Unofficial Translation Royal Government of Cambodia No. 66 Sub-Decree on Establishment and Implementation Of the Priority Operating Cost (POC) within the Framework of Development Cooperation ROYAL GOVERNMENT OF CAMBODIA - Having seen the Constitution of the Kingdom of Cambodia - Having seen the Royal Decree No. NS/RKT/0908/1055 dated September 25, 2008 on the appointment of the Royal Government of Cambodia - Having seen the Royal Kram No. 02/NS/94 date July 20, 1994 promulgated the Law on the Organization and Functioning of the Council of Ministers - Having seen the Royal Kram No.06/NS/94 dated October 30, 1994 promulgated the Law on Common Statute of Civil Servant of the Kingdom of Cambodia - Having seen the Royal Decree No. CS/RKT/1297/273 dated December 01, 1997 on the Common Principles of the Organization of the Civil Services - Having seen the Royal Decree No. NS/RKT/0904/284 dated September 27, 2004 on the Establishment of the Supreme Council for State Reform - Having seen the Royal Decree No. NS/RKT/1201/450 dated December 01, 2001 on the Base Salary and Supplement Allowance of Civil Servant - Base on the need of the Royal Government Hereby Decides Chapter 1 General Provision Article 1. This Sub-Decree is to establish and implement the Priority Operating Cost (POC) within the framework of development cooperation based on the principles of harmonization, alignment and adjustment. Chapter 2 Principal of Priority Operating Cost Article 2. The Priority Operating Cost is a lump-sum payment to public servants who are selected to work within the framework of development cooperation. Priority Operating Cost payments will end when the expected results are met or the development cooperation program or project ends. Article 3. The Priority Operating Cost is not a salary or salary supplement.

- Having seen the Constitution of the Kingdom of Cambodia

- Having seen the Royal Decree No. NS/RKT/0908/1055 dated September 25, 2008 on the

appointment of the Royal Government of Cambodia

- Having seen the Royal Kram No. 02/NS/94 date July 20, 1994 promulgated the Law on the

Organization and Functioning of the Council of Ministers

- Having seen the Royal Kram No.06/NS/94 dated October 30, 1994 promulgated the Law on

Common Statute of Civil Servant of the Kingdom of Cambodia

- Having seen the Royal Decree No. CS/RKT/1297/273 dated December 01, 1997 on the

Common Principles of the Organization of the Civil Services

- Having seen the Royal Decree No. NS/RKT/0904/284 dated September 27, 2004 on the

Establishment of the Supreme Council for State Reform

- Having seen the Royal Decree No. NS/RKT/1201/450 dated December 01, 2001 on the Base

Salary and Supplement Allowance of Civil Servant

- Base on the need of the Royal Government

Hereby Decides

Chapter 1

General Provision

Article 1.

This Sub-Decree is to establish and implement the Priority Operating Cost (POC) within the

framework of development cooperation based on the principles of harmonization, alignment and

adjustment.

Chapter 2

Principal of Priority Operating Cost

Article 2.

The Priority Operating Cost is a lump-sum payment to public servants who are selected to work

within the framework of development cooperation. Priority Operating Cost payments will end when the

expected results are met or the development cooperation program or project ends.

Article 3.

The Priority Operating Cost is not a salary or salary supplement.

Article 4.

In the context of development cooperation programs, development partners can not finance any

other costs to public servants outside the Priority Operating Cost instrument unless legally regulated by

the Royal Government of Cambodia.

Chapter 3

Priority Operating Cost Payment Grid

Article 5.

The lump sum payment of Priority Operating Cost for a month shall be as follows:

1. The level of Priority Operating Cost for the national level or back office includes:

- Costs for oversight/leadership of a program 1,470,000 Riels to 1,680,000 Riels

- Costs for management of a project 840,000 Riels to 1,260, 000 Riels

- Costs for implementation of operation 504,000 Riels to 756,000 Riels

2. The level of Priority Operating Cost for sub-national level or public services delivery includes:

- Costs for management of a project 378,000 Riels to 462,000 Riels

- Costs for implementation of operation 210,000 Riels to 294,000 Riels

3. The level of Priority Operating Cost for selected high skilled specialists will be defined

separately following agreement between the Royal Government of Cambodia and Development Partners.

Chapter 4

Implementation Procedure of Priority Operating Cost

Article 6.

The selection of public servants to individual Priority Operating Cost schemes shall be

transparent, based on the Term of Reference, merit based, equitable and clear procedure.

Article 7.

The implementation procedure of the Priority Operating Cost shall follow the principles set out in

the Priority Operating Cost Implementation Guide, which was prepared by the Steering Committee to

Review and Resolve Salary Supplement within the Framework of Financing Cooperation in consultation

with Development Partners.

Article 8.

Priority Operating Cost implementation shall start from July 1, 2010.

Chapter 5

Final Provision

Article 9.

All of the provisions which are contrary to this Sub-Decree null void.

Article 10. The Minister in charge of the Office of the Council of Ministers, the Minister of Economy and

Finance, Ministers and Secretaries of State of all ministries/institutions shall implement this Sub-Decree

from the date of signing.
