The Central Vigilance Commission (CVC) has recommended disciplinary action against 21 senior officials of the Directorate General of Civil Aviation (DGCA) for illegal activities. They have been blamed for getting their children or spouses appointed in private airlines without clearance and using their position to unduly influence such private airlines. The officials are supposed to regulate aviation mechanism to ensure safety in Indian skies but the CVC recommenda- tions show a complete breakdown of the regulatory mechanism. It may be noted that when the fake pilot licence scam broke out last year, the Ministry of Civil Aviation in consultation with the Central Vigilance Commission called in Mr. Samir Sahai, Chief Vigilance Officer of Pawan Hans. After initiating enquiries, he exposed the wrong doings of several DGCA officials. The result is that Mr. Samir Sahai has been removed from DGCA in May this year! The post of the CVO in a government organization is permanent and is created by the Department of Personnel and Training. The Gas Authority of India, the Central Warehousing Corporation of India, Pawan Hans, Air India and other central government agencies have the posts of CVO and official to handle vigilance duties. However, for the DGCA, the Ministry of Civil Aviation has clubbed the vigilance function with the duties of finance and administration. It may be noted that the CVC had asked the Ministry of Civil Aviation to place a proposal before the Department of Personnel and Training to create a post of CVO in the DGCA. The Director General of Civil Aviation also had informed the Ministry regarding the need for a CVO. But the Ministry is yet to act on the directive of the CVC. The main aim of the Vigilance Department is to initiate steps to curb corruption and malpractices. Vigilance functions can be divided broadly into three parts: preventive vigilance, punitive vigilance and surveillance & detection. Some of the prime functions to achieve this are: Investigation of complaints having vigilance angle against all categories of employees; Monitor progress of action recommended by Vigilance against such employees; Study and examine systems & procedures followed in the department; Identify corruption-prone areas and suggest remedial measures to minimize scope for V. However, the state government and the villagers affected are yet to arrive at an agreement over the quantum of developed land to be given to the people, who have already dropped their demand for compensation of Rs 20 crore per acre. The villagers are demanding 40 per cent of the developed land, while the state government has offered 22.5 per cent. State urban development secre- tary Manukumar Srivastav, along with City and Industrial Develop- ment Corporation (Cidco) officials, today met the representatives of the villagers to discuss their various demands. The meeting was incon- clusive, and both parties are ex- pected to again meet on August 13. Cidco Joint Managing Director Tanaji Satre told Business Standard, “At today's meeting, PAVs (project affected villagers) have agreed for a joint measurement for the land to be acquired for the aeronautical pur-pose. The negotiations on the quantity of developed land to be offered to the PAVs would continue.” Another government official said the government was keen to arrive at a consensus with PAVs before Prime Minister Manmohan Singh's visit to Mumbai on August 18-19 to review the progress of vari-ous infrastructure projects, including the Navi Mumbai International Air-port. Civil Aviation Minister Ajit Singh has already announced his ministry was ready to help in the project. Of the 2,020 hectares of land required for the airport project, 1,400 hectares lay in Cidco's possession. Another 450 hectares of privately- owned land is yet to be acquired. Of this, 274 hectares are purely for aeronautical purposes. R.C. Gharat, chief negotiator of the PAVs, stated people from 10 affected villages had approved a joint measurement of the land. “However, we will continue to press for providing 40 per cent of the developed land of 274 hectares to PAVs from the 10 villages. During the joint measure-ment, the villagers and officials of the revenue depart-ment would actually measure the land in the possession of families ...the land required for the airport project,” Gharat said. He hoped the negotiations would reach a consensus. Gharat reiterated the allocation of 40 per cent net developed land had nothing to do with the government's policy announced in 1994 to provide 12.5 per cent of the developed land to villagers affected by development projects in Navi Mumbai. Will Disciplinary action against DGCA Officials Guarantee safety in Indian Skies ?

The Central Vigilance Commission (CVC) has recommended disciplinary action against 21 senior officials of the Directorate General of Civil Aviation (DGCA) for illegal activities. They have been blamed for getting their children or spouses appointed in private airlines without clearance and using their position to unduly influence such private airlines. The officials are supposed to regulate aviation mechanism to ensure safety in Indian skies but the CVC recommenda-tions show a complete breakdown of the regulatory mechanism.

'Japan Inc' are convinced that there must be more to it than Japanese Inc i.e., 'Creative' and 'Intuitive', like the ones what 'Tata Steel' at Jamshedpur by 'Tatas' in India.

'Japanese Inc' means, 'Conse-nsus, Decision Making, Quality Circles'. These ideas indeed also 'in-fluenced and created' General Motors, Ford Motors in USA too.

That made 'workers' found companies by a 'leadership of a worker'. Even Nitro Nobel in Sweden too, so too in then Germany and in a lot of European countries were founded.

Even East India Company was founded by just British Traders finding a sensible 'business opportunity' in the East. Once spirit of mind is tainted, then, all the troubles started, as it did start in the East India Company which every one knows.

Indeed all these 'companies' held 'similar philosophy' as that of Japanese experience.

Like farmers created 'agricul-ture', so workers created industries by their 'cooperative perceptions, better known as 'Consensus', decision making that led to 'Qua-lity circles'. That way you got paddy, wheat, cereals… over con-sistent hard selfless work ethos, farmer produced food grains but he ate only porridge tat is 'selfless work ethos' as he strived for the benefit of others.

That means either agriculture or industry or for that matter any major productive operation is to be

P.C. George the Chief whip of UDF in Kerala who is also be referred to as the “Mouth of the South” seems to also be suffering from a foot in the mouth disease. His big mouth is landing him in a lot of trouble these days. From his conversations, it seems that power has gone to his head and he has suddenly started talking like the Communist party Chief Achu-dandan. According to some of his Congress party colleagues his mouth and tone eerily reminds one of Achudanandan's sarcasm laden and contemptuous speeches.

It is reported that PC George talks like a ruffian & a goonda towards his own party men. So much so that most people in his party hate him. They think he is an airhead with lots of ego and pride and he has a need to display his prowess as the Chief Whip of the ruling party of Kerala. It is well known saying in India that power corrupts absolutely and those politicians who are sober and quiet, keep winning elections till the time power goes to their head. That is when the mouth starts to run in high gear and the brain in low gear with all the resultant consequences. This is exactly what is happening with PC George.

Every politician in India is a smooth talker. Indian politicians have cultivated the art and style of non confrontational politics which is also called in Hindi as “Chup Baito Aur Mil Baatke Khao” (share and loot and quietly enjoy together). This is the number one qualification, ability and skill that is required of all Indian politicians.

Any politician who cannot adhere to the above policy finds himself in hot water with corruption cases lodged against him or finds that he is booted out of the party and does not get a ticket in subsequent elections.

In the case of PC George, he has successfully avoided all that and finally made it to the post of Chief Whip of the UDF. He de-finitely knows how to use a whip but he does not know where and how to use it and this makes him totally unfit to be a politician. If he can berate and insult his own colleagues in the party and create rift and bad blood between himself and them, how can he have cordial relations with the opposition and fulfill the main role of the almighty Indian politician.

PC George needs to under-stood that while it may be ok for a person to be outspoken, it is not when he is a politician in a very powerful position especially that of chief whip of the ruling party of the state.. Such a person should always measure his words before he speaks. He was told about this several times by several MLAs as well as by Thankachan, Chief Coordinator of UDF who had also warned him. Now that most of his party colleagues are against him, it remains to be seen whether he can whip the boys any more or whether the boys will give him a sound whipping along with a good kick that would see him falling from the lofty heights of UDF Chief whip to an “also ran” in the next assembly elections.

Right to SilenceA person against whom cri-

minal proceedings have been instituted has been given the right to keep silent about his accusa-tions. This privilege has been conferred by the doctrine of presumption of innocence in favour o f the accused which forms the basis of the administration of criminal justice in India as well as in USSR. Thus, though an accused is obliged to report for interroga-tion he has a right not to incrimi-nate himself and shall in no case be compelled to be a witness against himself.

Right to protection against unlawful search, seizure etc: The criminal legislation of both India and USSR provide certain safeguards in favour of the accused against unlawful encro-achments upon his rights in the course of an interrogation, search and seizure being conducted by the investigation authorities. The

question of the constitutional validity of a search warrant made with respect to an accused for the production of any document or thing in his custody is violating Article 20( 3) of the constitution of India has often been raised before the Indian judiciary. But the Supreme Court, as early as in M.P Sharma V. Satishchandra's case,

had laid down that neither the search nor the seizure of docu-ments in possession of the accused in pursuance of warrants under section 96 (now section 93of the new code) of the code of criminal procedure, were violative of the fundamental right of the accused guaranteed by Article 20(3) of the constitution.

Under the Soviet law, the investigator can resort to measure like search and seizure only in exceptional cases. Though in most of the cases the investigator or the organ of mititia conducting the search can do so only with the sanction of the procurator, in urgent cases searches may be made without the sanction of the procurator. Section 165 of the Indian Criminal Procedure Code also empowers the police Officer, to carry out searches in urgent cases without first applying to the court for authority.

No one ever thought that the movement against corruption launched by Anna Hazare would be called off in such a tame fashion and so abruptly. Sadly, it is what happened on the evening of Friday, the 3rd August, 2012 at Jantar Mantar in New Delhi where the leaders including Anna himself were on an indefinite fast. By evening, there were large crowds at the venue and public support was overwhelming. This was the third fast undertaken by Team Anna in the capital in fifteen months, apart from the one that was held at the MMRDA grounds in Mumbai on Decem-ber 29, 2011 which failed to pull crowds.

Anna Hazare, Kejriwal and others broke their fast accepting a glass of juice offered by General (Rtd) V.K Singh who was among the leaders who occupied the dais. Anna, then, addressed the gathering saying that they would go for a referendum on whether they should participate in ele-ctoral politics. Some of the mem-bers felt that only by entering politics, they could change the government which was the real solution for corruption. No doubt, there were dissenting voices. However, it was decided to enter active politics by launch-ing a new party. Anna, however, made it clear that he would neither lead the party, nor stand for election. Naturally, the sudden decision to float a new party created utter confusion among the supporters of the anti corruption movement. Political pundits even started calculating the pros and cons of a new party and wondered whether it would affect the prospects of the BJP.

On Monday, the 6th August, 2012, came a terse announce-ment from the septuagenarian Gandhian that it was decided to disband Team Anna. Thus came the unexpected end of a movement which at one time had stirred the people and brought the government to the negotiating table. No more talk of civil society, Team Anna, Jan Lokpal or even a new political party. The whirlwind blew over.

Anna Hazare's movement was a crusade against corruption that was endemic in the govern-ment. It came at a time when not a day passed without the news of

a major scam. Corruption had gone beyond imaginable levels. The 2 G Spectrum, Madhu Koda, Commonwealth games, Mining scams etc. grabbed the headlines every day. It was, therefore, no wonder that Anna Hazare who spearheaded the anti corruption movement received spontaneous support from one end of the country to the other.

However, the fact was that the movement lacked a focus. There was no action plan as to how to eliminate the malady from the body politic. It was a deep rooted malady and couldn't be easily eradicated. Anna Hazare's one and only remedy was the enactment of the Jan Lokpal Bill as opposed to the government's LokPal Bill. He believed that a strong Lokpal Bill would put an end to the corruption in the country. His campaign only dwelt on the need for a Jan Lokpal Bill and insisted on the govern-ment tabling the one drafted by his team. This was a tall order. Not only that, he started issuing ulti-matum to the government. It was a case of the so called civil society usurping the powers of a duly elected Parliament.

The government did not yield on this issue, though it assured Team Anna that a strong Lokpal Bill would be enacted soon.

Anna Hazare and his team would not have been unaware of the functions of the legislature. He would have certainly known that the essence of democracy was the framing of laws by the elected representatives after due delibera-tions in the Assembly. It was up to the Legislative Assembly / Parlia-ment to accept or reject any suggestions that came from the civil society or the public.

Anna Hazare's agitation recei-ved a boost when yoga guru Baba Ramdev joined him. Baba was already a television figure and had a huge following. His mission hitherto was the promotion of the ancient system of Yoga and the propagation of Ayurveda.

The yoga guru jumped into the fray and instantly became a public figure championing a great cause, that of bringing back the black money stashed in banks in Switzerland and other countries. Since it was also a fight against corruption, the two leaders found a common platform in the Anna movement..

Though Anna Hazare's cam-paign against corruption was publicized as apolitical, it was in essence anti congress. The mem-bers had stated publicly during the by election in Haryana that they would work against the congress candidate.

Critics of the movement found that the members of Team Anna who were fighting corruption were themselves involved in certain corrupt practices.

The Jan Lokpal Bill came in for criticism from several quarters. The contentious issue was the ombudsman or Jan Lokpal who would be empower-ed to investigate complaints of corruption not only against ministers, but also against the Prime Minister. An officer being installed above the Prime Minister of a country was an unacceptable proposition.

In the meantime, members of the team started making baseless allegations against the cabinet ministers and the Prime Minis-ter. Even the president was not spared. The sheen started wearing off. Team Anna, choice of words came in for severe criticism. Justice Hegde took exception to Prashant Bhushan likening the PM to Shikhandi. “Bhushan told me that he had used it as a metaphor to explain his point. Whatever was the character of Shikhandi in my-thology, it is totally unaccep-table for any member of Team Anna to make such a remark,” said Justice Hegde. At one time, members of the parliament thought of reprimanding Team Anna for the abusive language they used against them.

It seems realization dawned on Anna Hazare rather late in the day, that the members of parlia-ment were not going to succumb to threats and ultimatums of his group. Secondly, it became clear that the only way to achieve their goal was to defeat the ruling party at the elections. If corrup-tion had to be eliminated, there had to be radical changes and people of good character and integrity had to be elected to the Assemblies and the Parliament.

Since Anna himself was not interested in floating a new party or standing for election, the best option was to disband the team and let each one pursue his own calling.

For Anna, it may be back to social work. When we look at the movement that collapsed, we would be aghast at the colossal waste it produced. Tons of newsprint and miles of TV footage were wasted. About Anna's decision, Shiv Sena supremo Bal Thackeray said “Anna Hazare folled the people. He should have taken this decision earlier. Now that the team is dissolved, one headache is over, for him too”.

H1N1 death in Navi Mumbai, toll in Maharashtra rises to 30

MUMBAI: A 20-year-old pregnant woman from Raigad succumbed to H1N1 in Navi Mumbai last week, taking the state toll for the infection this year to 30—the highest in the country. This was also the third death in the Mumbai Metropolitan Region (MMR) this month.

The latest victim, Soniya Pohal, was brought to D Y Patil Hospital on Saturday after her symptoms—fever and cold—intensified. Officials from Raigad said she had also developed breathlessness. Doctors said Pohal, who died on Sunday, did not have any underlying illness.

Epidemiologist Dr Pradeep Awate said the woman was pregnant, which made her prone to the infection. She is the fifth pregnant woman to succumb to H1N1 in the state this year. "Most of the H1N1 patients who died were (either pregnant or) suffering from conditions such as diabetes, hypertension and cardiac ailments," Dr Awate said. In all, 14 people had pre-existing ailments, besides the five women who were pregnant. The remaining 11 individuals were healthy and fell to the infection alone.

While experts are still looking for answers to why the virus is back in circulation this year, the count of positive H1N1 cases across the state as well as MMR has been steadily rising. Between April and July, 477 positive cases were detected, of which 41% were in Mumbai. But the city has been lucky to not report a single death since 2010. The BMC's epidemiologist Dr Mangala Gomare maintains that heightened awareness among people and alertness among health authorities have kept the infection under control in Mumbai.

Still, city doctors say pregnant women need to be vigilant and seek medical help as soon as symptoms of the viral infection start manifesting.

More than 100 flat and shop owners in Navi Mumbai - who were denied occupancy certificates by local authorities - suffered another setback on Monday when the Bombay High Court refused to give them any reprieve. A division bench of Justices AM Khanwilkar and SS Shinde dismissed their petitions, saying the court would not use its special powers to regularise unauthorised constructions.

On April 9, City and Industrial Development Corporation (CIDCO), the planning authority for Navi Mumbai, refused to give the certificates to 83 flat and 18 shop owners at Green Heritage complex, Kharghar. Officials alleged that the builder had violated norms by developing more residential and commercial space than sanctioned.

The owners, however, claimed that they were not aware of the violations and had purchased the properties legally. An occupancy certificate is a document that confirms a building's compliance with construction codes and other laws, declaring it to be suitable for occupation.

It is mandatory for all property buyers to obtain this clearance. “Individual rights and interests are subservient to the concerns for public health and safety,” the court said while hearing the owners' petitions that sought regularisation of the affected properties. “If they (property buyers) are carried away by the brochure and the public advertisements and do not make such inquiries, then they cannot turn around and seek assistance of the courts.”

Green Heritage, a project by Abhishek Builders and Developers, was given permission to create 97 flats, 20 commercial establishments, and a three-storey office building. The company, however, constructed 160 residential flats, 38 shops and a four-storey office building. The unauthorised constructions came to light during an inspection by CIDCO, which then turned down applications for occupancy certificates.

The affected owners told the court that CIDCO should not withhold the clearance as they had already secured approvals from the fire department and other civic agencies.

Justices Khanwilkar and Shinde, however, cited an earlier judgement: “Ultimately, if they purchase flats without bothering to make inquiries and seeking details of the construction at site, then they are themselves to blame.”

They further noted: “In such cases, flat purchasers are aggrieved but their interest cannot override those of the public at large. When science and technology have advanced to a great extent and enactments such as Right to Information are in place, it is not unreasonable to expect flat purchasers to avail of the same and seek details of construction before booking flats.”

The court added that there are laws for redressal of individual grievances. “However, they cannot seek a writ directing the planning authority to regularise illegal constructions. That makes a mockery of the law,” it said.

Centre for Asia Pacific Avia-tion (CAPA), an aviation consul-tancy group has stated in a study that India could face the possibility of downgrading of its aviation safety system by the US Federal Aviation Administration (FAA), if urgent steps to strengthen institu-tions like DGCA to meet the chall-enges of fast-growing air traffic were not taken. Facing the threat of downgrading of the aviation safety net is a challenging task for Mr. Arun Mishra, the new DGCA chief. He has stated that his prime focus would be to take all measures to ensure safe and secure flying in India.

Meanwhile, the International Civil Aviation Organisation (ICAO) is scheduled to carry out a safety audit of DGCA this year-end. Similar safety audits are also being carried out on a regular basis
