RESTRICTIVE COVENANTS FOR

SUGAR PATCH SUBDIVISION

BEFORE ME, the undersigned Notary Public, personally came and appearedPATCH INVESTMENTS, L.L.C., herein referred to as “Developer”, appearing hereinthrough its Members and Co-Managers identified below, authorized as may be seen fromthat Certificate filed for record at Conveyance Book 1417, at Page 259, under File No.2008-00014295, Iberia Parish public records, who declared that it is the owner of the lotssituated in Sugar Patch Subdivision as shown on that plat of survey prepared by S. J.Langlinais & Associates, Inc., Stephen J. Langlinais, P.L.S., dated December 23, 2008 withrevisions April 18, 2009 and April 30, 2009, filed for record in recorded in ConveyanceBook ________, Page _______, Under File No. ___________________ of the public recordsof Iberia Parish, Louisiana, and that it hereby establishes the following covenants andbuilding restrictions which shall be binding upon and run with the title to said property ashereinafter set forth below:

(1) No lot in this subdivision shall be used for any purpose other than singlefamily residential. No more than one residence shall be constructed on anylot in this subdivision. No commercial activities of any kind shall beconducted on any lot in this subdivision.

(2) The minimum living floor area of the main structure of any dwelling placedon a lot in the subdivision (exclusive of porches, garages, carports or carshelters) shall be 1,500 square feet. This restriction of square footage of floorspace shall not apply to multiple storied dwellings, in which case the groundfloor shall contain not less than 1,000 square feet of floor space, excludingporches, garages, carports or car shelters. All structures, other than theprimary residential dwelling, including barns, out buildings and fences, onsaid lots are to be approved by the Developer or its successor named for thatpurpose, by letter of approval.

(3) No garage, metal building, house trailer, mobile home, tent, shack, barn, orother outbuilding shall ever be used as a residence, either temporarily orpermanently, nor shall any structure of temporary character be used as aresidence; nor shall a trailer or mobile home be moved onto a lot for use asan accessory building.

(4) No accessory building or appurtenant structure shall be permitted on any lotfor rental purposes.

(5) The roof of any building shall be constructed or covered with asphalt orcomposition shingles, or factory baked enamel corrugated ribbed panel metalroofing, or new pre-finished metal roofing of good quality.

(6) No dwelling shall be moved on any lot in the subdivision, in whole or in part,with the exception of new dwellings or new modular dwellings meeting theminimum square footage requirements. All dwellings situated on piers mustbe completely skirted and or enclosed from the ground to the base of thestructure.

(7) All residences shall be constructed so as to front LA Highway 87 or CrochetRoad.

(8) No lot shall be re-subdivided, (with the exception of lot #39) nor shall anydwelling be erected or placed on any re-subdivided lot, with the followingexceptions: One person may own two or more contiguous lots, and constructa residence thereon, in which event the total of the contiguous lots shall beconsidered as one lot, subject to these restrictions. It shall also bepermissible for two persons to purchase a single lot and divide it amongthemselves, providing each party already owns one full size contiguous lot asshown on the plat of record, as same may be amended from time to time. Insuch event, the total area owned by one owner, the full lot and partial lotshall be considered as one lot for purposes of these restrictions.

(9) All lot owners shall maintain proper drainage between their lot and theadjacent lot(s), and nothing shall be constructed or erected upon any lot line,or boundary between the lots that would restrict normal drainage or wouldcause surface water to drain upon an adjacent lot.

(10) Fences shall be permitted, however no fence, wall or other similar structureshall be erected nearer to the front lot line than the front wall of the dwelling.Barbed wire or similar type wire material shall under no circumstance beused for fencing. Wood fencing, vinyl fencing, lattice fencing, and hurricanefencing are permissible.

(11) No residence shall be located on any lot nearer to the front lot line than theminimum building setback line of 150 feet for lots fronting on Crochet Roadand 50 feet for lots fronting on La. Hwy 87. No building or appurtenantstructure shall be located nearer than ten (10) feet to its side lot line. Noaccessory building or appurtenant structure shall be located closer to thefront lot line than the front of the main dwelling on such lot. No building orappurtenant structure shall be located nearer to the rear lot line than 50 feet.

(12) Natural gas storage tanks (butane) shall be allowed provided that,(a) all tanks shall be completely shielded from view of the neighborhood

using materials permissible for fencing as described in paragraph #10.(b) All tanks shall be located to the rear of the main dwelling and their

location shall comply with side and rear lot line setbacks.

(13) No vacant lot in this subdivision shall be allowed to grow up in weeds andshall be maintained in accordance with applicable parish regulations.

(14) No noxious trade or activity shall be carried on upon any lot, nor shallanything be done thereon which may be or become an annoyance or nuisanceto the neighborhood.

(15) No abandoned or junked cars, boat trailers, or other vehicles shall be kept onany lot in the subdivision, nor shall any lot be used for the storage ofcommercial vehicles or equipment other than motor vehicles, which are, useddaily away from the premises.

(16) No lumber or other materials may be stored on any lot except for amaximum period of 120 days prior to commencement of construction on abuilding or structure on any lot, during which construction time buildingmaterials may also be stored on said lot.

(17) No lot shall be used or maintained as a dumping ground for rubbish. Trash,garbage or other waste shall be kept in sanitary containers.

(18) Horses may be kept provided that they are not kept, bred, or maintained forany commercial purposes, including the raising and selling of horses. Horsesmay only be kept on the lots measuring a minimum of (3) three acres in area,provided they are kept on the rear one-third (1/3) of such lots. All structuresmaintained for horses, including fences, on said lots are to be approved bythe Developer or its successor named for that purpose, by letter of approval.Other than horses, dogs, and cats, no other animals, including livestock orpoultry may be kept on any lot in this subdivision, with the exception of thoseanimals, livestock or poultry to be kept and or raised as 4-H projects.

(19) No signs of any kind shall be displayed to the public view on any lot exceptone sign of not more than five square feet advertising the property for sale orrent, or signs used by a builder to advertise the property during theconstruction and sales period.

(20) All electrical and or cable service to houses and or out buildings erected inthe subdivision shall be placed underground, at the expense of the purchaser.

(21) With the exception of Lots 1 through 3 and 33 through 39, all sewerdischarge lines shall be run to the rear property line and discharge into theditch along the rear property line.

(22) No trucks, vans, trailers, boats, or any vehicle other than a passenger car willbe permitted to park in yards or in front of any residence for longer than atwelve (12) hour period. No vehicle shall be abandoned or junked in thissubdivision by any lot owner.

(23) No oil drilling, oil development operations, or mining operations of any kindshall be permitted upon or in any lot, nor shall tanks, tunnels, mineralexcavations, or shafts be permitted upon or in any lot. No derrick or anyother structure designed for use in boring oil or natural gas shall be erectedor permitted within this subdivision. This does not prohibit the development,outside of this subdivision area, of mineral production by directional drillingfrom adjacent properties. Developer reserves all oil, gas, and other mineralsin, or under all of the property described herein.

(24) Easements for installation and maintenance of utilities and drainage facilitiesare reserved as shown on the recorded plat. The developers shall not beliable for any damage done by them, their assigns, agents, employees, toshrubbery, trees, or flowers or other property of the owners situated on theland covered by said easements.

(25) These restrictions shall continue in force and effect for a period of fifteen (15)years from the date hereof and shall be automatically extended for successiveperiods of ten (10) years. These restrictions may be altered or amended atany time by a vote of the owners of more than one-half (1/2) of the lots in thesubdivision, provided that Developer’s consent shall be required for anyamendment until Developer no longer owns any lot in the subdivision.

(26) The failure by a landowner to enforce any restrictions, conditions, covenantsor agreements imposed herein shall in no event be deemed a waiver of theright to do so thereafter as to that breach, or as to one occurring prior orsubsequent thereto.

(27) The provisions contained herein shall run with the title to and bind that landof this subdivision and shall insure to the benefit of and be enforceable byany owner of the land, included in this subdivision, their respective legalrepresentatives, their successors and assigns.

(28) Invalidation of anyone of these covenants by a judgment or a court ordershall in no way affect any of the other provisions, which shall remain in fullforce and effect.
