This handbook has been created to tell you about Sweet Treats Bakery and our policies,regulations, and benefits. Employment at Wil l Agreement

YouremploymentwithSweetTreatsBakeryisat-will.Althoughwehopethatyouremploymenthere will be mutually rewarding, both you and Sweet Treats retain the right to end theemploymentrelationshipatanytimeandforanyreason,orfornoreason.

Background Checks

Inaneffort toguarantee thatprospectiveSweetTreatsemployeesarecapable to fulfill theirpositionandtoencourageasafeenvironmentatSweetTreatsBakery,wemaintaintherighttoconduct pre-employment background checks on all applicants regardless of position appliedfor.Alljoboffersarecontingentonthedeliveryofabackgroundcheckreport.

BackgroundcheckswillbeperformedincompliancewiththeFederalFairCreditReportingAct,Americans with Disabilities Act, and all other state or federal privacy and antidiscriminationlawsor acts. Included in thebackground checkwill be any criminal historyof said applicant;evidence of a criminal conviction does not, however, routinely ban employment. Additionalchecksmaybemadeonapplicantsiffittingandnecessarytothejob.

Sweet Treats also reserves the right to conduct background checks on current employees inpromotionalorreassigningsituationsincompliancewiththeconditionsabove.

Personal Conduct

HereatSweetTreatsBakery,webelievethatthereisaverystrongconnectionbetweencleanlinessandjobperformance.Personalhygieneisamustwhenworkinginthefood-serviceindustry.Goodpersonalhygieneincludes,butisnotlimitedto:properlycleanedandtrimmednails,hands,andteeth.Workclothingmustbefreeofholes.Thereabsolutelywillbenoopentoedorclogtypeshoesworn,andyoumustwearsocksatalltimes.Nopiercingsthatarevisibletocustomerswillbeallowed.

Employees Under 18 Years Old

Disclaimer:Aworkpermitmustbeobtainedforallemployeesundertheageof18.FederalandStateChildLaborLawsstate thatemployeesunder theageof18are strictlyprohibited fromoperatingcertaintypesofkitchenequipmentanddevices.Youwillbetrainedaccordingly.

Trial Period

Therewill be a 90-day evaluation period starting on your first day ofwork. This trial periodallowsustoassessyourwillingnessandabilitytocarryouttheessentialfunctionsrequiredforyourhiredposition. If it is foundthatyouareunabletofulfill theessential functions listed inyour jobdescriptionwithreasonableaccommodation,wereservetherighttoterminateyouremploymentatanypointasdiscussedintheemploymentatwillagreement.

Orientation Period and Training

AsSweetTreats’newestemployee,werecognizeyourpotentialforsuccessinourcompanyandwill work toward your success throughout the first few weeks of your employment, or theorientationperiod.Thereisnospecifiedallotmentoftimefortheorientationperiod.Weallowall new employees the time they need to find their feet in the bakery; historically, theorientationperiodhastakennolongerthanamonth.ThistimeenablestheManagementteamtogettoknowyoubetterandseehowyouassimilatetoyournewworkenvironmentandthepeopleyouwillbeworkingwith.Italsoallowsyoutobecomemorefamiliarwiththecompanyandhowweoperate.

Duringtheorientationperiod,youwillbetrainedbyaManagerorco-workerskilledintheareayouwillbeworkingin.Youwillalsobegivenatraininghandbookwhichwillcontainalloftheresponsibilities associated with your position. Be aware that training is not exclusive to theorientation period and you should expect to receive continuous training throughout youremployment.Ifyoufeelyoudonotunderstandwhatisexpectedofyou,weencourageyoutocommunicateyourconcernswithyourtrainerinordertoreceiveadditionaltrainingifneeded.

Uniforms

AllemployeesarerequiredtoweartheirSweetTreatsBakeryshirtdistributedduringfirstshiftworkedandappropriatebottoms(longjeansorkhakis)whenontheclock.Additionalshirtsmaybepurchasedfor$5.00fromanyManageratanytime.

Ifworkinginthekitchen,youwillberequiredtowearanapron,rubberglovesandhairnet–allprovided–wheneverhandlingfood.

On the Clock

Employeesarepaidhourlyandit isyourresponsibilitytopunchyourtimecardinandoutforeveryshift thatyouwork.Punching inearly isnotpermittedandwillnotbeacceptedunlessyou are asked to start your shift early by the Manager on duty. Tardiness also will not betolerated.Neverpunchinoroutforanyonebutyourself.Failuretofollowtheclockinginandoutpolicieswillbeconsideredfraudulentbehaviorandimmediateterminationmayoccur.

Employee Meetings

Occasionally,generalstaffmeetingswillbecalled.YouabsolutelyMUSTattendthesemeetings.Ifyoucannotforalegitimatereason,pleaseletyourManagerknowassoonaspossible.IfyoufailtoletyourManagerknow,disciplinaryactionsmaybetaken.

Attendance and Punctual ity

Sickleavemaybeusedinthecaseofanemergencyorsuddenillness.Patternsofabsenteeismortardinessmayresultindisciplineeveniftheemployeehasnotyetexhaustedavailablepaidtimeoff.AbsencesduetoillnessesorinjuriesthatqualifyundertheFamilyandMedicalLeaveAct (FMLA) will not be counted against an employee’s attendance record. Please see thesectionaboutFMLAformoreinformationonhowtoqualify.MedicaldocumentationwithintheguidelinesoftheFMLAmayberequiredintheseinstances.

NotshowingupforworkandnotcallingtoletyourManagerknowyouwillbeabsentisano-call/no-showandisaseriousmatter.Thefirstoccurrenceofanocall/noshowwillresult inawrittenwarning.Thesecondseparateviolationmayresultinterminationofemployment.Anocall/noshowlastingthreedaysmaybeconsidered jobabandonmentandmaybedeemedanemployee’svoluntaryresignationofemployment.

Schedules/Calling in Sick

TheschedulingatSweetTreatsBakerywillbedoneweekly.Priortoeachweek,yourManagerwillpostalistaskingforyourworkschedulerequests.Pleasegetallofyourrequestsinassoonaspossible.Whilewewilltrytoaccommodateallrequests,pleaseunderstandwemaynotbeabletodoso.Requestswillbedealtwithonafirstcomefirstservebasis.Ifyoudonotgetyourworkrequestsinbeforescheduling,yourrequestswillmostlylikelynotbegranted.Employeesshouldbeavailabletoworkholidays,breaks,andspecialevents.Specialcircumstanceswillbedealtwithonacase-by-casebasis.

Whentheschedulehasbeenposted,itbecomesofficialfortheweek.Ifyouareinneedoftimeoff,itisyourresponsibilitytocoveryourshift.Yoursupervisormustapprovethesechanges.Ifyouaresickandunabletofindsomeonetocoveryourshift,youmustcallthemanagerondutyatleast3hoursinadvance.Pleasenotethatabsencesandtardinesswillberecordedineachemployee’spersonnelfile.

Promotions

SweetTreatsBakerytriestopromotefromwithincurrentemployeesbeforelookingelsewhere.Ifyouhappentobe interested inanotherposition,pleasetalk toaManager.Promotionsarestrictly based on one’s skills, knowledge, and abilities set forth by Management. Service,attitude,andloyaltywillalsobeconsidered.Pleasenote,promotionsarenotstrictlybasedonlengthofemploymentaloneandarenotjusthandedout.

Wage and Overtime Payment

Paymentofwageswillbeperformedbi-weeklyforanywagesearneduptoaweekbeforethepaydate.Bi-weeklypaydaysareeveryotherFriday.Anyovertimeearnedwithinapayperiod,whichwillbecombinedwithanyregularwagepayments,willalsobepaidbi-weekly.Overtimeconsistsofanyhoursworkedover40inasingleweek.Payforovertimewillconsistof1.5timesoverregularwage.

Accordingtocompanypolicy,employeepaycheckswillonlybepersonallygivenfromManagertoemployeeormailedtotheirdirectaddress.Toensurepersonalsecurity,therewillbenoexceptionstothispolicy.

Payrol l Deductions

Thefollowingrepresentsthesortsofdeductionsyouwillnoticeonyourpaycheckstubsandtaxstatements:

• Federalincometaxes• Stateincometaxes• Socialsecuritytaxes• Medicaretaxes

Tips

Tocomplywiththefriendlyandcustomer-committedenvironmentwepromoteatSweetTreatsBakery,tipswillnotbesolicitedduringoperatinghoursorduringanytransactions.Solicitationincludesbutisnotlimitedtopresentingatipjarattheregister,postingasigntellingthatweaccepttips,etc.Shouldacustomerverballyexpressadesiretotipyouoraco-workerwithoutyoursolicitation,youmayacceptbeforepromptlystoringsaidtipoutofcustomer’sview.

Meals/Rest Periods

Youareentitled toa50%discountonall foodpurchased foreveryshiftyouwork.Thismealmustbetakenonehourbeforeyouwork,duringaManager-designatedbreak,orwithinonehourafteryourshift.Thismealmustbeonlyforyou.Youmaynotpurchasefoodforfriendsorfamilywithyouremployeediscount.However,youmaytakefood-to-goafteryoushiftisover.Employeesareallowedfreesodaorwaterduringtheirshift.

Safety

ItistheresponsibilityofeachSweetTreatsBakeryemployeetoconductalltasksinasafeandeffectivemannercomplyingwithalllocal,stateandfederalsafetyandhealthregulations.

Everyemployeehastheresponsibilitytolearntheemergencyplanforhis/herarea.Eachfacilitywillhaveanemergencyplandetailingproceduresinhandlingemergenciessuchasfire,weather-relatedeventsandmedicalcrisespostedneareachexit.

ItistheresponsibilityoftheemployeetocompleteanAccidentandIncidentReportforeachsafetyandhealthviolationthatoccursbyanemployeeorthattheemployeewitnesses.Failuretoreportsuchaninfractionmayresultindisciplinaryaction.

Managementrequiresthateverypersonassumetheresponsibilityofindividualandorganizationalsafety.Failuretoabidebycompanysafetyandhealthguidelinesorengaginginbehaviorthatplacestheemployee,customerorcompanypropertyatriskcanleadtoemployeedisciplinaryactionand/ortermination.

TheHealthandSafetyCommitteeandthesafetydirectorhavetheresponsibilityandauthoritytoimplementthesafetyandhealthprogramintheinterestofasaferworkenvironment.

Vacations

Allfull-timeemployeesareeligibleforvacationtime.Vacationtimeaccrualbeginsthefirstdayofemployment,andcanonlybeusedsubsequenttobeingaccruedfromhoursworked.Pleasesubmitallvacationrequestsatleast3weekspriortorequestedvacation.Requestsarenotguaranteedtobegranted–SweetTreatsBakerymustbeabletooperatesmoothlythusrequestswillbeacceptedgiventhatstaffingrequirementscanbemetatthattime.Vacationtimerequestswillbereturnedwithin4daysfromManagement.Vacationwillbepaidattheemployeescurrentwagerateandwillnotincludeovertimepay.

Family and Medical Leave Act of 1993 (FMLA)

The FMLA entitles eligible employees job-protected leave for specified family and medicalreasons with continuation of group health insurance coverage under the same terms andconditionsasiftheemployeehadnottakenleave.In the state of Wisconsin, eligible employees are entitled to up to 6 weeks of leave in acalendaryearforthebirthoradoptionofachild,upto2weeksofleaveinacalendaryearforthecareofachild, spouse,parent,domesticpartner,orparentofadomesticpartnerwithaserioushealthconditionandupto2weeksofleaveinacalendaryearfortheemployee'sownserioushealthcondition.Federally,eligibleemployeesareentitledtotwelveworkweeksof leaveina12-monthperiodfor:• thebirthofachildandtocareforthenewbornchildwithinoneyearofbirth;• theplacementwiththeemployeeofachildforadoptionorfostercareandtocareforthe

newlyplacedchildwithinoneyearofplacement;• tocarefortheemployee’sspouse,child,orparentwhohasaserioushealthcondition;• a serious health condition that makes the employee unable to perform the essential

functionsofhisorherjob;• anyqualifyingexigencyarisingoutofthefactthattheemployee’sspouse,son,daughter,

orparentisacoveredmilitarymemberon“coveredactiveduty;”orTwenty-six workweeks of leave during one 12-month period to care for a covered servicememberwithaseriousinjuryorillnessiftheeligibleemployeeistheservicemember’sspouse,son,daughter,parent,ornextofkin.

Military Leave

WehereatSweetTreatsBakerysupportandappreciatethecontributionsofouremployeeswhoactivelyparticipateintheuniformedservices.SweetTreatswillprovideleavetobothfullandparttimeemployeeswhoareorderedtomilitarydutytotheextentrequiredbyfederalandstatelaw.PleaseletyourManagerknowassoonaspossible,whenyouareawareofsuchorders.Ifordersarenotavailableatthetimeofyourrequest,pleasepresentthemassoonastheybecomeavailable.

Bereavement Leave

Full-timeemployeesareallowedfourdaysbereavementleavepercalendaryear.Thiswillbeapaidleaveandwillonlybeissuedforthedeathofadirectfamilymember.Directfamilymembersinclude:spouse,parent,sibling,child,andgrandparent.

Harassment/Discrimination/Inappropriate Behavior

SweetTreatsBakeryhasazero-tolerancepolicyconcerningharassment.Ourgoalistoprovideemployeeswithasafeharassment-freeworkingenvironment.

Harassment is defined as any unwelcome act of physical or verbal nature. All forms ofharassment,sexualorotherwise,arestrictlyprohibitedandwillbedealtwithonacase-by-casebasis.

Drug-Free Workplace

SweetTreatsBakeryhasa time-honoredcommitment toprovideasafeandproductiveworkenvironment.Alcoholanddrugabuseareathreattothehealthandsafetyofemployeesandtothewell being of our business. For these reasons, Sweet Treats Bakery is committed to theremovalofdrugand/oralcoholuseandabuseintheworkplace.

Thispolicyidentifiesproceduresdesignedtocorrectinstancesofalcoholand/ordruguseintheworkplace. This policy applies to all employees and all applicants for employment of SweetTreatsBakery.

Employee Assistance and Drug Free Awareness

Illegaldruguseandalcoholabusehavemanyhealthandsafetyconsequences.Ifyouoranotheremployee needs more information on these health consequences you can as your HumanResourceDirectorformoreinformation.OurHumanResourceDepartmentistrainedonhowtoassistemployeeswithdrug/alcoholproblems.

Sweet Treats Bakery will assist and support employees who are seeking help for theirdrug/alcoholproblemsbeforedisciplinaryactionorterminationisrequired.SuchemployeesofSweet Treats Bakery may be allowed to use accrued time off, placed on leave of absence,referredtotreatmentproviders,andotherwiseaccommodatedbylaw.

Work Rules

Thefollowingrulesapplytoallemployees:

• Wheneveremployeesareworkingtheyareprohibitedfrom:o Using,possessing,buying,selling,manufacturingordispensinganillegaldrug(to

includepossessionofdrugparaphernalia).o Beingundertheinfluenceofalcoholoranillegaldrugasdefinedinthispolicy.o Thepresenceofanydetectableamountofany illegaldrugor illegal controlled

substanceinanemployee’sbodywhileperformingcompanybusinessorwhileinacompanyfacilityisprohibited.

o SweetTreatsBakerywillnotallowanyemployeetocometoworkwhiletakingprescribed drugs that are negatively affecting the employee’s ability to safelyand effectively perform their job duties. Employees taking a prescribedmedicationmustcarryitinthecontainerlabeledbyalicensedpharmacistorbepreparedtoproduceitifasked.

o Anyillegaldrugsordrugparaphernaliawillbeturnedovertoanappropriatelawenforcementagencyandmayresultincriminalprosecution.

Required Testing

SweetTreatsBakeryretainstherighttorequirethefollowingtests:

• Pre-employment:Allapplicantsarerequiredtopassadrugtestbeforeworking.A joboffer from Sweet Treats Bakery is contingent on the applicant passing the drug test.Refusing to take a drug test will result in disqualification of further employmentconsideration

• Reasonable Suspicion: All Sweet Treats Bakery employees are subject to drug testingbased on observations by a supervisor of obvious drug or alcohol use on the job,possession, or impairment. The Human Resource Department must be made awarebeforesubjectinganemployeeforreasonablesuspiciontesting.

Inspections

SweetTreatsBakeryreservestherighttoinspectallareasofthepropertyfordrugs,alcoholoranyothercontraband.Allemployeesandvisitorsmaybeaskedtocooperateintheseinspectionsoftheirpersons,workareasandpropertythatmightconcealdrugs,alcohol,orothercontrabanditems.Employeeswhopossesstheseitemsorrefusetocooperateinaninspectionaresubjecttoappropriatedisciplineuptoandincludingtermination.

Smoking and Tobacco

SweetTreatsBakeryisasmoke-freeandtobacco-freeestablishment.SmokebreaksmustfollowregularBreakPolicyGuidelines,takeplaceduringregularscheduledbreaks,andbetakenaminimumof10feetawayfromtheproperty.SmokinginyourSweetTreatsBakeryuniformisstrictlyprohibited.

Consequences

Applicants who refuse to cooperate in a drug test or who test positive will not be hired.Employees who refuse to cooperate in required tests or who use, possess, buy, sell,manufactureordispensean illegaldrug inviolationofthispolicywillbeterminated.Thefirsttimeanemployeetestspositiveforalcoholorillegaldruguseunderthispolicy,theresultwillbedisciplineuptoandincludingdischarge.

Complaint Procedure and Retal iation

Regarding discrimination and harassment complaints, it is the responsibility of employees toreport incidents to aManager promptly. His or her identitywill be kept confidential and noretaliationagainstpersonsinvolvedwillbeacceptedortolerated.Athoroughinvestigationwillbeconductedbasedonfacts,witnesses,andevidencebeforeanydisciplinaryactionsaretaken.

AllemployeefilesareconfidentiallyheldbyHumanResourcesandcanonlybeviewedbyManagementonaneed-to-knowbasis.

Personnelfilesaccesscangenerallybegrantedtocurrentemployeesuponathree-daywrittennoticerequest.HumanResourceswillreviewallfilespriortoaccess.Allcopiesoffiledocumentsmaynotberemovedfromthedepartment.

Ifrequiredbyduty,governmentrepresentativesorlawenforcementmaybegrantedaccesstofiles.

Foryoursafetyitisimperativethatwekeepourrecordsuptodate.PleasenotifyManagementassoonaspossibleifchangesaretooccurinanyoftheareaslistedbelow:

Discipl inary Procedures

Theseguidelineshavebeenputinplacetoactasameansofprotectionforyou,yourcoworkers,andpatronsofSweetTreatsBakery.Pleaseknowthatmanysituationswillbedealtwithonacase-by-casebasisandbedependentupontheseverityoftheviolation.Employeeswhoviolateanyofthefollowingregulationswillbedisciplinedaccordingly:

• VerbalWarning:Theissuewillbediscussedwithyouindividually,andyouwillbegiventhechancetocorrecttheproblembehavior.Failuretocorrectsaidbehaviororafutureincident(thesameoffenseordifferent)willresultimmediatelyinawrittenwarning.Allverbalwarningswillbedocumented,andputintoemployeepersonnelfiles.

• WrittenWarning:AsanemployeeofSweetTreatsBakery,youwillbegivennomorethanthreewrittenwarningswithinonecalendaryear.Ifadditionalincidentsoccurorfailuretocorrectaproblemafterthesecondwrittenwarningmayresultina1weeksuspensionordischarge.

• Discharge:Youmaybedischargedifyouhavereceivedatleasttwowrittenwarningsandathirdincidentoccurswithinonecalendaryear;orifyoufailtocooperateafterdisciplinaryactionshavebeentaken.

Termination of Employment

Inthecasethatyoumustvoluntarilyresignyouremployment,pleasehavethecourtesytogiveSweetTreatsBakeryatleastthecustomarytwo-weeknotice.ThisgivesusanopportunitytohireareplacementandminimizesdisruptiontoSweetTreatsandyourco-workers.WealsowouldlikeyoutoprovideyourManagerwithyourreasonforleavingandthelastdaythatyouareavailabletowork.Asstatedbefore,allpropertyofSweetTreatsBakerymustbereturnedonorbeforeyourlastdayofwork.

Return of Sweet Treats Property

IfaseparationbetweenSweetTreatsBakeryandanemployeeoccurs,theemployeemustsurrenderanyandallcompanypropertytotheManagerondutypromptlyaftertheirlastshift.Failuretodosowillresultinadeductionfromtheemployee’slastpaychecktoreplaceanypropertynotreturnedatseparation.

Ifemploymentisterminated,anyaccruedvacationtimethroughthelastdayofemploymentwillbepaidout.

General Information

Parking

ParkingislimitedtothelotconnectedwithSweetTreatsBakery.Ifyoumustdrive,pleaseparkinthefurthestspotsfromtheestablishment.Thisiscommoncourtesyforourcustomers.Duetothislackofparking,wedorecommendwalking,biking,carpooling,orusingpublictransportationinordertokeepthislimitedlotopen.

BicycleswillneedtobeparkedintheallocatedbikerackbackbehindSweetTreatsBakery.Bikesmustbetakenattheendofyourshift.Undernocircumstanceswillbikesbeallowedtobeparkedovernight.Bicyclelocksareagoodwaytoensurebikesafetywhileatwork.SweetTreatsisnotliableorresponsibleforbikesinthebikeracks.

Lost and Found

AnyitemsfoundinoroutsidethebakerybyanemployeeistobeturnedinimmediatelytotheManageronduty.Therewillbeasmallboxlocatedinthebackwherelostandfounditemswillbekept.ThisboxwillbegiventoGoodwillattheendofeachmonth.Three-daynoticewillbegivenpriortotheboxbeingdonated.

PersonalphonecallsarestrictlyprohibitedduringworkshiftsunlesspermissionfromtheManagerondutyhasbeengiven.Pagersandcellphoneuseisstrictlyprohibited.YoumayalsonotcarrythemwithyouwhileondutyunlesstheyarerequiredforyourpositionheldatSweetTreatsBakeryoryouhaveanemergency.

BoththetelevisionsandstereointheBakeryarefortheenjoymentofourcustomers.Theyareabsolutelynotforstaffviewingandlistening.Pleaseleaveboththetelevisionandstereoaloneatalltimes.Anystaffmemberwhoturnschannelsorturnsupthevolumewithoutpermissionwillbesubjecttodisciplinaryaction.PleaseconsulttheManagerondutyifyouneedassistancewitheitherthetelevisionorthestereo.

Packages

Pleaseleaveallpersonalitemsathome.Thisisabusinessandtoconductthebusinessproperly,wecan’thaveemployee’spersonalitemsontheground.Thiscanbecomeatrippinghazardanddoesnotlookprofessional.Allpackages,backpacks,orbundlescarriedintooroutoftherestaurantmaybesubjecttoexaminationatanytimebytheManageronduty.

Office

TherearetwosmallofficesforSweetTreatsBakery.Itisstrictlyforbusinesspurposesonlyandisabsolutelyofflimitstoallemployeesatalltimeswithoutpermission.

No Solicitation Policy

SweetTreatsemphasizesthispolicyinordertopreventunnecessarydisruptionsintheworkplace.Thesaleoftickets,solicitationofcontributions,oranytypeofsolicitationisstrictlyprohibited.TheonlyexceptiontothispolicyisifthesolicitationofcontributionsissponsoredorauthorizedbySweetTreatsBakery.
