 Moi hamlet, Long Dinh commune, , Chau Thanh district, Tien Giang province; NN2) Chien Thang Slaughter, 1/7B My Yen, Ben Luc district, Long An province and NN3) Thanh Loi Tire Patching Business – 1229 Highway 1A, Block 5, Binh Tri Dong ward, Binh Tan district, Ho Chi Minh city.

According to the results, the quality of the underground water at 03 sampling locations is rather good. Most of the pollution criteria met the permissible limits in QCVN 09:2008/BTNMT - National technical regulation on underground water quality.

4.6. Socio-economic Status of the Subproject Area 4.6.1. Economics * Ho Chi Minhcity

Binh Tan district: In the recent years, the economy of Binh Tan has strongly increased; total productive value of the industries in 2010 isVND 1,703.08 billion, increasingVND 447.52 billion in comparison with 2009, gaining the development speed of 135.64%. The current economic structure of Binh Tan district is transferring to the trend of Industry – Services - Agriculture.

Binh Chanhdistrict: The economic situation of Binh Chanh in recent years has positively changed. The industrial productive value out of the Government is VND 4,585,036 million in 2011. The number of state-owned companies is 2,804 in 2011.

* Long An province

The economic situation of Long An Province in 2011 is totaled up with the field of agriculture, forestry and aquaculture, industry, construction; commercial – services. The area of agriculture and aquaculture (area I) increases 5.2% exceeding the proposed schedule (1 – 1.2%) and higher than 2010 (5%), in which agriculture increases 5.7%, forestry increases 1.4% and aquaculture increases 3.4%. Cultivation increases 8% due to good crops, good price, farmers get benefits, especially from rice; most of production of crop plants increases in comparison with the previous year.

*Tien Giangprovince

The Gross Domestic Product (GDP) of quarter I of 2012 is aroundVND 4,069 billion, increasing 9% in comparison with the quarter I of 2011 (expectation in increasing from 10.5-11%). The area of agriculture, forestry and aquacultureincrease 5,1% in comparison with the quarter I of 2011.

4.6.2. Culture – Social Aspects * Ho Chi Minhcity

Binh Tandistrict has 38 pre-schools with 524 teachers and 11,242 pupils; 40 high schools with 1,766 teachers and 45,572 students. There is 1.53 ha of land for health. Annually 156,000 people are checked and treated medically, satisfying the demand of disease treatment and prevention for people. Presently there is a health center at An Lac and a clinic at Tan Tao area.

Binh Chanh district: the educational situation of the district is recently much cared, the number of children going to first class is 100%. Most of communes have medical stations; health of mother and children is fully cared

Education: all communes have elementary schools; the ratio of children at school age going to school is 100%.

Health: Ben Luc hospital, Tan Ancity has a general hospital, there is a medical station at Wards/ communes.

* Tien Giangprovince

Education of Chau Thanh district is much cared; the number of children going to school at school age is 100%. All communes of the district have medical centers (doctor is always in duty).

Cai Lay: All communes haveelementary schools and 96.4% of communes has high schools. The number of children at school age going to school is 100%. The whole district has 28 medical centers (100%) where doctors are always in duty.

The subproject is not in areas of historical area, cultural heritage site, social-culture structure and national defence – security as well.

4.7. Protected Areas, Natural Reserves, Sensitive Areas, Cultural Property, Historical Monument, Temple and Pagoda in the Subproject Area. The subproject provinces of HCM city and Long An have the following natural reserves:

Can Gio Biosphere Reserve bounded by Dong Nai on the north, East sea on the south, provinces of Tien Giang and Long An on the west and Ba Ria – Vung Tau province on the east. Total area of Can Gio mangrove forest biosphere reserve is 75,740 hecta, in which the score area is 4,721 hecta, the buffer zone is 41,139 hecta, and the transitional area is 29,880 hecta. Can Gio mangrove forest has a very special environmental condition, this is an intermediary ecosystem (buffer system) between the underwater ecosystem and the terrestrial ecosystem, the freshwater ecosystem and the salt water ecosystem.

Dong Thap Muoi Medicine Reserve in Binh Phong Thanh commune, Moc Hoa district, Long An province, 110km away from Ho Chi Minh city, 60km away from Tan An town in road, with the area of 1,041 hecta in which 800 hecta is primeval Melaleuca forest, 100 hecta is a wide pond (in dry season). In the reserve region, there are around 21 kinds of vascular plants and the native fauna of Dong Thap Muoi such as stork, heron, painted stork, little cormorant, crane etc.

Lang Sen Wetland Reserve in Dong Thap Muong, in the area of Vinh Loi and Vinh Dai commune, Tan Hung district, Long An province. Lang Sen has a natural area over 5,000hecta; in which a natural limitation that rather special is a isle with the width of 1,500hecta. This is a diversified ecological area, typically for the flooded wetland area with a wild flora and fauna system, having many species in the red list.

These natural reserves are located far away from the transmission lineand outside the influence areas by the subproject (see Figure 1.2). Specifically, Can Gio mangrove biosphere reserver is 30km away from the transmission line towards the South – East; Dong Thap Muoi Medicine reserve is 35km away from the transmission towards the North - West; and Lang Sen wetland reserve is around 58km away from the transmission line towards the North-West. Therefore, it is not anticipated that the subproject would have any adverse impact on these sensitive areas. The location of the substation in relation to the environmentally sensitive natural reserves is indicated in Figure 1.2.

The subproject is not located in or near any physical cultural resources such as cultural properties, historical monuments, sagred reserves, temples, pagodas etc.

V. POTENTIAL IMPACTS The environmental screening of the subproject indicates that it is eligible for financing considering that the subproject would not involve possible high risk and would not create potential adverse impacts on (a) critical natural habitats and/or protected area including proposed protected areas; (b) loss or damage to cultural property, including sites having archeological (prehistoric), paleontological, historical, religious, cultural and unique natural values; (c) water regime, particularly water flow; and (d) other significant environmental and social impacts.

The subproject would bring about positives changes to the local and regional economies, creating favorable conditions for local production activities and other social benefits.

The implementation of the subproject would mainly cause land acquisition, increased dust generation, air pollution, domestic waste, and health and safety issues due to construction activites and electrical magnetic field. Site investigation and document review were conducted for identifying and assessing the these potential negative impacts, including consultation with the local communities and affected people. However, these impacts are not significant, temporary, localized with available mitigation measures. Only OP 4.01 and OP 4.12 are triggered for this subproject. Given its modereate adverse environmental impacts, the subproject has been categorized as a Category B project.

The potential negative impacts of the subproject are identified in table 5.1 and could be minimized by applying the proposed mitigation measures developed for the subproject which are described in Table 6.1.

The route mainly runs along agricultural land, and the subproject mainly involves rehabilitation and upgrading of the the existing transmission line. The route and the power towers will be chosen to coincide with the old foundations and ROW of the existing transmission line to avoid and minimizeland acquisition and clearance vegetation cover. Thus, its effects on vegetable and landscape due to site clearance is expected to be small.

3 Permenant and temporary land acquisition

+ Land used for construction are divided into 3 categories: Land acquired permanently for tower foundation construction; Land affected due to regulations on the ROW of high-voltage tarnsmission line; In addition to the ROW, in construction phase, some land will be temporarily acquired

for erecting tower and stringing wires (in the ROW), building temporary facilities for the transportation and storage equipment and material.

+ The project’s total area of permanently required land is 38,828m2 for tower foundation construction.74,796 m2would be temporarily acquired for construction area, and 3,829 m2for temporary works (storage) for construction activities and stringing wires. + 113 households (498 people) would be affected by permanentland acquisition, and the percentage of households with permanently revoked land ranges from 2.06% to 96.60% of their total landholding area, average scale is 29.55%. 49 households will loss over 30% of their total land, but none of them belongs to the vulnerable group, and most of them have

nonagricultural jobs. No affected household needs to be relocated. Permanent land acquisition by the subproject would adversely affect househols income and livelihood of the affected households. However, they can continue farming on the remaining land. They can use compensation money to buy other land or invest in production. Therefore, land acquisition of the subproject would not cause major disturbance to the lives of local people, and its impact canbe assessed as moderate. Area of affected land within the ROW is mainly agricultural land accounting for 73.49%.

Residential land has very low scale accounting for 14.55%. The remaining area is covered by rivers, canals, and roads. Thus, impact of land acquisition can be minimized by compensation and support measures in comply with provisions of the State without a major impact on the lives of affected households.

4 Soil erosion and eboulement generation caused by excavation and fillback duration Small Short-term

The transmisson line would traverse medium and large rivers and canals 28 times. Construction of the pole foundation at locations near canals and river edges, if not properly managed, can cause small landslides and soil erosion affecting natural drainage in irrigation canals.

However, during excavation of pole foundation, the contractor would apply measures for reinforcing the foundation.The terrain of the subproject area is flat, furthermore, excavation, backfill and levelling works will be priorly implemented in dry season so impacts on landslide and erosion is assessed as small.

5 Dust generation caused by construction activity, exhaust gas of transporation means of equipment and materials during construction

Small Short-term

- Dust will generate during excavation, backfill of foundation. Specially, it will happen in the construction activities in the dry season. However, impacts do not concentrate at the same location; it will be distributed at each foundation location. Quantity of excavation and backfill are not large. In addition, the tower foundation location is located in the agricultural region; the humidity of land is rather high so the diffusion of dust is not significant from the construction activities.

- Diffusion of dust will happen at the surface of road due to transportation means. However, most of main road routes have been asphalted for the construction activities so the diffusion of dust is not significant. Dust only happens at transmiting location from the

- Dust and exhaust gas are generated from activities of engines of transportation means and machineries. These means are used the clean-fuel so pollution content of waste gas is not high. Effects on the waste gas are not significant in the subproject region because generated location is mainly in rural region.

At section G9 – G11 of the subproject crosses over the residential region in Tan An city. This location will bear strictly air pollution, the remaining locations of the subproject cross over the agricultural region so the effects on air pollution is assessed as small.

6 Impacts from noise and vibration

Small Short-term

Noise and vibration can be caused by transportation means and mechinaries. However, construction activites are mainly carried out by manual method or semi-mechineries with a small means so the intensity of noise is not high.

Construction time at each location is short; it is only two – three days for the excavation works, five days for foundation, five days for tower erection and two-three days for cable stringing so the noise and vibration only happen during this short time at each tower foundation.

Most of the construction locations are located in the rural region, away from residiential region; therefore, impacts on the noise and vibration are not high. The region caused strictly noise is the foundation locations crossing over the residential region in Tan An city; section G9 – G11 where has the foundation near the local house.

7 Water and soil pollution due to hazardous waste

Small Short-term

The waste oil volume from activities of maintenaince and transportation can affect the quality of soil and water. The waste oil volume for each oil-supplying activity of 59 construction means is estimated at about 413 liters/time, and estimated around 68 – 138liters/month. The waste oil volume at section I and II is 15 – 30liters/month and 53 – 107 liters/month. This volume only happens at the maintenance agents and they were collected by these agents. Therefore, the waste oil volume generates is very low at construction site; it only happens when having small repairment at site.

8 Impacts on environmental quality due to waste and wastewater

Effects on environmental quality due to waste, including domestic solid waste and construction solid waste.

- The amount of generated waste is 120kg/day for total 200 worker of the whole subproject. These amounts will be allocated at the four camps; these camps are near the main traffic axis so their wastes will be collected via the regional collection system. Therefore, impacts on the domestic waste can not happen due to the non-collection and non-treatment.

- Construction solid waste: total quantity of excavated soil at each foundation location is 114,370.89 m3 in construction phase. The quantity of backfill is 87,952.66m3. Thus, quantity of redundant soil from excavation and backfill activities is 26,418.23 m3. This quantity will be fully utilized to slope banks against erosion in the foundations so the subproject will not generate quantity of redundant soil. In the process of casting and installing foundation can generate a lot of construction wastes such as concrete debris, formworks, steel scrap, crates etc. However, most of these construction wastes can be recycled and reused so it would be easy to control and collect this waste. In addition, this is a subproject which is rehabilitated and upgraded from the existing transmission line so all equipment, materials and steel tower of the existing route will be displaced and recaptured/withdrawn and stored in owner’s warehouse.

Impacts on environmental quality due to waste water, including waste water of construction workers and waste water from constuction activities.

- Waste water will be distributed at each construction location with a low capacity. The wastewater capacity for 15 workers is estimated about 1,2 m3/day at each construction location and the distance of each location is 366m. Besides, the construction locations mostly are located in the agricultural land so impacts on the domestic wastewater are assessed as small.

- Waste water from construction activity includes the source from pump pit drainage and a little capacity from quipment and machinery’s sanitary during construction. The main component of the pollutant in waste water are inorganic substances such as soil, sand,

9 Worker and public Safety from camps and warehouses and spread of infectious diseases

The subproject provides warehousing (close and open warehouses) for storage of materials and equipment. Workers will rent local housing for the duration of construction activities. There will be a large concentration of workers at the site, which could affect the local region and could introduce disease for the local people and vice versa. However, the level of disease transmission will not be high because the construction team will be educated and guided on disease prevention measures. The construction contractor will ensure sanitary conditions for workers, and communes in the region of the subproject have provided clinics.

10 Conflict between construction workers and local people

Small Short term

There are an estimated 200 workers at the site (divided into four teams among the two construction sections). There are 35 workers at section I and 65 workers at section II. It is proposed 30% of the total labor workforce will be local residents so there is no difference between culture and lifestyle. In addition, most of the non-local workers are technical labors who have extensive construction experience. These workers have been acquainted with the local culture at the site; therefore, the conflict between non-local workers and local people and community is expected to be minor.

11 Traffic interruption due to construction activities

Transportation, excavation and stringing wire activities will affect local traffic for a short period of time only.

Transportation of construction materials is benefited by traffic system development in the subproject’s region.

The national highway system, provincial roads, and inter-district roads are in good condition. The inter-paths are developed in the agricultural and garden land regions

The national highway at the region of Tan An city has a médium level traffic density. This is the localtion that can affect the traffic significantly during stringing wire.

12 Effects on local traffic system quality caused by construction and transportation activities Small Short term

The transportation of materials with the high frequency can affect the rural road system in the local region.

The construction materials will be transported by trucks along the national highway, provincial roads and inter-district roads. The foundation location away from them will be transported by manual means to the construction foundation location. Therefore, the transmission frequency mostly increases low on the paths with bad quality. The subproject’s activities will rarely affect these paths.

Nowadays, government authorities and local people closely monitor traffic management at the local region. The means a weight load exceeding the limit will not be permitted access to the local roads. This is also an issue for the contractor who must meet and carefully propose the transportation solution and avoid damaging the local roads system.

13 Effects due to de-energizing for construction activity

Length of the transmission line is 71.83 km, the route will coincide with the ROW of the exiting 220kV Phu Lam - Cai Lay 1 and 2 transmission line. Therefore, during construction process, it is necessary to de-energize the relevant 220kV transmission lines such as transmission lines of Phu Lam - Long An 1 and 2; Long An - Mỹ Tho 1 and 2; My Tho – Cai Lậy 1 and 2. However, during construction phase, a construction method will be issued by the contractor and approvedby owner in order to mitigate impacts. This activity will cooperate with regional load dispatching center to ensure demand of power supply.

Thus, considering the calculated results of electric field strength under the transmission line at the height of 1m above ground level, where the clearance between the lowest conductor and the ground level is 8m, the electric field obtains the maximum value underneath the conductor, which is 4.5kV/m for super-bunder (ABC-ABC) phasing and 3.7kV/m for low-reactance (ABC-CBA) phasing. These values are always lower than permited maximum value (5kV/m) stipulated in Clause 4, Article 1 of Decree 81/2009/ND-CP, regulating the value of electric field strength at any outdoor point, at the height of 1m above ground level.

15 Effects on bird and airplane

Height of tower is less than 30 m; and its height will not affect to bird and airplane.

Besides, the transmission line runs parallel with the Highway No.1 from Hochiminh city to Tien Giang province, its route has not been cut via movement direction of bird migration. Additionally, no cases of dead birds during their migration due to transmission line have been observed by the power grid management and operation units in southern region. Birds and insects will not get an electric shock when landing on the transmission line. The existing 220kV Phu Lam – Cai Lay had existed and operated for 23 years and it had been shown that operation of this transmission line has not caused negative effects on wild animal, imgration bird and birds in this region as well.

16 Interference with radio, television or other communication

19 Hazard on collapsed tower

Towers of 220kV transmission line can be collapsed by cases of lightning, wind, storm, weak foundation; especially at tower location in river corridor, where it is easy collapsed soil. However, design and supervision has been immplemented well and met safety standards. Tower foundation was designed on the basic of conditions of topography, geology and hydrometeorology in region, its design has ensured against impacts due natural elements as statistics over the last 20 years. Therefore, although hazard on collapsed tower is very high but possibility of problem is low.

20 Effects due to domestic waste water and solid waste of operator

Small No impact The subproject is an overhead transmission line so it does not generate waste during

operation phase. Operators only check periodically this line according to stipulation of power sector; and implementation period is short and completes in a day.

21 Problem of grid, accidents during operation and management

Small Long-term Problem of power grid and accidents, during management, operation, repair and

maintenance works, can happen if worker of operation and maintenance don’t meet safety and operation stipulations. However, these workers always meet stipulations on power safety so risks will be assessed as small.

Conclusion:The implementation of the subproject would mainly cause land acquisition, increased dust generation, air pollution. However, these impacts are not significant, temporary, localized impacts with available mitigation measures. Therefore, the subproject is assessed as B environmental category in accordance with the WB’s criterion and eligible for funding by TEP project.

Ensure drainage system is always maintained cleared of mud and other obstructions.

Areas of the site not disturbed by construction activities shall be maintained in their existing conditions.

VII. Monitoring Program 7.1. Objectives It is essential to design the monitoring program and monitoring frequency appropriately to be able to demonstrate both the overall performance of the subproject works as well as the short- term impact due to peak construction activities. More specifically, as the integral and critical part of the EMP, the environment monitoring program should have the following objectives:

Determine the actual extent of the impacts.

Control impacts which are generated from construction process and mentioned in the EMP.

Check and supervise implementation of environmental protection solutions during construction based on EMP.

Suggest mitigation measures in case of unexpected impacts.

Suggest to the related parties to coordinate with central and local environmental organizations to solve any pending issues that might arise relating to environmental protection under the scope of the subproject.

Assess the effect of mitigation measures in pre-construction, construction and operation stages and recommend for improvement.

VIII. EMP IMPLEMENTATION ARRANGEMENTS Proper environmental management during construction requires the involvement of several stakeholders and agencies, each with different roles and responsibilities including: NPT, SPMB, DONREs (Provincial Department of Natural Resources and Environment) of provinces of Long An, Tien Giang and Ho Chi Minh city, the Contractors, the Construction Supervision Consultant, and local communities.

To ensure effective implementation of the EMP, the following actions will be carried out during the implementation of the subproject:

a)During thedetailed designandtenderdocumentation making

- During the detailed design of technical specifications and preparation of bidding contract documents for each contract, the technical design consultant will incorporate into these bidding and contractual documents the parts of the EMP specific to that contract, as well as the specific measures identified in the EMP.

- In preparing the bidding and contract documents, make an effort to ensure that the contractors are aware of the safeguard obligation and commit to comply. The environmental and social specifications (in Appendix 3) needs to be included in the bidding and contractual documents.

b) During the course of preconstruction and construction

SPMB will assign the Construction Supervising Consultant (CSC) and/or field engineer to be responsible for supervision of safeguard performance of contractor on a daily basis. A generic Terms of Reference (TOR) is provided in Appendix 2. CSC and/or field engineers will carry out, but not limited to, the following tasks:

- Before the commencement of the construction, confirm that all compensation for land and facilities are provided and relocation and/or land acquisition/donation has been completed.

- Review and approve Site Environmental Management Plan (SEMP) to be prepared by contractor before the commencement of the construction.

- Closely supervise the implementation of the EMP throughout the construction period.

- Confirm the compliance with the agreed environmental plan and inspect any damages incurred by the contractor. If necessary, prepare an order to compensate/restore the construction sites as specified in the contracts. Contractor safeguard performance will be included in the subproject progress report.

The role and responsibilities of relevant parties in the implementation of EMP are described in the following table:

- The SPMB is responsible for fostering effective coordination and cooperation between contractor, local authorities, and local communities during construction phase. SPMB will be assisted by the environmental staff, and CSC/or field engineer.

- Specifically SPMB will: i) closely coordinate with local authorities in the participation of the community during subproject preparation and implementation; ii) monitor and supervise EMP implementation including incorporation of EMP into the detailed technical designs and bidding and contractual documents; iii) ensure that an environmental management system is set up and functions properly; iv) be in charge of reporting on EMP implementation to NPT and the World Bank.

- In order to be effective in the implementation process, SPMB will establish an Environmental Unit with at least an environmental staff to help with the environmental aspects of the project.

Environmental Unit EU (EU) under SPMB

- The EU is responsible for monitoring the implementation of WB’s environmental safeguard policies in all stages and process of the subproject. Specifically, this unit will be responsible for: i) reviewing the subproject EIAs and EMPs prepared by consultants to ensure that they follow the project ESMF and meet the government and the Bank requirements; ii) helping PMB incorporate EMPs into the detailed technical designs and civil works bidding and contractual documents; iii) helping SPMB incorporate responsibilities for EMP monitoring and supervision into the TORs, bidding and contractual documents for CSC; iv) providing relevant inputs to the consultant selection process; v) reviewing reports submitted by the CSC; vi) conducting periodic site checks; vii) advising SPMB on solutions to environmental issues of the project; and viii) preparing environmental performance section on the progress and review reports to be submitted to NPT, the Bank, and the local authorities if requested.

Construction Supervision Consultant (CSC) and/or Field Engineer

- The CSC will be responsible for routine supervising and monitoring all construction activities and for ensuring that Contractors comply with the requirements of the contracts and the EMP. The CSC shall engage sufficient number of qualified staff (e.g. Environmental Engineers) with adequate knowledge on environmental protection and construction project management to perform the required duties and to supervise the Contractor’s performance.

- The CSC also assists SPMB in reporting and maintaining close coordination with the local community.

- Based on the approved EMP and environmental specifications/requirements in the bidding and contractual documents, the Contractor is responsible for establishing a site-specific EMP for each construction site area, submit the plan to the PMB and CSC for review and approval before commencement of construction. In addition, it is required that the Contractor get all permissions for construction (traffic control and diversion, excavation, labor safety,

- Actively communicate with local residents and take actions to prevent disturbance during construction.

- Ensure that all staff and workers understand the procedure and their tasks in the environmental management program.

and coordinate with agencies and keys stakeholders to resolve these issues.

Local community

- Community: According to Vietnamese practice, the community has the right and responsibility to routinely monitor environmental performance during construction to ensure that their rights and safety are adequately protected and that the mitigation measures are effectively implemented by contractors and the PMB. In case of unexpected problems, they will report to CSC/PMB.

Mass organizations

- These organizations could play a role as a bridge between the PPC/DPC, communities, contractors, and PMB by assisting in community monitoring.

- Mobilizing communities participation in the subproject, providing training to communities.

- Participating in solving environmental problems if any.

Province and District People’s Committees (PPCs/DPCs), Provincial DONRE

- Oversee implementation of subprojects under recommendations of DONRE and PMB to ensure compliance of Government policy and regulations.

- DONRE is responsible for monitoring the compliance with the Government environmental requirements.

EMP Implementtion Reporting Requirements

The safeguard performance will be included in the subproject and Project progress reports. PMBs with assistance from the CSC will include safeguard performance at subproject level to PMBs periodically. At the project level, NPT will prepare safeguard performance report twice per year for submission to the World Bank describing the Project progress and compliance with the ESMF and other safeguard requirements. The reporting requirement is described in Table 8.2 below.

IX. PUBLIC CONSULTATION AND INFORMATION DISCLOSURE 9.1.Public Consultation During the subproject preparation stage, the following activities were accomplished:

Activity 1: Investigation and discussion with local authorities about the route location.

Activity 2: Site investigation, Preparation of Environmental Impact Assessment and Environmental Management Plan for the subproject.

Activity 3: Organization of public consultation.

The meetings with local authorities and local people affected were carried out at the offices of twenty-three communes in the provinces of Tien Giang and Long An, and Ho Chi Minh city from July 26, 2013 to August 09, 2013. There were 105 persons and 492 persons, who were representing the local authorities and the affected people of twenty-three communes in provinces of Long An and Tien Giang; and Ho Chi Minh city, respectively, participated in the public consultation meetings.

Representatives of the subproject Owner and Consulting Company presented the following main issues to the public:

- Subproject description: route of transmission line, the foundation locations, and the necessity of construction of the above-mentioned subproject;

- Possible potential environmental impacts caused by the subproject;

- Measures to mitigate these impacts.

Public’s representatives invited to attend the public consultation meetings include: representatives of affected households, government representatives, and people associations.

Main comments at the public consultation meetings are summazied as follows:

- The subproject means a great deal to the local people; subproject’s owner should work closely with the committee representing the local people to quickly and carefully implement a compensation plan;

- Provide more details on compensation policies.

- Local people are more interested in how much land will be acquired; what will be the impact on trees, structure?

- Can houses be constructed under the ROW?

- Houses under the ROW will or will not have an effect on local people’s health when upgrading the existing transmission line?

- The owner is requested to execute the next steps, and the People’s Committee wishes that the project be expedited so it can serve and benefit the local people.

- In the past, compensation for the land at the location of the tower foundation has not been provided. During this subproject, it is requested that the owner should consider

compensating this foundation location.

- Houses under the ROW will be affected by an electro magnetic field. The power branch is requested to give solutions for repairing all damages.

- Owner needs to consider alternatives for roof-grounding of affected houses to avoid impacts of electro magnetic field to local people.

- Owner is required to offer a reasonable price to local affected people.

Based on the above questions, the representatives of the subproject’s owner and the consultant company has provided information related to the raised questions:

- Compensation rate will conform to rates regulated by provincial people committee. Compensation and assistance will be based on the unit price according to stipulations of the provinces and the local people will be reasonably compensated.

- At the present time, data on the impacted land and trees are not fixed; after detailed measurement, the Compensation committee will have concrete data and will inform the subproject affected households within a reasonable amount of time. Data will be disclosured at the office of commune local committees, where the subproject will overpass;

- Trees within ROWs with height above 4 m will need to be cut. High trees outside ROWs with the potential to fall down on or near the transmission line will need to be cut as well;

- The transmission line is designed according to the National Technical standard to ensure that it will not harm the health of the local people who are living under and near the transmission line; Transmission lines with voltage up to 220 kV will not cause electromagnetic field impacts. Houses and structures within ROWs will be modified, or repaired if they are made from flammable materials and will be compensated due to limited usage according to Degree 81/2009/ND-CP; and will be re-designed to fulfill condition that the lowest point of transmission line is more than 18 m far from the earth ground.

- Houses and structures shall be permitted to exist under the ROW according to Article 6 of Decision No.81/2009/ND-CP if they meet this stipulation. The height of line for upgrading the transmission line will be 15m; it will be higher than the existing one so the houses under the line will not be affected.

- The subproject will be designed to ensure that electro magnetic field within ROWs, at 1m height point in side houses will be <1kV/m according to Degree 81/2009/ND-CP; for the 1m height point outside houses will be <5kV/m. The transmission line will not affect normal lives of local people.

Beside the above-mentioned issues, subproject owner and Consultant also agree to receive all comments and will consider and update it to EMP report.

Activity 4: Review and update the EMP according to collected comments. Continue to receive feedback from affected households.

In addition, during the subproject construction phase, a supervising construction consultant will be hired to monitor the implementation of EMP.

9.2. Information Disclosure Disclosure of information was carried out in accordance with the World Bank requirements. The disclosure is as follows:

- The draft EMP of the subproject in Vietnamese was disclosed on January 24, 2014 at the office of People Committee of affected communes and districts in order for local people and institutions to approach and search.

- Also, the draft EMP in both Vietnamese and English versions were disclosed at the Vietnam Development Information Center (VDIC, 63 Ly Thai To St., Hanoi City) on January 24, 2014 for relevant organizations to read, inquire and give their opinions about the report. The draft EMP English version was disclosed at the Bank’s InfoShop in Washington DC on January 24, 2014.

- The final subproject final EMP was disclosed locally at the subproject sites, at the Bank’s InfoShop, and the Vietnam Development Information Center on April 18, 2014.

Appendix 2: Terms of reference for CSC General

In order to prevent harm and nuisances on local communities, and to minimize the impacts on the environment during the construction of the civil works under this subproject, a subproject EMP has been prepared and should be adhered to the Contractors and his employee.

The Construction Supervision Consultant is to provide professional technical services (“the Services”) to help ensure effective implementation of subproject EMPs.

Scope of Service:

The general services to be provided by the CSC are to inspect, monitor the construction activities to ensure that mitigation measures adopted in the EMP are properly implemented, and that the negative environmental impacts of the subproject are minimized.

On behalf of the SPMB, the CSC will conduct the following tasks:

- Conduct regular site inspections;

- Review the status of implementation of environmental protection measures against the EMP and contract documents;

- Review the effectiveness of environmental mitigation measures and subproject environmental performance; - As needed, review the environmental acceptability of the construction methodology (both temporary and permanent works), relevant design plans and submissions. Where necessary, the CSC shall seek and recommend the least environmental impact alternative in consultation with the designer, the Contractor(s), and SPMB;

- Verify the investigation results of any non-compliance of the environmental quality performance and the effectiveness of corrective measures; and

- Provide regular feedback audit results to the contractor’s Chief Engineer according to the environmental stipulation and site-specific mitigation measures;

- Provide regular feedback audit results to the contractor’s Chief Engineer according to the noncompliance procedures of EMP.

- Instruct the Contractor(s) to take remedial actions within a specified timeframe, and carry out additional monitoring, if required, according to the contractual requirements and procedures in the event of non-compliances or complaints;

- Instruct the Contractor(s) to take actions to reduce impacts and follow the required EMP procedures in case of non-compliance / discrepancies identified.

- Instruct the Contractor(s) to stop activities which generate adverse impacts, and/or when the Contractor(s) fails to implement the EMP requirements / remedial actions.

- For contracts that Site Environmental Management Plan (SEMP) are required, the CSC shall provide the final review and recommend clearance of all Site Environmental plans which may affect the environment. These include, but are not limited to: dredging areas, borrow pits and disposal sites, worker’s camp plans. The CSC will review and approve the SEMP presented by the Contractors. Where these plans are found not to comply with the EMP, EIA or RAP, the CSC shall work with the SPMB and Contractor to establish a suitable measures or remediation.

- Addressing Complaints: Complaints will be received by the Contractor’s Site Office from local residents with regard to environmental infractions such as noise, dust, traffic safety, etc. The Contractor’s Chief Engineer or his deputy, and the CSC shall be responsible for processing, addressing or reaching solutions for complaints brought to them. The CSC shall be provided with a copy of these complaints and shall confirm that they are properly addressed by the Contractors in the same manner as incidents identified during site inspections. - Confirmation for Monthly Payments: The CSC shall confirm the monthly payments for environmentally related activities implemented by the Contractor.

- Report: the CSC shall prepare the following written reports:

Bi-weekly report of non-compliance issues

Summary monthly report covering key issues and findings from reviewing and supervision activities

At the end of the subproject, the CSC shall prepare a final report summarizing the key findings from their work, the number of infringements, resolutions, etc. as well as advice and guidance for how such assignments should be conducted in the future.

Apnndix 3: Environmental Specifications for the Contractor The environmental management requirements in construction of the subproject have been established and presented clearly in the EMP (indicate the specific section of the EMP here). The Contractor need to carefully read and fully understand all requirements included in the contractor’s bid: (Insert the name of the Civil Works Package here) of the subproject.

I. Overview In order to avoid negative effects into the environment and local community, as well as minimizing damaging impacts to the environment during the construction and operation stages of the resettlement sites, Contractor and workers are required to observe the mitigation measures as mentioned below:

- “Environmental Management Plan for the Project…”.

- The technical specifications, procedures and the most popular practices are presented in this annex.

II. Overall requirements of Contractor for environmental management Contractor need, in in line with the requirements of the EMP, to include, but not limited the following responsibilities:

- Be in compliance with the current national legal regulations on environmental management.

- Work in scope of requirements in the contract and the conditions in the bidding documents.

- Assign the representative of the construction team to participate in the site inspection operations by the PMB, CSC or the DONRE as well as implement all corrective actions to overcome the environmental issues as guidance provided by the Construction Supervision Consultant (CSC).

- Provide and update information for PMB about any activities, assignments that can contribute or continue to cause the significant harmful impacts into the environment.

- In case of instruction by the CSC and PMB, the Contractor must stop the construction activities that causes adverse impacts, also propose and conduct the environmental remedial actions and implementation other construction methods (if required) to minimize the negative environmental impacts.

- Establish and maintain an Environmental and Safety Unit, which consists of Construction team leader or Vice- team leader and Safety and Environmental Officer (SEO) with the purpose of receiving and dealing with the complaints, objections, argument and displeased of the local community caused by the construction operation. SEO is responsible to record all of complaints, resolve methods and results into the complained register. The register need to keep at the construction office and available for review by the supervision engineer and PMB.

III. Responsibilities of Contractor in EMP implementation: The construction Contractor has responsibility in compliance with the technical specifications of the EMP, (name of the subproject to be inserted here) and national environmental management regulations, including but not limited the following items:

i) The mitigation measures presented in relevant section of the EMP(indicate the specific section of the EMP here) and prepare budget for implementing the mitigation measures.

ii) Based on EMP, Contractor developed a detail Site Environmental Management Plan for addressing the construction related impacts. The SEMP includes the following components:

- Management Plan for worker camps. - Management Plan of the overall construction operation. - Plan for management and storage of construction materials (including the

dangerously chemicals) - Solid waste and waste water management plan (including construction and

household waste) - Plan for management and mitigation of noise and dust. - Plan for management and mitigation of impacts to vegetation and wild animals. - Plan for environmental landscape restoration - Healthy and safety ensuring plan at the construction. - Erosion and soil aggrandizement controlling plan. - Safety plan during the construction stage and training for workers about

environmental management and community relations. - Rules and regulations about living activities of staffs and workers at the

construction sites. - Emergency Problem Treatment Plan. - Management and Monitoring Plan for Report Process.

The detail measure of plan need to satisfy the following requirements: to implement the particular mitigation measures: who implement (people, team, etc), how to implement (labours, machines, equipment, etc.) and the cost. This plan shall be completed and submitted to the CSC for review and approval before start of the construction. The Contractor will:

a) ensure that at least one supervisor is available in compliance with EMP before and during the construction time.

b) ensure that all of the construction activities will be approved in document of the relevant authorities.

c) ensure that all of staff and workers understand through their process and duties.

d) be in compliance with requirements about the environmental management monitoring and reporting in EMP and inform to PMB about the difficulties and solutions.

e) Inform to the local authority and PMB in case of environmental problems and co-ordinate with the relevant institutions and stakeholders for resolving.

IV. Safety and Environmental Officer of Contractor: Each contractor will nominate a Safety and Environmental Officer (SEO) to work full-time at the construction site. Requirements for a SEO include an undergraduate degree in Environmental Major, at least 3 years of working experience in environmental management, training and monitoring at the infrastructure construction project. Additionally, SEO should have a good knowledge about Vietnamese Environmental Legal Regulations and has

participated to the labor safety and sanitation training class that organized by Department of Labour- Invalids and Social Affairs and have the labor safety and sanitation certificate.

SEO have the responsibilities for implementing and managing EMP of Contractor. Tasks of SEO will include, but not limit the following activities:

i) Training and developing environmental awareness for workers of Contractor within 2 weeks after the contractor is mobilized. The training is repeating every six months. The additional trainings will be implemented under the guidance of Environmental Supervision Engineer.

ii) Conduct the internal environmental monitoring at the site to check the construction activity implementation of contractors, equipment and implementation methods to manage the environmental pollution and evaluate the efficiency of the mitigation measures into the environmental impacts.

iii) Internal monitoring the implementation of environmental mitigation measures and in compliance of contractors with the environmental protection measures to prevent and control pollution; the committed requirements in the contract; guidelines of the contractor(s) on environmental improvement, environmental awareness and also proactive measures to prevent pollution.

iv) Conduct an investigation and propose the mitigation measures for the contractor(s) in case of incompliance/ infringe the EMP; monitoring and implementing the environmental mitigation measures.

v) Evaluate the success of the EMP implementation to estimate effectively the cost and adequacy of the implemented mitigation measures.

vi) Survey after receiving the complaint, thence evaluate and select the corrective actions.

vii) Conduct the additional monitoring activities, based on the concrete guidelines of the monitoring engineer and/ or PMB; and

viii) Contact and implement all activities under the co-ordination or guidance of the Contractor Leader, Environmental Supervision Engineer, Supervision Engineer, PMB, representatives of the provincial environmental management offices, local authority about all of environmental problems if necessary.

ix) Establish the regularly reports for the environmental implementation of the civil works package.

x) All of the internal monitoring as well as other activities of SEO should be documented and updated frequently in the environmental implementation monitoring diary of Contractor. This diary is used for normally checking by the CSC to evaluate the effectiveness of mitigation and the work of SEO.

V. Monitoring the environmental implementation of Contractor: The PMB will sign a contract with the Consultant to carry out the task of CSC. The CSC will apply the environmental and monitoring activities of the package as indicated in Appendix 2. The environmental monitoring engineer of construction/execution monitoring Consultant is responsible to monitor daily the implementation of measures, in order to minimize environmental impact and safety of the Contractor. The construction monitoring Consultant will carry out the following main tasks:

Before the construction stage, make sure that all of the compensation process for land, works on land and relocation and/ or recovery/ donation of land as well as the clearance of landmines and UXO have been completed.

Review and approve the SEMP for implementing the EMP by Contractor before the construction operation.

During the construction process, monitoring closely the compliance with implementing of the environmental and safety mitigation measures.

Confirm the compliance with the EMP of Contractor and check any negative effect or damage caused by the contractor. If necessary, establish a request statement for contractor to compensate/ restore the construction site, as provided in the contract. The implementation of environmental management issues of the Contractor shall be mentioned in the progress report of the sub-projects.

VI. Compliance Framework: a) The contractors are not allowed to implement the construction activities, including

preparation of construction within the project scope in advance the detail SEMP for implementation of the EMP are reviewed and approved by the construction supervision consultant and environmental official of the Client.

b) The PMB is mandatory to ensure that the Contractor in compliance with the contract provision including compliance with EMP and the detail implementation plan of EMP. In case of incompliance with EMP, Client will require the Contractor to bring out the suitable measures.

c) In order to ensure in compliance with the environmental standards of the sub- project, PMB is allowed to hire the third party to solve the problems in case the Contractor could not implement the remedies on time, leading to the negative effects into the environment, as follow:

- For small infringements (such as minor impact/ damage, temporary and repairable), PMB or the representative of PMB (the CSC) will notify the Contractor to correct the problems as required in the EMP within 48 hours after receiving the official report. If the mistakes are satisfactorily repaired during that time, no more action should be undertaken. Supervision consultants have the right to extend more 24 hours in the limited time for recovery, under the conditions that the Contractor has implemented activities but not completed the prescribed time, due to irresistible conditions that mentioned in the contract.

- For major violations, it is required about 72 hours for repairing, the PMB through the CSC will announce the violation and require the Contractor to rectify the problems within the prescribed time by their budget. If the Contractor fails to complete corrective work according to the specified time, they will be punished by financial punishment (cost punishment is calculated by the cost of remedying damage)

- According to the evaluation of the CSC, if the Contractor fails to resolve the problems in environmental management or the contractor conduct reparing unsatisfactorily within the specified period of time (48 hours or 72 hours), the investors have the capacity to arrange for another contractor (third-party) to implement the suitable measures and deduct money for this task from the contract with the contractor in the next payment.
