Following the Guidelines does not eliminate the need for submission of plans for approval by the ACC. Even if the homeowner's proposed addition or alteration is identical to another that has been approved, it must be submitted for approval. Each application will be reviewed on a case- by-case basis due to different conditions on particular lots. Review: Approval and/or Disapproval The ACC shall have thirty (30) calendar days after the receipt of complete submittal forms and plans at the management company offices to approve or disapprove the submitted plans. Incomplete submittals will be returned to the homeowner prior to ACC review. The ACC shall furnish a written decision to the homeowner setting forth the reasons for its decision and the nature of any objections. The ACC shall have broad discretionary authority to interpret the guidelines and shall, to the extent reasonably possible, apply the guidelines equally and in an even-handed manner with regard to similarly situated properties. In addition, The ACC may disapprove any application if, in its discretion, it believes the homeowner has not submitted sufficient or accurate information for the ACC to exercise the judgment required by the CC&Rs and these guidelines.

Review and approval or disapproval will include, but not be limited to, consideration of materials, quality of workmanship, colors, consistency with the external design and color of existing structures on the lot and on neighboring lots and overall aesthetic considerations. The location of the improvement with respect to topography and finished grade elevation is also considered.

The ACC, the Board of Directors, and the management company shall have no liability in connection with or related to approved plans, specifications of improvements. The approval of the plans does not mean that judgment is passed on the structural soundness of the addition nor its effect upon existing or future drainage. The review of the plans is for aesthetic purposes only. Homeowner is responsible for insuring all appropriate City, County, and State Building codes and permit processes are adhered to.

The ACC shall have the right to disapprove an application if any part of it is not in accordance with the CC&Rs or these guidelines, or is incomplete, or is not in compliance with relevant government approvals and regulations, or is deemed by the ACC to be contrary to the best interests of the Sunset Cove Community.

If a proposed improvement has been disapproved, and the homeowner believes some misunderstanding might be responsible, only one appeal may be made to the ACC, in person or in writing, which will be considered at the next regular meeting of the ACC, provided the homeowner submits an appeal within 30 days of the disapproval. Requests for appeals should be submitted to the management company. Late appeals will not be considered, nor will more than one appeal be considered by the ACC. Only one further appeal may be made to the Board of Directors.

Review Fees: The Board shall have the right, in its sole discretion, to assess against homeowners a processing fee to defer the costs incurred by the ACC in considering any requests for review or approval submitted to it. The fee shall be in such amount and payable in accordance with such schedule as reasonably determined by the ACC. The schedule of fees shall take into account the proposed land use, and the size and complexity of the project to be reviewed. Such schedule of fees may be revised and amended at the discretion of the ACC. Should the ACC deem that a fee is to be paid in regards to a specific request, the ACC shall have fourteen (14) days from the receipt of the ACC Request Form to notify the homeowner of the amount to be paid. The request shall be deemed disapproved until such time as the fee has been paid. Upon receipt of the fee payment, the ACC shall have thirty (30) days to approve or disapprove the request.

I. FRONT YARD LANDSCAPING A. New or modified front yard landscaping SHALL NOT require the approval of the ACC if it

conforms to the following general guidelines:

1. Irrigation of plant materials shall be provided by a permanent, automatic, underground watering system. System shall remain in working order so as to insure plants remain viable, without excessive or wasteful watering. Sprinklers shall be installed such that they do not overspray either the public sidewalk or any block fencing within the community.

2. All landscaping areas shall be occupied by plant material or groundcover. All bare earth surfaces must be covered with the exception of flowerbeds, which shall be maintained in a neat and trimmed fashion and shall not exceed 10% of the landscapeable front yard area.

3. Ground cover may be of two types:

a. Vegetative ground cover consisting of living plant materials horizontal, as well as vertical growth, generally not exceeding eighteen inches (18”) in height.

b. Inert ground cover consistent with the specifications of section I-B-4 with accent areas of river rock. River rock shall not exceed 20% of the front yard area.

4. Artificial turf (artificial grass) SHALL require the approval of the ACC. To insure realistic appearance, homeowner is required to submit an actual sample, no smaller than 2” x 2” of the proposed product to be installed with the ACC request form. Contractor performing installation should also provide at least two homes in the same general area of the Sunset Cove community that have already installed the same material to allow ACC to visually inspect an installation for aesthetic quality of the proposed material.

5. Benches shall be permitted provided that the bench is situated upon the front porch, and is manufactured of natural wood, concrete, or a combination of natural wood and metal. PLASTIC chairs or tables SHALL NOT be allowed in front yards on a permanent basis.

6. Berms are encouraged to add interest to the landscaping. The height and scale of the berm should be compatible with the rest of the yard.

7. All front yard turf (or lawn) areas must be maintained year round. Overseeding with perennial rye grass in fall and winter is encouraged, but not required. Lawns must be kept mowed and weed free, year round. As indicated in item 1 above, all lawns are to be irrigated by an automatic sprinkler system. Homeowner is responsible for insuring sprinklers and timers are maintained to minimize excessive watering. Homeowners are reminded that excessive water overflows into the common areas, potentially damaging Common area landscaping, is discouraged.

8. Holiday decorations are permitted provided that the decorations do not become an annoyance or nuisance to the community. Decoration that make noise, music, etc. shall be maintained at a level such that they cannot be heard indoors of any adjacent property. Decorations SHALL NOT be put up more than thirty (30) days prior to the holiday, and shall be removed not more than ten (10) days after the holiday. The

exception is the Christmas or Winter Holiday season where decorations shall not be displayed before November 1st, and shall be removed no later than the third weekend of January of the following year.

9. Owner may only display One sign, such as “Family Name” or “Welcome”, at or near the front door, and not more than one security company sign at or near the front door or garage door.

B. The following front yard landscaping SHALL require approval of the ACC, even if done in conjunction with any portion of Section I-A-1 through I-A-9, above.

1. Changes in dimension, shape or size of front lawn area SHALL require prior approval of the ACC.

2. Lawn or yard ornaments, bird baths, statues, fountains, decorative wall hangings, poured in place concrete, etc. SHALL require prior approval by the ACC.

3. Hardscape accents (ie: saltillo tile, concrete and/or brick pavers) used to construct stepping-stones and boarders will be permitted if colors are compatible with the community. Acceptable colors are desert hues and earth tones, including muted reds and muted oranges. Hardscape (ie: concrete, brick, flagstone, tile, etc.) used to construct:

a. New or modified walkways;

b. New driveways or driveway extensions;

c. Freestanding walls or retaining walls;

d. Porch, patio or seating areas;

e. New, replacement or revised lawn borders;

SHALL require prior approval by the ACC.

4. Tinting, coloring or dying of decomposed granite, or the installation of same SHALL require prior approval by the ACC. As a guide, the ACC will only approve tinting, coloring or dying of decomposed granite only in earth tone hues and colors typically found in the Desert Southwest. No Greens, whites or blues shall be approved.

5. Replacement of original exterior lights (porch or exterior garage lights) SHALL require prior approval by the ACC if new light fixtures are not similar in size, style and color, to those originally installed by the Builder at original construction.

6. No Floodlights or similar style lights shall be mounted or erected upon the front of the home.

7. Landscaping accent lights (ie: Malibu or other Low-Voltage lights) SHALL NOT Require prior approval provided that the power supply (transformer) box is not visible from the street. Homeowner is required to install lights so that lighting does NOT spread to adjoining properties, and to maintain all lights in a good and orderly condition. Fixtures that become weathered or damaged are to be repaired, replaced or removed promptly.

The ACC SHALL RESERVE THE RIGHT to request reasonable modifications to front yard landscaping as it deems appropriate.

II REAR YARD AND SIDE YARD LANDSCAPING A. For purposes of this section, Side Yard shall be defined as the yard area located on the side

of the home and behind the front block wall. Yard areas on the side of the home, but in front of the block wall is defined as Front yard, and shall be governed under Section I of these guidelines.

B. New or modified rear yard and side yard landscaping SHALL NOT require approval of the ACC if it conforms to the following general guidelines:

1. Irrigation systems must be directed away from walls to eliminate seeping through, staining or draining onto adjoining properties, including common areas. Any planters that consist of bermed dirt against a wall must be sealed and water-proofed in order to avoid seepage onto neighboring properties. Seepage causes fencing blocks to deteriorate which is both unsightly and can cause the structural failure of the wall. The offending homeowner shall be responsible for any and all costs associated with repairing or replacing any walls, common or otherwise that become damaged due to water directed at it in violation of this section.

2. Hardscape (ie: concrete, brick, flagstone, tile, etc.) used to construct new or modified walkways, freestanding walls or retaining walls, patio or seating areas that ARE NOT visible from the street or an adjoining yard.

3. Non-deciduous trees are encouraged for side and rear yards. Trees shall be placed in locations, which will not encroach upon other lots.

4. Decorative strings of lights may be displayed at the patio eaves provided the lights consist of small “mini-light” strings of bulbs, similar in style to those sold at Christmas time. Lights must be maintained in a good and safe manner at all times. Lights that “Blink” or otherwise “Pulsate” are not allowed.

C. The following rear yard and side yard improvements SHALL require approval of the ACC: 1. All pools and spas placed in rear yards SHALL Require approval unless construction:

a. Does not require a City of Chandler Building Permit AND b. Does not Require a “Hard-Wire” electrical connection AND c. No block walls are removed or damaged during the construction AND d. Construction is completed within thirty (30) days of commencement of the

construction. 2. Pools and spas not meeting the requirements of section II-C-1 above and ALL ancillary

components of pools and spas (pumps, filters, gas or electric fired heaters, slides, gazebos, etc.) that are visible from the street or any adjoining property while standing at ground level SHALL require the prior written approval of the ACC. Upon Approval by the ACC, Any walls removed during construction shall be walls contained on the Owner's Lot. Removal of walls abutting a Common Area SHALL NOT be allowed. Any wall removed shall be replaced to its original condition, including texture and paint, matching the previous color of the removed wall. A color change SHALL require prior approval on a separate request as specified in section XVI-B.

3. Backwashed or other pool water SHALL be contained on an Owners individual Lot. Effective August 1, 2006, Chandler City code prohibits the release or discharge of pool water into any street. As an alternative, a homeowner may utilize the sewer clean-out pipe to drain excess pool water, provided the flow rate of the water does not exceed 12 gallons per minute. Specific details are available from the City of Chandler. As of November 14, 2006, these instructions could be found at:

Under NO circumstances may a homeowner drain pool water into any Common Area, or into the street, which drains into any common area.

4. Solar energy equipment visible from any adjoining property SHALL require the prior approval of the ACC. The ACC asks the homeowner to consider the following guidelines:

a. Solar panels should be installed at the rear of the home where possible;

b. Solar panels should be of a “Terra Cotta” or “Black” color and where possible, should be mounted flat against the tiles such that the pitch of the panels matches the pitch of the roof the panels are mounted upon;

c. All piping leading to or from the panels should be painted, colored or masked so as to match the color of the building it is adjacent to. That is, where the pipe passes in front of stucco, it should be colored to match the stucco color, and where the pipe passes in front of the trim colored eaves, the pipe should be colored to match the trim color, and where it passes in front of the roof tiles, the pipe should be colored to match the color of the tiles. Painting or coloring the pipes will help to reduce the visual impact of the pipes against the backdrop of the home;

d. All components visible from the street, common area or any adjacent property must be properly maintained so that the visible components always appear in a good, neat and undamaged condition. Any component(s) that break, become damaged, or otherwise unsightly, as determined by the Association, at its sole discretion, shall be replaced, repaired, repainted or removed at the expense of the homeowner;

e. Traditional pool pumps, pool filters and electric or gas fired pool or spa heaters are required to be installed at ground level in a manner consistent with City of Chandler building code(s). Pumps or ancillary components of solar energy systems other than the panels and piping to and from the panels shall be installed in a non-visible location behind the owner’s back yard fence. Exceptions to a “non-visible” installation would apply if the solar panel manufacturer or the contractor doing the installation work requires an ancillary pump or other components of the solar energy system to be mounted in a visible location because not doing so would impair the functioning of the device or adversely affect the cost or efficiency of the solar energy system;

f. The Association has been advised that City of Chandler building codes REQUIRE the issuance of a permit by the City before any work may be started on the installation of a pool, spa, or any solar energy device that would be connected to an electrical

system or add weight to the structural load of a home’s roof truss system. The Association STRONGLY encourages each homeowner contemplating a pool, spa or solar energy system to contact the City’s planning department to insure they and their contractors are in code compliance.

D. Any increase or modification to a rear yard wall or side yard wall height SHALL require the prior written approval of the ACC. 1. Changes made to a "shared" wall must be a joint request signed by all adjoining Lot

owners. 2. Any increases in wall height must be approved by the City of Chandler. 3. Wall additions must match existing wall in color and texture.

The ACC SHALL RESERVE THE RIGHT to request reasonable modifications to rear yard and side yard landscaping if deemed appropriate.

III REPLACEMENT OF FRONT DOOR, GARAGE DOOR OR EXTERIOR WINDOWS

A. Installation of a replacement entry door SHALL require approval of the ACC, unless the replacement is identical in style, dimension and color as the original installed by the builder.

B. Installation of a replacement garage door SHALL require the approval of the ACC unless the replacement is identical in style, dimension and color as the original. Door is to be painted in a semi-gloss or gloss finish exterior paint, matching the color of the stucco or other approved color scheme. (See Color Scheme section XVI-B for more details).

C. Installation of replacement windows SHALL require approval of the ACC, and shall match in style and appearance those windows being replaced. Exceptions will be considered on a case-by-case basis. Emergency replacement of a broken pane of glass SHALL NOT require the approval of the ACC if the replacement pane matches in style and any tinting of the broken pane being replaced.

IV LIGHTING A. New or modified light fixtures visible from any neighboring property SHALL require

approval of the ACC unless the light fixture is a replacement and complies with ALL of the following conditions: 1. Replacement fixtures are identical in size, style and color to those originally installed

by the builder. 2. Replacement fixtures are installed in the same location using existing wiring and

junction box. B. Security lights, whether or not installed by the builder, SHALL BE shielded in such a

manner that the light shines primarily on the owner’s own lot. Lights that create excessive light spillage or create a glare that is visible from other lots are prohibited. Colored lights are prohibited in light fixtures mounted on the front of the home, except when displayed in a manner consistent with section I-8 (holiday decorations).

C. All approved light fixtures shall be maintained in a good and safe condition. Homeowner is required to repair, replace or remove any fixtures that becomes unsightly or falls into disrepair, becomes a safety hazard, becomes broken or otherwise inoperable.

V SCREEN / SECURITY DOORS A. Screen / security doors constructed of any material or color not conforming to the

following stipulations SHALL require the prior written approval of the ACC.

1. Screen doors constructed of wrought iron and painted either:

a. the same color as the house;

b. the same color as the window/door frames;

c. Black, White, Off-White (Beige) or Verde-green; SHALL NOT require approval of the ACC.

2. Screen Doors SHALL be maintained in a good and clean condition, free from signs of weathering, peeling or flaking paint, or other signs of disrepair.

VI BASKETBALL STANDARDS A. Permanent Basketball standards SHALL NOT be permitted.

B. Portable Basketball standards or Basketball Hoops “Hoop Set” SHALL NOT require the approval of the ACC. Hoop Sets may be set up on the Owner’s lot.

C. Homeowner is REQUIRED to maintain the hoop set in a good and safe condition at all times. Hoop sets that fall into disrepair, or become unsightly due to wear or damage, or hoop sets that appear to be unsafe will be cited for immediate repair or removal.

D. The following are examples of disrepair: If the hoop has a torn net, broken parts, peeling paint or peeling decals, etc. The following are examples of unsafe: Hoop sets that are not fully set up, are laying down, or otherwise appear to be falling down or unstable.

E. The owner of a property in which a basketball hoop is installed will be responsible for any damages caused to other properties.

F. Under Arizona statutes, all Homeowners are allowed the “Quiet Enjoyment” of their residence. Therefore, each homeowner who sets up or makes available for use a basketball hoop set agrees that Basketball SHALL NOT be played any earlier than 8:00AM and no later than 9:00PM, Sunday through Thursday; and no earlier than 8:00AM and no later than 10:00PM, Friday and Saturday.

VII SHEDS A. Sheds, which are installed in the backyard, SHALL NOT require the approval of the ACC

as long as they meet the following guidelines: 1. Commercially made sheds that do not exceed the height of the fence by more than

twenty-four (24) inches and are to be maintained in a clean and rust free condition on all four sides and at all times.

2. There SHALL NOT be storage of ANY items or materials on top of the shed. B. Sheds that exceed the height of the fence by more than twenty-four (24) inches SHALL

require the approval of the ACC. C. Sheds that show signs of wear (damage, fading, or peeling paint) shall be promptly,

repaired, replaced or otherwise removed.

VIII SATELLITE DISHES / ANTENNAS A. The Federal Communications Commission (FCC), through Rule “47 C.F.R. Section

1.4000”, as amended, DOES allow an association to enact and enforce restrictions on the placement of Analog or Digital receivers, whether antenna or dish. As such, this section is set forth to provide guidance for acceptable installation. No portion of this section is to construed as prohibiting the installation of any receiver such that it cannot receive an acceptable quality signal as specified in the above referenced Rule. When a homeowner is contemplating the installation of an antenna or an internet/satellite dish, the homeowner is to consider the following guidelines regarding placement. It is our intent to limit the visual appearance of such devices such that they do not detract from the aesthetic quality of the community. Your installer can and will find a suitable location that adheres to these guidelines IF YOU ASK them to.

B. Homeowner is required to submit an ACC request form FOR NOTIFICATION PURPOSES ONLY upon start of installation, but not later than ten (10) calendar days after the completion of the installation. Homeowner is to include information regarding the type of receiver, the name of the company, if any, doing the installation work and a description or drawing, depicting the location where the receiver is installed.

C. For Safety reasons, homeowners are encouraged to have their receivers professionally installed to insure they are installed in conformance with any applicable code requirements. Receivers that are not mounted securely may become a projectile, causing serious injury or damage to people or property if torn from its mounting by high winds. Likewise, receivers that are not properly grounded may cause serious injury or damage to people or property if struck by lightning.

D. Preferred and acceptable locations for the placement of a receiver shall be as follows: 1. Mounted to the rear of the home, rear or side fence at a height that does not allow any

portion of the receiver to be visible from the street, or while standing at ground level from any adjacent property, including common areas.

2. Mounted on a pole, mast or tripod type stand in the backyard of the lot, at a height that does not allow any portion of the receiver to be visible from the street, or while standing at ground level from any adjacent property, including common areas.

3. If no location exists in a homeowner’s lot the conforms to D1 or D2, then homeowner may install receiver mounted at the eave of the roofline AT THE REAR of the home, in the least conspicuous location that receives an acceptable quality signal where it is NOT visible from the street.

4. All cables, brackets, etc. visible above the fence line, shall be painted or otherwise colored to blend in with the surface it is mounted to.

5. Internet or satellite receivers larger than 1 meter (39.37”) in diameter MUST BE ground mounted, and no portion of the receiver may be visible from the street, or while standing at ground level from any adjacent property, including common areas.

E. If a homeowner cancels the subscription service for which the Dish antenna was originally installed, the dish no longer complies with the requirements of FCC Rule “47 C.F.R. Section 1.4000”, as amended, and within 30 days of the cancellation of said subscription service, the Dish antenna shall be removed or otherwise relocated such that it is no longer visible from the street, or while standing at ground level from any adjacent property, including common areas.

F. Attic antennas are strongly encouraged and DO NOT require approval or notification.

IX GUTTERS AND DOWNSPOUTS Gutters and downspouts SHALL NOT require approval of the ACC if they are painted white or brown, or to match the color of the house or the trim adjacent to where installation occurs. No black or aluminum colored gutters or downspouts will be allowed.

X SIGNS A. One "For Sale" sign on a homeowner’s own lot placed by a professional residential

brokerage company SHALL NOT require ACC approval. B. One “For Sale” sign on a homeowner’s own lot, which has been purchased or made by an

Owner, SHALL NOT require ACC approval. C. In addition, One “Open House” sign, may be placed on the homeowner’s own lot to promote

an open house event. “Open House” signs are to be erected no sooner than sunrise on the day of the event and removed promptly at the conclusion of the Open House.

D. Pursuant to Arizona Statute, signs shall not exceed the industry standard size of 18” by 24” and may include a single “Sign Rider” not to exceed 6” by 24”dimensions,

E. One “Yard Sale” or "Garage Sale” on a homeowner’s own Lot SHALL NOT require the ACC approval. “Garage Sale” and “Yard Sale” Signs are to be erected no sooner than sunrise on the day of the event and must be removed promptly at the conclusion of the Sale.

F. Signs on Lots SHALL NOT block any sidewalk traffic. G. Signs in Common Areas must be freestanding, require NO holes, stakes, etc. that may cause

damage to the common area. Signs must be placed no sooner than sunrise and removed no later than sunset on the day of the event and SHALL NOT block any sidewalk area.

H. A maximum of three (3) signs may be erected in Common Areas for one (1) event. Signs advertising one or more homes for sale are NOT permitted in any Common Area location.

I. Pursuant to Chandler city code §39-10.8, political and campaign signs on behalf of candidates for public office or urging action on primary, general or special election ballots are permitted provided that they may NOT be displayed more than forty-five (45) days prior to the day of the election and must be removed no later than seven (7) days after the election day. The total sign area shall not exceed ten (10) square feet, nor five (5) feet in height. Political signs covered by this code located on a homeowner’s own lot SHALL NOT require prior approval of the ACC. Political signs are NOT allowed to be posted in any Common Area.

The ACC SHALL RESERVE THE RIGHT to request reasonable modifications to such signs if deemed appropriate.

XI SWING SETS / PLAY SETS ("PLAY EQUIPMENT") A. All swing sets, play sets, forts, etc., “Play Equipment” shall be placed in the rear yard a

minimum of six feet (6’) from any wall adjoining the yard of a neighbor. B. Play equipment SHALL require ACC approval, unless the Play Equipment adheres to ALL

of the following guidelines: 1. Play Equipment is Commercially Manufactured for installation in a residential setting; 2. No part of the Play Equipment shall exceed the height of the rear or side yard wall by

more than twenty-four (24) inches; 3. Elevated play platforms cannot exceed a height of four feet (4’) from the ground;

4. No colorful canopies, roofs or other visual distractions higher than twenty-four (24) inches above the height of the fence may be attached to the Play Equipment. Canopies or roofs that are two (2) feet or less above the height of the fence shall be of a canvas material in a solid color. Due to rapid deterioration, canopies of a plastic ‘fabric type’ material SHALL NOT be allowed in any manner that allows them to be visible from the street, or while standing at ground level from any adjacent property, including common areas. No lights or nighttime illumination of the play equipment shall be allowed, (except previously approved Security lighting);

5. All Play Equipment must be maintained in a good, safe, clean, and rust free condition at all times. Play Equipment that falls into disrepair, or become unsightly due to wear or damage, or Play Equipment that appear to be unsafe will be cited for immediate repair or removal.

XII GATES A. Repainting gates with the natural wood color originally installed by the builder or the same

color as the block wall the gate is attached to SHALL NOT require approval of the ACC. B. New Gate Installations SHALL require the approval of the ACC.

1. Installation MUST NOT be on a wall adjacent to a common area. 2. Installed gate MUST conform to the style and construction of those gates originally

installed in the community by the builder. Wrought Iron and wood slat. 3. Wood slats in the new gate shall be painted with natural wood color similar to that used

by the builder or the same color as the block wall the gate is attached to. The wrought Iron portion shall be painted Black or the same color as the block wall the gate is attached to.

XIII DISPLAY OF FLAGS Pursuant to A.R.S. §33-1808, the U.S. Flag may be displayed at any time of the year, one per residential lot, on a bracket mounted or in-ground flagpole. Bracket mounts may be installed on a home or garage, and mounts should be painted to match the color of the home or garage it is attached to. A. An in-ground flagpole of wood or metal, temporary or permanent, SHALL require the

approval of the ACC and are subject to the following requirements: 1. One in-ground flagpole may be installed, not to exceed more than twenty (20) feet in

height (including any balls or finials), with setbacks of at least ten (10) feet from all property lines, including common area or public sidewalks. (The measurement of twenty (20) feet shall start with the elevation of the City sidewalk at zero (0) feet. The approved location for the mounting of an in-ground flag pole will be such that the distance from the pole to the building or driveway of any adjacent property shall be at least the same distance that the in-ground flag pole is tall.

2. Flag(s) MUST be made of cloth, not other materials, such as plastic, colored lights, or painted objects, etc. Pursuant to the United States Flag Code (Federal Flag Code) §6(c), “The flag should not be displayed on days when the weather is inclement, except when an all-weather flag is displayed.”

3. In addition, an official or replica of a flag of the United States Army, Navy, Air Force, Marine Corps or Coast Guard may be displayed in a manner consistent with the Federal Flag Code (P.L. 94-344; 90 Stat. 810; 4 United States Code sections 4 through 10).

4. The following flags are also allowed under A.R.S. §33-1808:

a. The POW/MIA Flag; b. The Arizona State Flag; c. An Arizona Indian Nations Flag.

5. ALL flags displayed are REQUIRED to be displayed in conformance to the United States Flag Code as specified in code sections (P.L. 94-344; 90 Stat. 810; 4 United States Code sections 4 through 10) and the following conditions: a. The horizontal width of the flag(s) may not exceed five (5) feet in width; b. Flags are to be lowered at sunset, unless the flags are illuminated at night by artificial

lighting; c. If requested, approved lighting shall consist of not more than two flood type lights

mounted at the base of the flagpole, at a distance of not more than three (3) feet from the pole. The light shall be directed up at the top of the flagpole where the Flag(s) are flying. Under no circumstances will lighting be permitted from a light fixture mounted to the home or any other structure, including the flagpole;

d. Lights shall be aimed or directed in a manner such that excess light is not spilled onto any adjacent property;

e. The approved flagpole and approved lighting shall be maintained in a good and safe condition at all times.

6. Seasonal (holiday) flags may be flown only for the specific holiday the flag represents, and shall conform to the holiday display requirements as stipulated in Section I-8, above.

7. Sports Team Flags may be displayed, but are limited to ONE flag displayed at a time. 8. All Flags are required to be maintained in a neat and good condition at all times. Flags

that become worn, torn or otherwise damaged, shall be promptly removed. 9. Other decorative flags are not allowed at any time.

XIV AWNINGS / UMBRELLAS A. Installation of temporary or permanent awnings over windows or patios SHALL require the

approval of ACC. Awnings will be considered for approval only if:

1. Awning is installed on the rear or side of home, behind the homeowners’ property fence;

2. Awning is of a canvas type in a solid color matching the exterior body (stucco) or the fascia trim color.

B. Umbrellas of a standard size and shape designed and sold for residential patio use that do not exceed the height of the rear yard fence by more than two (2) feet SHALL NOT require the Prior approval of the ACC. Umbrellas are permitted in the rear yard only.

C. Temporary shelters similar in style, design and purpose to those typically referred to as “easy-ups” SHALL NOT require the prior approval of the ACC provided that they:

1. Are not used for durations longer than 40 hours per use;

2. Not used more than once per month.

3. Prior ACC approval SHALL be required for durations longer than 40 hours per use, or more than one use per month.

Awnings, umbrellas and other canopies are to be maintained in a good and clean condition at all times.

XV SUNSCREENS Installation of sunscreens SHALL NOT require the approval of the ACC, provided that the installation conforms to the following

A. Material color is of a black or charcoal colored material, or a color that matches the color of the wall surrounding the window the screen is placed into.

B. All Sunscreens on the home shall be of the same material/color.

D. Sunscreens are to be maintained in a high quality condition that will not detract from the quality of the community.

XVI REPAINTING OF HOMES / WALLS ALL Repainting Of Homes and/or Walls REQUIRE Approval Of The ACC Even If There Is NO Color Change. A. When a homeowner submits a request to repaint the home in the original color the home was

painted by the builder, or to repaint the home in the color previously approved by the ACC for the home in question, then the request shall be considered approved upon receipt by the Management company.

B. All other exterior color combinations SHALL require prior written approval of the ACC. In an effort to keep the community from looking old and dated, the ACC will allow homeowners to select a color scheme of their choosing to submit for approval. Homeowners should be mindful of the impact their roof color will have on the overall appearance of the finished project.

C. Homeowners are reminded that “bleed-through” occurs when painting a light color over an existing darker color. Bleed-through will cause the finished color to appear different than the color originally approved. The ACC reserves the right to require a homeowner to repaint any portion or all areas painted, if the finished color differs from that that was submitted for approval and approved by the ACC. An example of bleed through would be similar to a blue painted over a red, which will make the finished job appear purple. If the approval was for blue, then the homeowner would be required to repaint the offending areas so that they appear the same tint of blue approved by the ACC.

D. Requests for approval of a non-standard color scheme, require the homeowner to submit a request package which includes all of the following: 1. The ACC Request Form; 3. A drawing or sketch of the home drawn to scale (an elevation drawing) that details

where which color will be applied; 4. A set of color chips to correspond to the selected colors, (A set of color chips includes

five (5) chips of each color for review by the five members of the ACC); 5. The identification of the paint manufacturer and the sheen chosen (flat, eggshell, semi-

gloss or gloss); 6. The name and contractors’ license number for the person(s) or firm(s) doing the work.

XVII ARCHITECTURAL ACCENTS A. Architectural Accents are defined as brick, rock, stone, or other quarried material, whether

natural or artificially created. Stucco Stone® is an example of artificially created stone. Architectural Accents SHALL require the prior approval of the ACC. Requests will be considered with or without a paint request.

E. Requests for approval of Architectural Accents, require the homeowner to submit a request package which includes the following: 1. The ACC Request Form; 2. A drawing or sketch of the home drawn to scale (an elevation drawing) that details

where accents will be applied; 3. A color brochure reflecting the exact accent material to be used, including color, tint,

hue, size etc.; 4. The identification of the manufacturer, if not detailed in the brochure; 5. The name and contractors’ license number for the person(s) / firm(s) doing the work.

If the work is to be performed by someone other than the homeowner, please identify the contractor and contractor’s license number where indicated.
