FURTHER INFORMATION ® Since 2015, the Housing Service Centre (HSC) has received multiple

complaints from neighbours about the behaviour of and guests which include loud noise, music, parties, drunken behaviour, as well as drug and alcohol issues. Tenants from have complained about this behaviour.

® The SC has had difficulty contacting to discuss the complaints. During December 2015 and January 2016, the HSC conducted home visits and sent correspondence to home address, however did not respond.

o On 22 February 2016, visited the HSC to discuss the issues with tenancy. During this discussion, was given a verbal warning.

® Further complaints were received from on 28 October and 16 November 2016. was again interviewed by staff. had visitors staying with

I refer to your email dated 2017 to the Honourable Micl< de Brenni MP, Minister for Housing and Public Works and Minister for Sport regarding the behaviour of your neighbour. I am replying on the Minister's behalf.

The Department of f-lousing and Public Works takes its responsibility as a landlord very seriously and explains to all tenants their responsibilities under their State Tenancy Agreement and the Residential Tenancies and Rooming Accommodation Act 2008. Tenants are required to maintain their property in a clean and tidy state and are expected to respect neighbours' rights by not causing a nuisance or disturbing the reasonable peace, comfort or privacy of the community.

While the Fair Expectations of Behaviour policy recognises that many public housing tenants are among the most vulnerable in our society and may need support to sustain their tenancies, criminal, threatening and disruptive behaviour is never acceptable.

When complaints are received relating to public housing tenants, the department must investigate fihem and take appropriate action in accordance with departmental policies and the Act. The type of action taken by the department is determined according to the nature of the breach. In many instances, the department will endeavour to assist tenants to modify their behaviour so that they can sustain their tenancy and live in harmony with their neighbours.

I appreciate that you would like more detailed information on the action being taken by the department to address your concerns. However, the department is required to respect a tenant's right to privacy, which means 1 am t,►nable to disclose any specific information. The Department would like to assure you that they are working with the tenant to resolve the issues you have raised and are hopeful that the relationship between neighbours will improve in response to the action being taken.

The Department of Housing and Public Works takes all complaints very seriously. Everyone has a right to expect a peaceful and safe environment in their homes and neighbourhoods, and I can understand that the incidents you describe would be distressing. When complaints are received relating to public housing tenants, the department must first investigate them in order to take appropriate action. This is in accordance with departmental policies and the Residential Tenancies and Rooming Accommodation Act 2008,

Many of the department's clients are among the most vulnerable in the community and .departmental staff work closely with other agencies to help tenants behave in a responsible and community-minded manner. While it can take time to resolve certain issues, I can assure you that the deparkment is doing all it canto address your concerns,

— Since the commencement of tenancy, seven complaints have been received alleging fighting, foul language, an untidy yard and loud music. Staff from the Housing Service Centre (HSC) investigated the complaints and action was taken in line with departmental policy and the Residential Tenancies and Rooming Accommodation Act 2008. The actions included five home visits; seven telephone calls; the issue of three Notices to Remedy Breach on 14 December 2016, 10 January 2017 and 23 March 2017; the issue of two Notices to Leave on 9 January 2017 and 11 April 2017; referral to local

— On 7 September 2017, HSC staff telephoned to discuss the complaints, had not played any loud music or interfered with neighbours' peaceful enjoyment of their properties. Staff reminded

about tenancy obligations, which acknowledged understood.

• Street: — Since the commencement of tenancy, one complaint has been received

regarding an untidy yard HSC staff investigated the complaint and action was taken in line with departmental policy and the Residential Tenancies and Rooming Accommodation Act 2008. The actions included two home visits; the issue of a Notice to Remedy Breach on 16 December 2016; and a Notice to Leave on 9 January 2017. rectified the matter and was not required to vacate the property. No complaints have been received since the Notice to Leave was withdrawn.

— On 7 September 2017, HSC staff contacted to discuss the complaints, which denied. had not played any loud music or interfered with neighbours' peaceful enjoyment of their properties. Staff reminded

The Department of Housing and Public Works takes its responsibility as a landlord seriously and explains to all tenants their rights and responsibilities under their State Tenancy Agreement. Tenants have a responsibility to be a good neighbour and maintain their property to an acceptable standard. In instances where tenants contravene their tenancy agreement, the department investigates and takes all action possible under departmental policies and the Residential Tenancies and Rooming Accommodation Act 2008.

registration under the National Regulatory System for Community Housing. • The Department of Housing and Public Works funds under the Supportive

Housing Program, to provide tenancy and property management for the department-owned Brisbane omplex at

KEY ISSUES • On 25 September 2017, departmental staff contacted staff to determine if

they had knowledge of a community-led campaign to distribute flyers relating to drug use at the complex.

was sent on 5 June 2017 and an Acting Deputy Director-General response was sent on 26 June 2017 (refer to Attachments 7 and 2).

• During 2017, two complaints were received from one other neighbour. However, one complaint was verbal and did not provide specific details, and the other was making allegations of drug possession/dealing which was referred to the Queensland Police Service (QPS) to action.

• While action has been taken in response to the complaints, this action has been limited due to staff not being able to verify information and the one-on-one nature of some concerns.

• On 23 March 2017, staff members from the HSC interviewed about complaints and alleged drug activity. denied having any drug charges against and felt vexatious complaints were being made. does not believe is disrupting the peace, comfort and privacy of the neighbours.

• was referred to the Tenancy Support Project and also referred to Footprints for assistance with tenancy management issues.

I understand that you have previously declined an invitation to attend mediation with your neighbour. I would encourage you to reconsider this option as it may assist to resolve the ongoing conflict.

• Since the beginning of tenancy, the Housing Service Centre (HSC) has recorded 11 complaints about behaviour, one property condition matter and two occupancy issues (refer to Attachment 1).

FURTHER INFORMATION • On 21 June 2017, a phone call was received from the private owner at

stating there was a recent incident at unit alleged that the tenant owes money to drug dealers and is so scared oved out of nit and in with

(in the same complex). Furthermore, there are squatters living in uni , and the Queensland Police Service (QPS) and the Queensland Ambulance Service had attended and escorted some people away.

• On 22 June 2017, a letter was sent to t unit at unit (where allegedly staying) stating that the HSC urgently needed to speak with

about tenancy. The letter stated that had not contacted the HSC by 30 June 2017, a Notice to Leave may be issued.

• On 23 June 2017 contacted the HSC again to advise that the squatters were still residing in and there was drug activity, which has been reported to the QPS. Staff from the HSC attempted to contact and , however were unsuccessful.

• On the same day, staff from the HSC contacted Police to seek further information. QPS staff advised they are unable to disclose information due to privacy, however if the tenant requires assistance to have squatters removed, they can assist.

• The HSC agreed to provide an extension until 10 July 2017 to to ensure that the occupants had vacated the property, advising that if this did not occur the Department of Housing and Public Works would [ook at taking further action againsttenancy.

• On 10 July 2017, staff from th HSC contacted to see if there had been any improvement. Staff were advised the squatters were still in the property.

The Department of Housing and Public Works takes its obligations as a landlord seriously and explains to all tenants their responsibilities under the State Tenancy Agreement, departmental policies and the Residential Tenancies and Rooming Accommodation Act 2008. All tenants are required to respect the peace, comfort and privacy of the community and maintain their property to a standard that reflects community expectations. In instances where tenants are suspected of breaching their tenancy agreement, the department investigates and, if required, takes appropriate responsive action.

I can confirm that the issues you reported are being investigated by officers from the Housing Service Centre. I note your advice regarding previous reports to the department. In some instances, the complaints you made could not be substantiated. On other occasions, the department took formal tenancy action under the Act. I am unable to provide specific details as the department is required to respect its clients' rights to privacy.

Departmental staff work closely with other agencies to address disruptive behaviour and help tenants behave in a responsible and community-minded manner. While it can take time to resolve certain issues, I can assure you that the department is doing all it can to address your concerns.

The department's Fair Expectations of Behaviour policy recognises that some tenants are among the most vulnerable in the community and may need support to sustain their tenancies. However, criminal, threatening and repeated disruptive behaviour is never acceptable.

I encourage you to continue to report any suspected criminal activity to the Queensland Police Service, which has the power investigate offences and gather evidence to support any future action that may be taken by the department.

• On 7 November 2016, phoned the HSC to complain aboutalleged the tenant was involved in illegal drug activity and verbal abuse towards a

neighbour, advised would put his complaint in writing, however, no complaint was received.

+ No other complaints have been received for this tenancy. • On 22 February 2017, a complaint was received from regarding alleged

drug activity, multiple visitors blocking access to driveways, and threatening and aggressive behaviour towards a neighbour.

• On the same day, QPS information was received noting one call for service in November 2016 for a male person resisting arrest.

• On 23 February 2017, a doorknock was completed of the surrounding area, with no issues identified from neighbours. One neighbour reported a large volume of traffic going to

residence. Advice was received of an unregistered motorbike being illegally ridden, however no confirmation of the residence involved was provided.

• On the same day, staff from the HSC made a home visit to the tenant's property while conducting doorknock which revealed a handy skip in'the front of the property, two motorbikes in the yard and rubbish at the property. No one at the property responded to housing officers.

• While the doorknock was being conducted, staff witnessed three vehicles attendproperty, occupants running into the property and leaving within five minute intervals. This occurred overt a timeframe of approximately 15 minutes.

The HSC has investigated each complaint through home visits, interviewing neighbours and discussions with the QPS. I can assure you that the Department of Housing and Public Works takes its responsibility as a landlord very seriously and explains to all tenants their responsibilities under their State Tenancy Agreement and the Residential Tenancies and Rooming Accommodation Act 2008. Tenants are required to maintain the property in a clean and tidy state and are expected to respect neighbours' rights by not causing a nuisance or disturbing the reasonable peace, comfort and privacy.

In addition to this, in December 2015, I announced the `Fair Expectations of Behaviour' policy. While this policy recognises that some social housing tenants are among the most vulnerable in our society and therefore may need support to sustain their tenancies, criminal, threatening and disruptive behaviour is never acceptable.

When complaints are received relating to social housing tenants, the department must investigate them and take appropriate action in accordance with departmental policies and the Residential Tenancies and Rooming Accommodation Act 2008. The type of action taken by the department is determined according to the nature of the breach. In many instances, the department will endeavour to assist tenants to modify their behaviour so that they can sustain their tenancy and live in harmony with their neighbours.

Staff from the Housing Service Centre have investigated the concerns you have raised. The department is required to respect its tenants' right to privacy which means I am unable to provide you with any specific information of action taken. However, I can advise that there are some circumstances when a tenant's absence from the property is approved by the department. POINTS OF RELEVANCE

• On 9 September 2016, commenced tenancy at in a one-bedroom apartment.

• From 15 November 2016 to 5 March 2018, there have been 18 behaviour complaints recorded against tenancy, which include loud talking, excessive visitors to the property and alleged drug use/supply.

® On 5 May and 12 July 2017, was issued Notices to Remedy Breach for disruptive behaviour.

• On 23 and 24 April 2018, complaints were received from of and of respectively, alleging that was selling drugs from the

property. ® On 27 April 2018, in response to these complaints, staff from the Housing Service

Centre (HSC) contacted both and Both tenants agreed for their details to be shared with the QPS to assist with an investigation of the alleged drug offences and were satisfied with the advice provided by staff.

• On 1 May 2018, a Notice to Remedy Breach was posted to or confirmed disruptive behaviour including talking loudly, excessive visitors and noise.

• On 2 May 2018, contacted the HSC was advised tha has been issued a Notice to Remedy Breach for the confirmed behaviour.

• On 8 May 2018, the allegations of criminal activity (drug dealing/drug supply) were forwarded to QPS for appropriate follow-up,

• In 2017, has made approximately seven complaints about the behaviour ofThe behaviour includes

• Only two complaints have been received in 2017 from one other neighbour. However, onecomplaint was verbal and did not provide specific details and the other complaint was makingallegations of drug possession/dealing which was referred to Queensland Police Service (QPS)to action.

• While action has been taken in response to complaints, this action has been limited due tolimited verification and the one-on-one nature of some concerns.

• Staff from the Housing Service Centre (HSC) applied to Right to Information toobtain a list of any call outs and charge had been issued by the QPS.

• has been advised on multiple occasions by staff from the HSC thatallegations of illegal activity fall outside the Department of Housing and PublicWorks'jurisdiction. has been directed to contact QPS and Police Link.
