3 8 PAYMENT OF FEES

PAYMENT OF FEES.

All fees for Lectures, Examinations or Degrees are to be paid, NOT AT TEE REOISTBAR'S OFFICE, but to the credit of the University account AT TEE NATIONAL BANE OF AUSTRALASIA, University Branch, or the Head Office, 273 Collins Street, or any of its branches.

Special pay-in slips, prepared in triplicate, will be found in the banking chamber of the Head Office, and at all branches of the National Bank. Two portions of the slip must be lodged with the bank ; the third, duly stamped and initialed by the receiving teller, must be produced at the Registrar's Office, if an entry for lectures or examination is being lodged, with the entry form. No receipt will be given by the Office for such payments, but the bank slip will be returned to the payer if a request to that effect is made. Where students have not personal access to a branch of the Bank, they may forward their re­mittance by cheque or money order direct to the Registrar. For all such remittances official receipts will be sent by return post.

BE it enacted by the King's Most Excellent University Act Majesty by and with the advice and oon- I915 '

sent of the Legislative Council and the Legisla­tive Assembly of Victoria in this present Par­liament assembled and by the authority of the same as follows (that is to say): —

1. This Act may be cited as the University Short title Act 1928, and shall come into operation on a day commencement to be fixed by proclamation of the Governor in division Council published in the Government Gazette, and is divided into Pa r t s and Divisions as follows: —

Act to the extent thereby expressed to be re­pealed are hereby repealed. Such repeal shall not affect, any appointment election regulation or statute or standing orders made or any degree diploma or certificate given or any licence granted or any lease or mortgage entered into or executed under the said Acts or any of them before the commencement of this Act and suoh repeal shall not affect auy grant of laud made or directed to be made either to the University of Melbourne or to the University jointly with any other person or body.

3. In this Act unless inconsistent with the nontext or subject-matter—

" Casual vacancy " means a vacancy however occurring in the oflice of any member of the council or of auy member of the

standing committee of convocation other­wise than by the retirement of suoh member on the expiration of his term of office.

" C o u n c i l " means council as constituted under this Act.

" Governor" means the Governor (or the person for the time being administering the Government of Victoria) not acting under tho advice of a Minister respon­sible to Parliament.

" G r a d u a t e " means a person upon whom has been conferred or who has been ad. mitted without examination to any

degree pursuant to any Act relating to the University for the time being in force and whether before or after the passing of this Act.

" H e a d of an affiliated college" moans the "Head of an. person who is the Warden of Trinity jS t* 6 " College, the Master of Ormond College, ' the Master of Queen's College, or the Rector of Newman College respectively, or the person who holds under whatever designation the office corresponding to to any of the foregoing offices; and (in tho case of any other residential college hereafter affiliated to or connected with the University pursuant to section eighteen of this Act) means such person as the governing body of that college desig­nates for the purposes ot this Act as the head thereof.

"Member of the teaching staff" includes "Member of the • r & teaching staff, professor.

Division I.—The University.

4. A University is hereby declared to have been established on the eleventh day of April One thousand eight hundred and fifty-three at Melbourne, The University shall consist of a coun­cil and convocation and shall be a body politic aud corporate by the name ol " The University of Melbourne," and shall for all purposes be deemed to bo the same body corporate and politic as the body- under that name consisting formerly of a council and senate. The University of Melbourne by such name shall have perpetual succession and shall have a common seal and shall by the same name sue and be sued plead and be im­pleaded and answer and be answered unto in all courts ot Victoria, and shall be capable in law to take purchase and hold all goods chattels and personal property whatosever, and shall also be able and capable in law to receive take purchase and hold tor ever not only such lands buildings hereditaments and possessions as may from time to time be exclusively used and occupied by the immediate requirements of the University but also any other lands buildings hereditaments and possessions whatsoever situate in Victoria or else­where, and shall be able and capable in law to grant demise aliene or otherwise dispose of all or any of the property real or personal be­longing to tho University, and also to do all other matters and things incidental or apper­taining to a body politic:

Provided that it shall not bo lawful for the University to alienate mortgage charge or demise any lands tenements or hereditaments of which it has become seised or to which it may become entitled by grant purchase or otherwise (unless with the approval of the Governor in Council), except by way of lease for any term not exceed­ing twenty-one years crom the time when such lease is made in and by which there shall be re-

served: during the whole of the term the highest rent that can bo reasonably obtained for the same without fine.

Division 2.—The Council.

(e) Two members shall be elected by the undergraduates but shall not include any member of the teaching staff or any person under the full age of twenty-one years;

(q) Two aud not more than two members shall be heads of affiliated colleges who shall be appointed by co-option by the council;

(h) Not more than two other members shall be persons appointed by co-option by the oouncil; and

(i) the present members of the Council of the University in office a t the commencement of this Act shall for the respective terms for which they were elected or appointed be deemed to be members of the council elected or appointed under this Act.

6. Subject to this Act— elected or appointed members of the coun­

cil shall be entitled to hold office for four years and shall (if qualified) be eligible for re-election or re-appoint­ment; and

the term of office of members elected or ap­pointed to fill vacancies caused by the retirement of members on the expira­tion of their term of office shall be reckoned as commencing immediately after the expiration of such term:

Provided tha t (a) any member of the oouncil appointed by the

Governor in Council may be removed by the Governor in Council;

(i) Members so appointed as being heads of affiliated colleges shall be entitled to hold office for a term of four years; and such term shall be reckoned as commencing on and including the day of appointment; aud vacancies however occurring in the office of members so appointed shall be filled by the appoint­ment by the oouncil by co-option of heads of affiliated colleges in rotation so far as practicable; and

(ii) All other members appointed by co-option whenever appointed shall' retire on the date (next after their appoint­ment) on which members appointed by the Governor in Council retire by effluxion of time.

7. (1) Subject to this Act elections of members of the council shall be conducted in accordance mtb statutes or regulations of the University.

(2) In the case of elections of members by con­vocation or by undergraduates such statutes or regulations may provide for voting by post and for preferential voting or for proportional repre­sentation where the principle of proportional representation is applicable,

(3) In the case of elections or appointments of members of the oouncil to fill vacancies caused by the retirement of members on the expiration of their term of office

(a) elections or appointments ot members (other than members appointed by co-option) shall be made within one month before the date of the expiration of the term of office aforesaid and shall take effect immediately on the expiration of such term; and

(6) the appointment of members to be then ap­pointed by co-option shall be made at a meeting of the council to be held on or as soon as practicable after that date.

8. In any case where— (a) at any election for elective members of the

council— (i) no seats or vacancies are filled; or (ii) a number of seats or vacancies less than the whole number which should have been filled is filled; or

(6) any such election should have been held but is not held—

the seats or vacancies which should have been filled and are not filled shall severally be deemed to be casual vacancies; and. the members eventually elected to fill the same shall be entitled to con­tinue" in office as if elected a t suoh election.

12. At every meeting of the council the chan­cellor or in his absence the vice-chancellor shall preside as chairman; and in the absence of the chancellor and vice-chancellor tho members of the council present shall elect a chairman.

13. No member of the council shall be entitled to vote either in the council or in any committee thereof on any subject in which he has a direct pecuniary interest, and the vote of any member so interested shall be disallowed.

14. (1) All questions which come before any meeting of the council shall be decided by the majority of tho members present.

(2) The chairman at any such meeting shall have a voto and in case of an equality of votes a casting vote.

(3) No question shall be decided at any meet­ing ot the council unless at least eight members thereof are present.

15. The council shall have full power to ap­point and dismiss all professors officers and ser­vants of the said University, and shall have the entire management and superintendence over the affairs concerns and property thereof, subject to tho statutes and regulations ot the University.(a)

16. Nothing in the last preceding section shall be deemed either to restrict tho power of the University to make any statute or regulation for the good government thereof or to impose upon tho council any duty inconsistent with any such statute or regulation.

(a) At a visitation held at the University on 16th July, 1871, by His Excellency Viscount Canterbury as visitor, assisted by Molesworth, J., the visitor said, " I think that the words 'subject to the statutes and regulations of the said University* apply to the whole of the powers vested in the council by this section, and I am of opinion, therefore, it must be held that the founder contemplated the enactment, by the constituted authorities, of statutes or regula­tions which would be binding on the council in the exercise by them of any or all of the powers thus vested in them. In the absence of any statute or regulation to the contrary, the council may exercise, according to their discretion, all the powers vested in them by this section."—See 2 A.J.R., 91.

, the regulation of these stipends they could not be regulated at all. But while I am of opinion that it is competent for the constituted authorities to regulate by statute the number, stipend, and manner of appointment and dismissal of the professors as well as of the other officers of the University, I do not think that the words ' shall have full power' at the commencement of the 7th section of the Act by themselves render it absolutely imperative on those in whom the power of making statutes or regulations is thus vested to exercise that power. And I am of opinion that, in the absence of any statute or regulation to the contrary, the council may exercise, according to their discretion, all the powers vested in them by the 6th section of the Act."—See 2 A.J.R., 91.

(d) By the visitor (ubi supra) :—" I cannot discover in the Act of incorporation any provision investing the council and senate with equal authority on any one subject or any sign that it was •the intention of the founder that this equality should exist; on the contrary, it is, I think, clear that by the Act of incorporation •executive and administrative functions are vested in the council alone. The exercise by the council of their executive and admini­strative powers is controlled or controllable by the University statutes (made or to be made) as well as, of course, by the law of Victoria, and in passing such statutes the senate has a voice. But the legislative powers vested in the senate arc not co-ordinate with those of the council; for it is for the council to frame and initiate •every statute, while the power of the senate is limited to the accept-

23. (1) There shall be a standing committee of convocation (hereinafter referred to as " the stand­ing committee") consisting of the warden of con­vocation ex officio and not less than forty other persons who are members of convocation:

Provided tha t no member of the coun­cil and that no member of the teaching staff or other officer of tho University whoso sole or principal employment is in connection with his duties as such shall be a member of the standing com­mittee: Provided further that if any memiber of the standing committee is elected or appointed to be a member of the council or is appointed to be a member of the teaching staff or other such officer as aforesaid his office as a member ot the standing committee shall become vacant.

(2) Subject to this Act— (a) the elective members of the standing com­

mittee shall be elected by convocation; and

(ft) the elections shall be conducted in accord­ance with statutes or regulations of the University.

(3) Such statutes or regulations may provide for voting by post and for preferential voting or for proportional representation where the principle of propfoTtional representation is applicable.

(4) The council may from time to time in ac­cordance with statutes of tho University deter­mine—

(a) the number of members of the standing committee to be elected;

(6) how the several clases of graduates are to be represented theron whether separate­ly or by grouping together two or more classes; and

(c) the number of members to be elected as representing each class or group of

(ii) the council again submits the same to tho standing committee with or with­out any amendments made by the stand­ing committee and the standing com­mittee fails to approve the same or returns the same to the council with amendments to which the council does not agree—

(4) For the purposes of this section the date of the submission of any proposal to any faculty or to the professorial board shall be the date on which the same is received by the dean of the faculty or the president ot the professorial board (as the case may be).

31. All statutes and regulations made pursuant to this Act shall be reduced to writing, and the common seal of the University having been affixed thereto shall be submitted to the Gover­nor to be allowed and countersigned by h im; and if so allowed and countersigned shall be binding upon all persons members of the University and upon all candidates for degrees to be conferred by the same; and the production of a verified copy of any such statutes aud regulations under t i e said seal sliall be sufficient evidence of the authenticity of the same in all courts of justice and before persons acting judicially.

issued and applied out ot the consolidated revenue (which is hereby to the necessary extent appro­priated accordingly) and be paid to the Univer­sity tho sum of #Forty-flve thousand pounds as a fund for maintaining the University, and for defraying the several stipends which may be appointed to be paid to thef several professors officers and servants to be appointed by such University, and for defraying the expenses of such fellowships scholarships prizes and exhibi­tions as are awarded for the encouragement of students in tho University, and for providing a library for the same, and for discharging all necessary charges connected with the manage­ment thereof.

(2) Where any responsible Minister of the Crown desires. tha t ,any investigation be made by mem­bers of the teaching staff of the University such investigation shall be made and upon such terms

35. The Council shall in every year include in its annual report to the Governor a full and separate account of the income and expenditure under the last preceding section and a detailed statement of the manner in which the provisions of the said section have been carried into effect.

36. (1) There shall be established and kept by the council a fund to be called the University Students Loan Fund (hereinafter referred to as " the said fund.").

(2) In addition to any money already credited to or paid into the said fund there shall be credited to or paid into (as the case may be) the said fund—

(a) from the consolidated revenue (which ia hereby to the necessary extent appro­priated accordingly) in each financial

Division .—Trust Property. 37. (1) Where trust property constituting the

endowment of any scholarship, exhibition or priae awarded by the University or constituting any other endowment of the University is held by trustees other than the body politic and corporate of the University itself (hereinafter referred to aa " the corporation") the person having power to appoint new trustees may by deed appoint the corporation to be the custodian trustee of the t rust property.

(2) The power to appoint the corporation to be custodian trustee may be exercised whether or not the number ot trustees has been reduced below the original number.

(3) Upon every such appointment being made the following provisions shall have effect: —

(f) The power of appointing new trustees, when exercisable by the trustees, shall be exercisable by the managing trustees alone, but the corporation when so ap­pointed as aforesaid shall have the same power of applying to the court foi the appointment of a new trustee as any other trustee; and

{g) In determining the number of trustees for the purposes of the Trusts Act 1928 the corporation shall not be reckoned as a trustee.

(4) The corporation shall not be appointed as custodian trustee where tho will settlement or other instrument creating the trust contains a direction to the contrary.

(5) This section applies whether the t rust was created before or after the passing of this Act.

Division -I.—Audit.

38. (1) The council shall arrange for a con­tinuous audit ot the income and expenditure of the University and such audit shall be made a t such intervals not exceeding one month as the Governor directs.

(2) There shall be an annual audit of the ac­counts of the University made by the Auditor-General.

(3) The following provisions shall apply to the annual audi t : —

(o) The Auditor-General shall have with re­spect to tho accounts of the University all the powers conferred on him by any law relating to the audit of the public accounts;

(6) The University shall pay into the con­solidated revenue a t the Treasury in Melbourne, an amount to be determined by the Auditor-General to- defray the costs and expenses of the audit and the remuneration of the officers of the Auditor-General engaged in the audi t ;

Section 3.

41. Every student being an undergraduate shall during such terms of residence as the UniTersity may by statute appoint dwell with hia parent or guardian, or with some near relative or friend selected by his parent or guardian and approved by the chancellor or vice-chancellor, or in some collegiate or educational establishment affiliated to or in connection with the University, or in a boarding-house licensed as aforesaid.(<0

42. No election or appointment under this Act shall be deemed to be invalid by reason only of such election or appointment being made sub­sequently to the time provided for in this Act; and any person so elected or appointed shall be entitled to continue in the office to which he is eo elected or appointed as if he had been elected or appointed thereto at such time.

43. The oouncil shall in every year report the proceedings of the University during the previous year to the Governor; and such report shall con­tain a full account of the income and expenditure of the University audited as provided in this Act; and a copy of every such report and of all the statutes and regulations of the University al­lowed aa aforesaid by the Governor shall be laid in each year before the Legislative Oouncil and the Legislative Assembly. 44. The Governor shall be the visitor of the said University, and shall have authority to do all things which appertain to visitors as often as to him seems meet.

3. (2) Each of tbe said annual payments shall be paid to the University and be applied by the University—

1. (1) This Act may be cited as the University Act 1933 and shall be read and construed as one with the University Act 1928 (hereinafter called the Principal Act) and the Act and enactment amending the same which Acts and enactment aud this Act may be cited together as the Uni­versity Acts.

Commencement. *(2) This Act shall conic into operation on a day to be fixed by proclamation ot the Governor in Oouncil published in the Government Gazette.
