Located 47 km south of Adelaide, Willunga is an historic township which was established only 3 years after thesettlement of South Australia. Purchasing Tips

Private Treaty: This simply means the property is for sale with a price or price range. The emphasis in on private,so rest assured if you are interested in making an offer, it will remain strictly confidential. Unconditional offer: This is the most enticing offer to vendors, effectively meaning you are ready to purchasenow with a cash unconditional offer. Conditional offer: This is when you offer to buy the property, only if certain conditions are accepted by thevendor. These must be listed on the contract. For example, your offer may be conditional on arranging finance.If finance cannot be arranged within a certain period of time, the offer becomes void. Another condition mightbe an extension of the settlement period or subject to the sale of your own property by a certain date. Whateverthe conditions you set, if the seller does not accept the conditions, further negotiation may take place or theoffer may simply be declined. The fewer and more reasonable your conditions, the stronger your offer mayappear compared to any other offers the vendor may receive. Finance: This is the most common condition in a contract. You will need to stipulate your lender and their details,the amount you are seeking to borrow, and basic terms. 2 weeks is the typical timeframe stipulated to gain loanapproval. Subject to settlement: This is a great condition if your own contract of sale is unconditional, or, in other words, allthe conditions of your own sale have been satisfied. Ensure you are clear on the actual status of your contract. Subject to sale: This is often a needed condition, but possible the least desirable for a vendor. Still, depending onthe vendor’s timeframe and situation, they may consent to that condition, especially if the offer is higher. Building and pest inspections: Most purchasers choose to have inspections done during the cooling off periodto make their offer more attractive. If you are uncomfortable with that timeframe, you can request a longerperiod be written into the contract. It is important to have a balanced view on inspections, remember thecontractor is being paid to find faults. Every property, even brand new ones are not perfect, but it’s importantyou are aware of any serious problems. Contract of sale: When your offer on the sales contract is accepted by the seller and signed, the contract iscomplete. Vendors have no cooling off rights.

Cooling off: This is also known as the vendor statement or form 1 and is served to the purchaser after thecontract is signed. At this point the purchaser has a cooling off period of 2 clear business days during which theycan decide to withdraw from the sale by advising the vendor or agent in writing before the period expires. Deposit: This is usually paid the next business day at the expiration of the cooling off period by EFT. Insurance: From contract onwards, you will require a cover note, as you have an “equitable interest” in theproperty. Ensure you have taken out a policy prior to cooling off expiring. Settlement date: This will have been negotiated on the contract. Settlement occurs at the lands title officearound midday, and you will be represented by your conveyancer. The agent can legally only release the keysto the purchaser once settlement has been confirmed. Crack open the champagne.
