1. On 1992-03-28 the complainant "black male Simon Mbuti Mokoena of 6458 Khumalo street Tokoza laid a charge of(1) Assault common (2) M.I. to property against unknown members of the Defence Force under tlie following circumstances i-2. (1) The complainant alleges that on 1992-03-28 at about18s30 he was standing at the gate of his house no.6458 Khumalo street Tokoza, and saw somebody passing "by a car shooting in the air. lie then went into his house *

(2) Lator he heard a shooting at his house and when investigating he discovered that it was unknown, black soldiers standing on top of their buffalo truck. Their buffalo truck was standing infront of his neighbour. Those unknown soldiers entered his house and said theywere looking for an AK.47 Rifle* They were under influence of liquor* Those black soldiers then assaulted him with a butt of a rifle on M s face* After that the soldiers left his house and wont away without searching his house.(3) The complainant then obtain'the registration numbers of the buffalo truck as .112%' Thereafter he noticed that the gate of_hio yard, wall of his house, window frames, window panes and the roof of his house were damaged as the result of the shooting. Nobody was injured as the resultof shooting* The value of the damage is about RIO 000-00. He cannot be able to identify those unknown soldiers as it was dark*

3« As the result of the assault he alleges that he received some pains on his face*
