No.II(2)/HE/1020/2018.—In the matter of the charitable Endowments Act, 1890 (central Act VI of 1890) and in the name of “The Peruganur Arasayammal Muthiah charitable Endowment Fund” (hereafter referred to as “the said Endowment”) tenable in Government Arts college, Melur, Madurai District.

I. VESTING OF PROPERTIES.

wHEREAS, an application has been made to the Government of Tamil Nadu under clause (b) of sub-section (1) of Section 6 of the charitable Endowments Act, 1890 (central Act VI of 1890) by Thiru M.Balasundaram, 72, Vanjinathan Street, Thanthonimalai, Karur- 639 005, the donor of the said Endowment for vesting the property specified in the Schedule below, in the Treasurer of charitable Endowments, chennai, appointed under Section 3 of the said Act for the State of Tamil Nadu, the Governor of Tamil Nadu, in exercise of the powers conferred by Section 4 of the said Act, hereby orders that the said property be vested in the Treasurer aforesaid, and be held by him and his successors in office, subject to the provisions of the said Act and the Rules, which from time to time, may be or shall be made or ‘deemed to have been made thereunder and subject to the conditions setforth in the Scheme settled under Section 5 of the said Act, for the administration of the said Endowment.

II. ScHEME FOR ADMINISTRATION.

wHEREAS, an application has been made to the Government of Tamil Nadu under clause (b) of sub-section (1) of Section 6 of the charitable Endowments Act, 1890 (central Act VI of 1890) by Thiru M. Balasundaram, 72, Vanjinathan Street, Thanthonimalai, Karur- 639 005, the donor of the said Endowment specified above, for settling a scheme for administration of the said Endowment, the Governor of Tamil Nadu, in exercise of the powers conferred by sub-section (1) of Section 5 of the charitable Endowments Act, 1890 (central Act VI of 1890), hereby settles the Scheme setforth in the Schedule below for the administration of the said Endowment and appoints the Endowment committee, Government Arts college, Melur, Madurai- 625 106 to administer the property. The Scheme shall come into operation from the date of publication of this Notification in the Tamil Nadu Government Gazette.

1 The fund shall be called “The Peruganur Arasayammal Muthiah charitable Endowment Fund” at Government Arts college, Melur, Madurai District.

2 The fund shall be administered by the Endowment committee, Government Arts college, Melur.

3 From and out of the annual interest accruing on the said fund, the prize shall be given to the top ranker of M.com Degree course among the current batch students who completed the course at Government Arts college, Melur.

4 If more than one student securies the same marks, the prize shall be equally distributed among them.

5 The mode by which the interest amount shall be given to the student may be specified by the administration.

6 The unutilized amount of the interest may be added to the corpus of the said fund.

7 The decision of the administrator will be final, in all matters relating to the administration of the said fund.

and sub-section (2) of Section 5 of the Minimum wages Act, 1948 (central Act xI of 1948) and in supersession of the Labour and Employment Department Notification No. II(2)/LE/874/2013, published at pages 766 and 767 of Part II - Section 2 of the Tamil Nadu Government Gazette, dated the 20th November 2013, the Governor of Tamil Nadu after consultation with the Advisory Board hereby revises the minimum rates of wages payable to the classes of employees in the employment in cinema Industry in the State of Tamil Nadu specified in column (2) of the Schedule below, as specified in the corresponding entries in column (3) thereof, the draft of the same having been previously published as required by clause (b) of sub-section (1) of Section 5 of the said Act.

2. This Notification shall come into force with effect on and from the date of its publication in the Tamil Nadu Government Gazette.

(i) The dearness allowance is linked to the Average chennai city consumer Price Index Number for the year 2010 (that is 161 points with base 2001 = 100) and for every raise of one point over and above 161 points, an increase of Rs. 49.70 (Rupees Forty nine and paise Seventy only) per month shall be paid as dearness allowance.

(ii) The dearness allowance shall be calculated on the first April of every year on the basis of the average of the consumer price indices of the preceding twelve months, that is, from January to December.

(iii) The first calculation of dearness allowance shall thus be effective from the date of publication of the Notification in the Tamil Nadu Government Gazette based on the Average chennai city consumer Price Index Number for the previous year.

(3) where the nature of work is the same, no distinction in the payment of wages shall be made between men and women employees.

(4) To arrive at the daily rates of wages, the monthly wages shall be divided by 26.

(5) wherever the existing wages are higher than the minimum wages fixed herein, such existing wages shall be continued to be paid.
