Dera Professors,

In the Circular sent to the District Secretaries by the General Secretary

giving the minutes of the central executive meeting held at Trichy on 6th October,

it is mentioned that I am not going to contest for any post in the coming elections.

It is true. However, the point that apology was offered to me for federation

affairs and changing the programme of the conference finalized by the governing

body is not mentioned. This is called Convenient, one sided reporting. Hereafter,

whoever is in charge of reporting must record it then and there immediately after

the meeting. Secondly the executive forgot to thank the outgoing treasurer. It

was not done deliberately but an omission of a protocol.

I am branded as an anti federation man. Yes, I am anti federation but pro

JAC. Here I must narrate the history of JAC of College Teachers (AUT, MUTA,

TNGCTA). I was the Convener of the first JAC meeting on 1st January 1978 at

Hotel Natraj, Trichy. Professors P.K. Rajan, B. Parthasarathy, (MUTA)

V. Narayanasamy, Velaiah (AUT) Prof. Narasingam, K.S. Narayanasamy (G.C.T.A)

officially attended it. You know the good work done by JAC after that till date.

We never formed a federation but JACTTEA, JACSATO.

What is the difference between JAC and a federation? In JAC there is no

official president, secretary, etc. All have equal status with one convener which

goes by rotation. There is no voting; Only consensus. Normally in JAC politicians

have no role. In a federation there are office bearers (not yet elected) who are

usually politically coloured. Politically coloured people form a coterie and drag

the federation according to the dictates of their political masters. Ideological

fanaticism will get the upper hand in course of time. AIFUCTO itself is a federation

dominated by political colour and one gentleman was the general secretary for

more than thirty years. I have narrated my experience. Ordinary members are not

aware of such things. I do not say “after me the deluge”. Let TANRECTA flourish.

6. Pending formal authorisation by the Accountant General, the revised Dearness Allowanceshall be paid straightaway by the Pension Pay Officer,

Chennai-6, Treasury Officers and Public Sector Banks concerned.

7. This order will apply to the following categories of pensioners:-

i) Government pensioners, Teacher pensioners of aided and local body educationalinstitutions and other pensioners of local bodies.

ii) The State Government employees who had drawn lumpsum payment on absorptionin Public Sector Undertaking / Autonomous body / Local body / Co-operativeinstitution and have become entitled to restoration of 1/3rd commuted portion ofpension as well as revision of the restored amount.

iii) Present and future family pensioners; In the case of divisible family pensioners,Dearness Allowance shall be divided proportionately.

iv) Former Travancore-Cochin State pensioners drawing their pension on 1st

November, 1956 in the Treasuries situated in the areas transferred to Tamil NaduState on that date, i.e. Kanniyakumari District and Shencottah taluk of TirunelveliDistrict.

v) Pensioners who are in receipt of special pensions under Extra-ordinary PensionRules, Tamil Nadu and Compassionate Allowance.

8. The expenditure on Dearness Allowance payable to the Pensioners shall

be debited to:

“2071. Pension and Other Retirement Benefits - 01. Civil - 101. Superannuation andRetirement Allowances - I. Non-Plan - AC. Dearness Allowance to Pensioners - 03.Dearness Allowance (D.P. Code 2071 01 101 AC 0306)"

The expenditure on Dearness Allowance payable to the Family Pensioners shall bedebited to

" 2071. Pension and Other Retirement Benefits - 01. Civil - 105. Family Pensions - I.Non-Plan - AC. Dearness Allowance to Family Pensioners of Tamil Nadu Government- 03. Dearness Allowance (D.P. Code 2071 01 105 AC 0308) ".

9. Orders regarding sanction of Dearness Allowance to the widows and children of thedeceased Contributory Provident Fund / Non Pensionable Establishment beneficiaries ofState Government and the former District Board who are drawing ex-gratia will be issuedseparately.

10. The increased expenditure due to the sanction of Dearness Allowance in this order isallocable among the successor States as per the provisions laid down under the StateReorganization Act, 1956.

ORDER:

In the Government Order first read above, orders were issued sanctioning the revisedrate of Dearness Allowance to the State Government pensioners / family pensioners asdetailed below:-

2. The Government of India, in its Office Memorandum third read above has enhanced theDearness Allowance payable to its pensioners / family pensioners from 80% to 90% witheffect from 1st July, 2013.

3. Following the orders issued by the Government of India, the Government has nowdecided to sanction one additional installment of Dearness Allowance at 10% to the Pensioners/ Family Pensioners of the State with effect from 1.7.2013. Accordingly, the Governmentsanction the revised rate of Dearness Allowance to the State Government Pensioners /Family Pensioners as indicated below:-

4. The Government also direct that the increase in Dearness Allowance shall be paid incash to the Pensioners / Family Pensioners with effect from 1.7.2013.

5. While arriving at the revised Dearness Allowance, fraction of a rupee shall be roundedoff to the next higher rupee if such fraction is 50 paise and above and shall be ignored if it isless than 50 paise. It will be the responsibility of the Pension Disbursing Authority includingPublic Sector Banks etc. to calculate the quantum of Dearness Allowance payable in eachindividual case.

H3, dated 17.9.13.I am directed to invite your attention to the references cited and to clarify the various

points raised therein as follows:-

1. If an employee in the pre 01.06.1988 (Fourth Pay Commission scales of pay) promoted to one or more higher posts during the period 01.06.1988 to 31 .12.1995, it is presumed that their pay can be regulated notionally in the corresponding Fourth Pay Commission scales of pay, in the promotional posts app licable to the lower post held by them as per their earlier option.

Presumption is confirmed

2. If an employee in the pre 01.06.1988 (Fourth Pay Commission scales of pay) appointed to selection grade OR special grade during the period 01.06.1988-31.12.1995, it is presumed that one increment benefit can be given notionally in the Fourth Pay Commission scales of pay on movement to the Selection Grade / Special Grade.

Presumption is confirmed

3. In para 15 of the Government Order it has been stated that the orders shall be eligible to those pensioners who are alive on the date of Government Order (i.e. 23.08.2013). If a pensioner after exercising option died after 23.08.2013 before actually receiving the monetary benefits, it may be clarified whether the spouse / legal heir is eligible to receive Life Time Arrear /Family Pension.

Specific cases as and when brought to the notice of Govt, will be clarified separately.

4. According to G.O.Ms.No.555, Finance (Pay Cell) Department, dated 10.06.1985, stagnation increment beyond the maximum of the time scale of pay (Fourth Pay Commission scales of pay) at the rate of last increment shall be given annually in the ordinary grade / selection grade / special grade, the maximum of whose time scale of pay does not exceed Rs.2000/-p.m. and this maximum was raised to Rs.3000/- p.m. w.e.f. 01.10.1984.

Presumption is confirmed

Consequent on the implementation of Fifth Pay Commission scales of pay ordered in G.O.Ms.No.666, Finance (Pay Cell) Department, dated 27.06.1989, it has been ordered that the stagnation increment be sanctioned once in two years after reaching the maximum of their time scale subject to the maximum of 3 increments and ceiling of Rs.5450/- ceiling raised to Rs.6000/-w.e.f. 01.06.1988 monetary benefit 01.04.1992.

According to G.O.Ms.No.363, Finance (PGC) Department dated 23.08 .2013. the pay of the retired employees has to be regulated notionally from 01.06.1988 till their date of retirement only in the Fourth Pay Commission time scales of pay, it is therefore presumed that stagnation increments shall be sanctioned annually subject to a maximum of Rs.3000/- in terms of Fourth Pay Commission orders, during the period 01.06.1988 to 31.12.1995. The above presumption may kindly be confirmed.

5. The pay regulation period relates to the years 1988 to 1995 and already a period of 20 - 25 years has elapsed. There is difficulty in tracing out the service registers of the pensioners due to efflux of time / bifurcation of offices / closure of offices / due to natural calamities like fire / flood etc. and also due to unforeseen circumstances. In such cases it may be clarified whether the notional pay in the Fourth Pay Commission scales of pay may be regulated with reference to the Pay Bills and acqu ittances rolls (which is to be retained for 35 years) for the period up to the date of retirement and w.r.t. available records of pay fixation statement / increment register etc.

Yes Further, the clarification issued in Govt. letter No.8199/ Pay Cell/99-5, dated 1.6.99 shall also be adhered to.

6. In para 15 of the Government Order it has been o rdered that the pay of retired employees shall be regulated in the Fourth Pay Commission time scales of pay by the pay fixing authorities notionally where the employees last served. During the period 01.06.1988 to 31.12.95, certain officials moved from non-self drawing level to self - drawing status. It is presumed that the notional pay regulation may be done by the pay fixing authority for the self drawing period and by the Pay and Accounts Officer OR the Accountant General as the case may be for the self drawing period.

Presumption is confirmed

7. As there is no specific mention in the Government Orders regarding the payment of other retirement benefits it may be clarified whether difference in payment of DCRG / is due to be paid to the retired pensioners covered in this Government Order, as admitted on the previous occasion, based on the orders issued in G.O. Ms. No.272, 273 Finance (Pension) dated 15.06.1998 and G.O.Ms.No.449, Finance (Pension) dated 12.10.1999.

As per the orders issued in para-15 of G.O.Ms.No.363, Finance (PGC) Department, dated 23.8.2013, the employees retired between 1.6.1988 and 31.12.1995 are entitled only for pension revision based on the notional pay fixation as per the option exercised by such retired employees and claiming DCRG and other retirement benefits does not arise.

8. In G.O.Ms.No.1101, Finance dated 13.10.1990, for those employees drawing pay of Rs.3501/- and above, 32% of D.A. has been sanctioned w.e.f. 01.07.1990 subject to a maximum of Rs. 1,824/-

Similarly, in G.O.Ms.No.263, Finance dated 03.04.1991, 38% of D.A. has been sanctioned w.e.f. 01.01.1991 subject to a maximum of Rs.2,166/-

But, the above ceiling has not been shown in the Annexure - II of the Government Order. This may be clarified.

The maximum ceiling specified in the Government Orders shall be adopted .
