    FIRST FINANCIAL BANK ATM and VISA® DEBIT CARD

    TERMS and CONDITIONS

    EFFECTIVE MAY 1, 2018

    The following Terms govern any Card, as defined below, issued by First Financial Bank. “You,” “your” and “yours” individually and jointly refer to the Account Holder(s) and anyone who uses the Card with your permission. “We,” “our,” “us,” “First Financial Bank” and “Bank” means First Financial Bank and its successors and assignees. The initial use, signing or other acceptance of the Card by you, any other person to whom a Card has been issued on your behalf, or by any other person you authorize or permit to use the Card constitutes acceptance of the following Terms & Conditions. These Terms supplement your Account Terms and Conditions, including the section titled Electronic Fund Transfers-Your Rights and Responsibilities, and your Special Handling/Electronic Banking Disclosure of Charges.

    1. DEFINITIONS

    In the following disclosures, these words are used often and are defined as follows: a. Account refers to the individual or joint Checking Account or Savings Account to which

    a Card is linked. b. Account Terms and Conditions refers to the document outlining the responsibilities

    and obligations related to the Account and is provided to you at the time you open your Account.

    c. Account Holder is a natural person(s) or legal entity in whose name the account is maintained on the Bank’s records. A person who is designated by an Account Holder to act on that Account Holder’s behalf is not an Account Holder, but has the authority of the Account Holder. The Account Holder will be bound by the acts of that representative. Account Holders that are legal entities, including but not limited to corporations, limited liability companies, partnerships, estates and trusts, are not natural persons, and can only act through designated representatives. In such cases, it is the legal entity that is the Account Holder.

    d. ACH means the Automated Clearing House used by the Bank. e. ATM means any Automated Teller Machine, whether in the United States or overseas,

    whether of Bank or a specified shared network, at which, amongst other things, you can use your Card to access your funds in your Account(s).

    f. Authorized Hold means a temporary hold placed against some or all of the funds in your Checking Account when we authorize a Card transaction from a merchant.

    g. Authorized User means you and any other person you authorize or permit to use the Card.

    h. Available Balance is defined as set forth in Section 8. i. Bank Affiliate shall mean any one or more direct or indirect subsidiaries of First

    Financial Bank and its successors and assigns. j. Card shall mean every type of ATM card and every type of card which is also a Visa

    Debit Card that we may periodically issue to you with the exception of prepaid cards. k. Checking Account is a deposit account that may or may not bear interest.

    l. Electronic Terminal or EFT Terminal means an electronic device, other than a telephone operated by a consumer, through which a consumer may initiate an Electronic Fund Transfer (EFT). The term includes, but is not limited to, point-of-sale (POS) terminals, ATMs, and cash dispensing transactions.

    m. Foreign Transaction means a transaction that occurs or is submitted to us from outside the United States of America.

    n. HSA is a Health Savings Account as defined by the Internal Revenue Code, 26 U.S.C. Section 223 et. seq.

    o. Mobile Device means a smartphone, tablet, or any other hand held or wearable communication device that allows you to electronically store or electronically present your Card or Card number (“Digital Card Number”) and you can use that Digital Card Number to make Card transactions or service your Account.

    p. Online Banking means a service that allows you to have access to the Account by using any personal computer or Mobile Device that has access to the internet.

    q. Overdraft Protection is defined as set forth in your Account Terms and Conditions.

    r. PIN means a Personal Identification Number. s. Savings Account is an interest-bearing deposit account, and has a limitation of 6

    transactions or withdraws that can occur in a month’s time period. t. Service means a telephone banking, internet, access product or point-of-sale service. u. Special Handling/Electronic Banking Disclosure of Charges refers to the

    document outlining the fees and other related charges related to your Account and provided to you at the time you open your account.

    v. Visa means Visa, Inc.

    2. YOUR RESPONSIBILITY AND AGREEMENT TO PAY You assume responsibility for all transactions arising from authorized use of the Card by any Authorized User regardless of means of access. If you have authorized another person to use the Card in any manner, that authorization shall be deemed to include the authorization to make withdrawals or transfers of funds to or from the Account, and such authorization shall be deemed to continue until you have taken all steps necessary to revoke it by preventing such use by that person, including, without limitation, notifying the Authorized User and contacting us to inform us that the Authorized User is no longer authorized. Use of the Card via PIN with an ATM allows the Authorized User access to all associated Accounts, including Savings Accounts.

    We will issue to you a Card for your use only. You will be assigned a PIN. At no time should you reveal your PIN to another or make it available, directly or indirectly, to any other person. When you receive your PIN, memorize it. Do not write it on your Card. Destroy any written record of your PIN.

    3. USE OF CARD

    You can use your Card to make purchases, payments, or use your Card at ATMs, as further explained below. The types of transactions you may make and relevant limitations may differ depending on the type of Checking Account(s) or Savings Account(s) you have with us, and where the transactions are made. The amount of each purchase or payment, including any cash withdraws, will be deducted from your Checking Account. You agree that we may hold funds representing purchases or bill payments authorized until posted to your Checking Account.

    a. Purchases. (i) For Cards attached to Checking Account(s) you may purchase goods

    or services from merchants that accept the card. You can also request cash back when you make a purchase using your PIN with merchants who offer this service. (ii) If your Card is linked to an HSA your Card should only be used for purchases of qualified medical expenses as allowed by the Internal Revenue Code.

    b. Payments. You can pay bills directly to merchants using your Card, from your Checking Account(s). If you use the Card to pay bills, and we approve such use of the Card, you agree to the transfer of money in the Account to the accounts of the third parties you designate. Such transfer will be made upon your instructions by use of a telephone, Mobile Device, or other means acceptable to us. You agree to allow a reasonable period of time (at least five (5) business days) for a third party to receive the payment. You agree that we will not be liable for any delays caused by mail service or any third party. In no case will we be liable for any interest or late payment charges assessed by a third party or termination of a service caused by a delay in a third party’s receiving or processing a payment. You agree to notify us of any change in your address or account with a third party, including change of account number.

    c. ATMs. Your Card can be used at any First Financial Bank ATM to withdraw cash, view Account balances, make cash or check deposits to accounts, transfer funds between Accounts, or make a balance inquiry. You may use your Card at non-First Financial Bank ATMs; however, you may also be charged a foreign ATM fee by the ATM provider in addition to any fee charged by us. Your Card may be limited to your Available Balance, or the daily transaction limits for ATMs as set forth in your Account Terms and Conditions. Fees for these services are set forth in the Special Handling/Electronic Banking Disclosure of Charges provided to you at Account opening.

    d. Mobile Devices. You may use your Card to access your Checking Account(s) through a Mobile Device with merchants who accept mobile payments. When you use your Card with your Mobile Device mobile carriers may charge you message and data rates, or other fees. Your Card information is sent across wireless and computer networks, and information about your Mobile Device may be transmitted to us or others, such as merchants. You should secure your Mobile Device, and we encourage you to password protect or lock your Mobile Device to help prevent unauthorized use.

    e. Foreign Transactions. Any transactions in a foreign currency will be converted into U.S. dollars using an exchange rate for the applicable central processing date.

    f. Illegal Transactions and Internet Gambling. You must not use your Card or Account for any illegal purpose or internet gambling. You must not use your Card or Account to fund any account that is set up to facilitate internet gambling. We may deny transactions or authorizations from merchants who are apparently engaged in or who are identified as engaged in the internet gambling business.

    g. EFTs. EFTs are governed as set forth in your Account Terms and Conditions.

    4. CANCELLATION AND TERMINATION You may cancel your Card(s) by notifying us in writing and physically surrendering the Card(s) to terminate this Card Agreement. Your termination will be effective once any and all Card(s) issued on the Account have been closed. However, this Card Agreement shall remain in effect for purchases made, and services rendered prior to termination. This liability will be joint and several. We may cancel the Card at any time without notice. If we do, you will surrender the Card(s) immediately upon our request or the request of our agent. We reserve the right to refuse or terminate your use of the Card in our sole discretion at any time.

    5. DISCLOSING INFORMATION Generally, we will not disclose information about your Account, but we may do so in the following situations: a. To comply with a statute, regulation, or rule. b. In any legal process, including subpoena, search warrant, or other order of a

    government agency or court. c. In connection with examinations by state and federal banking authorities. d. If we need to disclose information to complete a transaction. e. To verify the existence and condition of your Account for a third party, such as a

    merchant or credit bureau. f. To provide information to the legal representative or successor of a deceased co-

    owner for the period during which the deceased had an interest in your Account. g. To report the involuntary closure of your Account. h. When disclosure is necessary to protect you, your Account, or our interests. i. If you give us your permission. j. To our agents, independent contractors, and other representatives who service or

    process your Account transactions, or for similar purposes. k. To a Bank Affiliate and to unaffiliated third parties in accordance with our Privacy

    Policy disclosure.

    6. GOVERNING LAW The laws of the United States and the laws of Ohio govern this agreement regardless of your place of residence. This card is issued under the laws of the United States and the laws of Ohio, without regard to Ohio’s conflicts of law provisions.

    7. FEES FOR USING YOUR CARD

    The fees and charges for your Card are outlined on the Special Handling/ Electronic Banking Disclosure of Charges document provided to you at the time you opened your Account(s). The Special Handling/Electronic Banking Disclosure of Charges may be updated from time to time, but you will be given notice in accordance with your Account Terms and Conditions. The Special Handling/Electronic Banking Disclosure of Charges is available in our branches, on our website at www.bankatfirst.com, and by calling our Customer Service Center at 877-322-9530.

    8. AVAILABLE BALANCE

    a. Definition. Your Available Balance is the most current record we have about funds that are available for withdrawal from your Checking Account(s), does not include your outstanding checks and your scheduled bill payments, or other transactions that have not yet been paid from the Account. Additionally, funds on hold from an Authorization Hold will be subtracted from your Available Balance. Your Available Balance may include deposits still subject to verification or collection by us.

    b. Limits. You may use your Card as often as you want every day as long you stay within your daily ATM limit and daily purchase limit as set forth in your Account Terms and Conditions, and you have sufficient Available Balance in your Account(s) used for withdrawal.

    9. LOST OR STOLEN CARDS; UNAUTHORIZED USE

    a. Authorizations. When we approve a transaction or purchase, we call that an “authorization.” We may limit the number of authorizations we allow during a period of time (e.g., If we notice out-of-pattern use of your Card, suspected fraudulent or unlawful activity, or internet gambling). For security reasons, we cannot explain the details of the authorization system. If we do not authorize the payment, we may notify the person who attempted the payment that has been refused. We will not be responsible for failing to give an authorization. You agree to notify the Bank promptly in writing to the address provided below of any Authorized User who is no longer authorized on your behalf.

    b. Lost or Stolen Cards and Visa Zero Liability Policy. Please reference your Account Terms and Conditions, for how to report lost and stolen cards, and for your liability and limits thereto. To notify us of a lost or stolen card our contact information is listed in Section 11 below.

    c. Investigation and Prosecution. You agree to assist the Bank in the investigation and prosecution of claims for unauthorized transactions by completing the appropriate statements and reports reasonable requested by the Bank.

    d. Visa Account Updater Service (“VAU”). If you give your Card number to a merchant with authorization to bill for recurring payments, and your Card number or expiration date changes, you should notify the merchant with your new Card information. We subscribe to the Visa Account Updater (“VAU”) Service and provide updated Card information to the VAU Service. If a merchant participates in the VAU Service, that merchant may receive the updated Card information.

    10. BANK’S LIABILITY

    a. Merchant Disputes. Except as may be prohibited by law or regulation, we will not be liable for any claims, defenses, rights and offsets you now or hereafter may have against any merchant or other payee for merchandise or for services acquired via the Card.

    b. ATM and EFT Terminal Malfunctions. We are not responsible for damages resulting from an ATM or merchant terminal malfunction. You will promptly notify us if a First Financial Bank ATM fails to dispense the correct amount of cash or provide a receipt, by calling or writing us at the telephone number or address provided on your Account statement.

    c. Failure to Make Transfers. If we do not complete a transfer to or from your Checking Account on time or in the correct amount according to these Terms (and, as applicable, pursuant to the Account Terms and Conditions), we will be liable for your losses or damages. However, there are some exceptions, and we will not be liable, for instance:

    i. If, through no fault of ours, you do not have enough money in your account to make the transfer;

    ii. If the transfer would go over the credit limit on any Overdraft Protection product(s); iii. If the EFT Terminal where you are making the withdrawal does not have enough

    cash; iv. If the EFT Terminal or system was not working properly and you knew about the

    breakdown when you started the transfer; v. If the circumstances beyond our control (such as fire or flood) prevent the transfer,

    despite reasonable precautions that we have taken; or vi. If the transaction falls within an exception stated herein or another agreement we

    have with you.
