    A. Legislation.Current environmental legislation affects all companies, having to be respected without exception. This framework is mandatoryindependently of whether or not an Environmental Management System is being implemented.

    B. Regulations.Environmental regulations assumed voluntarily by each company are articulated in the Environmental Management System.

    Environmental laws and regulations are mandatory andvoluntary, respectively, being applicable at any moment:

    Before any activity: prevention During the activity: control and correction. After the activity: monitoring and compensation of

    any environmental impact.

    According to the Spanish Constitution, the breach of environmental laws can lead to three types of legal responsibilities:

    a) Criminal liabilityb) Civil liabilityc) Administrative sanctions

    To these three types of responsibilities a 4th has been recently added:d) Environmental responsibility

    a) Criminal liability

    It is punitive or disciplinary and may lead to imprisonment (up to 4 years), monetary fines (maximum 216,000) and temporary or permanent shut down of the activity.

    Environmental crime is contained in Title XVI of the Spanish Penal Code:"Crimes relating to the planning and protection of the national heritage and environment".

    Punishable offenses: Extractions or Excavations, Landfills, Injections, Reservoirs Discharges, Emissions, Noises and vibrations, Radiation,

    Affected Areas: Soil and subsoil Surface water and groundwater Atmosphere

    b) Liability.

    It is reparatory, regulating the obligation of every individual to repair, restore or compensate damage and / or injury caused under an obligation that may arise from the law, contracts or pseudocontratos and unlawful acts or omissions (Article 1089 of the Civil code).

    Contractual liability: duty to indemnify and / or repair any damage due to a breach of contract. Tort: duty to indemnify and / or repair any damage due to breach of contract obligations without agreement or an unlawful act not punishable by law (most of the attacks on the environment). Vicarious liability (by business owners). Liability for criminal offense (associated with criminal liability).

    These are common elements essential to appreciate civil responsibility: action, unlawfulness, culpability and the causal link.

    c) Administrative responsibility.

    It is punitive or disciplinary, may lead to fines, imposition of corrective actions, suspension of activities and, in the extreme, the definitive closure of facilities (sentences of imprisonment not possible

    The Administrative Law typifies the sanctions and gives competences to public administrations to enforce them

    There are administrative sanctions in all provisions protecting the general issues related to the environment.

    In any case, the competent authority is subordinate to the judiciaryby contentious administrative channel.

    c) Environmental responsibility.

    It is preventative, avoidant and reparative, establishing the obligation by every operator to prevent and count on the means to repair the damage caused to the environment in the public domain. The guarantees necessary according to their activity must be provided.

    Law 26/2007 Environmental Responsibility:http://www.boe.es/buscar/doc.php?id=BOE-A-2007-18475 Source: transposition of Directive 2004/35 / EC, high environmental remediation costs incurred by the state in recent years and insufficient liability regime by not covering the public domain. Purpose: regulate the responsibility by operators to prevent, avoid and remedy environmental damage.

    It is a fundamental requirement of any work to comply with the law and to have all permits and authorizationsnecessary for full and proper development.

    There had been talk since the early 90s of an environmental voluntary framework: the introduction, on a voluntary basis, of environmental management systems by the companies, in order to increase their competitive advantage and appropiately address new challenges that may appear.

    The main rules that govern the voluntary framework for a companys environmental management activities are:

    International Standard ISO 14001. EU Regulation 761/2001, which enables organizations to voluntarily adhere to an eco-managed and audited community (EMAS II).

    The ultimate goal of the Environmental Management Systems (EMS) is the continued improvement of the entities environmental behavior.

    This role model should use feedback to achieve that continued improvement; its based on the methodology known as PDCA (Plan-Do-Check-Act).

    The success of this system depends on the commitment at every level of the company, specially senior management.

    A. Legislacin.La legislacin ambiental vigente afecta a todas las empresas, debiendoser cumplida sin excepcin. Este marco es obligatorio e independientedel hecho de tener implantado o no un Sistema de Gestin Ambiental.

    B. Normativa.La normativa ambiental asumida por cada empresa, con carctervoluntario, se articula en el Sistema de Gestin Ambiental.

    La legislacin y la normativa ambiental tienen para cada empresa un carcterobligatorio y voluntario, respectivamente, siendo de aplicacin en todomomento:

    Antes de cualquier actividad: prevencin. Durante: control y correccin. Despus: seguimiento y compensacin de cualquier impacto al

    medio ambiente.

    1. Responsabilidades legales.

    De acuerdo con la Constitucin, el incumplimiento de la legislacinambiental puede dar origen a tres tipos de responsabilidades jurdicas:

    a) Responsabilidad penal.b) Responsabilidad civil.c) Responsabilidad administrativa.

    A estos tres tipos de responsabilidades se ha sumado recientemente la:d) Responsabilidad medioambiental.

    a) Responsabilidad penal.

    Tiene carcter punitivo o sancionador, pudiendo dar lugar a penas privativas de libertad (mximo de 4 aos), multas pecuniarias (mximo de 216.000 ) y clausura temporal o definitiva de la actividad.

    El delito ambiental est recogido en el ttulo XVI del Cdigo Penal: "De los delitos relativos a la ordenacin del territorio y la proteccin del patrimonio histrico y del medio ambiente.

    Conductas punibles: Extracciones o excavaciones, Aterramientos, Inyecciones, Depsitos, Vertidos, Emisiones, Ruidos y vibraciones, Radiaciones,

    Espacios afectados: Suelo y subsuelo, Aguas superficiales y Aguas subterrneas, Atmsfera.

    b) Responsabilidad civil.

    Tiene carcter reparatorio, regulando la obligacin que tiene toda persona de reparar,restituir o indemnizar los daos y/o perjuicios causados en virtud de una obligacinque puede nacer de la ley, los contratos o pseudocontratos y los actos o las omisionesilcitas (Artculo 1089 del Cdigo Civil).

    Responsabilidad civil contractual: obligacin de indemnizar y/o reparar cualquierdao debido a un incumplimiento de un contrato. Responsabilidad civil extracontractual: obligacin de indemnizar y/o repararcualquier dao debido al incumplimiento de obligaciones que se contraen sinconvenio o a un acto ilcito no penado por la Ley (la mayor parte de los atentadoscontra el medio ambiente). Responsabilidad civil subsidiaria (de los empresarios). Responsabilidad civil por ilcito penal (asociada a la responsabilidad penal).

    Son elementos comunes esenciales para poder apreciarse la responsabilidad civil: la accin, la antijuricidad, la culpabilidad y el nexo de causalidad.

    c) Responsabilidad administrativa.

    Tiene carcter punitivo o sancionador, pudiendo acarrear multas,imposicin de medidas correctoras, suspensin de actividades y, enextremo, la clausura definitiva de las instalaciones (no es posible imponerpenas de privacin de libertad).

    El Derecho Administrativo tipifica las sanciones y da competencia a lasdistintas administraciones pblicas para imponerlas.

    Existen sanciones administrativas en todas las disposiciones que protegenlos aspectos generales relacionados con el medio ambiente.

    En cualquier caso, la Administracin competente est subordinada a laautoridad judicial por la va contencioso administrativa.

    c) Responsabilidad medioambiental.

    Tiene carcter preventivo, evitativo y reparatorio, fijando la obligacinque tiene todo operador de prevenir y contar con los medios necesariospara reparar los daos causados sobre el medio ambiente de dominiopblico, debiendo aportar las garantas necesarias acorde con su actividad.

    Origen: trasposicin de la Directiva 2004/35/CE, elevados gastos dereparacin medioambiental afrontados por el Estado en los ltimos aos einsuficiencia del rgimen de responsabilidad civil al no cubrir el dominiopblico. Objeto: regular la responsabilidad de los operadores de prevenir, evitar yreparar los daos medioambientales.

    2. Requisitos legales de una obra de construccin.

    Es requisito fundamental de cualquier obra cumplir con la ley y tener en regla cuantos permisos y autorizaciones sean necesarias para su completo y adecuado desarrollo.

    En las obras deber contarse con todos los permisos necesarios: Licencia de obras o de actividad (o contrato con la Administracin y Actade replanteo). Autorizaciones de captaciones y vertidos. Autorizaciones de enganche a servicios. Inscripcin en el Registro de pequeos productores de residuospeligrosos., etc.

    Para completar los requisitos legales aplicables a la obra, se debe solicitar enlos Ayuntamientos la legislacin ambiental especfica en forma de Ordenanzasmunicipales relacionadas con:

    Recogida de basuras Vertidos Actividades clasificadas Ruido Proteccin de zonas verdes Emisiones atmosfricas Limpieza viariaTransporte y vertido de tierras y escombros, etc.

    Desde comienzos de los aos 90 se est hablando de un marco voluntariomedioambiental: de la introduccin, con carcter voluntario, por parte de las empresas,de sistemas de gestin medioambiental con el objeto de aumentar su ventaja competitivay hacer frente adecuadamente a los nuevos retos medioambientales que se las plantean.

    Las principales normas que "regulan" el marco voluntario de las actuaciones de gestinambiental de una empresa son:

    La Norma Internacional ISO 14001. El Reglamento de Ecogestin y auditora medioambiental de la UninEuropea 761/2001 por el que se permite que las organizaciones se adhieran concarcter voluntario a un sistema comunitario de gestin y auditora medioambiental(EMAS).

    El objetivo final de los Sistemas de Gestin Ambiental (SGAs) es la mejora continuadel comportamiento ambiental de las entidades.

    Este modelo a seguir debe utilizar la retroalimentacin para conseguir la mejora continua.Se basa en la metodologa conocida como PHVA (Planificar-Hacer-Verificar-Actuar).

    El xito del sistema depende del compromiso de todos los niveles y funciones,especialmente de la alta direccin. 14
